Definitions

§ 9.03.491 Definitions.

For the purpose of this article, certain terms and words are to be used and interpreted as defined hereinafter. Words used in the present tense shall include the future tense; words used in the singular number include the plural and words in the plural number include the singular, except where the natural construction of the writing indicates otherwise. The word "shall" is mandatory and not discretionary.
Accessory building.
A subordinate building or a portion of the main building located on the same lot as the main building, the use of which is incidental to that of the dominant use of the building or premises. Accessory buildings may include parking garages, adjacent farm structures, home workshops and tool houses, storage sheds, home greenhouses, etc. An accessory dwelling shall mean the same as an accessory building except it may be used as a residence.
Accessory use.
A use customarily incidental, appropriate and subordinate to the principal use of the land or building(s) and located upon the same lot therewith.
Adult entertainment enterprise.
Reference article 5.05 of the city Code of Ordinances.
Advertising sign or structure.
Any device or structure, regardless of the material used in the construction of such device or structure and regardless of how such sign or structure is erected, and of any character whatsoever that advertises a business, product or activity. All such signs or structures shall be governed by division 3, part III of this article.
Airport.
A place where aircraft may land and take off, usually equipped with hangers, facilities for repairing and/or refueling aircraft, accommodations for training pilots and other facilities and accommodations for passengers, pilots and/or flight crews.
Alley.
A minor right-of-way, dedicated for public use, which is used primarily for placement and maintenance of utility lines and for vehicular service access to the back or side of properties otherwise abutting on the street.
Amusement center.
A public place of business making use of three (3) or more coin-operated amusement machines, devices, or apparatus, excluding pool or billiard tables, operated by insertion of a coin or similar object, for the purpose of entertainment or skill.
Amusement, commercial (indoors).
An amusement enterprise wholly enclosed in a building which is treated acoustically so that noise generated by the enterprise is not perceptible at the bounding line of the property and including, but not limited to, a bowling alley or billiard parlor.
Amusement, commercial (outdoors).
Any amusement enterprise offering entertainment or games of skill to the general public for a fee or charge wherein any portion of the activity takes place in the open including, but not limited to, a golf driving range, archery range and miniature golf course.
Antenna.
An instrument or device consisting of wires, poles, rods or reflecting disc, designed for transmitting or receiving any portion of the radio, microwave or electromagnetic spectrum.
Antenna, commercial.
An antenna in excess of forty (40) feet in height above the ground elevation at the base of the tower, pole, structure or support and primarily used for commercial broadcasting. If mounted atop a structure, the total height above the ground may not exceed forty feet (40'). A satellite dish antenna in excess [of] twelve (12) feet in diameter shall also be considered as a commercial antenna. A microwave-transmitting tower and/or towers used for cellular transmissions also are considered commercial antennas.
Antenna, noncommercial (amateur radio or CB radio).
An antenna not exceeding forty (40) feet in height above the ground elevation at the base of the tower, pole, structure or support. If mounted atop a house or other structure, the total height above the ground may not exceed forty feet (40'). A satellite dish antenna not to exceed twelve (12) feet in diameter shall also be considered as a noncommercial antenna.
Antique shop.
An establishment offering for sale, within a building, articles such as glass, china, furniture or similar furnishings and decorations which have value and significance as a result of age, design and sentiment.
Apartment.
A dwelling unit contained in an apartment building and which is for rent or lease.
Apartment building or house.
A structure containing two or more apartments.
Apartment, garage.
A dwelling unit designed or constructed as a part of a private garage.
Art gallery or museum.
An institution for the collection, display and distribution of objects of art or science, and which is sponsored by a public or quasi-public agency and which facility is open to the general public.
Atmospheric pollution.
The discharging from stacks, open storage, chimneys, exhausts, vents, ducts, openings, or open fires of such air contaminants as visible emissions, sulfur dioxide, particulate matter, hydrocarbons, fumes or similar material or gases.
Automobile.
A self-propelled mechanical vehicle designed for use on streets and highways for the conveyance of goods and people and required to be registered and appropriately licensed by governmental agencies. Vehicles exceeding 2.5 tons gross vehicle weight (GVW) are excluded from this definition. The word "auto" is typically interchangeable with "automobile."
Automobile and trailer sales area.
An area, other than a street, used for the display, sale or rental of new or used automobiles, trucks, or trailers, where no repair work is done. Such area shall not include automobile wrecking or dismantling or the sale of salvaged parts. Such sale area shall include one space per sales unit in addition to any other on-site parking requirements.
Automobile leasing and renting.
The leasing or renting of automobiles, motorcycles and light duty vehicles.
Automobile repair (major).
