OFF-STREET PARKING

REQUIREMENTS

§ 155.125 ADMINISTRATIVE PROCEDURE.

   The administration and inspection requirements of this subchapter shall be the responsibility of the Building Official. The Building Official shall determine compliance with this subchapter prior to the approval or the issuance of a building permit.

§ 155.126 EXCEPTIONS TO OFF-STREET PARKING REQUIREMENTS.

   (A)   The Building Official is granted the authority to issue a building permit where there are minor discrepancies with regard to the requirements established in this subchapter, where it is determined that the literal application of the requirements would constitute an undue hardship with regard to the applicant’s particular circumstances and would not be essential in accomplishing the objectives of this subchapter.
   (B)   In areas that are fully or near fully developed, a variance of up to 30% of the number of off-street parking spaces required in this subchapter shall be allowed by the Building Official, if the conversion of a structure from a nonresidential use to another use would require the addition of more off-street parking, and if it is determined that the literal application of the revisions would constitute an undue hardship with regard to the applicant’s particular circumstances and would not be essential in accomplishing the objectives of this subchapter.
   (C)   If the applicant is dissatisfied with the decision of the Building Official with regard to a requested exception, the applicant shall be entitled to appeal the decision to the Board.
   (D)   The off-street parking requirements of this chapter will not apply to buildings and uses in the 400 Block of Main Street.

§ 155.127 MINIMUM REQUIREMENTS FOR SPACES.

   There shall be provided, at a time as a building permit is issued for the erection, alteration or use change of a structure, off-street parking spaces in accordance with the following minimum requirements:
   (A)   Bowling alley: five parking spaces for each lane;
   (B)   Business or professional office, studio, bank, medical or dental clinic: three parking spaces plus one additional parking space for each 250 square feet of floor area over 500;
   (C)   Church, theater, auditorium (except school), sports arena, stadium or gymnasium: one parking space for each four seats or bench seating spaces;
   (D)   Library, museum or art gallery: ten parking spaces plus one additional space for each 300 square feet of floor area in excess of 2,000 square feet. If an auditorium is included as a part of the building, its floor area shall be deducted from the total and additional parking provided on the basis of one space for each four seats that it contains;
   (E)   Dance hall, assembly or exhibition hall without fixed seats: one parking space for each 100 square feet of floor area used thereof;
   (F)   Fraternity, sorority or dormitory: one parking space for each bed;
   (G)   Furniture or appliance store, hardware store, wholesale establishment, machinery or equipment sales and service, clothing or shoe repair or service shop: one parking space for each 300 square feet of floor area;
   (H)   Hospital: four parking spaces plus one additional parking space for each four beds;
   (I)   Hotel: one parking space for each sleeping room or suite plus one space for each 200 square feet of commercial floor area contained therein;
   (J)   Industrial plant: the number of parking spaces required to accommodate all plant employees and construction forces on any single shift;
   (K)   Mortuary or funeral home: one parking space for each 50 square feet of floor space in slumber rooms, parlors or individual funeral service rooms;
   (L)   Motor vehicle sales room and used car lot: one parking space for each 800 square feet of sales floor or lot area;
   (M)   Private club, lodge, country club or golf club: one parking space for each 150 square feet of floor area or for every five members, whichever is greater;
   (N)   Restaurant, nightclub, café or similar recreation or amusement establishment: one parking space for each 100 square feet of floor area;
   (O)   Retail store or personal service establishment, except as otherwise specified in this section: one parking space for each 250 square feet of retail sales or floor area;
   (P)   Rooming house or boardinghouse: one parking space for each sleeping room;
   (Q)   Sanitarium, convalescent home, home for the aged or similar institution: one parking space for each six beds;
   (R)   School, elementary: one parking space for each ten seats in the auditorium or main assembly room or more space for each classroom, whichever is greater;
   (S)   School, secondary and college: one parking space for each eight seats in the main auditorium or three spaces for each classroom, whichever is greater;
   (T)   Single-family detached dwelling: two parking spaces for each dwelling unit.
   (U)   Tourist home, cabin or motel: one parking space for each sleeping room or suite;
   (V)   Townhouse, two-family and multi-family dwelling: two and one-quarter spaces per dwelling unit. Guest parking is to be provided within 300 feet of each dwelling unit; and
   (W)   Tubing-related business: one parking space for each four tubes available for rental for any purpose

§ 155.128 RULES FOR COMPUTING NUMBER OF SPACES.

