CHAPTER 10

6 Residential District

§ 10-6A-1 Purpose.

The purpose of the R-1 Residential District is to provide an area for residential uses and those public and semipublic uses normally considered an integral part of the residential neighborhood they serve.

§ 10-6A-2 Permitted Uses.

The following uses are permitted in the R-1 One- and Two-Family Residential District:
A. 
Residential Uses:
Single-family residences
Two-family residences
B. 
Nonresidential Uses:
Accessory buildings, structures and uses
Churches and synagogues
Community centers
Home occupations
Libraries
Noncommercial museums and art galleries
Parks, playgrounds and other noncommercial public open space
Schools; public, private, or parochial

§ 10-6A-3 Special Permitted Uses.

Group home small, provided no group home shall be located within 1,000 feet of another group home.
Other uses of the same general character as those listed in Section 10-6A-2 of this article may be permitted upon review by the Zoning Board of Appeals in accordance with the provisions of Section 10-2-4 of this title.

§ 10-6A-4 Bulk Requirements.

A. 
Building Height And Setbacks:
1. 
Principal Structures:
a. 
No principal structure shall exceed three stories or 35 feet in height.
b. 
No principal structure shall encroach upon the following setbacks:
(1) 
Front yard: 25 feet.
(2) 
Rear yard: 25 feet.
(3) 
Side yard: 10 feet.
2. 
Accessory Structures:
a. 
No accessory structure shall exceed one story or a maximum height of 15 feet as a vertical distance from finished floor to: the highest point of a flat roof; the deck line of a mansard roof; the average height between top wall plate and ridge of gable, hip and gambrel roofs.

b. 
No accessory structure shall encroach upon the following setbacks:
(1) 
Front yard: 25 feet.
(2) 
Rear yard: five feet.
(3) 
Side yard: 10 feet.
c. 
Accessory structures and uses shall have fifty-foot setbacks on through lots.
B. 
Lot Area And Additional Yard Requirements: The following minimum requirements shall be observed:
1. 
Lot area:
a. 
Nine thousand square feet.
b. 
Eight thousand square feet for lots platted prior to December 13, 1973.
2. 
Lot width:
a. 
Seventy-five feet.
b. 
Sixty six feet for lots platted before December 13, 1973.
3. 
Additional yard requirements; exceptions:
a. 
Front yards to be that distance from the front lot line to the front foundation of the house which would be the average distance of said dimension of all existing dwellings on that side of the block, said average distance to be determined by measuring a distance from the front foundation of each house to the front lot line of each lot, adding all said measurements together and dividing by the number of dwelling structures so measured, all said dwelling structures and measurements to be for those dwellings fronting on the same side of the block as the proposed structure (said measurements shall be from the foundation of each dwelling structure and shall not be made from a front porch, step or stoop [see Subsection 10-3-9G of this title]), in any event, the front yard to be not less than 15 feet rear, 25 feet; side to be not less than 10% of the lot width for each side yard, in any event, not less than five feet; said front, rear and side yard setback requirements to be applicable only to those lots platted prior to December 13, 1973, and being less than 75 feet in width.

b. 
A private garage or other accessory use or structure may be constructed adjacent to a rear or side lot line when such rear or side lot line is bordered by an alley or alleyway owned by the City, and the aforesaid rear yard and side yard requirements shall not be applicable as to such private garage or other accessory use, but only as to the side or sides of the lot adjacent to the alley or alleyway.

§ 10-6A-5 Signs.

§ 10-6B-1 Purpose.

§ 10-6B-2 Permitted Uses.

The following uses are permitted in the R-2 General Residential District:
All permitted uses in the R-1 Residential District
Apartment houses
Clubs and lodges, private
Funeral homes and mortuaries
Group home small and group home large. No group home, large or small, shall be located within 1,000 feet of another group home, large or small.
Hospitals
Multiple-family dwellings
Nursery schools
Nursing homes
Rooming houses

§ 10-6B-3 Special Permitted Uses.

Other uses of the same general character as these listed in Section 10-6B-2 of this article may be permitted upon review by the Zoning Board of Appeals in accordance with the provisions of Section 10-2-4 of this title.

