AMENDMENTS

§ 156.170 GENERAL.

   The Village Board of Trustees may, from time to time, on its own motion, on petition of any persons or persons in interest, or on initial recommendation of the Planning Commission, amend, supplement, or repeal the regulations and provisions of this chapter.

§ 156.171 THE PLANNING COMMISSION ADVISORY REPORT.

   Any such proposed amendment or change, when initiated by the Village Board of Trustees or by individual petition, shall be referred to the Planning Commission for an advisory report thereon. When a proposed amendment or change is initiated by the Planning Commission, said advisory report shall accompany the initial recommendation of the Planning Commission.

§ 156.172 PROCEDURE BEFORE PLANNING COMMISSION.

   Before giving an advisory report or an initial recommendation on any proposed amendment, the Planning Commission shall first conduct a public hearing thereon, the date and place of which shall be fixed in advance by the Planning Commission at any regular or special meeting. Notice of the public hearing shall be given not more than 30 nor less than 15 days before the hearing:
   (A)   By regular mail sent to the applicant and to every owner of real property adjacent to the premises for which the amendment is requested; and
   (B)   By publication in a newspaper of general circulation within the village.

§ 156.173 PROCEDURE BEFORE VILLAGE BOARD OF TRUSTEES.

   After receiving the advisory report from the Planning Commission and before acting on any proposed amendment, the Village Board of Trustees shall hold a public hearing on the proposed amendment at the next regular meeting of the Village Board of Trustees, unless the Village Board of Trustees shall otherwise specifically order than such hearing by it be held at a subsequent regular or special meeting. Notice of the time and place of the public hearing before the Village Board of Trustees shall be made at least 15 days prior to the hearing in a newspaper of general circulation in the village.

§ 156.174 WRITTEN PROTEST.

   In case of a written protest against any proposed amendments of the regulations or districts, signed and acknowledged by the owners of 20% of the frontage proposed to be altered, or by the owners of 20% of the frontage immediately adjoining or across an alley therefrom, or by the owners of 20% of the frontage directly opposite the frontage proposed to be altered, if filed with the Village Clerk, the amendment shall not be passed except by a favorable vote of at least two-thirds of the Village Board of Trustees then holding office.

§ 156.175 COSTS.

   For individual applications for rezoning of lands or any other proposed change, a fee of $200 shall be charged for processing each application.
