C-COMMERCIAL DISTRICT

§ 27-801 Purpose.

The purpose of the C-Commercial District is to provide reasonable standards for the orderly development and expansion of commercial uses in areas where a nucleus of such uses already exists and where, due to the character of undeveloped land, the development of commercial uses is feasible. The standards of this district are designed to separate access roads from major thoroughfares, to minimize traffic congestion, to provide buffer yards and screen planting where such adjoin residential districts, and to otherwise create conditions conducive to carrying out these and other purposes of this chapter.

§ 27-802 Area of Application.

The following regulations shall apply to all areas designated C-Commercial District on the Zoning Map.

§ 27-803 Use and Lot Area Requirements.

The chart, Permitted Uses and Special Exceptions-C-Commercial District, on the following page shows permitted (P) and special exception (SE) uses and the lot area requirements.[1] Where a use or matter is also regulated by Part 11, Part 12, or any other section of this chapter, the most restrictive provision shall apply.

§ 27-804 Setbacks and Buffer Yards.

1. 
Setbacks. Each lot shall meet minimum front, side and rear setback requirements as follows:
A. 
Front setback: 35 feet, except when along major or minor arterial roadways as designated in the Manchester Township Comprehensive Plan, when such front setback shall be 50 feet.
B. 
Each side setback: 15 feet.
C. 
Rear setback: 35 feet.
D. 
Smaller setback distance may be permitted by special exception granted by the Zoning Hearing Board, except that parking shall be permitted in front yards so long as it is located at least 10 feet from any street line.
2. 
Buffer Yard Requirement.
A. 
When adjacent to an A-Agricultural, RL-Low Density Residential, RM-Medium Density Residential, or RH-High Density Residential District, a buffer yard shall be provided in addition to the yard setback required by Subsection 1 above, the depth of which shall be at least 50 feet. All such buffer yards shall be provided and maintained in accordance with the provisions of this chapter regulating buffer yards.
B. 
When adjacent to a pre-existing residential use existing as of the date of this chapter within the C-Commercial District, a buffer yard shall be provided in addition to the yard setback required by Subsection 1 above, the depth of which shall be at least 50 feet. All such buffer yards shall be provided and maintained in accordance with the provisions of this chapter regulating buffer yards.
C. 
When adjacent to a public street on which a Residential District or preexisting residential use abuts on the opposite side, the dimension of the right-of-way of the public street shall not be considered to be part of the depth of the buffer yard.

§ 27-805 Building Height Limit.

The height limit for a main building shall be 35 feet except that the height limit may be extended to 45 feet if each side yard is increased in width one foot for each additional foot of height. The height limit for accessory buildings shall be 25 feet. Modification of this section is permitted by special exception.

§ 27-806 Lot Coverage.

No more than 40% of the area of each lot shall be occupied by buildings and no more than 70% of the area shall be occupied by impervious surface.
