CHAPTER 1167
Sale of Cannabis
1167.01 DEFINITIONS.
The City adopts the definitions set forth in Section 3780.01 of the Ohio Revised Code.

1167.02 PROHIBITED ACTIVITY.
(a) Pursuant to Section 3780.25(A) of the Ohio Revised Code, Recreational Adult Use Cannabis Operators are prohibited within the City of Louisville, Ohio.
(b) No person shall operate as an Adult Use Cannabis Operator within the City of Louisville, Ohio.
(c) No building permits, certificates of occupancy or any other permits shall be granted by the City of Louisville to any person who intends to open, use any land or devote any floor area of the business for the purpose of the sale of recreational cannabis. Subject to Section 3780.25(B) of the Ohio Revised Code, no existing business in the City may expand in any way that would establish sale of cannabis.

1167.03 ACTIVITY NOT PROHIBITED BY THIS SECTION.
(a) This chapter is limited to the prohibition of the cultivation, processing and retail sale of recreational cannabis as contemplated within Chapter 3780 of the Ohio Revised Code and to the extent permitted by R.C. 3780.25 by the Ohio Revised Code.
(b) This chapter shall not be construed to prohibit to the cultivation, processing, and retail sale of medical marijuana as contemplated in Chapter 3796 of the Ohio Revised Code.
(c) The chapter shall not be construed to prohibit the legal "home grow" of cannabis consistent with R.C. 3780.25(G)(3) of the Ohio Revised Code.

1167.04 SAVINGS CLAUSE.
If any provision of this chapter becomes, or is deemed by a Court of Competent Jurisdiction, illegal, invalid or unenforceable, it shall not affect the validity of enforceability of any other provision of this chapter.
