CHAPTER 1165

Penalties

1165.01 INJUNCTION.

   No person shall erect, construct, alter or repair, or maintain any building or structures, or use any land in violation of this Ordinance or the regulations enacted pursuant thereto. In the event of any such violation or imminent threat thereof, upon the request of the Mayor or Council, the Village Solicitor, on behalf of the Village, shall institute a suit for injunction to prevent or terminate such violation.

1165.02 VIOLATION OF PLANNING COMMISSION REGULATIONS.

   Whoever willfully violates any rule or regulation adopted by the Council or the Planning Commission shall forfeit and pay not less than two hundred fifty dollars ($250.00) to be recovered with costs in a civil action brought by the Solicitor in the name of the Village of Metamora for the use thereof. Each day such violation shall continue it shall constitute a separate forfeiture.

1165.03 TRANSFER OF COMMON LAND PROHIBITED.

   When a common land, a street, recreation area, park or other open land has been set aside with the approval of the Planning Commission for the exclusive use, in common, by abutting or other owners or occupants of land, the sale, transfer or change of use of such land or any part thereof is prohibited unless the Planning Commission has given it prior consent thereto, which shall be confirmed by action of Council. Whoever willfully violates this Section shall forfeit and pay to the Village of Metamora not less than one hundred dollars ($100.00) as determined by the Council. Such sum shall be recovered, with costs, in an action brought by the Solicitor in the name of the Village of Metamora and for the use thereof.

1165.04 PENALTIES.

   Any person who shall:
   (a)    Use or occupy any land or place, build, erect, alter, remodel, restore, or rebuild thereof any building or structure, or permit any building or structure to remain on such land; or use, occupy or operate such building or structure in any, or for any use or purpose which is not permitted by the provision of this Ordinance;
   (b)    Aid, assist, or participate with any person placing, building, erecting, altering, remodeling, restoring, or rebuilding any building or structure which is not permitted by the provisions of this Ordinance;
   (c)    Violate or fail to perform any condition, stipulation, or safeguard set forth in any permit issued pursuant to the Ordinance or continue to use or occupy the premises or building as previously authorized by such permit beyond the duration limit therein stated;
   (d)    Refuse to permit the Zoning Inspector or his assistant to enter any premises in the Village to investigate a reported violation of the provisions of this Ordinance;
   (e)    Knowingly make any materially false statement of fact in an application to the Zoning Inspector or his assistants for the permit, or in any plans or specifications submitted in relation to any application under this Code; or
   (f)    Being an owner or lessee of any premises, knowingly suffer or permit a violation of this Ordinance to occur or exist on such premises; shall be charged with a violation of this Ordinance, a just misdemeanor, for each such action or omission and upon conviction thereof shall be fined not more than two hundred fifty dollars ($250.00) together with the costs of prosecution. Each day during which a violation continues shall be deemed a separate offense. The imposition of any sentence shall not exempt any offender from compliance with the provisions of this Ordinance.
