LIRC Light Industrial Restricted Commercial District
§ 282-152 Declaration of legislative intent.
It is the purpose of this district to provide for light industrial uses as well as certain businesses that require high visibility, while prohibiting intensive combinations, and to control the number of access points.
§ 282-153 Designation of district; applicability.
In the LIRC Light Industrial Restricted Commercial District, the following regulations shall apply.
§ 282-154 Use regulations.
A building may be erected or used and a lot may be used or occupied for any of the following purposes and no other:
Standalone retail store, including retail outlet or showroom for appliances, electronics, furniture, clothing and automobile sales agency specializing in the sale of new cars, late model used cars and providing automotive service facilities.
Financial institution including a credit union, bank or savings and loan association with drive-through facilities, provided a separate lane shall be provided for at least eight automobiles which shall not interfere with any required parking spaces or driveways.
Sales of automotive accessories, such as parts, tires, batteries, radios and other automotive supplies. Installation of parts shall be performed in an enclosed structure.
The following uses are permitted only when authorized as a special exception by the Zoning Hearing Board, subject to the specific conditions stated herein:
Service business, including barber, beautician, laundry and dry cleaning, shoe repair, tailor, photographer, travel agency, only when such use is accessory to a permitted use.
For individual lots smaller than three acres in size there shall be at least one use having a minimum of 10,000 square feet of gross floor area. In no event shall more than three uses be provided in the center.
For individual lots three or more acres in size there shall be a minimum of two uses, each having a minimum of 20,000 square feet of gross floor area. In no event shall more than five uses be provided in the center.
District yard. In no case shall any building or structure be erected closer than 200 feet to any residential district, nor any parking area closer than 100 feet to any residential district. This district yard shall be maintained as a green area, and buffered as required by the landscaping provisions of the Hatfield Township Subdivision and Land Development Ordinance.[1]
Parking and loading. All-weather parking and loading facilities shall be provided in accordance with the applicable provisions of Article XXIV, Off-Street Parking and Loading.
Except as otherwise regulated by § 282-156D, no parking, loading or driveway shall be located closer than 20 feet to any side or rear property line nor closer than 20 feet to the ultimate right-of-way of an arterial highway, except that portion of the driveway required for normal ingress and egress. The adequacy of off-street parking facilities shall be subject to the continuing jurisdiction of the Board of Commissioners which shall have authority to require such additional parking, loading, ingress and egress facilities as it deems necessary.
Signs. Signs shall be permitted in accordance with Article XXIII, Signs. Signs allowed in the LI Light Industrial District shall be permitted in the LIRC Light Industrial Restricted Commercial District.
Landscaping. All development in the LIRC Light Industrial Restricted Commercial District shall have landscaping designed and maintained in accordance with the applicable sections of the Subdivision and Land Development Ordinance of Hatfield Township, as amended.[1]
Outdoor and land use. The outdoor display of goods shall be designed as an integral part of the site and, with the exception of an automobile sales agency, such display shall conform to all building setback requirements. The outdoor storage of materials or trash shall be designed and maintained to be completely screened from view by a landscape buffer and shall also conform to all building setback requirements.
Hazardous use. The storage, distribution, treatment or handling of toxic or hazardous wastes and chemicals, as defined by Pennsylvania Act 97,[2] shall be prohibited.
Site lighting. Exterior lighting provided in conjunction with any building or use shall be placed not higher than 25 feet above grade and shall be screened so as not to permit the source of illumination to be seen from off the premises. Only color corrected types of illumination shall be used. The hours of illumination of such lights (except security lighting) shall be limited to hours of business operation and shall otherwise be extinguished between 10:00 p.m. and 6:00 a.m., prevailing time.
Access control. Individual lots within the LIRC District shall take vehicular control access from an interior access road or reverse frontage road. Direct access to existing or proposed expressway or arterial streets shall be prohibited; provided, however, that right turn exit only egress may be permitted when separated at least 500 feet from a street intersection along the same side of the street.
Driveway access to an interior collector street shall be separated from the right-of-way of an existing expressway or arterial roadway by a distance of not less than 200 feet.
Each development shall consist of a harmonious selection of uses, buildings, service and parking areas, circulation and open spaces, planned and designed as an integrated unit.
