Unless the context otherwise requires, the following definitions shall be used in the interpretation and construction of this chapter:
ACCESS DRIVEA paved surface, other than a street, which provides vehicular access from a street or private road to a lot.
ACCESSORY APARTMENTA separate dwelling unit, in conformity with §
240-47, which is subordinate in size and intensity of use to the primary use of the building in which it is located.
ACCESSORY EQUIPMENTAny equipment servicing or being used in conjunction with a wireless telecommunications facility or wireless support structure. The term includes utility or transmission equipment, power supplies, generators, batteries, cables, equipment buildings, cabinets and storage sheds.

ACCESSORY STRUCTUREA structure detached from a principal building on the same lot and serving a purpose customarily incidental and subordinate to the principal building or use.
ACCESSORY USEA use of land or of a building or portion thereof customarily incidental and subordinate to the principal use of the land or building and located on the same lot with such principal use.
ACTIVE RECREATIONActive recreational endeavors of the type accommodated by public parks and recreation areas and/or accommodated by public buildings, structures and improvements of the type recommended by any recreation master plan of the Town, including activities such as exercise, sports, playgrounds, swimming, and related active or social activities.

ADAPTIVE REUSE, REUSEContemporary use of an existing building or structure for a use other than that for which it was originally designed, intended or occupied, e.g., use of a former barn as a commercial building. This shall include the expansion of the existing building or structure by not more than 25% of the existing gross floor area.

ALLEYA right-of-way that is primarily intended to provide a secondary means of access to abutting properties and is not intended for general traffic circulation.
ALTERATIONAny deliberate change made to an existing site, development, structure, or natural feature which alters the appearance, use, or functionality of the structure or feature.
ANIMATED AND MOVING SIGNAny sign or part of a sign that changes physical position or light intensity by any movement or rotation or that gives the impression of such movement or rotation. This may include but is not limited to flags having commercial messages and all pennants, banners, streamers, propellers and discs, as well as flashing signs, signs with illuminated elements that are used to simulate the impression of motion and searchlights.

ANTENNAA device, including but not limited to whips, dishes, and panels, which is attached to a structure, for transmitting and receiving electromagnetic waves.
APARTMENTOne or more rooms with private bath and kitchen facilities constituting an independent, self-contained dwelling unit in a building containing three or more dwelling units.
AQUIFERAn underground bed or stratum of earth, gravel or porous stone that contains water.
ATTACHED DWELLINGA building containing three or more dwelling units each separated by at least one party wall.

AUTO REPAIR, MAJORGeneral repair to automobiles, rebuilding or reconditioning of engines, transmissions, drive trains, ignition systems, upholstery, exhaust systems, the dismantling or temporary storage of inoperable or wrecked vehicles to the minimum extent necessary to perform services, or any other automotive operation requiring the overnight keeping of vehicles. Auto body repair and collision repair is excluded from this category.

AWNING OR VALANCE SIGNA sign with its copy on a shelter made of any nonrigid material, such as fabric or flexible plastic that is supported by or stretched over a frame and attached to an exterior wall of a building or other structure. Individual letters, words or symbols may be affixed or applied to any surface. An awning or valance sign is a nonfreestanding sign.

BANNERA sign composed of nonrigid material such as cloth, plastic, fabric or paper with no supporting framework.

BASE STATIONA structure or equipment at a fixed location that enables Commission-licensed or authorized wireless communications between user equipment and a communications network. The term does not encompass a tower as defined in this subpart or any equipment associated with a tower.

A. The term includes, but is not limited to, equipment associated with wireless communications services such as private, broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul.
B. The term includes, but is not limited to, radio transceivers, antennas, coaxial or fiber-optic cable, regular and backup power supplies, and comparable equipment, regardless of technological configuration (including distributed antenna systems and small cell networks).
C. The term includes any structure other than a tower that, at the time the relevant application is filed with the Town of LaGrange pursuant to this section, supports or houses equipment described in Subsections
A and
B of this definition that has been reviewed and approved under the applicable zoning or siting process, even if the structure was not built for the sole or primary purpose of providing such support.
BED-AND-BREAKFASTAn owner-occupancy residence resulting from a conversion of a one-family dwelling, used for providing overnight accommodations and a morning meal to not more than 10 transient lodgers and containing not more than five bedrooms for such lodgers.

BENCH SIGNAny sign painted on or otherwise attached to a bench or other seat meant to be seen by the public. The sign must be a plaque no taller than the size of the bench slats and containing letters no taller than the size of the slats identifying that the bench has been donated and by whom.

