ARTICLE II

Districts and District Regulations

Section 405.020 District Boundaries and General Regulations.

A. 
In order to classify, regulate and restrict the location of trades, industries, and the location of buildings designed for specified uses; to regulate and limit the height and use of buildings hereafter erected or structurally altered; to regulate and limit the intensity of use and the lot areas; and to regulate and determine the areas of yards, courts, and other open spaces surrounding such buildings, the City is hereby divided into districts of which there shall be eight (8) in number known as:
"R-1"
One-Family Residential District
"R-2"
One-Family Residential District
"R-3"
Two-Family Residential District
"R-4"
Multi-Family Residential District
"B-1"
General Business District
"B-2"
Central Business District
"I-1"
Light Industrial District
"I-2"
Heavy Industrial District
B. 
The boundaries of these districts are shown upon the Zoning District Map, which is on file in the City offices and is made a part of this Chapter by reference. Said map and all the information shown thereon shall have the same force and effect as if all were fully set forth or described herein. The original of this is properly attested and is on file with the City Clerk.
C. 
All territory which may hereafter be annexed to the City of Hayti shall be classified in the "R-1" Residential District until, within a reasonable time after annexation, the annexed territory shall be appropriately classified by ordinance in accordance with this Chapter.
D. 
Whenever any street or other public way is vacated by official action of the City of Hayti, the zoning district adjoining each side of such street or public way shall be automatically extended to the center of such vacation and all area included in the vacation shall then and henceforth be subject to all appropriate regulations of the extended districts.
E. 
Where uncertainty exists with respect to the boundaries of the various districts as shown on the Zoning District Map, the following rules shall apply.
1. 
Where a boundary line is given a position within a street, alley or non-navigable stream, it shall be deemed to be in the center of the street, alley or stream, and if the actual location of such street, alley or stream varies slightly from the location as shown on the Zoning District Map, then the actual location shall control.
2. 
Where a boundary line is shown as being located a specific distance from a street line or other physical feature, this distance shall control.
3. 
Where a boundary line is shown adjoining or coincident with a railroad, it shall be deemed to be in the center of the railroad right-of-way and distances measured from a railroad shall be measured from the center of the designated main line track.
4. 
Where the district boundaries are not otherwise indicated and where the property has been or may hereafter be divided into blocks and lots, such boundaries shall be construed to be the lot lines and where the districts are bounded approximately by lot lines, said lot lines shall be construed to be the boundary of such districts unless said boundaries are otherwise indicated on the map.
5. 
In unsubdivided property, unless otherwise indicated, the location of district boundary lines shall be determined by the use of the scale provided on the Zoning District Map.
F. 
General Provisions.
1. 
No building or structure shall be erected, converted, enlarged, reconstructed, moved or structurally altered nor shall any building or land be used except for the use permitted in the district in which the building or land is located.
2. 
No building or structure shall be erected, converted, enlarged, reconstructed, moved or structurally altered except in conformity with the height, yard, area per family, parking and other regulations prescribed herein for the district in which the building is located.
3. 
The minimum parking, yards, and other open spaces, including lot areas per family required by this Chapter, shall be provided for each and every building or structure hereafter erected, and such minimum parking, yards, open spaces and lot areas for each and every building or structure whether existing at the time of passage of this Chapter or hereafter erected shall not be encroached upon or be considered as a yard or open space requirement for any other building or structure.
4. 
Where a lot has less area than the minimum requirements for the district within which the lot is located and was a lot of record in separate ownership from adjacent property at the time of passage of this Chapter, that lot may be used only for single-family dwelling purposes or for any non-dwelling purpose permitted in the district within which such lot is located.
5. 
Every building hereafter erected or structurally altered shall be located on a lot as herein defined and in no case shall there be more than one (1) main building on one (1) lot unless otherwise provided in this Chapter.

Section 405.030 "R-1" One-Family Residential District Regulations.

