ARTICLE VI

GENERAL REQUIREMENTS AND PERFORMANCE STANDARDS FOR MANUFACTURING DISTRICTS.

SECTION 15.1. - [General requirements].

The following general requirements shall apply to all manufacturing districts:

15.1-1 Use Exclusions. No lot, parcel, or tract of land shall be used, and no building or structure shall be erected, altered, or remodeled for any of the following uses: abattoirs; arsenals; crematories; creosote treatment or manufacture; fat rendering; fertilizer manufacture; fireworks or explosive manufacture or storage; dumping, reduction, or other processing of garbage, dead animals, offal or refuse, except as customarily incidental to a permitted principal use; ore reduction; petroleum processing or refining, pyroxylin manufacture; natural or synthetic rubber, caoutchouc, or gutta percha manufacture or treatment; salt works; sauerkraut manufacture; soap manufacture; smelters; stock yard or slaughter of animals or fowls; tallow, grease or lard manufacture or treatment; tanning, curing or storage of rawhides or skins; tar distillation, or manufacture; cement concrete or asphaltic concrete mixing plants; storage of materials of a fire and explosive nature except as incidental to manufacture; junk shop, junk yards or automobile wrecking yards.

15.1-2 Fire and Explosive Material Exclusions. No activities involving the storage, utilization of manufacturing of materials or products which decompose by detonation shall be permitted, except such as are customarily incidental to the operation of a principal use in such quantities, and in a manner conforming with applicable performance standards set forth hereafter under 15.2 of this Section. Such materials shall include, but shall not be confined to: all primary explosives such as lead azide, lead styphnate, fulminates and tetracene; all high explosives such as TNT, RDX, HMK, PETN and picric acid; propellants and components thereof, such as nitrocellulose, black powder, boron hydrides, hydrazine and its derivatives; pyrotechnics and fireworks such as magnesium powder, potassium chlorate and potassium nitrate; blasting explosives such as dynamite and nitroglycerine; unstable organic compounds such as acetylide, tetrazoles, perchloric acid, perchlorates, chlorates, hydrogen peroxide in concentrations greater than thirty-five (35) percent; and nuclear fuel; fissionable materials and products and reactor elements such as Uranium 235 and Plutonium 239.

15.1-3 Outside Storage. All activities involving the manufacturing, fabricating, assembly, disassembly, repairing, storing, cleaning, servicing, and testing of materials, products and goods shall be within completely enclosed buildings. Outside storage of refuse, materials, products and goods is prohibited.

15.1-4 Screening and Fencing. Refer to Fence Ordinance.

15.1-5 Architecture. A building in a manufacturing district shall be compatible to the architectural design of nearby areas. Such determination is subject to review and approval by the Plan Commission and Board of Trustees.

SECTION 15.2. - Performance Standards.

Any use established in a manufacturing district which involves the manufacturing, fabricating, assembly, disassembly, repairing, storing, cleaning, servicing, or testing of materials, goods, or products, shall be operated in such a manner as to comply with applicable performance standards as hereinafter set forth governing noise, smoke, particulate matter, toxic or noxious matter, odors, fire and explosive hazards, or vibration, or glare, or heat for the district in which such use shall be located; and no use, already established on the effective date of this ordinance, shall be so altered or modified as to conflict with, or further conflict with such applicable performance standards for the district in which such use is located.

15.2-1 Noise. Sound levels shall be measured with a sound level meter and associated octave band filter manufactured according to standards prescribed by the American Standards Association. Measurements shall be made using the flat network of the sound level meter. Impulsive type noises shall be subject to the performance standards hereinafter prescribed, provided that such noises shall be capable of being accurately measured with such equipment. Noises capable of being so measured, for the purposes of this ordinance, shall be those noises which cause rapid fluctuations of the needle of the sound level meter, with a variation of no more than plus or minus two decibels. Noises incapable of being so measured, such as those of an irregular and intermittent nature, shall be controlled, as not to become a nuisance to adjacent uses.