BUFFER STRIPVegetated land area used to visibly separate one use from another or to shield or block lights, noise or other nuisances.
BUILDINGAny structure having a roof supported by columns or walls, used or intended to be used for the shelter or enclosure of persons, animals or property.
BUILDING INSPECTORThe individual designated by the Town Board to enforce provisions of the Building Code.
BUILDING LINEA line on a lot which is parallel to or concentric with a street right-of-way line where the lot has frontage and which does not extend into the area required for a setback from the center line or right-of-way line of a public road.
BUILDING SQUAREThe minimum area of a lot, having dimensions as specified in Schedules B1 and B2, in which a building may be sited. No portion of this minimum building square shall contain, include or be encumbered by any of the following environmental constraints: wetlands, water bodies, one-hundred-year floodplains or slopes of 25% or more along at least a forty-foot continuous distance within the building square (i.e., measured by utilizing two-foot contours, the building square includes at least one ten-foot change in elevation, or greater, over that 40 feet).

BULLETIN BOARDA particular type of changeable copy sign that displays copy in a casement made of glass, Plexiglas or other materials. It identifies the institution or organization on the premises on which it is located, and it contains the name of the institution or organization, the name of individuals associated with it, and general announcements of events or activities occurring at the institution or similar messages.

CABANA/POOLHOUSEA detached accessory building on a parcel of land improved by a single-family residence only. For the purpose of this Code a cabana/poolhouse shall only be permitted as an amenity to an existing inground pool. Cabana features may include changing rooms, a bathroom, a gathering space, a bar, a barbeque grill, a small kitchen, pool equipment, and entertainment electronics such as a TV, computer and sound system.

CENTRAL SEWER (COMMUNAL SEWAGE SYSTEM)A system utilized for the collection and disposal of sanitary sewage, including the various devices for the treatment of such wastes, owned and operated by a person other than a municipality or sewerage works corporation and not an individual or public sewerage system, and which may serve three families or more, greater than 10 people, or having a flow of 1,000 gallons or greater per day.
CHANGE IN USEAny change in the use or occupancy of land, buildings and other structures as follows (see §
240-27):
A. A change in a use listed on one line of Schedule A1, A2 or A3 to a use listed on another line, when the off-street parking or loading standards applicable to the new use differ from the preceding use.

CODE ENFORCEMENT OFFICERA member of the Code Enforcement Personnel appointed pursuant to Chapter
83 of the Code of the Town of LaGrange.

COLLOCATIONThe use of a single mount on the ground by more than one utility carrier and/or several communication mounts on an existing building or structure by more than one utility carrier.

COMMERCIAL KENNELA commercial enterprise in which five or more pets that are more than four months of age, including but not limited to dogs, cats and other small animals, are kept overnight for the primary purpose of boarding or breeding for which a fee is charged or paid.

COMMON AREAAn area of land, contiguous or noncontiguous, which is held in common ownership by all owners or tenants within a land development (subdivision or building) either by percentage interest or a management organization/homeowners association and available for use by all owners or tenants, groups of owners or tenants, and their invitees. The management organization/homeowners association is responsible for maintenance of the common area(s) as well as some insurance and reserves for replacement of any improvements or amenities contained within it.

COMMUNICATIONS TOWERAny tower whose primary use is to support equipment and signals used for communications.

CONDOMINIUMA building, or group of buildings, in which dwelling units, offices, or floor areas are owned individually and the structure, common areas, and facilities are owned by all the owners on a proportional, undivided basis.
CONFERENCE CENTERA facility consisting of open rooms which can be arranged as meeting rooms, lecture rooms, display and exhibition halls to meet the specific needs of the user for conducting business, professional and educational meetings, conferences and seminars. Dining and food service may be provided. Conference centers may also be located within a hotel or inn as defined in this chapter.

CONGREGATE HOUSING FACILITYA type of housing in which each individual has a private bedroom and shares with other residents the common dining room, recreation room or other facilities.

CONVENIENCE STOREA retail business offering common grocery products, such as but not limited to beer, milk, beverages, limited household items, candy and snack foods, self-serve coffee, newspapers and magazines, sandwiches and other prepared foods, to patrons purchasing relatively few items on a convenience basis generally for off-site consumption. Where any component of the convenience store proposes to include a food service business or a fast-food restaurant as defined in this chapter, then each of the combined uses shall be treated as a separate and independent use to the effect that each use, e.g., convenience store and a fast-food restaurant component, must satisfy the provisions of this chapter which regulate that use.

COVERAGEThat percentage of the plot or land area covered by the building area.
DBHThe diameter at breast height of trees. This commonly used abbreviation is to provide a common standard by which to measure trees.
DECIBEL (db)A unit of sound pressure level. The noise level in an average residence is about 50 decibels.
DIRECTIONAL SIGNAn on-premises sign for the convenience of the public. Such signs give directions or information about a facility, such as the location of exits, entrances, parking lots, and amenities. The intent is to encourage proper circulation. It may not contain advertising copy. A directional sign is an informational sign.