General repair or reconditioning of engines, air conditioning systems and transmissions for motor vehicles; wrecker service; collision services, including body and/or frame straightening or repairing; customizing, painting; vehicle steam cleaning; undercoating and rust-proofing; any uses listed enter [under] "Automobile repair (minor)" and other similar uses.
Automobile repair (minor).
Minor repair or replacement of parts, tires, tubes and batteries; diagnostic services, minor motor services such as grease, oil spark plug and filter changing; tune-ups; emergency road service; replacement of alternators, starters, hoses, brake parts; washing and polishing; performing state inspections and making minor repairs necessary to pass said inspections; normal serving of air conditioning systems; and other similar minor services for automobiles. This definition does not include any operations named under "Automobile repair (major)" or any other similar use.
Automobile sales (new).
An establishment whose primary business is the sale and display of new automobiles within a showroom and on an adjacent open car sales lot. Used automobiles may be a secondary use.
Automobile sales (used).
An establishment whose primary business is the sale and display of used automobiles within a showroom or on an adjacent open car sales lot.
Automobile storage.
The storage or impoundment, on a lot or tract, of operable automobiles for the purpose of holding such vehicles until claimed by its legal owner or sold for impoundment or other storage fees.
Auto parts sales (new).
An establishment providing the sale and inside display of new and reconditioned parts for automobiles.
Auto wrecking.
The collecting and dismantling or wrecking of used motor vehicles or trailers, or the storage, sale or dumping of dismantled, partially dismantled, obsolete, or wrecked motor vehicles or their parts.
Background noise.
Noise from all sources other than that under specific consideration including traffic operating on public thoroughfares.
Bar.
A place where spirituous, vinous, malt or other alcoholic beverages are sold for consumption on the premises, and more than 20% of the gross business is derived from such sales. The term shall also include "tavern," "inn," "nightclub," or "beer parlor."
Board.
Board of zoning adjustment (BZA).
Boarding house or rooming house.
A building, other than a hotel, where lodging and/or meals for three or more persons are provided for compensation.
Building.
Any structure built for the support, shelter, and enclosure of persons, animals, chattels, or movable property of any kind. Shipping containers are not allowed for use as a "building," including accessory uses.
Building ends.
Those sides of a building having the least horizontal dimension. As used herein for the building spacing regulations for multiple-family dwelling, a building end shall be interpreted as being the narrowest side of a building regardless of whether it fronts upon a street, faces the rear of the lot or is adjacent to the side lot line or another building.
Building line.
A line parallel or approximately parallel to the platted property line at a specified distance therefrom making the minimum distance from the platted property line that a building may be erected.
Building official.
The building official or person charged with the enforcement of the planning, zoning and building codes of the city.
Certificate of occupancy.
An official certificate issued by the city through the enforcing official that indicates conformance with or approved conditional waiver from the zoning regulations and authorizes legal use of the premises for which it is issued.
City council/city aldermen.
The elected, governing body of the City of Jacksboro.
Clinic, health.
A building in which a group of physicians, dentists, or physicians and dentists and allied professional assistants are associated for the purpose of treating and diagnosing ill or injured outpatients. A clinic may include a dental or medical laboratory or a dispensing apothecary.
Club or lodge.
An association of persons for the promotion of a nonprofit common objective such as literature, science, politics, good fellowship and similar objectives, which meets periodically and which is limited to members.
Club, private.
Quarters for a private organization, a principal purpose of which is the preparation and service of food and/or drink for members and their guests only.
Commission.
See planning and zoning commission.
Community center.
A building dedicated to social or recreational activities, serving the city or a neighborhood and owned and operated by the city, or by a nonprofit organization dedicated to promoting the health, safety, morals or general welfare of the city.
Comprehensive plan.
Graphic and textual form policies which govern the future development of the city and which consists of various components governing specific geographic areas and functions and services of the city.
Condominium.
The same as an apartment except that the tenant has the option of obtaining title of ownership of the dwelling space and physical interior of the dwelling space. The building's owner retains title to the building frame, the building physical exterior, and all physical service facilities and ways of the building which are not part of the physical interior described above, and the land on which the building is located. Restrictive covenants ensure that the functional and environmental conditions of the interior of each dwelling unit are maintained to the extent that the value of all the other dwelling units in the same building is protected.
Convalescent home.
Any structure used for or occupied by a person recovering from illness or suffering from the infirmities of old age.
Cosmetic services.
The retail services focused on matters of personal cosmetic health and beauty which are typically elective in nature, such as but not limited to hair care and nail salons, spas, massage therapy, waxing, permanent makeup (meaning producing designs that resemble makeup such as eye lining and enhancing colors to the skin of the face, lips and eyelids), microblading, microdermabrasion, botox, chemical peels, facials, tanning, eyelash extensions, eyebrow threading, electrolysis, shaving, skin care, personal grooming, [and] non-medical weight loss/weight reduction services. This definition does not include tattoo or piercing shops.
