ARTICLE II
Establishment of Districts
§ 247-5 Use districts.
The Town of Hoosick is hereby divided into the following land use districts, as shown on the Land Use District Map.[1]
A.
Hamlet - H: traditional hamlet areas and areas around the Village of Hoosick Falls, mixed residential and small commercial with limited floor/building sizes; Hoosick, North Hoosick, Walloomsac, Potter Hill, Mapletown, Buskirk and Eagle Bridge.
B.
Light Industrial/Commercial - LIC: near state highways, for larger commercial buildings and industrial uses.
C.
Rural Residential - RR: smaller residential lots in areas that are not heavily agricultural.
D.
Agricultural/Residential - AR: rural areas, including small and large farms, low-density residential and rural uses.
E.
Conservation/Resource Management - CRM: parklands, cemeteries, state forest lands, lands protected by conservation easements, schools, rivers and trout streams.
F.
Historic Overlay - HO: a buffer area of 50 feet around a National Historic Register-listed property or a Town of Hoosick historic property.
G.
Flood Fringe Overlay - FFO: the 100-year floodplain and floodway of the most recent FEMA Flood Insurance Rate Map.
H.
Dailey Mine Zone - DZ: for the mining use of construction aggregate(s) as per NYS Supreme Court, Rensselaer County, William E. Dailey, Inc., v. Town Of Hoosick, Rensselaer County Legislature, et al. Stipulation of Settlement Index No. 186-678, State of NY Department of Environmental Conservation.

§ 247-6 Land Use District Map.
The location and boundaries of all land use districts now established or which may hereafter be established by the provisions of this chapter are shown on the Land Use District Map, Town of Hoosick. This map, together with all explanatory matter and all amendments, is hereby adopted and made a part of this chapter. This map shall be kept up-to-date and shall be available for public inspection in the office of the Town Clerk. A reduction of this map is attached in this chapter as Appendix A, for illustrative purposes only.[1]

§ 247-7 Interpretation of district boundaries.
Where uncertainty exists with respect to the boundaries of any of the land use districts established or which may hereafter be established by the provisions of this chapter as shown on the Land Use District Map, the following rules shall apply:
A.
Where district boundaries are indicated as approximately following the center lines or right-of-way lines of roads, highways, railroads, public utility easements or watercourses, said boundaries shall be construed to be coincident with such lines. Such boundaries shall be deemed to be automatically adjusted if a center line or right-of-way line of such road, highway, railroad, public utility or watercourse is moved a maximum distance of 50 feet.
B.
Where district boundaries are indicated as approximately following the Town or village boundary line, property lines, lot lines or projections thereof, said boundaries shall be construed to be coincident with such lines or projections thereof.
C.
Where district boundaries are so indicated that they are approximately parallel to the Town or village boundary line, property lines, lot lines, right-of-way lines, or projections thereof, said boundaries shall be construed as being parallel thereto and at such distance there from, as indicated on the Land Use District Map or as shall be determined by use of the scale shown on the Land Use District Map.
D.
Where a district boundary line divides a single lot in a single or joint ownership of record at the time such line is established, the regulations for the less restricted portion of such lot may, at the owner's discretion and with the exception of the Flood Fringe Overlay District and Historic Overlay District, extend not more than 30 feet into the more restrictive portion, provided the lot has road or highway frontage in the less restrictive district.
E.
In all other cases, where dimensions are not shown on the Land Use District Map, the location of the boundaries shown on the map shall be determined by the use of the scale appearing therein.
§ 247-8 Permitted uses; prohibited uses.
Permitted uses and prohibited uses in each district are shown in the Use Table in Article III. The district schedule of area and bulk regulations in Article IV establishes minimum lot area, open space, lot width, frontage, and setbacks, and maximum structure coverage and height requirements.
§ 247-9 Applicability of land use district regulations.
A.
No building, structure, or land shall be used or occupied, and no building or structure or part thereof shall be erected, moved, altered or enlarged except in conformance with the use regulations and the area and bulk requirements specified in this chapter for the district in which it is located.
B.
No part of a yard or other open space required in connection with any building or use shall be included as part of a yard or other open space similarly required for another building.
C.
No yard or lot existing at the time of passage of this chapter shall be reduced in size or area below the minimum requirements set in this chapter.
D.
No off-road parking or loading space required for one building or use shall be included as meeting, in whole or in part, the off-road parking or loading space required for another building or use except as otherwise provided in this chapter.
E.
Within each district, the use regulations and the area and bulk requirements in this chapter shall be considered minimum regulations and shall apply uniformly to each kind of building, structure, land or use.
