- CITIZEN BOARDS
All citizen boards created to administer this code or the comprehensive plan shall be governed by the following provisions:
A.
Board membership and officers.
1.
Each board shall have five members appointed by the City council. A City council member shall serve as an ex-officio member of the board.
2.
Each member shall reside in the City of Midway.
3.
Each member shall be appointed to a three-year term, except that initially, two members shall be appointed for a term of two years, and three members shall be appointed for a term of three years. No person may serve more than two-consecutive three-year terms. Persons disqualified by this provision may be re-appointed after one year elapses after the expiration of the second term of service.
4.
When a position becomes vacant before the end of the term, the City Council shall appoint a substitute member to fill the vacancy for the duration of the vacated term. A member whose term expires may continue to serve until a successor is appointed.
5.
The members of each board shall annually elect a chair and vice chair and may create and fill other offices as the board deems necessary.
6.
Each board shall create whatever subcommittees it deems necessary to carry out the purposes of the board.
7.
The chair of the board shall annually appoint the membership of each subcommittee from the members of the board.
8.
The City manager shall appoint a City employee to serve as secretary to the board, and recorded and custodian of all board records.
9.
Members shall not be compensated, but may be paid for travel and other expenses incurred on board business outside the City's jurisdiction under procedures prescribed in advance by the City council.
10.
The City council shall appropriate funds to enable each board to perform its prescribed functions.
11.
If any member fails to attend four successive meetings, including special meetings, the board shall declare the member's office vacant and notify the city Council.

Establishment. The planning and zoning board is hereby created as a citizen board to recommend land use policies to the City council, and to review and approve or deny development plans submitted under this Code.
B.
Membership. Any interested citizen may be appointed to the Board, but those with experience or interest in the field of planning and zoning shall receive special consideration.
C.
General long-range planning functions, powers and duties.
1.
The board shall obtain and maintain information on population, property values, the land economy, land use and other information necessary to assess the amount, direction and type of development to be expected in the City.
2.
Pursuant to and in accordance with the local government comprehensive planning and Land Development Regulation Act, Chapter 163, Part II, Florida Statutes (F.S. § 163.3161 et seq.), the board is hereby designated as the local planning agency for the City and shall perform the functions and duties as prescribed in the Act.
3.
The board shall monitor and oversee the operation, effectiveness and status of this Code and recommend amendments to the City council that are consistent with the Midway comprehensive plan.
4.
The City council may ask the board for advice about specific land use issues and policies.
5.
The board shall conduct public hearings to gather information necessary for the drafting, establishment, amendment, and maintenance of the various elements of the comprehensive plan and provisions of this Code.
6.
The board may make or obtain special studies on the location, condition and adequacy of facilities of the City and county, including housing, commercial and industrial facilities, schools, public buildings, public and private utilities, transportation and parking.
7.
The board shall review redevelopment plans prepared under Chapter 163, Part III, Florida Statutes (F.S. § 163.330 et seq.).
D.
General development review functions, powers and duties.
1.
The board shall review and act upon applications for development review pursuant to this Code.
2.
Pursuant to the local government comprehensive planning and Land Development Regulation Act [now Community Planning Act—F.S. § 163.2511 et seq.], the planning and zoning board is hereby designated to be the land development regulation commission, i.e., the local planning agency, and shall perform the duties and functions prescribed in the Act.
3.
The board shall perform other lawfully assigned duties.
4.
Each final action of the board is advisory to the City council, and the board may not in any manner obligate the City.
E.
Legal representation. The City council shall appoint legal counsel to represent the board.