Country club/golf course.
A golf course and clubhouse that are available to a specific recorded membership. Such a club may include, as adjunct facilities: a dining room, private club, swimming pool, cabanas, tennis courts and similar service and recreational facilities for the members.
Court.
An open, unoccupied space, bounded on more than two sides by the walls of a building. An inner court is a court entirely surrounded by the exterior walls of a building. An outer court is a court having one side open to a street, alley, yard or other open space.
Coverage.
The percent of a lot or tract covered by the roof or first floor of a building. Roof eaves to the extent of two (2) feet from the walls of a building shall be excluded from coverage computations.
Custom personal service.
Tailor, dressmaker, shoe shop or similar shop offering custom service.
Customarily incidental use.
A use of a building or premises, not involving the conduct of a business, which is only secondary to the principal use and is necessary to the enjoyment of the premises for any of the principal uses permitted within a zoning district. A customarily incidental use may include a customary home occupation.
Customary home occupations.
A customary home occupation is an occupation customarily carried on in the home by a member of the occupant's family without significant structural alterations in the building or any of its rooms, without the installation of machinery or heavy equipment, and without the use of a sign to advertise the occupation. It is an occupation or activity that is clearly incidental and secondary to the use of premises for dwelling purposes, and is not detrimental or injurious to the economic or aesthetic value of adjoining property. Customary home occupations shall not include barber shops, beauty shops, carpenter shops, electrical shops, plumber shops, radio shops, tin-painting, furniture repairing, sign painting, or any form of merchandising activity.
Dance hall.
Any room, space or building primarily used and commonly resorted to for the purpose of dancing, and to which admission by the general public can be had by paying a fee or by the purchase, possession or presentation of a ticket or token, or, to which the public generally may gain admission with the payment of a fee directly or indirectly or without payment of a fee.
Day camp.
A facility arranged and conducted for the instruction and organized outdoor recreation of children on a daytime basis.
Day nursery/day-care center.
A place where children are left for care a part of the twenty-four (24) hours of the day; also known as a day-care center.
Day spa.
Refer to definition and use chart for cosmetic services.
Depth of rear yard.
The mean horizontal distance between the rear line of a building other than an accessory building and the rear lot line.
Development site.
The tract of land on which a developer constructs physical improvements, as, for example, a residential subdivision, a townhouse community, or a shopping village. In most cases, this involves subdividing one larger tract into a number of smaller parcels and constructing at least the infrastructure associated with the entire project.
District.
A zoning district, a section of the city for which the regulations governing the area, height, and use of buildings and land are uniform.
Drive-in restaurant.
Any eating establishment which either serves food to occupants of parked automobiles or offers facilities that would encourage patrons to eat in parked vehicles.
DU.
Abbreviation for dwelling unit.
DU/A.
Abbreviation for dwelling units per acre.
Duplex.
An apartment building containing two and only two dwelling units.
Dwelling, multiple.
A building used or designed as a residence for two or more families or households living independently of each other.
Dwelling, single-family, attached.
A residential structure containing one and only one dwelling unit that is attached or joined to one or more other dwelling units or other structures.
Dwelling, single-family, cluster.
Any arrangement, groupings, clustering, or complex of single-family dwellings of any type.
Dwelling, single-family, detached.
A residential structure containing one and only one dwelling unit and not attached to any other house or structure.
Dwelling unit.
Living quarters, including at least minimal housekeeping and sanitary facilities, for use exclusively by one person or one household.
Easement.
A grant of one or more of the property rights by the property owner to and/or for the use by the public, a corporation or another person or entity.
Family home.
A place where not more than six (6) persons with physical or mental disabilities are provided room and board, as well as supervised care and rehabilitation by not more than two (2) persons.
Field construction office.
A building or structure, of either permanent or temporary construction, used in connection with a development or construction project for housing temporary supervisory or administrative functions related to development, construction or the sale of real estate properties within the active development or construction project.
Flea market.
An outdoor, or partially indoor premises, where the main use is the sale of new and used household goods,, personal effects, tools, artwork, small household appliances and similar merchandise, objects or equipment, in small quantities, in broken stalls, lots or parcels, not in bulk, of the use or consumption by the immediate purchaser in a building, open air or partly enclosed booths or stalls not within a wholly enclosed building. The term "flea market" shall not be deemed to include wholesale sales establishments or rental service establishments, nor does it pertain to retail sidewalk sales, garage sales, arts and craft shows or sales held by nonprofit organizations.