A. 
The purpose of this district is to provide for single-family residential development of spacious character, together with such churches, recreational facilities and accessory uses as may be necessary or are normally compatible with residential surroundings and at the same time to preserve open spaces. These districts are located to protect existing development and contain vacant land considered appropriate for such residential development in the future. The regulations set forth in this Section or set forth elsewhere in the Chapter, when referred to in this Section, are the regulations in the "R-1" Residential District.
B. 
Use Regulations. A building or premises shall be used only for the following purposes:
1. 
Farming.
2. 
Single-family dwellings.
3. 
Churches and church bulletin boards.
4. 
Public buildings, parks, playgrounds and community centers.
5. 
Public schools, elementary and high, and private educational institutions having a curriculum the same as ordinarily given in public schools and having no rooms regularly used for housing and sleeping purposes.
6. 
Home occupations.
7. 
Country clubs, golf courses, except miniature courses or practice driving tees operated for commercial purposes.
8. 
Railroad rights-of-way, including a strip of land with tracks and auxiliary facilities for track operations, but not terminal or maintenance facilities.
9. 
Temporary buildings, the use of which are incidental to construction operations or sale of lots during development being conducted on the same or adjoining tract or subdivision and which shall be removed upon completion or abandonment of such construction, or upon the expiration of a period of two (2) years from the time of erection of such temporary buildings, whichever is sooner.
10. 
Temporary signs not exceeding ten (10) square feet in area pertaining to the lease, hire or sale of a building or premises on which such sign is located.
11. 
Accessory buildings and uses, including private garages, customarily incident to the above uses but not involving the conduct of a business.
12. 
Conditional uses as provided for in Section 405.140.
13. 
Group homes as defined in Section 405.010 of this Chapter, provided however, that the exterior appearance of the home and property shall be in reasonable conformance with the general neighborhood standards. Adequate supervision shall be provided by the operator of the group home to insure the safety of the public. In any specific "R-1" neighborhood no group home permitted herein may be operated and maintained within one thousand five hundred (1,500) feet of any other such group home. Individuals recovering solely from alcohol and drug abuse shall have the same rights as any other person who is not physically or mentally handicapped in respect to residency in the City's "R-1" Residential District.
C. 
Height And Area Regulations. The height and area regulations set forth in Sections 405.110 and 405.111 shall be observed.

D. 
Parking Regulations. Off-street parking spaces shall be provided in accordance with the requirements for specific uses set forth in Section 405.130.

Section 405.040 "R-2" One-Family Residential District Regulations.

A. 
The purpose of this district is to provide for single-family residential development on medium sized lots, together with such churches, recreational facilities and accessory uses as may be necessary or are normally compatible with residential surroundings. This district is located to protect existing development of this character and contains vacant land considered appropriate for such development in the future. The regulations set forth in the Section or set forth elsewhere in this chapter, when referred to in this Section, are the regulations in the "R-2" Residential District.
B. 
Use Regulations. A building or premises shall be used only for the following purpose:
1. 
Any use permitted in the "R-1" Residential District.
C. 
Height And Area Regulations. The height and area regulations set forth in Sections 405.110 and 405.111 shall be observed.

Section 405.050 "R-3" Two-Family Residential District Regulations.

A. 
The purpose of this district is to provide for single-family and two-family residential development on medium sized lots, together with such churches, recreational facilities and accessory uses as may be necessary or are normally compatible with residential surroundings. The district is located to protect existing development of this character and contains vacant land considered appropriate for such development in the future. The regulations set forth in this Section or set forth elsewhere in this Chapter, when referred to in this Section, are the regulations in the "R-3" Residential District.
B. 
Use Regulations. A building or premises shall be used only for the following purposes:
1. 
Any use permitted in the "R-2" Residential District.
2. 
Two-family dwellings.
C. 
Height And Area Regulations. The height and area regulations set forth in Sections 405.110 and 405.111 shall be observed.

D.

Section 405.060 "R-4" Multi-Family Residential District Regulations.

