EAST MAIN OVERLAY DISTRICT
(a)
Purpose. The purpose of this article is to protect and promote the health, safety, aesthetics and general welfare of the present and future residents of the Village of Little Chute by:
(1)
Regulating and restricting the location and use of buildings, structures and land for trade, industry, residence and other uses for compatibility and aesthetic reasons.
(2)
Lessening the danger and congestion of traffic on the roads and highways; limiting the number of intersections, driveways and other friction points; minimizing other hazards; and, insuring the continued usefulness of all elements of the existing highway system for their planned function.
(b)
Applicability.
(1)
This article is designed to determine, establish, regulate and restrict development in an area adjacent to State Highway 96. The jurisdiction of these regulations shall include all lands adjacent to this highway located East of Sanitorium Road Easterly to the East Village Limit.
(2)
Words used in the present tense shall include the future tense, words used in the singular number shall include the singular. The word "shall" is mandatory and the word "may" is permissive.
(c)
Severability. It is hereby declared to be the legislative intent that should any provision of this article be declared invalid by a court of competent jurisdiction, such decision shall not affect the validity of this article in its entirety or any part thereof, other than that so declared to be invalid.

Purpose. The purpose of this chapter is to amend certain zoning controls for the development that will occur within the affected corridor. The acquisition of additional right-of-way has caused an added burden under setback regulations by the reduction of lot depths. The reasons for this control are to amend the front yard setback regulations established within the underlying zoning district regulations.
(b)
Setbacks amended. All front yard setback requirements of the underlying zoning regulations shall be reduced by two feet where the setback is adjacent and parallel to the Highway 96 right-of-way within the area described in [section] 44-560(b)(1).