Flood.
A temporary rise in stream flow or stage that results in water overtopping its bank and inundating areas adjacent to the channel.
Floodplain.
The area outside the flood way that is subject to inundation by the 100-year flood.
Floodway.
The channel of a stream and adjacent land areas that are required to carry and discharge the floodwater of flood flows of any stream associated with the 100-year flood with an allowable maximum increase in water surface elevation above the 100-year flood of one (1) foot.
Floor area.
The total square feet of floor space within the outside dimensions of a building including each floor level, but excluding cellars, carports or garages, also called living area.
Floor area ratio (FAR).
The ratio between the total square feet of floor area in a structure and the total square feet of land within the lot or tract on which the structure is located.
Frequency.
The number of oscillations per second in a sound wave.
Game processing.
Means the processing of hunter killed game, whether by bow and arrow or firearm, consistent with all applicable state and local regulations and licenses as herein adopted or as may be adopted and amended, for the use and/or consumption by the owner of said game. For purposes of this section, the following animals are game animals: mule deer, white-tailed deer, pronghorn antelope, desert bighorn sheep, gray or cat squirrels, fox squirrels or red squirrels and collared peccary or javelina. Game processing establishment means a commercial establishment in which game is processed or otherwise prepared and packaged for human consumption, but not for commercial or retail sale.
Garage apartment.
A dwelling unit for one family erected conjunction with a garage.
Garage, private.
An accessory building for private storage of motor vehicles.
Garage, public.
A building or portion thereof designed or used for the storage, sale, hiring, care or repair of motor vehicles, which is operated for commercial purposes.
Garage, storage.
A building or portion thereof, other than a private garage, used exclusively for parking or storage of self-propelled vehicles, but with no other services provided except facilities for washing.
Halfway house.
A home for not more than six (6) persons who have demonstrated a tendency toward alcoholism, drug abuse, anti-social or criminal conduct, together with not more than two (2) providing supervision and other services to such persons, all of which live together as a single housekeeping unit.
Health studio.
Any recreational facility where all activities are contained within an enclosed building which is open to the general public for a fee or charge. Such facilities may include, yet are not limited to, aerobic exercise, tennis, swimming or racquet facilities, gymnasiums, weight room, sauna or other associated recreational activities.
Hospital.
An institution in which there are complete facilities for diagnosis, treatment, surgery, laboratory, X-ray, nursing, and the prolonged care of bed patients.
Housing and Urban Development (HUD) certification label.
The certification label (also known as a HUD tag) is a metal plate that is affixed to the outside of the manufactured home. Section 3280.11(b) [24 CFR section 3280.11(b)] states, "The label shall be approximately 2 in. by 4 in. in size and shall be permanently attached to the manufactured home by means of 4 blind rivets, drive screws, or other means that render it difficult to remove without defacing it. It shall be etched on 0.32 in. thick aluminum plate. The label number shall be etched or stamped with a 3 letter designation which identifies the production inspection primary inspection agency and which the Secretary shall assign. Each label shall be marked with a 6 digit number which the label supplier shall furnish. The labels shall be stamped with numbers sequentially."
Incidental use.
Any use different from the primary use but which complements and/or supplements the primary use. Incidental shall mean an area that constitutes not more than fifteen percent (15%) of the main use.
Industrial park.
A large tract of land that has been planned, developed and operated as an integrated facility for a number of individual industrial uses, with special attention to circulation, parking, utility needs, aesthetics and compatibility.
Infrastructure.
Structures built below, on, or approximately on the surface of the ground which provide the foundations for super-structures, or which provide services for building structures or for other utility purposes, for example, streets, water and sewer lines and their appurtenances, and storm drain systems.
Institution.
A building occupied by a nonprofit corporation; a nonprofit establishment for public use.
Institution for the care of alcoholic, psychiatric or narcotic patients.
An institution offering resident treatment of alcoholic, narcotic or psychiatric patients.
Junk or salvage yard.
Premises upon which waste or scrap materials are bought, sold, exchanged, stored, packed, disassembled or handled, including but not limited to scrap iron and other metals, paper rags, rubber tires, bottles and used building materials. This term shall also include an automobile wrecking yard and automobile parts yard.
Kennel.
Any lot or premises on which four (4) or more dogs, cats or other domestic animals at least four (4) months of age are housed or accepted for boarding, trimming, grooming and/or bathing for which remuneration is received.
Landscaping.
The use of material such as, but not limited to, grass, groundcovers, shrubs, vines, hedges, trees or palms, and non-living durable material commonly used in landscaping, such as, but not limited to, rocks, pebbles, sand, walls or fences, but excluding paving, to meet landscaping requirements.
Living area.
