CHAPTER 9

01 - PLANNING AND ZONING COMMISSION AND PLAN

9-01-01. - Creation of Planning and Zoning Commission.

There was heretofore created a body known as the Planning Commission of the City, which has also served as the Zoning Commission of the City, which Planning and Zoning Commission has been and is actively serving the community. It is intended that this commission will continue as the Planning and Zoning Commission of the City, with duties and functions hereinafter recited, pursuant to powers authorized by the N.D.C.C.

9-01-02. - Members.

The Planning and Zoning Commission shall consist of seven (7) members. Six (6) members shall be appointed by the Mayor with the approval of the City Council. One (1) member of said commission shall be a person residing outside of the corporate limits of the City, and shall be appointed by the Board of County Commissioners of the County. The City Engineer, City Attorney and Mayor of the City shall act as ex-officio members of said commission.

9-01-03. - Term of Members.

The ex-officio members of the Planning and Zoning Commission shall serve during and for the respective terms for which they have been elected or appointed. Of the six (6) members of said commission first appointed by the Mayor, one (1) member shall hold office for the term of one (1) year, one (1) for the term of two (2) years, one (1) for the term of three (3) years, and one (1) for the term of four (4) years, and two (2) for a term of five (5) years from and after his appointment. Thereafter, the members shall be appointed for terms of five (5) years. One (1) member appointed who resides outside the corporate limits of the City shall be appointed for a term of five (5) years.

9-01-04. - Approval of Appointments.

The Mayor shall submit to the City Council at the next meeting after making such appointments, the names of persons who shall be residents of the City. The City Council shall by majority of vote, confirm or reject such appointments. If such appointments are rejected, the Mayor shall make other appointments for such appointees as may be rejected, which said appointment shall be approved or rejected in like manner. If a vacancy occurs on the Planning and Zoning Commission among the members resident in the City, an appointment to fill such unexpired term shall be made in the manner in which original appointments were made. If a vacancy occurs on said Commission by the member who resides outside the corporate limits of the City, the appointment to fill the unexpired term shall be made in the same manner in which the original appointment was made.

9-01-05. - Powers and Compensation.

The Planning and Zoning Commission shall have all of the powers and perform all of the duties as may now or hereafter be provided by law, and each member of the Planning and Zoning Commission shall receive compensation as provided by in resolution and may additionally be allowed actual expenses for traveling as provided by law.

9-01-06. - Comprehensive Plan.

The "City of Lincoln Comprehensive Plan", dated February, 1979 and originally adopted by the City Council on March 20, 1979 and which is on file in the office of the City Auditor, together with any amendments as may be made from time to time to such plan by resolution of the City Council, shall be the comprehensive plan for the City.