A. 
The purpose of this district is to maintain a residential environment while permitting a wide variety of dwelling types. Single-family, two-family and multiple-family dwelling units are permitted on medium sized lots, together with such churches, recreational facilities and accessory uses as may be necessary or are normally compatible with residential surroundings. Population densities and height of buildings permitted are low enough to be generally compatible with single-family development in the same neighborhood. The regulations set forth in this Section or set forth elsewhere in this Chapter, when referred to in this Section, are the regulations in the "R-4" Residential District.
B. 
Use Regulations. A building or premises shall be used only for the following purposes:
1. 
Any use permitted in the "R-3" Residential District.
2. 
Multiple-family dwellings.
3. 
Boarding or lodging housing.
C. 
Height And Area Regulations. The height and area regulations set forth in Sections 405.110 and 405.111 shall be observed.

D. 
Parking Regulations. Off-street parking spaces shall be provided in accordance with the requirements for specific uses set forth in Section 405.130.

Section 405.070 "B-1" General Business District Regulations.

A. 
The purpose of this district is to provide sufficient space in appropriate locations for a wide variety of commercial and miscellaneous service activities generally serving a neighborhood area and located particularly along certain existing major thoroughfares where a general mixture of commercial and service activity now exists, but which uses are not characterized by extensive warehousing, frequent heavy trucking activity, open storage or material, or the nuisance factors of dust, odor and noise associated with manufacturing. The regulations set forth in this Section or set forth elsewhere in this Chapter, when referred to in this Section, are the regulations in the "B-1" General Business District.
B. 
Use Regulations. A building or premises shall be used only for the following purposes:
1. 
Any use permitted in the "R-4" Residential District.
2. 
Automobile parking lots.
3. 
Drive-in restaurants, bowling alleys, dance halls, skating rinks or theaters.
4. 
Dressmaking, tailoring, shoe repairing, repair of appliances and bicycles, dry cleaning and pressing, and bakery with sale of bakery products on the premises and other uses of a similar character.
5. 
Farm implements, sale or repair.
6. 
Funeral homes or mortuaries.
7. 
Motels.
8. 
Banks, offices and office buildings.
9. 
Commercial garages.
10. 
Non-flashing sign pertaining only to a use or service conducted on the property where the sign is located. Any sign or display in excess of thirty (30) square feet in area shall be attached flat against a wall of the building and in no case shall any sign or display project above the roof line.
11. 
Personal service uses, including barber shops, beauty parlors, photographic or artists' studios, taxicabs, newspaper or telegraphic service stations, dry cleaning receiving stations, restaurants, and other personal service uses of a similar character.
12. 
Retail stores or shops such as grocery, drug store, meat market, florist, notion or stationery stores, further, there shall be no slaughtering of animals or poultry on the premises of any retail store.
13. 
Filling stations.
14. 
Accessory buildings and uses.

D.

Section 405.080 "B-2" Central Business District Regulations.

A. 
The purpose of this district is to encompass the retail, service and office area of the central business district and permit a wide variety of uses to provide basic trade and services to Hayti and the area surrounding the City. This district is intended to provide a centralized location for trade and service activities having regional influence. The regulations set forth in this Section or set forth elsewhere in this Chapter, when referred to in this Section, are the regulations in the "B-2" Central Business District.
B. 
Use Regulations. A building or premises shall be used only for the following purposes:
1. 
Any use permitted in the "B-1" General Business District.
2. 
Private clubs and lodges.
3. 
Medical clinics.
4. 
Hospitals or clinics for small animals, dogs, cats, birds, and the like, but not kennels.
5. 
Laboratories, research, experimental or testing.
6. 
Hotels.
7. 
General service and repair establishments including dyeing or cleaning works or laundry, plumbing and heating, printing, painting, upholstering or tinsmithing.
8. 
Taverns.
9. 
Accessory buildings and uses.
10. 
Auto repair garage, but shall not include rebuilding, dismantling or storage or wrecked or junked automobiles.
11. 
Food storage lockers.
12. 
Stores for conduct of retail business.
13. 
Printing shops.
14. 
Auto sales lot.
C. 
Height And Area Regulations. The height and area regulations set forth in Sections 405.110 and 405.111 shall be observed.

D. 
Parking Regulations. Off-street parking spaces shall be provided in accordance with the requirements for specific uses set forth in Section 405.130.

Section 405.090 "I-1" Light Industrial District Regulations.