The floor area of the enclosed parts of a dwelling unit, exclusive of garages, measured by the exterior dimensions.
Local utility line.
The facilities provided by a municipality or a franchised utility company for the distribution of gas, water, surface drainage water, electric power, telephone service or cable television, or for the collection of sewage or storm water.
Lodging house.
A building other than a hotel where lodging for five or more persons is provided for compensation on a more or less temporary basis. A lodging house shall not include those uses that are customary in servicing the transient trade usually associated with hotels and motels.
Lot.
Any plot of land occupied or intended to be occupied by one main building and the required parking, or a group of main buildings, and accessory building(s) and uses, including such open spaces as are required by the ordinance [this article], and other laws or ordinances, and having its principal frontage on a public street.
Lot area.
The total area, measured on a horizontal plane, included with [within] the lot lines.
Lot, corner.
A lot which has at least two adjacent sides abutting for its full length on a street, provided that the interior angle at the intersection of such two sides is less than one hundred thirty-five degrees (135°).
Lot depth.
The mean horizontal distance from the front street line to the rear line.
Lot, double frontage.
A lot, other than a corner lot, which is contiguous to two streets, and which, therefore, has two front yards.
Lot, frontage.
That dimension of a lot or portion of a lot abutting on a street, excluding the side dimension of a corner lot.
Lot, interior.
A lot other than a corner lot.
Lot line.
The platted boundary of a lot.
Lot line, front.
The narrower side of the lot abutting a street. When two lot lines abutting streets are of equal length, the owner shall have the choice in designating which shall be a lot frontage. For a lot that has a boundary line which does not abut the front street line, is not a rear lot line and lies along the same general directional orientation as the front and rear lot lines, then said line shall be considered a front lot line in establishing minimum setback lines.
Lot line, rear.
The lot line farthest from and most parallel to the front lot line. For triangular lots, the point opposite the front lot line shall be considered the rear lot line and have a value of zero.
Lot line, side.
Any lot line not the front or rear lot line.
Lot of record.
A lot, which is typically a part of a subdivision that has been appropriately platted by a registered engineer or surveyor and has been recorded in the office of the county clerk.
Lot, reverse corner.
A corner lot, the rear lot line of which abuts the side lot line of an adjacent lot.
Lot, through.
An interior lot having frontage on two streets. The same as a double frontage lot.
Lot width.
The horizontal distance measured between side lot lines parallel to the front lot line and measured from the point on the building line that is closest to the front lot line.
Manufactured home or HUD-code manufactured home.
A structure constructed on or after June 15, 1976, according to the rules of the United States Department of Housing and Urban Development, built on a permanent chassis, designed for use as a dwelling with or without a permanent foundation when the structure is connected to the required utilities, transportable in one or more sections, and in the traveling mode, at least eight body feet in width or at least 40 body feet in length or, when erected on-site, at least 320 square feet. (Ref: Texas Occupations Code section 1201.003(12))
Manufactured home display and sales.
The offering for sale, storage or display of trailers or manufactured homes on a parcel of land, but excluding the use of such facilities as dwellings either on a temporary or permanent basis.
Manufactured home park.
A unified development of manufactured home sites, plots or stands arranged on a large tract under single ownership, meeting the area and yard requirements of this article, and designed to accommodate manufactured homes for a more or less permanent duration.
Manufactured home subdivision.
A parcel of land that has been designed, platted, improved and is intended for the placement of individually owned manufactured home units on platted lots that can be purchased outright by the owners of the manufactured home units.
Masonry and glass pane.
The exterior wall surface of a building which consists of any kind of masonry, such as brick, stone, concrete block, or other such materials which are not wood, metal, or plastic, and including the areas of doors and windows located within such exterior walls.
Mobile home.
A structure constructed before June 15, 1976, built on a permanent chassis, designed for use as a dwelling with or without a permanent foundation when the structure is connected to the required utilities, transportable in one or more sections, and in the traveling mode, at least eight body feet in width or at least 40 body feet in length or, when erected on-site, at least 320 square feet. (Ref: Texas Occupations Code section 1201.003(20))
Modular home or industrialized home.
A structure designed for the occupancy of one or more families that is constructed in modules or modular components built at a location other than the permanent site where the structure will be inhabited. It is designed to be used as a permanent residential structure when the module or the modular component is transported to the permanent site and erected or installed on a permanent foundation system. (Ref: Texas Occupations Code section 1202.002 and section 1202.002(c))
Motel.
A building or group of buildings, designed, arranged or used for temporary occupancy having accommodations for housing, parking of automobiles in close proximity to the quarters occupied by the owner of such automobile and providing for five or more such quarters. The term "motel" shall include all establishments coming under the general classification of "drive-in hotel," "tourist court," and any other such establishment that houses visiting transient clientele.
