Kingfisher City Zoning Code

CHAPTER 2

ADMINISTRATION AND ENFORCEMENT

11-2-1: RESPONSIBILITY FOR ENFORCEMENT:

It shall be the duty of the building inspector (zoning administrator) to enforce this title. If the zoning administrator shall find that any of the provisions of this title are being violated, he shall notify in writing the persons responsible for such violations, indicating the nature of the violation and ordering the action necessary to correct such violation, and shall take such other action as is authorized by law to ensure compliance with or to prevent violation of its provisions. (Ord. 939, 11-14-2011)

11-2-2: CONDITIONAL USE PERMIT; FEE:

   A.   Procedure For Authorizing: Where the letter "p" appears for certain uses in the tables of permitted uses, their use is permitted subject to acquiring a conditional use permit. The uses designated under the various districts herein as "conditional uses" are so classified because they more intensely dominate the area in which they are located than do other uses permitted in the district; however, the nature of such uses makes it desirable that they be permitted to locate therein. The following procedure is established to integrate properly the conditional uses with the other land uses located in the district. These uses shall be reviewed and authorized or rejected under the following procedure:
      1.   An application shall be filed with the city planning commission for review. Such application shall show the location and intended use of the site, the names of all the property owners and existing land uses within three hundred feet (300') and any other material pertinent to the request which the planning commission may require.
      2.   The city planning commission shall hold one or more public hearings thereon.
      3.   The planning commission shall, within forty five (45) days of the date of application, transmit to the city commission its report as to the effect of such proposed building or use upon the character of the neighborhood, traffic condition, public utilities and other matters pertaining to the general welfare, and the recommendation of the planning commission concerning use thereon. Thereupon, the city commission may authorize or deny the issuance of a building permit for the use of land or buildings as requested. (Ord. 939, 11-14-2011)
   B.   Fees: In accordance with subsection A of this section, a fee in an amount set by the board of commissioners as provided in the fines and fees schedule in appendix A, division IV of this code shall be paid at the time of submission of the application. (Ord. 939, 11-14-2011; amd. 2013 Code)

11-2-3: PLATTING REQUIREMENT:

For the purposes of providing a proper arrangement of streets and assuring the adequacy of open spaces for traffic, utilities, and access of emergency vehicles, commensurate with the intensification of land use customarily incident to a change of zoning, a platting requirement is established as follows:
For any land which has been rezoned upon application of a private party, no building permit or zoning clearance permit shall be issued until that portion of the tract on which the permit is sought has been included within a subdivision plat or replat, as the case may be, submitted to and approved by the city commission upon the recommendation of the planning commission, and filed of record in the office of the county clerk of Kingfisher County. Provided that the city commission, upon the recommendation of the planning commission, may remove the platting requirement upon a determination that the above stated purposes have been achieved by previous platting or could not be achieved by a plat or replat. (Ord. 939, 11-14-2011)

11-2-4: VIOLATIONS; PENALTIES:

A violation of this title shall be deemed a misdemeanor and shall be punishable by fine. Any person, firm or corporation who violates or refuses to comply with any of the provisions of this title shall be fined in an amount set by the board of commissioners as provided in the fines and fees schedule in appendix A, division III of this code for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. (Ord. 939, 11-14-2011; amd. 2013 Code)
