ARTICLE VI
Administration, Fees and Deposits
§ 255-87 Duties of Planner/Zoning Administrator and Building Inspector.
A.
The office of Planner/Zoning Administrator is hereby established. The Planner/Zoning Administrator shall administer the Zoning Code, and the City Building Inspector shall ensure compliance and inspect on-site operations.
B.
The Planner/Zoning Administrator and Building Inspector shall enforce the provisions of this chapter as provided herein. In addition to the duties and powers under this chapter, expressed or implied, they shall have the duty and power to:
(1)
Issue all permits required by this chapter.
(2)
Conduct inspections of land, buildings or structures at reasonable times to determine compliance with and enforce the provisions of this chapter.
(3)
Maintain all records necessary for the enforcement of this chapter, including but not limited to all maps, amendments and special use permits, variances, appeal notices and applications therefor.
(4)
Receive, file and forward all appeals, notices, applications for variances, special use permits or other matters to the appropriate officials and boards.
(5)
Institute, in the name of the City of Hudson, any appropriate actions or proceedings to enforce this chapter.
(6)
The Planner/Zoning Administrator shall serve as Secretary, a nonvoting member, of the Plan Commission.
§ 255-88 Fees.
A.
There shall be an application fee to cover the cost of hearings, mailings, publications and minutes for all applications made pursuant to the provisions of this chapter in the amount established by the Common Council.

B.
All fees collected shall be deposited in the City of Hudson General Fund.
§ 255-89 Additional fees required for project review costs.

A.
As a condition of City review of an application to the City of Hudson, the City may require an applicant to pay any extraordinary costs the City incurs in reviewing the application. Costs to review applications covered under this section may include, but shall not be limited to, City staff time, legal review, engineering review, and any other consultant fees. Generally, the terms regarding applicant payment of extraordinary costs the City incurs in application review will be contained in a predevelopment agreement, development agreement or other legally binding agreement which shall be approved by the Common Council. Applications for certificates of compliance, development plan review for building permits and planned development reviews shall be subject to the provisions of this chapter.
B.
The City of Hudson shall refund any remaining amount of the additional fees required in this section within one year after the final City action on the application.
C.
The City of Hudson shall not pay interest on any additional fees required in this section.