Museum.
An establishment operated as a nonprofit, noncommercial repository for a collection of scientific, natural or literary curiosities or objects of interest or works of art, not including the regular sale or distribution of the objects collected.
Nonconforming use.
A building, structure or use of land lawfully occupied at the time of the effective date of this article or amendments thereto, and which does not conform to the use regulations of the district in which it is situated.
Nursing home.
A home where elderly or handicapped persons are provided with lodging, meals and nursing care.
Occupancy.
The use or intended use of land or buildings by residents, proprietors or tenants.
Open space, common open space, permanent open space.
Open space is that land area which is relatively free of man-made structures, where water bodies, land forms, and vegetation predominate: Common open space is that open space which is owned, used or operated and maintained for the common benefit of the inhabitants of a development; permanent open space is that open space land which is legally restricted to park, floodplain, or other open space usage; or which is publicly owned and utilized as open space.
Open storage.
The storage of any equipment, machinery, building materials or commodities, including raw, semi-finished and finished materials, the storage of which is not accessory to a residential use, and which is visible from ground level; provided, however, that vehicular parking shall not be deemed to be open storage.
Parking lot.
An off-street area surfaced and improved for the temporary storage of motor vehicles.
Parking lot driving lane.
A driving area between parking spaces or providing access to parking spaces. Driving lanes will be fifteen (15) feet wide for one-way traffic and twenty-five (25) feet wide for two-way traffic.
Parking space.
A nine-foot (9') wide by eighteen (18) feet in depth area designated for off-street parking.
Parkway.
That public property situated between the curb or edge of a street and the property line of the land adjacent.
Particulate matter.
Any material, except uncombined water, which exists in a finely divided form as a liquid or solid at standard conditions when released into the atmosphere.
Patio home.
A single-family detached home or residence with permitted side and rear yards as narrow as five (5) feet each and which has constructed entirely around it, along the lot lines, a masonry wall eight (8) feet in height except for an opening for a driveway entrance.
Pawn shop.
An establishment where money is loaned on the security of personal property pledged in the keeping of the owners (pawnbroker). Retail sales of primarily used items also may be permitted.
Permanent makeup.
A cosmetic technique which employs tattoos (permanent pigmentation of the dermis) as a means of producing designs that resemble makeup, such as eyelining and other permanent enhancing colors to the skin of the face, lips, and eyelids.
Philanthropic institution.
Any organization operating under a nonprofit charter, the activities of which are devoted exclusively to benevolent purposes.
Planning and zoning commission (P&Z).
A board, appointed by the city council, to carry out the duties set forth by the city council in accordance with 211.007 of the Local Government Code for the proper and orderly growth of the community.
Plat.
A plan of a subdivision of land creating building lots or tracts and showing all essential dimensions and other information essential to comply with the subdivision standards of the city and subject to the approval by the planning and zoning commission and city council and filed in the plat records of Jack County. A registered engineer or surveyor must prepare such plat.
Portable building sales.
An establishment that displays and sells structures capable of being carried and transported to another location, but not including manufactured homes.
ppm (vol).
Parts per million by volume.
Pre-fab home.
A detached single-family dwelling which is prefabricated and assembled at a fabricating plant site for transporting in finished form to a residential lot site. This includes such homes which may be prefabricated into two or more major component parts, but each such part is structurally complete and otherwise finished, the only remaining operation being to connect said parts together and fix them to a foundation on the residential lot site.
Primary building.
The building or buildings on a lot that are occupied by the primary use.
Primary use.
The principal or predominant use of any lot or building.
Private club.
An establishment providing social and/or dining facilities which may provide alcoholic beverage service to an association of person, or in which alcoholic beverages are stored, possessed, mixed or consumed and served by the drink or in broken or unsealed containers, and otherwise falling within the definition, and permitted under the provisions of chapter 32 of the Texas Alcoholic Beverage Code, as the same may be hereinafter [hereafter] amended and as it pertains to the operation of private clubs. A private club shall be limited to membership by invitation only. No conditional use permit shall be granted for such use unless the use shall be in strict accordance with the standards and distance requirements of chapter 32 of the Texas Alcoholic Beverage Code. An applicant for a conditional use permit for a private club shall furnish with such application a site plan showing the property, location of all buildings in which a private club is to be located and the closest distance of such structure to the nearest property line.
Private recreation facility or private park.
A recreation facility operated for the exclusive use of private residents or neighborhood groups and their guests, and not the general public.
Private utility, other than listed.
A non-public utility requiring special facilities in residential areas or on public property such as heating, cooling, or communications not customarily provided by the municipality or public utilities.
