22 MANUFACTURED HOMES AND MOBILE HOMES

17.22.010 Definitions.

   "Blocking" means concrete or metal supports used to stabilize manufactured home or mobile home.
   "Manufactured home" means a movable or portable housing structure over thirty-eight feet in length or over twenty-four feet in width constructed to be towed on its own chassis and designed to be installed with a permanent foundation for human occupancy as a residence and which may include one or more components for towing purposes that can be retracted and which may be subsequently expanded for additional capacity or may be two or more units separately towable but designed to be joined into one integral unit as well as a single unit. "Manufactured home" also includes any movable or portable housing structure over twelve feet in width and forty feet in length which is used for nonresidential purposes. "Manufactured home" does not include recreational vehicles or mobile homes.
   "Mobile home" means a movable or portable housing structure which does not meet the definition of manufactured home.
   "Mobile home park" means an enclosed area set apart for the exclusive purpose of mobile home use.
   "Mobile home subdivision" means a subdivision designated and set apart for the exclusive use of mobile homes.
   'Termanent foundation" means footing composed with steel rebar or fibered concrete at least two feet by two feet and twelve inches deep with centers directly under I beam supports, and centers spaced no more than eight feet apart and complying with the regulations of the state of New Mexico for manufactured housing.
   "Skirting" means a substantial and solid structure completely enclosing the undercarriage and blocking of a mobile home or manufactured home and meeting the requirements of the Manufactured Housing Act and Regulations of the state of New Mexico. (Ord. 417 (part), 1998; Ord. 406 (part), 1997)

17.22.020 Regulation of mobile homes.

   No mobile home shall be occupied, located or used for residential purposes unless the mobile home is located on an approved lot or within a mobile home subdivision or mobile home park approved in accordance with applicable ordinances and regulations, blocked and skirted unless it meets or exceeds all fire, electrical and construction codes relating to mobile homes in effect January 1, 1985 and subsequent thereto. 17.22.030 Regulation of manufactured housing.

   A.   No manufactured home shall be occupied, located or used for residential purposes in zone "A," single-family dwelling, in zone "B," multifamily dwelling, in zone "C," commercial, or in zone "D," industrial, except upon prior approval by the city of the specific location in the city.
   B.   No manufactured home shall be occupied, located or used for residential purposes in zone "B," multi-family dwelling, zone "C," commercial, or any zone specifically allowed for its use unless it meets all requirements applicable to single-family site-built housing in that zone. 17.22.040 Regulations-In general.

   The regulations set forth in this chapter, or set forth elsewhere in this title, when referred to in this chapter, are the manufactured housing and mobile home regulations. (Ord. 406 (part), 1997)

17.22.050 Permitted uses.

   A building, manufactured home, mobile home or single-family detached dwelling shall be used only for the following purposes:
   A.   Any use permitted in the "A" single-family dwelling district;
   B.   One-family dwelling, containing a floor space of not less than six hundred square feet per family;
   C.   Professional offices, or studios of doctors, dentists, artists, musicians, lawyers and authors, beauty parlors limited to one operator who is the owner of the premises;
   D.   Nonprofit religious, educational and philanthropic institutions, but not penal or mental treatment institutions;
   E.   Accessory buildings and uses not involving the conduct of a business customarily incident to the above uses including a private garage. Any accessory building that is not a part of the main structure shall be located not less than sixty feet from the front lot line and shall require three thousand square feet of the land on said lot devoted to it, with a minimum distance of at least fifteen feet between structures. 17.22.060 Parking regulations.

   Whenever a structure is erected, converted or structurally altered for dwelling purposes, one parking space shall be provided on the lot for each dwelling unit in the structure. (Ord. 406 (part), 1997)

17.22.070 Height regulations.

   The height regulations for manufactured housing and mobile homes are the same as those in the "A" single-family dwelling district. (Ord. 406 (part), 1997)

17.22.080 Yard regulations.

   A.   The yard regulations shall be the same as in the "A" single-family dwelling district.
   B.   All interior courts shall have a width equal to at least the height of the highest part of the building or buildings forming the court. (Ord. 406 (part), 1997)

17.22.090 Intensity of use.

   Every lot shall contain an area devoted to each person living on said lot of not less than five hundred square feet per person or a minimum area of seven thousand square feet per family, whichever is less. (Ord. 406 (part), 1997)

17.22.110 Setbacks and yards.

   A.   Minimum Setbacks form Property Line.
   Front yard: There shall be a front yard having a depth of not less than twenty-five feet.
   Where lots have double frontage, the required front yard shall be required on both streets.
   Side yard: Side yard on the street side of a corner lot shall be not less than fifteen feet.
   Back yard: There shall be a rear yard having a depth of not less than thirty feet.

17.22.120 Screening.

   All principal and accessory uses shall be screened with shrubs or solid fencing from adjacent "A" single-family dwelling district and "B" multiple dwelling district (Ord. 406 (part), 1997)

17.22.130 Placement and

maintenance of mobile homes.
   A.   No mobile home may be placed upon any lot within the city prior to submitting a site plan and receipt of subsequent approval of said site plan by the city.
   B.   There shall be no occupancy of any mobile home until an occupancy permit is issued by the State of New Mexico Manufactured Housing Division; no occupancy permit shall be issued until the mobile home is connected to public sewer and water lines, or until an alternate system is approved by the State of New Mexico Manufactured Housing Division and is operational.
   C.   No mobile home may be parked on a roadway within the city for more than twenty-four hours.
   D.   No abandoned, burned or wrecked mobile home may be kept anywhere in the city for more than thirty days.
   E.   Each mobile home must bear an insignia which attests that the construction of the mobile home meets Regulation A119.1 of the American Nations Standards Institute (adopted by the U.S. Department of Housing and Urban Development and Federal Manufactured Home Construction and Safety Standards.)
   F.   Standard mobile home skirting must be provided around the entire perimeter of the mobile home between the bottom of the body of the mobile home and the ground.
   G.   Each mobile home must be anchored to the ground with at least four one-half inch steel auger anchors, two anchors on each side and in a manner in compliance with applicable state and federal regulations.
   H.   Each mobile home must be stabilized from beneath using a concrete, masonry, and/or metal support which shall be placed at each comer and placed at every ten feet of length in a manner acceptable to the city.

17.22.140 Inspections.

   A.   the city shall make such inspections as necessary to establish satisfactory compliance with this chapter and shall have the authority to enter upon any private or public real property at reasonable times for the purpose of inspecting and mvestigating conditions relating to the enforcement of this chapter.
   B.   It shall be the duty of the owners of mobile home parks or persons in charge thereof, or owners or occupants of a lot in a mobile home subdivision, to allow the city or their agent free access to such premises at reasonable times for the purposes of inspections.
   C.   It shall be the duty of every occupant of a mobile home park to allow the owner thereof, or their agents or employees access to any part of such mobile home park at reasonable times for the purpose of making such repairs and alterations as may be necessary to effect compliance with this chapter or with any lawful order issued pursuant to the provisions of this chapter.
   D.   The city shall conduct an original inspection within the mobile home when it is placed upon any lot. The fee for each original inspection shall be seventeen dollars and fifty cents.

17.22.150 Carports.

   Regulations of Chapter 17.24 shall apply. (Ord. 522 (part), 2014; Ord. 406 (part), 1997)
