VIOLATIONS AND VALIDITY
ARTICLE XV. VIOLATIONS AND VALIDITY
(1)
It shall be unlawful for any person, corporation or other legal entity to violate or fail to comply with any provision of this chapter.
(2)
A violation of this chapter is declared to be a noncriminal violation punishable by a fine as provided in F.S. § 775.082(5). Each day such offense continues after written notice shall be deemed a separate offense. F.S. § 775.083 subparagraphs (1)(e) and (2) provide for a fine not to exceed five hundred dollars ($500.00) for each offense.

The owner or tenant of any building, structure, premises, or part thereof, and any architect, builder, contractor, agent, or other person who commits, participates in, assists in, or maintains such violation may each be found guilty of a separate offense and suffer the penalties herein provided.
In the event that the planning and zoning committee shall become or be made aware of a violation of any of the provisions of this chapter, it shall provide written notice of said violation to the code enforcement board officer and the building official for appropriate action.
The violation of any of the provisions of this chapter may be restricted by injunction, including a mandatory injunction, and otherwise abated in any manner provided by law, and such suit or action may be instituted and maintained by the city commission or by any person affected by the violation of any such provision of this chapter.
If any section, paragraph, sentence, phrase, clause or other part or provision of this chapter is declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this chapter as a whole, or any part thereof, other than the part so declared to be invalid.
This chapter shall encompass and supersede all prior zoning and land development actions of the city commission; and all prior zoning ordinances and resolutions pertaining to zoning and land development are hereby repealed, provided however that any rights of variance heretofore granted shall remain in full force and effect.