Public building or facility.
Any building which is owned, leased, primarily used and/or primarily occupied by the United States government, the State of Texas, the City of Jacksboro, the Jacksboro Independent School District, Jack County or any subdivision or agency of the United States, the State of Texas or the City of Jacksboro, or any public or quasi-public utility.
Publish/publication.
Notice in the City of Jacksboro official newspaper.
Radio broadcasting without tower.
Facility used for studio, office or other broadcasting requirement without a tower.
Recreational area.
An area devoted to facilities and equipment for recreational purposes such as swimming pools, tennis courts, playgrounds, community clubhouses, or other similar uses.
Recreational vehicle.
For the purpose of this article, the term "recreational vehicle" encompasses a broad category of motor vehicles and trailers that include living quarters designed to be used for temporary accommodation, usually for camping or other recreational or temporary purposes, can be motorized or non-motorized, [and] is designed to be mobile rather than designed to be tied down or otherwise permanently attached to real property. The term includes but is not limited to: house trailer, travel trailer, camper trailer, motor home, camping trailer, truck camper. Not intended for and not allowed to be [used] as a residence.
Recycling center.
A facility, that is not a junkyard, and in which recoverable resources, such as newspapers, glass, aluminum and metal cans are collected, stored, processed for delivery to an end-user within a completely enclosed building.
Residence home for aged.
A home where elderly people are provided with lodging and meals with or without nursing care.
Residential structure.
Any structure containing one or more dwelling units and their accessories.
Rest home or nursing home.
A private home for the care of the aged or infirm, or a place of rest for those suffering bodily disorders, not containing equipment for surgical care or treatment of disease or injury.
Restaurant (or cafeteria).
An eating establishment where customers are primarily served at tables or self-served and food is consumed on the premises. Drive-through window service as an incidental service is included as permitted by zoning districts.
Restaurant (drive-in).
Any eating establishment which either serves food to occupants or parked automobiles or offers facilities that would encourage patrons to eat in parked vehicles.
Rowhouse.
One of several attached single-family dwellings positioned so as to form a row.
Screening device.
A structure such as a fence or wall not less than six (6) feet high nor greater than eight (8) feet high which serves as a visual screen. A structure in excess of eight (8) feet in height shall be deemed a wall and shall be subject to the provisions of the building code of the city.
Secondary use.
A collateral use of land or buildings, which is customarily done or performed in conjunction with a permitted principal use, but not constituting a majority of either the employment, area or revenue of the combined uses.
Servants' quarters.
An accessory building located on the same lot or grounds with the main building and used as living quarters for servants employed on the premises and not rented or otherwise used as a separate domicile.
Shipping containers.
A shipping container is a container with strength suitable to withstand shipment, storage, and handling. Shipping containers range from large reusable steel boxes used for intermodal shipments to the ubiquitous corrugated boxes. In the context of international shipping trade, "container" or "shipping container" is virtually synonymous with "intermodal freight container," a container designed to be moved from one mode of transport to another without unloading and reloading.
Small animal clinic.
An establishment for the care and medical veterinary practice on or for domestic household animals, conducted completely within an enclosed, soundproofed and air conditioned structure and not using any yard or open space for the activities defined.
Spa services.

Stable.
A stable and related open pasture where horses are quartered for owners on a fee basis. No horses or other livestock shall be stabled or corralled within one hundred (100) feet of any bounding property line.
Stable, commercial.
An establishment where horses are kept and rented to the general public for riding. No horses or other livestock shall be stabled or corralled within one hundred (100) feet of any bounding property line.
Stable, private club.
A paddock, stable and related riding and quartering facilities for horses owned by a specific number of recorded members and maintained for the exclusive use of such members and guests. No horses or other livestock shall be stabled or corralled within one hundred (100) feet of any bounding property line.
Stacked parking.
Parking of an automotive vehicle or vehicles either in a multi-level parking structure of at least two levels, or parking in a residential or private garage so that the vehicular parking space is either immediately below or immediately above part of the living area or other permitted use.
Stand.
A prepared place, usually in the form of a structural slab on the ground, for the purpose of providing a foundation and anchorage for a manufactured home or travel trailer, together with all related appurtenances.
Street line.
Street right-of-way line or boundary line.
Strolling path.
A pedestrian path, way, or trail which is designed, maintained, and intended for leisure walks or strolls along it.
Structural alterations.
Any change in the supporting member of a building, such as a bearing wall, column, beams or girders.
Structure.
A constructed facility; something (as a building) that is constructed.
Swim or tennis club.
A private recreational club with restricted membership, usually of less area than a country club but including a clubhouse and a swimming pool, tennis courts and similar recreational facilities none of which are available to the general public.
