Districts; Boundaries; Map

154.15 Districts Enumerated; Number

  1. In order to classify, regulate, restrict, and prescribe the use of buildings and premises, the height of buildings, the open space adjacent to buildings, and the density of population, the city is hereby divided into districts.
  2. There shall be six districts in number, known as:
    1. “A” residence district;
    2. “B” residence district;
    3. “B1” residence district, or ranch district;
    4. “C” commercial district;
    5. “D” business district; and
    6. “E” industrial district.

154.16 District Boundaries Described

  1. “A” residence district. The boundaries of “A” district shall be: all the area within the city limits except the areas described as “B,” “B1,” “C,” “D,” and “E” districts.

  2. “B” residence district. The boundaries of “B” district shall be:
    1. The area described as Blocks 1 through 68, Original City, excluding the area described in divisions (D), (E), and (F) of this section;
    2. The area described as Blocks 1 through 5, Barney Hubbs Addition to the city, excluding the area described in divisions (D), (E), and (F) of this section;
    3. The area described as Block 2, Lots 1 through 12; Block 3, Lots 1 through 12; Stuart Heights Addition to the city;
    4. The area described as Block 25, Lots 8 through 25; Block 26, Lots 8 through 19; Block 27, Lots 8 through 20; Stuart Heights Addition to the city;
    5. The area described as Block 43, Lots 26 through 50; Block 44, Lots 1 through 25; Herwig- Stuart Second Addition to the city; and
    6. The area described as the property adjoining Thornton Drive and/or Sandy Lane, commonly known as the Thornton area.

  3. “B” residence district; ranch district. The boundaries of “B” district shall be:
    1. Parallel with and starting at the north side of Dakota Avenue, from parallel with the west side of North First Street, to the west municipal limits, north to the municipal limits;
    2. Parallel with and starting at the east side of First Street from Highway 128, north to the municipal limits, and parallel with the north side of Highway 128, east to the municipal limits;
    3. Parallel with and starting at the east side of Highway 18 from parallel to the north side of Wyoming Avenue, north to the south side of Highway 128, east to the municipal limits;
    4. Parallel with and starting at the east side of Highway 18, east to the municipal limits, parallel with and starting at the south side of East Nevada Avenue, south to the municipal limits;
    5. Parallel with and starting at the south side of Whitworth Drive from the east side of the railroad right-of-way, to the west municipal limits, then south to the municipal limits;
    6. Parallel with and starting at the city pipeline right-of-way from the south side of West Nevada Avenue, south to parallel with the north side of Whitworth Drive, and parallel with Nevada Avenue, west to the municipal limits;
    7. Parallel with and starting at the east alley of Eighth Street, from the north side of Nevada Avenue, north to Highway 128, and west to the municipal limits, excluding the Western Heights Addition;
    8. Parallel with and starting at Highway 128, north to parallel with the south side of Dakota Avenue, parallel with the west side of Seventh Street, west to the municipal limits;
    9. Parallel with and starting at the east side of Second Street from the north side of Idaho Avenue, north to parallel the south side of Montana Avenue, then east to parallel with the railroad right-of-way;
    10. Parallel with the south side of Wyoming Avenue, south to parallel with the north side of Utah Avenue, then from parallel with the east side of Highway 18, east to the municipal limits; and
    11. Parallel with the north side of Nevada Avenue, north to parallel with the south side of Wyoming Avenue, then parallel with the east boundary of General Camp, east to the municipal limits.

  4. “C” commercial district. The boundaries of “C” district shall be:
    1. The area described as Blocks 1, 2, 3, 5, 6, 7, 8, 9, 10, 11, 12, 14, 15, 16, 17, 18, 19, 21, and 22, Herwig-Stuart Addition to the city;
    2. The area fronting on South Third Street with Missouri Avenue being the south boundary and West Minnesota Avenue being the north boundary of the area;
    3. The area fronting on South Third Street with California Avenue being the south boundary and Panther Avenue being the north boundary of the area;
    4. The area fronting on North Third Street with Wyoming Avenue being the south boundary and the north boundary line of Lot 12, Block 7 and Lot 1, Block 8, Original Town, being the north boundary of the area;
    5. The area fronting on Mesquite Drive between El Paso Drive and Nevada Avenue;
    6. The area fronting on East Utah Avenue with Property Street being the west boundary and the Texas-New Mexico Railroad being the east boundary of the area; and
    7. The area fronting on Kansas Avenue west of the Texas-New Mexico Railroad.
    8. The area fronting on State Highway 128, Northeast Annexation situated in the West Half of the Northwest Quarter of Section 21, Township 25 South, Range 37 East, N.M.P.M., Lea County, New Mexico
    9. Annexation of a tract of land located in the Southwest Quarter (SW/4) of Section 21 and North Half (N/2) of Section 28, Township 25 South, Range 37 East, N.M.P.M., Lea County, New Mexico being more described as East Merryman Ave and a Roadway Dedication on East Merryman Ave being more described as a 60-foot-wide undeveloped simple dedication crossing.

  5. “D” business district. The boundaries of “D” district shall be:
    1. The area fronting on State Highway 18;
    2. The area fronting East Kansas Avenue being east of the Texas-New Mexico Railroad; and
    3. The area, being east of Commerce Street.

  6. “E” industrial district. The boundaries of “E” district shall be:
    1. The area fronting East Kansas Avenue east of State Highway 18;
    2. The area fronting on the west side of North Bonita;
    3. The area fronting on the east side of Commerce Street; and
    4. The area fronting the east side of State Highway 18.

Annexation of a Tract of land located in the Southwest Quarter (SW/4) of Section 21 and North Half (N/2) of Section 28, Township 25 South, Range 37 East, N.M.P.M., Lea County, New Mexico being more described as East Merryman Ave. East Merryman Avenue Dedication being more described as a 60.00-foot-wide undeveloped simple dedication crossing.

154.17 District Map Adopted By Reference

The boundaries of the districts described in this code are shown upon a map, "Exhibit 1" which is made a part of this chapter, which map is designated as the "district map." The district map and all the notations, references, and other information shown thereon are a part of this chapter and have the same force and effect as if the district map and all the notations, references, and other information shown thereon were all fully set forth or described herein, the original of which district map is properly attested and is on file with the City Clerk and with the City Planning Commission, and that district map shall be a part of the Master Plan of the city.

154.18 Conflicts Between Descriptions And Map

The description of the districts given in this code shall control in all cases if there is a discrepancy between the description in this code and the district map.

154.19 Vacations; Adjoining District Extended

Whenever any street, alley, or other public way is vacated by official action of the City Council, the zoning district adjoining each side of that street, alley, or public way shall be automatically extended to the center of the vacation, and all area included in the vacation shall then and henceforth be subject to all appropriate regulations of the extended districts.

154.20 Annexations; Districting

All territory which may hereafter be annexed to the city shall be immediately placed and continued in the “B” residence district until otherwise changed by ordinance as provided in this code.
