CHAPTER 11

OFF STREET PARKING AND LOADING REGULATIONS

11-11-1: PURPOSE AND INTENT:

The following regulations are established to increase safety and lessen congestion in the village streets, to prevent the deficiency of motor vehicle parking spaces associated with the development of land and increased motor vehicle usage, to set standards for the required off street parking and loading, and to eliminate the on street storage of motor vehicles. In connection with any building hereafter erected or substantially altered or enlarged, or any parking lot hereafter installed, there shall be off street parking and loading areas provided that meet all of the minimum requirements of this chapter. If the business operation or use requires more spaces than the minimum required by this chapter for such business operation or use, then additional spaces shall be required as determined by the zoning administrator, or in the event that office is vacant, by the board of trustees. 11-11-2: GENERAL PROVISIONS:

   A.   Permissive Parking And Loading Facilities: Nothing in this chapter shall be deemed to prevent the voluntary establishment of off street parking and loading facilities to serve any existing use of land or buildings; provided, that there is adherence to all regulations herein governing the location, design, and operation of such facilities.
   B.   Damage Or Destruction: When any building, structure, or use is restored and continued in operation after being damaged or destroyed by fire, collapse, explosion or other cause to the extent that the cost of restoration exceeds fifty percent (50%) of its fair market value at the time of such damage or destruction, there shall be provided the off street parking and loading facilities required by this title. When any building, structure or use which is in existence on the effective date hereof is restored and continued in operation after being damaged or destroyed by fire, collapse, explosion, or other cause to the extent that the cost of restoration does not exceed fifty percent (50%) of its fair market value at the time of such damage or destruction, there shall be required only off street parking and loading facilities equivalent to any maintained at the time of such damage or destruction. However, in no case shall it be necessary to restore or maintain off street parking or loading facilities in excess of those required by this title.
   C.   Existing Uses: Whenever the existing use of a building or structure erected prior to the effective date hereof shall hereafter be changed to a new use, additional off street parking or loading facilities shall be required for such uses only in the event the floor area, occupancy loads, number of dwelling units, or some other factor affecting off street parking requirements is increased and then only to the extent required by the additional floor area, seating capacity, number of dwelling units, or other factor affecting the parking requirements. 11-11-3: OFF STREET PARKING:

