Agricultural District

12-601 Agricultural District

The Agricultural District is intended to provide a setting for historic agricultural use that is attractive, suitable for efficient and not objectionable to adjacent land uses. Unless otherwise noted in operations a written permit agricultural use is presumed to be:

  1. crops, farming, and grain storage facilities;
  2. Pens or pasture for animals not to exceed one large animal (cows, horses, ostriches, llamas, emus) or two small animals (dogs, sheep, pigs, or goats) for each 2.5 acres;
  3. (Revised November 2, 2005, Ordinance 2005-07) Single-family residences, provided that they shall be located on a minimum twelve-acre tract.

12-602 Agricultural District; Use Permit

All users and uses of the Agricultural District must be approved by the Village. Agricultural District uses that are consistent with the Village Code, especially Chapter 4 nuisance and State and Federal Environmental requirements shall be permitted and must establish the following in a written use permit.

  1. In-season roadside stands for the sale of farm products produced on the premises;
  2. Forestry, nurseries, orchards, green houses and truck farming;
  3. Operations which include noise, chemicals or hazardous materials and odor, but specifically prohibiting:
    1. Large animal operations;
    2. Buildings or pens for chickens or turkeys other than for the lot owners domestic consumption;
    3. Junk yards;
    4. Excess storage of amounts of chemicals hazardous materials which, if not contained pose a danger to health & welfare of the residents of the Village or occupants of the school;
    5. Aerial deployment of chemicals, herbicides, pesticides or fungicides deemed hazardous to the residents.

12-603 Agricultural District; Permitted Conditional Uses

  1. Schools, parks, cemeteries, churches, municipal buildings and charitable institutions;
  2. Kennels and small animal breeding facilities;
  3. Cellular tower.

12-604 Agricultural District; Area Regulations

  1. Maximum Building Height: 45 Feet;
  2. Minimum Side Yard: Principal Building 50 Feet – Each Side Accessory Building 50 Feet – Each Side which may be reduced to 20 feet with adequate landscape screening;
  3. Minimum Front Yard Setback: 50 Feet Minimum;
  4. Rear Yard Setback: 50 Feet Minimum;
  5. Lot Area 10 Acres Off-Street Parking: (Places of Public Gathering) 1 Parking Space per 4 seats;
  6. Minimum Residential Floor Area: 1,000 Square Feet.