   In computing the number of parking spaces required, the following rules shall govern:
   (A)   Floor area shall mean the foundation area of the specified use. For a multi-story building, each story shall be considered a separate foundation area, so that the total floor area of the building shall include the area of all floors added together;
   (B)   Where fractional spaces result, the parking spaces required shall be construed to be the nearest whole number;
   (C)   The parking space requirement for a use not specifically mentioned in this subchapter shall be the same as required for a use of a similar nature; and
   (D)   For mixed uses, the parking spaces required shall equal the sum of the requirements of the various uses computed separately.

§ 155.129 CONSTRUCTION OR USE CHANGES.

   Whenever a building or use is constructed or changed after the effective date of the ordinance by enlarging the floor area, number of employees, number of dwelling units, seating capacity or otherwise, to create a requirement for an increase in the number of parking spaces, the spaces shall be provided on the basis of the enlargement or the change in use.

§ 155.130 LOCATION OF SPACES.

   All parking spaces required in this subchapter shall be located on the same lot with the building or use served, except as follows:
   (A)   Where an increase in the number of spaces is required by a change or enlargement of the use or where the spaces are provided collectively or used jointly by two or more buildings or establishments, the required spaces may be located not to exceed 300 feet from an institutional building served and not to exceed 500 feet from any other nonresidential building served;
   (B)   No more than 50% of the parking spaces required for theaters, bowling lanes, dance halls, nightclubs or cafés may be provided and used jointly by similar uses not normally open, used or operated during the same hours as those listed; provided, however, that written agreement thereto is properly executed and filed as specified in division (D) below;
   (C)   Not more than 80% of the parking spaces required for a church or school auditorium may be provided and used jointly by similar uses not normally open, used or operated during the same hours as those listed; provided, however, that written agreement thereto is properly executed and filed as specified in division (D) below; and
   (D)   When the required parking spaces are not located on the same lot with the building or use served or when the spaces are collectively or jointly provided and used, a written agreement thereby assuring their intention for those purposes shall be properly drawn and executed by the parties concerned, approved as to form by the City Attorney, and shall be filed with the application for a building permit.

§ 155.131 MINIMUM DIMENSIONS.

   The minimum dimensions for off-street parking spaces required under this subchapter shall be as follows:
   (A)   Ninety-degree angle parking. Each parking space shall be not less than nine feet wide or less than 18 feet in length. Maneuvering space shall be in addition to parking space and shall be not less than 23 feet perpendicular in width;
   (B)   Sixty-degree angle parking. Each parking space shall be not less than nine feet wide perpendicular to the parking angle or less than 20 feet in length when measured at the appropriate angles. Maneuvering space shall be in addition to parking space and shall be not less than 20 feet in width;
   (C)   Forty-five-degree angle parking. Each parking space shall be not less than nine feet wide perpendicular to the parking angle or less than 19 feet in length when measured at the appropriate angles. Maneuvering space shall be in addition to parking space and shall be not less than 11 feet in width; and
   (D)   Other. Where off-street parking facilities are provided in excess of the minimum amounts specified in this subchapter, or when off-street parking facilities are provided but not required by this subchapter, the off-street parking facilities shall comply with the minimum dimensions for parking and maneuvering space specified in this section.

§ 155.132 DESIGN STANDARDS.

   The design of driveways, off-street parking stalls and curb cuts shall be in accordance with generally accepted municipal engineering standards and practices as determined by the Building Official.

§ 155.133 ACCESSIBLE PARKING SPACES FOR PERSONS WITH DISABILITIES.

   (A)   Off-street parking spaces shall be reserved for the physically disabled in a location and an amount not less than that required by the Americans with Disabilities Act accessibility guidelines.
   (B)   Each parking space reserved for the physically disabled shall conform to the identification requirements of the State Department of Licensing and regulation promulgated under state law, and the design specifications enumerated in the Americans with Disabilities Act accessibility guidelines.
   (C)   State law offenses for improper use of parking spaces reserved for the disabled upon private property shall apply within the city. Any peace officer and the designated city official enforcing parking regulations may issue citations for improper use.