   A.   Use: Required off street parking spaces accessory to uses listed in this title shall be solely for the parking of passenger motor vehicles of occupants, patrons, visitors, or employees or motor vehicles used in a permitted home occupation. Each required space shall be kept available at all times for parking of one motor vehicle.
   B.   Exemptions: When the application of the off street parking regulations specified hereinafter results in a requirement of not more than three (3) parking spaces for any commercial or business use, such parking spaces need not be provided. However, where two (2) or more uses are located on a single lot, only one of these uses shall be eligible for the above exemption. In no instances shall this exemption apply to dwelling units.
   C.   Computation:
      1.   When computation of the required number of off street parking spaces results in a requirement of a fractional space, a fraction of less than one-half (1/2) shall be disregarded and a fraction of one-half (1/2) or more shall counted as one space.
      2.   When computation of the required number of off street parking spaces is based upon the number of employees, the word "employed" shall refer to the maximum number of employees on duty at any one time.
   D.   Collective Provision: Two (2) or more buildings or uses may collectively provide the required off street parking, in which case, the number of parking spaces provided shall not be less than the sum of the separate requirements for each such building or use.
   E.   Location:
      1.   In the R1 and R2 districts, no off street parking shall be permitted in the front yard except on approved driveways of one- and two-family dwellings. On driveways leading to only one legal off street parking space, the parking of no more than two (2) cars side by side is allowed only under the following conditions:
         a.   The driveway must be paved; and
         b.   The width of the driveway approach and the driveway at the sidewalk must be a minimum of sixteen feet (16'). The required width shall be maintained to a sufficient length to allow parking of cars on private property. Existing driveways less than sixteen feet (16') wide may be flared to the required width and length without widening the driveway approach only if an approved driveway and/or culvert permit is issued by the village for said improvements. See title 8, chapter 2 of the village code for further information.
      2.   Parking spaces required for all other uses shall be located on the same lot or an adjoining lot; provided, however, that where ten (10) or more parking spaces are required:
         a.   Such parking spaces may be provided on a lot located not more than five hundred feet (500') from the lot requiring said parking. Such lot shall be owned by the owner of the use requiring the parking; and
         b.   No parking spaces permitted by subsection E2a of this section shall be located in a residence district.
      3.   All new and approved accessory off street parking spaces and driveways shall be located at least three feet (3') from any side lot line. All legal nonconforming driveways may be reconstructed at their existing location.
   F.   Design And Construction Standards:
      1.   Surfacing Of Parking Lots: All areas designed to accommodate four (4) or more off street parking spaces shall be surfaced with an all weather, dust free material.
      2.   Surfacing Of Driveways: All driveway entrances from a public street to an off street parking lot, as applied herein, shall be surfaced, at a minimum, with at least fifteen feet (15') of all weather, dust free material, measured from the edge of the pavement of the public street. See title 8, chapter 3 of the village code for further information.
      3.   Drainage:
         a.   All parking lots shall be sloped and/or drained so as to prevent surface water from such lots running onto adjoining property in unreasonable volumes.
         b.   All parking lots shall dispose of surface water in accordance with the village stormwater management ordinance. See title 10, chapter 6 of the village code.
      4.   Size And Access: Each required parking space shall open directly upon an aisle, a driveway, a driving area, or a public way of such width and design as to provide safe and efficient means of vehicular access and egress to such parking space at all times. The dimensions of such parking space or means of access shall not be less than shown in section 11-12-1, figure 1, of this title.
      5.   Wheel Stops: All open off street parking areas that have parking spaces abutting a property line or building or some other structure shall be required to have wheel stops of masonry, steel, heavy timber, or other material sufficient to prevent the protrusion of vehicles over property lines or into buildings, fences or screens. Where B-6.18 curb and gutter, as detailed in Illinois department of transportation highway standards, standard A-7.5, or sidewalk of similar geometry and function is utilized as the wheel stop, the gross depth of the parking stall may be reduced by two feet (2'), as measured from the back of the curb. This reduction may only be utilized when there is an additional two feet (2') beyond the curb to allow for the overhang of the vehicle.
      6.   Lighting: All off street parking areas regulated by this title shall have operational lighting fixtures directed away from residences in such a way as not to create a nuisance.
   G.   Storage Of Camping And Recreational Equipment: Any owner of camping and recreational equipment or a domestic utility trailer may park or store such camping and recreational equipment or utility trailer in a residence district subject to the following conditions:
      1.   At no time shall such parked or stored equipment be occupied or used for dining, sleeping or housekeeping purposes while parked or stored in a residence district except for a period of not to exceed fourteen (14) days in one calendar year; provided however, that such mobile home, travel trailer, pickup coach, motor home or camping trailer may be used only for sleeping purposes during such fourteen (14) day period.
      2.   If the major recreational equipment is a self-propelled vehicle, not stored on a trailer (such as a motor home), it must be parked on a hard surface, whether it is parked to the front or rear of the front line of the principal structure on the property. Camping trailers, domestic utility trailers, boats on trailers, and other items of major recreational equipment stored on trailers do not need to be on a hard surface if such major recreational equipment is stored or parked to the rear of the front building line of the principal structure on the property.
      3.   If the recreational equipment is parked or stored outside of a garage, it shall be parked or stored to the rear of the front building line of the principal structure on the lot. However, such camping and recreational equipment may be parked anywhere on the premises for loading or unloading purposes for a period not to exceed one week per episode. For the purposes of this subsection G3, an "episode" shall mean either preparing for or returning from a location other than the residential property at which the purpose of the existence of recreational equipment is used or intended. If the recreational equipment is parked on the front of the building line of the principal structure on the property, the equipment must be on a hard surface as defined in subsection F2 of this section.
      4.   Recreational equipment or a domestic utility trailer must be parked a minimum of three feet (3') from a side or rear yard lot line. (Ord. 2009-114, 10-5-2009)
   H.   Provisions For Disabled Accessibility: The requirements for parking stalls and ramps accessible to persons with disabilities shall be as enumerated in the Illinois accessibility code as adopted by the village. See section 10-1-14 of the village code for further information.
   I.   Minimum Number Of Off Street Parking Spaces Required: The following are the minimum off street parking requirements for the land use categories authorized by chapter 7 of this title, subject to the exemptions provided in subsection B of this section:

11-11-4: OFF STREET LOADING:

   A.   Location: All required loading berths shall be off street and shall be located on the same lot as the building to be served. No permitted or required loading berth shall be located within twenty five feet (25') of the nearest point of intersection of any two (2) street right of way lines, nor shall it be located in a required front or side yard.
   B.   Size: Unless otherwise specified in this title or amendment hereto, a required loading berth shall be at least ten feet (10') in width by at least twenty five feet (25') in length, exclusive of aisle and maneuvering space, and shall have vertical clearance of at least fourteen feet (14').
   C.   Access: Each required loading berth shall be served by appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movements as determined by the administrating official.
   D.   Surfacing: See subsection 11-11-3F of this chapter.
   E.   Repair And Service: No storage of any kind, nor motor vehicle repair work or service of any kind, shall be permitted within any required loading berth.
   F.   Space Allocated: Space allocated to be required loading berth shall not be used to satisfy any requirement of this title for off street parking spaces.
