SPECIAL PROVISIONS
(a)
Within the city there exists land which is subject to periodic flooding and inundation. Development of these lands is regulated by provisions contained in the floodplain ordinance which is made a part of this chapter by reference.
(b)
The flood hazard boundary maps (FHBM) and the flood insurance rate maps (FIRM) are also made part of this chapter by reference and shall be used to determine the location and extent of floodprone areas.

The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Commercial and professional buildings means all buildings that are intended or used for any business, occupation, profession, trade or any other commercial or industrial enterprise. This definition shall not apply to buildings used primarily for permanent residential purposes.

This division shall be mandatory for all commercial and professional buildings constructed in the city after April 12, 1988. Failure to provide and adhere to the commercial or professional building landscaping requirements shall be grounds for denial of request for building permit for such buildings, the issuance of a stop work order on proposed developments or the revocation of a certificate of occupancy issued, all in the discretion of the code enforcement officer.

Commercial and professional buildings shall be required to provide a landscaping plan to be submitted with the application for a building permit for review and approval by the mayor and council.

The landscape plan required in section 42-270 shall provide for a minimum of one tree with a minimum caliper diameter of two inches per 1,500 square feet of floor space or, in the alternative, two trees with a minimum of one-inch caliper diameter per 1,500 square feet of floor space of the building for which application for a building permit has been made.

The landscaping plan required in section 42-270 shall provide for the following for every commercial or professional building:
(1)
One bush per three feet of building frontage for a building with a setback line of 50 feet or less.
(2)
A minimum of two bushes per three feet of building frontage for a building with a setback line of 50 to 99 feet.
(3)
A minimum of three bushes per three feet of building frontage for a building with a setback line of 100 to 199 feet.
(4)
A minimum of five bushes per three feet of building frontage for a building with a setback line of 200 feet or more.

(a)
The landscape plan required in section 42-270 shall provide that an area equal to or greater than ten percent of the gross floor space of the proposed building shall be dedicated to grass or ground cover. Landscaped areas wherein trees or shrubs have been planted may be included in the computation of the minimum area to be planted in grass or ground cover.
(b)
All areas required to be landscaped shall be visible from the street. There is no prescribed design or formation of the landscape area; however, the area should be consistent with the architectural scheme of the building project and complement the plan for sediment and erosion control of the property.
