The following abbreviations are used to designate whether and how a principal use is allowed in a particular zone district:

P Permissive primary. Indicates the use is permitted by right within the respective zone district as a primary use and may be subject to compliance with Article IV, Supplementary Standards for Specific Uses as indicated in the right-hand column of the table.

C Conditional. Indicates a conditional use permit shall be obtained from the planning and zoning commission pursuant to Section 17.14.020(F) and may be subject to compliance with Article IV, Supplementary Standards for Specific Uses as indicated in the right-hand column of the table.

D Designated. Indicates a designated use permit shall be obtained from the village council pursuant to Section 17.14.020(F) and may be subject to compliance with Article IV, Supplementary Standards for Specific Uses as indicated in the right-hand column of the table.

A Accessory. Indicates the use is permitted as a permissive accessory use.

T Temporary. Indicates the use is permitted as a permissive temporary use.

_ A blank cell indicates the use is prohibited within the respective zone district.

The allowable use table lists the land uses allowed within all zone districts. The table contains use codes, general categories of land uses, specific land uses allowed, and indicates applicable supplementary development standards established under Article IV, Supplementary Standards for Specific Uses.

ZONES

A. The presumption established by Article III is that all legitimate uses of land are permissible, conditional, designated, accessory, or temporary use within at least one zoning district in the village's planning jurisdiction.

B.

When a land use is not explicitly listed in Table 17.08.020(1), Allowable Uses, the community development director shall determine the appropriate and most similar use type for the proposed use.

C.

If a land use is included in the definition of a listed use or is consistent with the size, scale, operating characteristics, and external impacts of a listed use, it should be treated as the same use.

D.

If a land use is determined to be a new or unlisted use, the community development director may determine that such a new or unlisted use requires a text amendment of this title.

E.

The community development director may also determine that text amendments for additional use-specific standards are necessary to reduce potential impacts to surrounding properties or the community.

Each land use that exists on the effective date of this title that was permissive or requires a conditional or designated use permit and received a conditional or designated use permit prior to the effective date of this title is deemed to have a valid conditional or designated use permit that allows continuation of the use.

A. The following uses are expressly prohibited in all zone districts except as otherwise permitted in Section 17.08.050(B):

1.

Any use involving the manufacturing, handling, sale, distribution, or storage of explosive materials or devices.

2.

Unauthorized private or recreational use of explosive materials.

3.

The use of a recreational vehicle as a permanent dwelling.

B.

Uses involving the manufacturing, handling, sale, distribution, or storage of explosive materials or devices may be permitted so long as they comply with federal, state, and local laws and are located within an allowable zone district, as specified in Table 17.08.020(1):

1.

Government and Civil Defense Facilities:

i.

Public safety facilities such as police stations, fire stations, and civil defense operations.

ii.

Federal or state military installations, military reserves, and national guard centers.

2.

Resource Extraction and Demolition:

i.

Mining, quarrying, or resource extraction operations.

ii.

Planned demolitions conducted by licensed demolition contractors with appropriate approvals. Demolition by explosives is permitted in all commercial and industrial zone districts but prohibited in residential zones or lots with a residential use.

3.

Manufacturing and Research Facilities:

i.

Facilities engaged in manufacturing or research and development activities that require controlled explosives as part of the development's operations.

ii.

Accredited universities or research institutions conducting regulated experiments involving explosives.

4.

Fireworks and Pyrotechnics:

i.

Facilities licensed for the storage, distribution, and sale of fireworks to the general public in compliance with applicable federal, state, and local regulations.

ii.

Businesses licensed to provide pyrotechnic displays for public events.
