ARTICLE II

STATEMENT OF PURPOSES

Sec. 28-26.- Statement of authority and intent.

These zoning provisions and zoning districts, as herein established, have been established for the purpose of promoting the health, safety, morals, and the general welfare of the community and in consideration of the Comprehensive Master Plan for Terrebonne Parish. The provisions have been designed to lessen congestion on streets; to secure safety from fire, panic, and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, schools, parks and other public requirements. These provisions have been made with reasonable consideration among other things, to the character of the district, and its peculiar suitability for the particular uses; and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community.

Sec. 28-27. - Area of jurisdiction.

(a)

The provisions of this chapter shall apply to all lands within the boundaries of the Urban Services District of Houma, as such boundaries exist or may exist in the future, as well as any geographical areas of Terrebonne Parish subject to zoning, as described in this chapter, and as may be illustrated on the "Zoning Map of the Parish of Terrebonne" incorporated herein by reference.

(b)

The provisions of this chapter shall also encompass the urban planning district of the Parish, as fully illustrated on the "Zoning Map of the Parish of Terrebonne" incorporated herein by reference the urban planning district specifically includes the Urban Services District of Houma and the area more fully described below:

Beginning at the intersection of the centerlines of Bayou Gardens Boulevard and St. Louis Canal Road; thence, southeasterly along the centerline of St. Louis Canal Road and its straight line extension to its intersection with the boundaries of the Urban Services District of Houma; thence, along the boundaries of the Urban Services District of Houma to its intersection with the centerline of an unnamed drainage canal in Section 83, T-17-S, R-17-E; thence, southwesterly and westerly along the centerline of the unnamed drainage canal to its intersection with the power line in Section 3, T-17-S, R-16-E; thence, northwesterly along the power line to its intersection with an unnamed drainage canal in Section 73, T-17-S, R-16-E, which is also the southeastern property boundary of Ellendale Plantation LLC; thence northeasterly along the centerline of the unnamed drainage canal/southeastern property boundary of Ellendale Plantation LLC and its straight line extension to its intersection with the centerline of the previous A & K Railroad right-of-way; thence, southeasterly along the centerline of the previous A & K Railroad right-of-way to its intersection with the centerline of Savanne Road; thence, northeasterly and easterly along the centerline of Savanne Road to its intersection with the centerline of Martin Luther King Boulevard; thence, northeasterly along the centerline of Martin Luther King Boulevard to its intersection with the centerline of West Park Avenue; thence, northerly along the centerline of West Park Avenue for a distance of 450 feet; thence, easterly for a distance of 265 feet; thence, southerly a distance of 185 feet;, thence, northeasterly a distance of 5265 feet to the intersection with the centerline of the straight line extension of St. Louis Canal Road; thence, southeasterly along the centerline of the straight line extension of St. Louis Canal Road to its intersection with centerline of Bayou Gardens Boulevard, the point of beginning.

Sec. 28-28. - Annexed and new territories.

(a)

Territory hereafter annexed into the Urban Services District of Houma, and not previously regulated by this chapter, shall be in the O-L (Open Land) District until and unless changed in accordance with the amendment procedure set forth herein.

(b)

New zones, regulations and districts within the parish shall be enacted by ordinance for the purpose of promoting the health, safety and general welfare of the community and consistent with the statement of authority and intent set out in section 28-26. Such new zones, regulations and districts shall not require compliance with the amendment procedures herein contained but shall require public hearing and recommendation by the zoning and land use commission prior to consideration by the Terrebonne Parish Council.

(c)

Amendments to existing zoning districts and the regulations contained in this Chapter shall comply with the provisions of Article X of this chapter.

Sec. 28-29. - Application of regulations.

Except as provided in this chapter:

(1)

No land shall be used or occupied, no structure shall be erected, altered, used or occupied, and no use shall be operated unless in conformity with the regulations prescribed by this chapter.

(2)

No structure shall be erected, altered, used or occupied to exceed the height limits herein established, to have less building site area or to have narrower or smaller front, side and rear yards than herein prescribed by this chapter.

(3)

No part of a yard or other open space required about any structure for the purpose of complying with the provisions of this chapter shall be included as a part of the yard or other open space similarly required for another structure.

(4)

No building site shall be reduced or diminished so that the building site area, yards or other open spaces shall be smaller than prescribed by this chapter.

(5)

Every structure, other than an accessory structure hereafter erected, altered, used or occupied, shall have provided and continuously maintained for it a separate building site as herein defined.

(6)

Every use, unless expressly exempted by this chapter, shall be operated entirely within a completely enclosed structure.