DIRECTORY SIGNA facade or wall sign located on the exterior facade of an office building that identifies the building tenants and their location within the building. A directory sign is a nonfreestanding sign.

DRIVE-IN RESTAURANTAn eating establishment with facilities devoted to the preparation, sales and service of food, refreshments, ice cream, edibles or nonalcoholic drink to patrons for consumption on the premises which permits or encourages consumption of such food and refreshments in parked or standing vehicles or informally outdoors. A drive-in restaurant shall be construed to include any form of drive-in, open-front, curb-service eating establishment or refreshment stand. Any drive-in restaurant proposing to distribute food or beverage at a drive-through service facility as defined in this chapter shall be considered to be a fast-food restaurant.

DRIVE-THROUGH SERVICE FACILITYA window or device in, at or through which a business provides services or the delivery of goods from inside a building to persons in a vehicle, and including all related access lanes, vehicular stacking spaces, drive-through aisles, bypass lanes, drive-through discharge lanes, canopies, message boards, automated banking teller devices, communication speakers, curbing, landscaping, lighting, pedestrian crosswalks, and other structures, equipment or site development for the drive-through function.

FARMAn area of land consisting of not less than seven acres, unless the parcel is located in a state-certified agriculture district, where crops are grown or animals are reared for commercial purposes, together with appropriate buildings. Nothing herein shall be deemed to prohibit gardening, the raising of animals as may be regulated elsewhere in the Code, or other agricultural activities conducted for private use or consumption as an accessory use to a dwelling.

FAST-FOOD RESTAURANTAny franchise or nonfranchise enterprise where pay-before-consumption expedited meals are offered from a counter-type installation, or from an accessory drive-through service facility, from which quickly prepared or preprepared food and/or beverages are ordered from a limited menu of items which are typically distributed in plastic or paper packaging, and which are taken away from the counter by the customer for consumption on or beyond the site, whether or not interior seating facilities are provided without table service. Any business proposing to distribute food or beverage at a drive-through service window shall be considered to be a fast-food restaurant.

FLASHING SIGNAny directly or indirectly illuminated sign which exhibits either changing natural or artificial light or color effects by any means whatsoever or which includes lights or messages that change, flash, blink or turn on and off intermittently, but specifically excluding time and temperature signs which display no other text or images. Flashing signs are a type of illuminated sign.

FLOODWAYThe channel of a natural stream or river and portion of the floodplain adjoining the channel, which are reasonably required to carry and discharge the floodwater or flood flow.
FOOD SERVICE BUSINESSA business, other than a restaurant, fast-food restaurant or drive-in restaurant, providing for carryout food and beverage, such as but not limited to bakeries, delicatessens, coffee shops, pizzerias and ice cream parlors, which may be components of grocery stores, food markets, convenience stores and gas marts and may provide limited seating for up to 12 customers without table service. A food service business shall not include a drive-through service facility as defined in this chapter. Any food service business proposing to distribute food or beverage at a drive-through service facility as defined in this chapter shall be considered to be a fast-food restaurant.

A small cell facility meets both the following qualifications: each antenna is located inside an enclosure of no more than six cubic feet in volume or, in the case of an antenna that has exposed element, the antenna and all of its exposed elements could fit within an imaginary enclosure of no more than six cubic feet; and all other wireless equipment associated with the facility is cumulatively no more than 17 cubic feet in volume. SUMMER DAY CAMPA property consisting of a tract of land and any tents, vehicles, buildings or other structures that may be pertinent to its use, any part of which may be occupied on a scheduled basis at any time between June 1 and September 15 in any year by children under 16 years of age under general supervision for the purpose of indoor or outdoor organized group activities, involving nonpassive recreational activities with significant risk of injury, for a period of less than 24 hours on any day the property is so occupied, and on which no provisions are made for overnight occupancy by such children. Summer day camps are distinct from, and do not include, such uses as health and fitness centers, spas, hotels, motels, municipal parks, churches and schools.

TOWERA. An erect structure or framework, either self-supporting or tied to the ground or other surface by diagonal cables, that is designed to support, including but not limited to the following: wireless service transmissions, receiving and/or relaying antennas and/or equipment, electrical or cable power lines of any transmission or conductance range, or any other equipment, device, or service.
B. A tower includes any structure and supporting apparatus that are attached to same.
TOWNHOUSEA single-family dwelling unit constructed in a group of three or more attached units in which each unit extends from foundation to roof with a yard or public way on not less than two sides, where each dwelling is located on its own parcel of land.

Such term shall not include structures supporting only wireless telecommunication service facilities. Any pole in excess of 50 feet shall be deemed a tower.

This regulation shall permit the use of business logos, identification or advertising on vehicles primarily and actively used for business purposes.