§ 10-6B-4 Bulk Requirements.

§ 10-6C-1 Purpose.

The purpose of the R-3 mobile home district is to provide adequate space for mobile home parks in an environment that is compatible to adjoining development.

§ 10-6C-2 Permitted Uses.

The following uses are permitted in the R-3 mobile home district:
Mobile home parks
Parks and recreation areas

§ 10-6C-3 Special Permitted Uses.

Other uses of a nature to serve the residents of the mobile home park in which they are located may be permitted upon review by the zoning board of appeals in accordance with Section 10-2-4 of this title.

§ 10-6C-4 Site And Structure Requirements.

A. 
Lot Sizes: The following minimum requirements shall apply:

1. 
There shall be at least three acres in a mobile home park, inclusive of lots, setbacks and internal roadways.
2. 
The individual mobile home lot size shall contain no less than 4,000 square feet.
3. 
The individual mobile home lot shall be at least 40 feet in width.
B. 
Yards And Setbacks: The following minimum setback regulations shall apply:
1. 
No building, structure, or mobile home shall be located closer than 40 feet to any property line of the mobile home park, nor closer than 50 feet to any county, township, City, state or federal highway, road, or street right of way.
2. 
Mobile homes shall be set back at least 15 feet from the pavement of streets or roadways within the park.
3. 
No mobile home, appurtenance thereto, or accessory building shall be placed within 16 feet of any other mobile home, addition, appurtenance, or accessory building, nor within 50 feet of any accessory or service building or structure.
C. 
Mobile Home Stands: Mobile homes shall be placed on mobile home stands. The mobile home stand shall be constructed of a minimum thickness of four inches of concrete with adequate base and shall have a minimum area to be coextensive with the floor area of the mobile home it is to accommodate. The mobile home stand shall be provided with anchors and tie downs for both over the top straps and anchoring to the frame, such as cast in place concrete "dead men", eyelets imbedded in concrete foundations, screw augers, arrow heads, anchors, or other devices in a manner that each shall be able to sustain a minimum vertical tension force of 4,800 pounds.
D. 
Parking: There shall be at least one off street parking space available to each individual mobile home lot and located within 100 feet of such lot. However, the total number of off street parking spaces provided in each mobile home park shall be equal to not less than 1 1/2 times the maximum number of mobile homes to be accommodated.
E. 
Landscaping: Along each property line of a mobile home park, there shall be provided, within the 40 feet setback area, screening or landscape planting which shall be so designed and/or planted so as to be at least 50% opaque when viewed horizontally between two feet and eight feet above ground level.
F. 
Improvement Requirements Within Mobile Home Parks: The following regulations shall apply:
1. 
Water Facilities: Public water facilities shall be available to each mobile home lot.
2. 
Street Location: The design and internal traffic circulation pattern shall not preempt the continuation of any existing streets insofar as they may be deemed necessary for the public requirements.
3. 
Street Construction: Street construction shall be of durable, dustless, all-weather surface and so graded as to dispose of all surface water accumulation.
G. 
Street Signs And Lot Numbers: Street signs conforming to the specifications of the City shall be installed by the owner so as to identify every street in the park, and each mobile home lot shall be designated by a consecutive number constructed and located as provided in Section 9-4-3 of this Code and in compliance with E911 regulations.

H. 
Recreation Area: All mobile home parks designed to accommodate 25 or more mobile homes shall have one or more recreation areas. Such areas shall be a minimum of 5% of the gross land area of the mobile home park, and no such recreation area shall be less than 10,000 square feet. Playgrounds, swimming pools, beaches, community buildings and other such facilities are considered recreational.
I. 
Service Building: Every mobile home park shall have a park management office and postal pickup and delivery facility as approved by the U.S. post office. The service building may include: 1) park laundry facilities; 2) custodial office; 3) emergency station; 4) indoor recreation areas; 5) civil defense shelter; and 6) public toilet facilities.

§ 10-6C-5 Compliance With State Law.

Every mobile home park shall be constructed and operated in accordance with the mobile home park law[1] and rules and regulations for mobile home parks as established by the state.
