DISTRICT REGULATIONS

§ 29-401 General Provisions.

1. 
The regulations governing the use of land, size of lots, yards, and buildings within each zoning district identified in Part 3 are established in this Part 4. For certain uses or exceptional situations, these regulations are supplemented by Part 5 and by other provisions of this Chapter.
2. 
No uses shall be permitted in any district if they are to be operated in such manner as to create any dangerous, injurious, noxious, or otherwise objectionable fires, explosion, radioactivity or other hazard, noise, vibration, odor, smoke, dust, dirt, or other forms of pollution, glare, electrical and other disturbances which adversely affect surrounding areas or premises.

§ 29-402 Residential-Suburban District (RS).

Off-street parking area shall be enclosed within a landscaped buffer when larger than five spaces in size.

D. 
A site plan detailing parking, buffer area, sign placement and design, and pedestrian access shall accompany the application for a zoning permit.
E. 
Public sewage and water facilities are required.
F. 
Minimum habitable floor area for residential use by dwelling type:

Two bedrooms: 650 feet.

An accessory apartment shall not exceed 33% of the total habitable floor area of a single-family dwelling nor 50% of the habitable floor area of a professional office building.
(4) 
The accessory apartment shall be located within the principal building.

The parking standards of § 29-510 shall only pertain to existing and proposed residential uses in the DD District. All other uses shall be exempted from parking requirements. For residential uses, the following additional standards shall pertain:
(a) 
Only off-street parking spaces shall be utilized to meet the required standards, although leased off-site spaces may be utilized for this purpose. Parking spaces shall only be counted once for tabulation purposes unless a satisfactory shared parking agreement is provided with the zoning permit application. All off-site or leased parking spaces must be within 600 feet of the premises in question.
(b) 
Lease information and a site plan detailing parking areas, aisles, and pedestrianways shall also accompany the zoning permit application.
(c) 
The site plan shall further indicate lot and building dimensions and space allocations for existing and proposed uses.

§ 29-407 Commercial Manufacturing District (CM).

No adult use shall be located within 500 feet of any residential district.
(2) 
No adult use shall be located within 1,000 feet of any public park or playground, school, church, child-care facility or other area where minors congregate.
(3) 
No adult use shall be located within 500 feet of any other adult use.
(4) 
No adult use shall be conducted in any manner that permits the observation of any material depicting, describing or related to specified sexual activities or specified anatomical areas from any public way or from any property not permitted as an adult use. This provision shall apply to any display, decoration, sign, show window, door, or other opening.
(5) 
Screening shall comply with § 29-506 of this Chapter.
(6) 
No adult use shall be conducted in any manner that violates any of the provisions of § 29-510, Off-Street Parking, of this Chapter.
(7) 
No adult use shall be located within 500 feet of any establishment licensed by the Pennsylvania Liquor Control Board to dispense alcoholic beverages.
(8) 
Outdoor lighting shall comply with § 29-518 of this Chapter.
(9) 
No signs shall depict, display or describe any portion of the human anatomy or specified sexual activities as defined in Part 2 of this Chapter. Signage shall comply with § 29-516 of this Chapter.
(10) 
Any adult use that violates any provision of this Chapter or any other applicable Borough ordinance shall have its zoning permit terminated within 30 days of being found in violation by the District Magistrate.

§ 29-408 Agricultural District (A).
