“R-1" GENERAL

RESIDENTIAL DISTRICT

§ 151.060 PURPOSE.

   The General Residential District is intended to establish an area of residential uses consisting of one and two family dwellings and multiple-unit dwellings.

§ 151.061 PERMITTED USES.

   The following are permitted uses:
   (A)   Single family dwellings if on lots of such areas and widths as hereinafter required;
   (B)   Two-family dwellings if on lots of such areas and widths as hereinafter required;
   (C)   Multiple-dwelling structures consistent with the surrounding land uses and in conformance with the minimum lot dimensions and setback requirements as hereinafter required;
   (D)   Non-commercial gardening;
   (E)   Public buildings and uses of the following kinds: parks, playgrounds;
   (F)   Manufactured homes on individually owned parcels of land, built in conformance with the manufactured home building code and in compliance with the provisions of this chapter;
   (G)   Apartments within existing single family dwellings.

§ 151.062 CONDITIONAL USES.

   The following uses may be permitted:
   (A)   Cemeteries, public services and uses, hospitals, sanitariums, homes for the aged and similar institutions and institutions of special education or charitable nature when required for the public health, safety or welfare;
   (B)   Churches, parish houses, convents, licensed child nurseries/daycare centers;
   (C)   Golf courses, county clubs, tennis courts, swimming pools and additional private and private-club recreational uses, all non-commercial;
   (D)   The extension of a use into a district where it would otherwise be prohibited, in a case where a district boundary line is so located that a lot is in more than one district;
   (E)   Boarding and lodging houses;
   (F)   Outdoor furnaces or boilers of any size or type when used in conjunction with the heating of adjacent interior spaces or the heating of domestic hot water used within such spaces. This shall include all furnaces not completely enclosed on all sides by the exterior building envelop walls;
   (G)   Planned Unit Developments as regulated by this chapter;
   (H)   Private garages or storage sheds exceeding 1,200 sq. ft.;
   (I)   Manufactured home park, subject to issuance of a license from the State Department of Health (M.S. § 327.15, as may be amended from time to time) and subject to the requirements of § 151.201;
   (J)   Bed and breakfast facility;
   (K)   Mortuary, funeral home;
   (L)   Clinics and medical and dental offices in conformance with all requirements of the R-1 District.

§ 151.063 ACCESSORY USES.

   The following are permitted accessory uses:
   (A)   Private garages of 1,200 square feet or less, parking spaces as regulated by § 151.204;
   (B)   Outdoor storage of recreational vehicles and equipment;
   (C)   Non-commercial greenhouses;
   (D)   Swimming pools, tennis courts and other recreational facilities which are operated for the enjoyment and convenience of the residents of the principal use and their guests;
   (E)   Tool houses, sheds and similar buildings for storage of domestic supplies and non-commercial recreational equipment;
   (F)   Essential services;
   (G)   Fencing, screening and landscaping as permitted and regulated by § 151.193;
   (H)    Home occupations consistent with § 151.202;
   (I)   Gazebos and similar structures;
   (J)   Pet shelters, pens, runs, cages, houses and kennels; for non-commercial use and accessory to the residential use.

§ 151.064 MINIMUM LOT SIZE.

   (A)   For one and two family dwellings, a lot area of not less than 7,000 square feet is required.
   (B)   For one and two family, a lot shall have a minimum width of 50 feet at the front yard setback line and a minimum depth of 140 feet.
   (C)   Multiple-dwelling units having 4 or less dwelling units must have a minimum lot area of 14,000 square feet. Not less than 1,500 square feet is required for each additional dwelling unit over 4.
   (D)   A lot width of not less than 100 feet and a lot depth of not less than 140 feet is required for multi-family dwellings.

§ 151.065 FRONT, SIDE AND REAR YARD REQUIREMENTS.

   (A)   Front yards.
      (1)   For all buildings and structures, a front yard of not less than 20 feet is required.
      (2)   For all buildings exceeding 35 feet in height, each front yard shall be an additional front yard setback of 1 foot for each 1 foot that the building exceeds the height of 35 feet.
   (B)   Side yards.
      (1)   For single story principal buildings and structures, two-side yards are required, each with a width of not less than 7 feet.
      (2)    For 2 or more story principal buildings and structures, 2 side yards are required, each with a width of not less than 10 feet.
      (3)   A side yard of not less than 5 feet is required for accessory buildings and structures.
      (4)   For all buildings exceeding 35 feet in height, each side yard shall have 1 additional foot for each 1 foot of building height over 35 feet.
      (5)   Where a lot is located at the intersection of two or more streets, the width of the yard along the side street shall not be less than ten feet for all buildings and structures.
   (C)   Rear yards.
      (1)   For principal buildings and structures, a rear yard with a depth of not less than 25 feet is required.
      (2)   No accessory building or structure shall be less than 5 feet from the rear lot line.

§ 151.066 MAXIMUM BUILDING HEIGHTS.

   Except for multiple-dwelling units, building heights shall not exceed 35 feet. Building heights for multiple-dwelling units shall not exceed 3 stories or 45 feet.
