AND MAP AMENDMENTS

§ 151.040 BUILDING ZONE MAP AND CHAPTER AMENDMENTS.

   (A)   Amendments to the use, height, yard, and court regulations affecting either the building zone map and/or this chapter shall be adopted as provided in R.C. §§ 713.07, 713.08, and 713.10 and any amendments or supplements thereto.
   (B)   A petition for amendment of the building zone map for additions and modifications of existing district designations and/or boundaries of existing district(s) or adding new district(s), shall include the following:
      (1)   A copy of the County Auditor’s village plat (527) page (or pages) necessary to show the area to be amended and a map showing present zoning district boundaries. The map shall show at least two streets in each direction beyond proposed zoning district boundaries;
      (2)   A list of the owners and their addresses of all properties in and within 300 feet of the nearest property line of amended area; and
      (3)   A proposed ordinance to amend the building zone map.
   (C)   The procedure for both building zone map and this chapter’s amendments is as follows.
      (1)   The Planning Commission shall transmit to Council the ordinance and documents with its approval or disapproval.
      (2)   The Planning and Zoning Committee of Council shall consider the proposal and report its recommendation to the full Council, and also may report a resolution fixing the time (not more than 30 days) for a public hearing before Council.
      (3)   Council shall cause notice of such public hearing to be published, as required by law, and in the case of a building zone map amendment, shall mail or send by certified mail at the prepaid cost of the proponents of the ordinance, a notice of the proposed change to owners of property in the area of such proposed change, and within 300 feet of the nearest property line of the amended area.
      (4)   After the public hearing, the final ordinance with documents shall be presented by the Planning and Zoning Committee of Council with its recommendation to the full Council.

§ 151.041 SUBDIVISION OF LAND IN THE VILLAGE.

   (A)   Generally. The Rules and Regulations Governing Subdivision of Land in Mariemont adopted by the Planning Commission on February 9, 1944, and revised in January, 1984, are adopted by reference and are incorporated herein in their entirety as if fully rewritten herein.
   (B)   Subdivision of an existing parcel of land.
      (1)   Any subdivision of an existing parcel of land or transfer of a part of a recorded parcel of land to an adjacent recorded parcel of land must be approved by the Planning Commission.
      (2)   (a)   The owner of the parcel to be subdivided must submit a letter requesting subdivision to the Planning Commission and five copies of a site plan prepared by a surveyor licensed in the state.
         (b)   Site plan must show the following:
            1.   All property lines of parcel to be subdivided with dimension and compass directions;
            2.   All structures thereon and their setbacks from all property lines;
            3.   Proposed new property lines with dimensions and directions, changes in dimensions of existing property lines, and revised setbacks of structures from proposed new property lines. Scale of drawing, compass points, abutting street right-of- ways, and areas of existing and proposed parcels; and
            4.   Name and address of owner of parcel to be subdivided and the County Auditor’s book, plat, and parcel number(s) of property.
      (3)   Compliance with other regulations of the Rules and Regulations Governing Subdivision of Land in Mariemont need not be complied with except as necessary to comply with the Building Code and this chapter.
