(a) The term “adult use cannabis operator” shall have the same meaning as in Section 3780(A)(2) of the Ohio Revised Code, effective December 7, 2023.
(b) No person or entity licensed as an adult use cannabis operator under Section 3780 of the Ohio Revised Code shall open, construct, expand, establish or operate any business or commercial enterprise of any kind within the corporate limits of the Village.
(c) No zoning clearance, permit, or other administrative approval shall be approved or issued by any administrative official of the Village, nor shall any variance be approved or granted, to any person, entity, or other applicant desiring or intending to operate a business or commercial enterprise as an adult use cannabis operator within the corporate limits of the Village.
(d) Any use or condition caused or permitted to exist in violation of any of the provisions of this Section 1248.02 shall be and hereby is declared to be a public nuisance and may be abated by the Village.
(e) This section shall be in effect from its passage until March 1, 2025, or until such other time as may be set by subsequent legislative action.

(f) The provisions of this Section shall not apply to areas of the Village zoned R-C Residential-Commercial District, C-1 Restricted Commercial District, and/or C-2 and C-2a General Commercial Districts, except where any such district is located between Union Street and Mount Vernon Avenue, South of Butler Street and North of Bustle Street, with Butler and Bustle Streets being understood to extend the complete distance between Union Street and Mount Vernon Avenue for the purposes of this section. Adult use cannabis operators may be located and operate in the areas allowed above to the extent otherwise allowed under Ohio law, Federal law and the Codified Ordinances of the Village of Loudonville.
