ARTICLE VII
RR Districts: Rural Residential Districts
§ 360-48 Intent.
This district is intended to provide for rural residential and agricultural uses in the Town. It accommodates farms, farm-related activities and low-density residential uses. The following regulations shall apply in all RR Districts:
§ 360-49 Uses permitted.
Permitted uses in the R-R District shall be as follows:
A.
Agriculture including but not limited to farms, farm-related operations, animal husbandry and raising of crops, livestock and livestock products, together with all customary buildings and structures associated with such uses.
B.
Forestry and conservation uses, activities and structures.
C.
Private stables.
D.
Roadside stands for the sale of farm products on nonagricultural properties, provided that any structure be set back a minimum of 20 feet from public right-of-way and that the property owner provide at least five off-street parking spaces.
E.
One-family detached dwellings.
F.
Places of worship.
G.
Parish houses or convents.
H.
Community facilities, public parks, playgrounds and public recreational areas.
I.
Schools.
J.
Governmental buildings owned and operated by a federal, state, county or other municipal government, governmental agency or public utility.
K.
Cemeteries.
L.
Golf courses with corresponding clubhouse.
§ 360-50 Uses permitted with a special use permit.
The following shall be permitted within RR Districts only after submission of a Special use permit application in accordance with § 360-132 and approval is received from the Town Board.
A.
Kennels, animal hospitals, veterinary clinics, animal boarding places.
B.
Public riding stables.
C.
Nursing homes and facilities for the elderly.
D.
Child care and nursery schools.
E.
Schools.
F.
Colleges and universities.
G.
Clubs, lodges and other nonprofit institutions.
H.
Farm market, provided that any structure be set back a minimum of 20 feet from public right-of-way and that there be at least five off-street parking spaces.
I.
Bed-and-breakfast establishments.
J.
Cluster development, subject to Article IX, Cluster Development, of the Code of the Town of Lewiston.
§ 360-51 Accessory uses.
Accessory uses and buildings must be incidental to the principal use. Any accessory building shall be located on the same lot with the principal building. The following accessory buildings, structures or uses shall be permitted within RR Districts:
A.
Any accessory structure or use customarily incidental for farm purposes, such as barns, sheds, silos and coops.
B.
Temporary, removable roadside stands and incidentals for the sale of agricultural products grown on the premises, provided that the stand does not exceed 150 square feet in floor area and is set back a minimum of 20 feet from the public right-of-way.
C.
Anything associated with normal forestry or wood lot management.
D.
Garages, parking areas and storage buildings.
E.
Private swimming pools and other private recreational uses and structures.
F.
Noncommercial greenhouses and garden sheds.
G.
Fences, subject to § 360-194 of the Code of the Town of Lewiston.
H.
Signs, subject to Article XXI of the Code of the Town of Lewiston.
§ 360-52 Right to farm.
It is hereby recognized that certain timely and viable agricultural and conservation practices create disagreeable odors, sights and/or sounds. However, the RR District is intended to provide for and encourage agricultural and conservation practices; therefore, nothing in this article shall be interpreted as to exclude any timely or viable agricultural or conservation practice.
§ 360-53 Area and dimensional standards.
The following requirements shall apply in all areas of the Town of Lewiston designated as Rural Residential Districts:
A.
The building height limit of nonagricultural structures shall not exceed 35 feet.
B.
The required lot area shall not be less than 25,000 square feet, or 30,000 square feet in areas of poor soils (soils do not pass perc test).
C.
The required lot depth shall not be less than 200 feet.
D.
The required lot width shall not be less than 125 feet measured along the front building line and along the front street line.
E.
Required yards.
(1)
Front yard depth. If there shall be a dwelling or dwellings erected on the same side of the street within 300 feet of either side line of a lot, the front yard depth of such lot shall be not less than the average depth of the front yards of all such dwellings within said distance, and the required front yard depth shall be not less than the average depth of the front yards of any dwellings on the opposite side of the street within a distance of 300 feet of either side lot line, extended to the opposite side of said street. In the event that there are no existing dwellings within 300 feet on either side of the street, the front yard depth shall be not less than 40 feet. In no event shall a front yard depth of more than 100 feet be required.
(2)
Side yard width. Each side yard width shall be not less than 15 feet.
(3)
The rear yard depth shall be a minimum of 15% of the depth of the lot.
F.
Accessory uses. No detached structure shall be located less than five feet from any lot line unless the use is located less than 100 feet from the street line, in which case it shall not be located less than 15 feet from the side lot line. All accessory uses shall comply with the requirements for front yard depth.
G.
Every dwelling shall have a minimum living area of 1,000 square feet for one-story dwellings, 850 square feet for one-and-one-half story dwellings and 600 square feet for two-story dwellings.
