ARTICLE VI

RADIO, TELEVISION AND WIRELESS COMMUNICATIONS FACILITIES

§ 110-721 General purpose and description.

Radio, television, and wireless communications facilities used in transmitting and receiving signal energy are essential and promote the health, safety, and general welfare of the citizens of the city. The purpose of this article is to govern the placement of these facilities in such a way that assures that their location and use do not compromise the aesthetic quality or historical appearance of the community, or the health, safety or welfare of the citizens of Llano.

§ 110-722 General regulations.

The following regulations apply to all radio, television, and wireless communication facilities located within any district in which such facilities are allowed, or for which a specific use permit may be issued.
(1) 
Any antenna (whether commercial or noncommercial), monopole, mast, tower, or similar facility in the city shall be located on a single city lot.
(2) 
The setback for each such facility shall be equal to or exceed the height of the facility measured to each boundary of the lot. For example, a tower 50 feet in height may not be located in a position on a lot which is situated less than 50 feet from any boundary of said lot.
(3) 
All such facilities must comply with the requirements of the Texas Historical Commission and with all local historical commission requirements.
(4) 
When it is necessary to acquire multiple lots in order to comply with the setback provisions herein, such lots must be replatted into a single lot.
(5) 
The maximum height of the facility may not exceed 75 feet. Height for all purposes shall mean the linear distance from the ground to the highest physical point on the facility.

§ 110-723 Permit required.

(a) 
All facilities described in this section shall require an installation permit to be issued by the city’s building department.
(b) 
An application for a permit shall include detail drawings, descriptions and specifications of all components including construction materials to be used.
(c) 
Applicants may be required to submit an engineering study describing proposed equipment, specifications and operational radio frequencies, and a statement that the proposed equipment is compliant with Federal Communication Commission rules and regulations and that there will be no interference with any public safety or government communication service.
(d) 
The building official may request any additional and relevant information before issuing a permit.

§ 110-724 Variance.

The planning and zoning commission may consider a request for a variance from the requirements in this section and forward a recommendation to the city council for review and final action. The decision of the city council on a request for a variance shall be final. Applicants requesting a variance shall file an application with the city manager. Fees charged shall be in accordance with a schedule of fees as adopted by the city council and amended from time to time.