Tanning salon.
Indoor tanning involves using a device that emits ultraviolet radiation to produce a cosmetic tan. Typically found in tanning salons, gyms, spas, hotels, and sporting facilities, and less often in private residences, the most common device is a horizontal tanning bed, also known as a sunbed or solarium. Tanning salon (limited).
A tanning salon in the central business district is an allowed limited use only as a secondary use to an approved primary use business. Refer to definition and use chart for cosmetic services.
Tattoo parlor.
An establishment or facility in which the practice of producing an indelible mark or figure on the human, by scarring or inserting pigment under the skin using needles, scalpels or other related equipment.
Taxidermy.
A facility for the preparing, stuffing and mounting the skins of animals, birds, and fish. The use of the property for this purpose shall be conducted in accordance with applicable state and local regulations and licenses, as herein adopted or as may be adopted and amended.
Temporary field or construction office.
A trailer, structure or shelter for temporary office use, subject to removal by order of the building official, used in connection with a development or building project for housing on the site for temporary administrative and supervisory functions and for sheltering employees and equipment.
Temporary sales -street vending.
The sale of merchandise from a temporary facility located on a public right-of-way, or private property, within the front or side yard area at disassociated periods of time. Street vending shall include any merchandise that is displayed to be sold in an open, [or] partially open, facility and is not designated as a seasonal item or is associated with any outside display or merchandise offered for sale by the primary use of the lot or tract on which it is located.
Tenant.
A dweller or occupant of a building who rents or leases the building from another person or company, generally referred to as the landlord (or owner).
Terminal, motor freight.
The use of property or buildings for the temporary parking of motor freight vehicles or trucks of common carriers, during loading and unloading and between trips, including necessary warehouse space for storage of transitory freight.
Tire dealer.
A retail establishment engaged in the sale and/or installation of tires for vehicles.
Townhouse.
A rowhouse or other attached or detached single-family dwelling in a group of other such dwellings which may be arranged with varying setbacks or varying orientations, and for which yard regulations are generally less restrictive.
Trailer camp or park.
Any premises on which one or more pickup coaches or travel trailers are parked or situated and used for the purpose of supplying to the public a parking space for one or more such coaches or trailers.
Travel trailer.
A vehicular, portable structure built on a chassis, designed to be used as a temporary dwelling and to be towed behind a motor vehicle, and not to be misconstrued as a manufactured home. A travel trailer shall not be considered as a permanent residence.
Truck and equipment repair.
An establishment providing minor and major repair services for heavy load vehicles and equipment.
Usable open space.
An open area that is designed and intended to be used for outdoor living and/or recreation. An area of common open space shall not have a slope exceeding ten percent (10%), shall have no dimension of less than ten (10) feet, and may include landscaping, walks, recreational facilities, water features and decorative objects such as artwork or fountains. Usable open space shall not include rooftops, accessory buildings, parking areas, driveways, turnaround areas or the rights-of-way or easements for streets or alleys.
Used car lot.
A lot or portion thereof to be used only for the display and sale of automobiles that are in condition to be driven on or off the lot. A used car lot shall not be used for the storage of wrecked automobiles, or the dismantling of autos.
Variance.
An adjustment in the application of the specific regulations of this article to a particular parcel of property, which because of special conditions or circumstances of hardship peculiar to the particular parcel, is necessary to prevent the property from being deprived of rights and privileges commonly enjoyed by other parcels in the same vicinity and zoning district. The hardship must not be self-imposed, [or] be financial in nature only and shall be unique to the property. All variances shall be considered and approved by the board of zoning adjustment.
Veterinary hospital.
An establishment for the care and medical treatment of large animals and domestic household pets having treatment and boarding facilities both in an enclosed building and outside pens or runs enclosed by permanent type of fencing.
Wrecking or auto salvage yard.
A yard or building where automobiles or machinery are stored, dismantled and/or offered for sale as whole units, as salvaged parts or as processed metal.
Yard.
The portion of a building lot that lies essentially, between the exterior wall surfaces of the principal building and the lot boundary lines. Obstructions in yards are not permitted except as provided for in section 6-500 [9.03.006(e)].
Yard, front.
A yard across the full width of the lot extending along the front line of the main building to the front line of the lot.
Yard, rear.
A yard between the rear lot line and the rear line of the main building and the side lot lines.
Yard, side.
A yard between the building and the side line of the lot and extending from the front yard to the required minimum rear yard.
Zero lot line.
A side lot line of a lot on which a structure is permitted to be located to the edge of the lot; that is, the side yard width is zero.
Zoning map.
The official certified map upon which the boundaries of the various zoning districts are drawn and which is an integral part of the zoning ordinance.