A. 
The purpose of this district is to provide for a wide variety of light manufacturing, fabricating, processing, wholesale distributing, and warehousing uses appropriately located for access by major thoroughfares or railroads. Commercial uses and open storage of materials are permitted but new residential development is excluded. The regulations set forth in this Section or set forth elsewhere in this Chapter, when referred to in this Section, are the regulations in the "I-1" Light Industrial District.
B. 
Use Regulations. A building or premises shall be used only for the following purposes:
1. 
Any use permitted in the "B-2" Central Business District.
2. 
Wholesale merchandising or storage warehouses.
3. 
Automobile repair garages, but no auto junk yards.
4. 
Trucking terminal.
5. 
Farm machinery and equipment sales and repair.
6. 
Contractor's yard.
7. 
Coal, coke, wood or lumberyard.
8. 
General service and repair establishments including dyeing, cleaning or laundry works, cabinet making, plumbing and heating, printing, painting, upholstering and appliance repair.
9. 
Manufacture or storage of food products, including beverage blending or bottling, bakery products, dairy products, candy manufacture, fruit and vegetable processing and canning, packing and processing of meat and poultry products, but not distilling of beverages or slaughtering of poultry or animals.
10. 
Manufacture of rugs, mattresses, pillows, quilts, millinery, shoes, hosiery, clothing and fabrics, and printing and finishing of textiles and fibers into fabric goods.
11. 
Assembly and manufacture from prefabricated parts of household appliances, electronic products, machinery and hardware products and similar products or the processing or assembling of parts for production of finished equipment.
12. 
Generally those light manufacturing uses similar to those listed in items (1) to (11) above which do not create any more danger to health and safety in surrounding areas and which do not create any more offensive noise, vibration, smoke, dust, lint, odors, heat or glare than that which is generally associated with light industries of the type specifically permitted.
13. 
Accessory buildings and uses including accessory signs and advertising structures related to the activity conducted on the premises but with total sign area not to exceed one hundred (100) square feet.
14. 
Kennels.
C. 
Height And Area Regulations. The height and area regulations set forth in Sections 405.110 and 405.111 shall be observed.

D. 
Parking Regulations. Off-street parking spaces shall be provided in accordance with the requirements for specific uses set forth in Section 405.130.

Section 405.100 "I-2" Heavy Industrial District Regulations.

A. 
The purpose of this district is to provide for industrial operations of all types except that certain potentially hazardous industries are permitted only after public hearing and review to assure protection of the public interest and surrounding property and persons. New residential development is excluded from this district. The regulations set forth in this Section or set forth elsewhere in this Chapter, when referred to in this Section, are the regulations in the "I-2" Heavy Industrial District.
B. 
Use Regulations. A building or premises shall be used only for the following purposes:
1. 
Any use permitted in the "I-1" Light Industrial District, except dwellings, hospitals, institutions, or other buildings used for permanent or temporary housing of persons.
2. 
Any other use not in conflict with the enacted laws of the State of Missouri or the City of Hayti regulating nuisances provided that no use emitting or likely to emit substantial amounts of dust, odor, gas, smoke or noise and none of the following specific uses shall be permitted unless and until the location of such use shall have been approved by the Board of Aldermen after a review and report by the City Planning Commission.
a. 
Acid manufacture.
b. 
Cement, lime, gypsum or plaster of Paris manufacture.
c. 
Distillation of bones.
d. 
Explosives manufacture or storage.
e. 
Fat rendering.
f. 
Fertilizer manufacture.
g. 
Gas manufacture.
h. 
Garbage, offal or dead animals, reduction or dumping.
i. 
Glue manufacture.
j. 
Petroleum or its products, refining of.
k. 
Smelting.
l. 
Stockyards or slaughter of animals.
m. 
Wholesale storage of gasoline.
n. 
Auto wrecking or salvage.
o. 
Junk, iron or rags, storage or garbage.
p. 
Any similar use that would be hazardous to the public health, safety or welfare.
In authorizing any of the uses in this Subsection, there may be imposed such reasonable requirements as to landscaping, screening, and other features of the development as are deemed necessary to protect adjacent property and prevent objectionable or hazardous conditions.
C. 
Height And Area Regulations. The height and area regulations set forth in Sections 405.110 and 405.111 shall be observed.