At no point on the boundary of a Residence or Business District shall the sound intensity level of any individual operation or plant (other than the operation of motor vehicles or other transportation facilities) exceed the decibel levels in the designated octave bands shown in the following table:

15.2-2 Smoke and Particulate Matter. The emission of smoke or particulate matter in such manner or quantity as to endanger or to be detrimental to the public health, safety, comfort, or welfare, is hereby declared to be a public nuisance, and shall henceforth be unlawful. For the purpose of grading the density of smoke, the Ringelmann Chart, published and used by the United States Bureau of Mines, shall be employed. The emission of smoke or particulate matter of a density greater than No. 2 on the Ringelmann Chart is prohibited at all times, except as otherwise provided hereinafter. The emission, from all sources within any lot area, of particulate matter containing more than ten percent by weight of particles having a particle diameter larger than forty-four (44) microns is prohibited.

Dust and other types of air pollution, borne by the wind from such sources as storage areas, yards, roads, and the like, within lot boundaries, shall be kept to a minimum by appropriate landscaping, paving, oiling, fencing or acceptable means. Emission of particulate matter from such sources in excess of the weight limitation herein specified is prohibited.

The emission of more than eight (8) smoke units per hour per stack is prohibited, including smoke of a density in excess of Ringelmann No. 2. However, during one (1) one-hour period in each twenty-four (24) hour day, each stack may emit up to sixteen (16) smoke units when blowing soot or cleaning fires. Only during fire-cleaning periods, however, shall smoke of Ringelmann No. 3 be permitted, and then for not more than three minutes.

15.2-3 Toxic or Noxious Matter. No use shall, for any period of time, discharge across the boundaries of the lot wherein it is located, toxic or noxious matter in such concentrations as to be detrimental to, or endanger the public health, safety, comfort, or welfare, or cause injury or damage to property or business.

15.2-4 Odors. The emission of odorous matter in such quantity as to be readily detectable at any point along lot lines, or as to produce a public nuisance or hazard beyond lot lines is prohibited.

15.2-5 Fire and Explosive Hazard.

a.

The utilization or manufacture of materials or products ranging from incombustible to moderate burning - as determined for liquids by a closed cup flash point of not less than 187°F - is permitted subject to compliance with all other performance standards. The storage of more than fifty thousand (50,000) gallons above ground or one hundred thousand (100,000) gallons underground is prohibited.

b.

The utilization in manufacturing processes of materials which produce flammable or explosive vapors or gasses - as determined for liquids by a closed cup flash point of less than 187°F - shall be permitted provided:

Said materials or products shall be stored, utilized, produced within completely enclosed buildings or structures having incombustible exterior walls.

2.

All such buildings or structures shall be set back at least eighty (80) feet from lot lines, or, shall be protected throughout by an automatic sprinkler system complying with installation standards prescribed by the National Fire Protection Association; or if the materials, goods, or products are liquids, the protection thereof shall be in conformity with standards prescribed by the National Fire Protection Association.

3.

That the final manufactured product does not itself have a closed cup flash point of less than 187°F.

4.

That the use and storage of such materials shall be in conformity with standards prescribed by the National Fire Protection Association, and the requirements of other ordinances of the Village and Fire District.

5.

That the storage of more than five thousand (5,000) gallons above ground or ten thousand (10,000) gallons underground of materials or products having a closed cup flash point of less than 105°F is prohibited.

6.

That the storage of more than twenty thousand (20,000) gallons above ground or forty thousand (40,000) gallons underground of materials or products having a closed cup flash point of between 105° and 187°F is prohibited.

15.2-6 Vibration. Any operation or activity which shall cause, at any time and at any point along the nearest adjacent lot line, earth borne vibrations, (other than background vibrations produced by some source not under control of this ordinance, such as the operation of motor vehicles or other transportation facilities), in excess of the limits set forth in Column I is prohibited. In addition, any operation or activity which shall cause at any time and at any point along a residence district boundary line, earth borne vibrations in excess of the limits set forth in Column II is prohibited. Vibration shall be expressed as displacement in inches and shall be measured with a three component measuring system approved by the Village.

* Steady State Vibrations, for the purpose of this ordinance which are continuous or, if in discrete pulses are more frequent than one hundred (100) per minute. Impact vibration, that is, discrete pulses which do not exceed one hundred (100) impulses per minute shall not cause in excess of twice the displacements stipulated.

15.2-7 Glare or Heat. Any operation or activity producing intense glare or heat within a completely enclosed building in such a manner as to be discernible along the lot line shall be prohibited.
