Zoning Districts and Zoning Map

§ 550-5 Designation of Zoning Districts.

[Amended 5-11-1987 by Ord. No. 316-1987]
For the purpose of this chapter, the Borough of Kittanning is hereby divided into nine Zoning Districts, differentiated according to permitted uses and building regulations, and are designated as follows:
R-1
One-Family Residence District
R-2
Two-Family Residence District
R-3
Multifamily Residence District
P-1
Public and Semi-Public District
B-1
Neighborhood Business District
B-2
Central Business District
B-3
General Business and Limited Manufacturing District
M-1
Manufacturing District
AC-1
Agricultural-Conservation District

§ 550-6 Zoning Map.

The location and boundaries of said Zoning Districts are hereby established as shown on the official Zoning District Map[1] of the Borough of Kittanning, dated July, 1965, revised November, 1966; revised February 4, 1969; revised on August 17, 1974; revised on February 14, 1977; revised on March 13, 1984; revised on October 17, 1984; revised on May 1, 1987; revised on March 14, 1988; revised on August 9, 1988; revised on March 28, 1991; revised on June 4, 1992; revised on May 2, 1996; revised on October 14, 1996; and further revised on July 6, 1998, on file in the office of the Borough Secretary. Said official Zoning District Map, together with any map inserts, amendments, notations, references or designations shown thereon, is hereby made a part of this chapter as if the same were fully described as set forth herein.

§ 550-7 Interpretation of boundaries.

A. 
Designation of zone boundaries. The zone boundary lines are intended to follow the right-of-way lines of streets, existing lot and property lines, the mean level of water bodies and Borough corporation lines, all as shown on the Zoning District Map; but where a zone boundary line does not follow such a line, its position is shown on the Zoning District Map by a specific dimension expressing its distance in feet from a street line or other boundary line as indicated, or by reference to a contour line delineated on the United States Geological Survey Maps.
B. 
Determination of locations for boundaries. In the event of uncertainty as to the true location of a zone boundary line in a particular instance, any decision of the Zoning Official may be appealed before the Zoning Hearing Board by any affected property owner. It shall be the duty of the Zoning Hearing Board to render its determination with respect thereto.

C. 
Division of a lot or parcel in single ownership. Where a zone boundary line divides a lot or parcel in a single ownership at the time of the passage of this chapter, any use authorized or permitted in either zone may be extended a distance not to exceed 50 feet beyond the boundary of the zone in which such use is authorized or permitted.

§ 550-8 Degree of restrictiveness.

The phrase "more restrictive uses," as employed in this chapter, shall mean the following:
A. 
Those permitted in an R-1 Zone are the most restrictive.
B. 
All other uses are less restrictive in the order they are permitted in the zone sequence: R-2, R-3, P-1, B-1, B-2, B-3 and M-1.
C. 
Where a use is specifically enumerated in a less restrictive zone, such use shall not be permitted in a more restrictive zone unless it is specifically enumerated as a permitted use therein.

§ 550-9 Limitation of land use.

Except as provided in this chapter, no building or part thereof or other structure shall be erected, altered, added to or enlarged; nor shall any land, building, structure or premises be used, designated or intended to be used for any purpose other than for the uses hereinafter listed as permitted in the zone in which such building, land or premises is located.

§ 550-10 Classification of annexed lands.

A. 
Any land annexed to or made a part of the Borough of Kittanning for municipal purposes subsequent to the adoption of this chapter shall immediately be classified as an R-1 Single-Family Residential Zone, as of the effective date of annexation.
B. 
Within 60 days from the effective date of any annexation proceedings, the Borough Planning Commission shall prepare and submit to the Borough Council a report and study of its recommendations for zoning of the annexed territory. The Planning Commission shall hold at least one public hearing thereon before submitting its final report to the Council.
C. 
At its next regular meeting following receipt of the final report of the Planning Commission, the Borough Council shall authorize the necessary legislation to amend the Zoning Ordinance and/or Map, in accordance with Article X hereof.

§ 550-11 Territory added to R-1 One-Family Residence District.

§ 550-14 Territory added to P-1 Public and Semi-Public District.

In accordance with the above-mentioned revised Zoning Map,[1] the following described piece, parcel or lot of land in the First Ward of Kittanning Borough, Armstrong County, Pennsylvania, is hereby made a part of a P-1 District rather than an R-3 District as heretofore. Said piece, parcel or lot of land is more particularly bounded and described as follows:
BEGINNING at a point at the southwest corner of South McKean Street, said point being located S 38° 52' 30" E, 249.00 feet from the southeast corner of South McKean Street and Mulberry Street; thence along said South McKean Street N 38° 52' 30" W, 157.00 feet to a point at the southwest corner of lands of Kittanning Borough; thence along said lands N 50° 29' 30" E, 81.52 feet to a point on the westerly line of lands of the Penn Central Railroad Co.; thence along said lands S 15° 35' 20" E, 62.36 feet to a point; thence along same S 13° 51' 10" E, 110.93 feet to a point; thence along same S 50° 29' 30" W, 10.00 feet to the place of beginning, containing 7,293.62 square feet, more or less.

§ 550-15 Territory added to B-1 Neighborhood Business District.

A. 
By Ordinance No. 319-1988, a revised Zoning Map was adopted to reclassify certain parts of District R-3 as District B-1.[1]

B. 
By Section 2 of Ordinance No. 389-1996,[2] the three properties located on the north side of Arch Street from Water Street to the first alley on the east side of the properties in question which were previously designated as an R-1, One-Family Residence District, were reclassified as B-1, Neighborhood Business District, with Section 3 of Ordinance No. 389-1996 stating that all the provisions of Ordinance No. 55-1966, as supplemented, which pertain to B-1 Neighborhood Business District to be applicable to the area as outlined in Section 2 of the ordinance. (Ordinance No. 389-1996 was passed over the Mayor's veto.)

§ 550-16 Territory added to B-2 Central Business District.

By Section 1 of Ordinance No. 388-1996, June 10, 1996, a portion of the B-2 General Business District was reclassified as B-3 General Business and Limited Manufacturing District.[1]

By Section 2 of Ordinance No. 397-1998, July 6, 1998, six properties located east of South McKean Street, and known and designated as "315 and 317 Mulberry Street" and "322, 338, 344 and 401 South McKean Street" were reclassified from R-2 Two-Family Residential District to B-3 General Business and Limited Manufacturing District.[2]

§ 550-18 Territory added to M-1 Manufacturing District.

By Ordinance No. 316-1987, the AC-1 District was added to the zoning districts and the Zoning Map was changed accordingly.[1]
