02 - ADOPTION, PURPOSE AND ZONING DISTRICTS
There is hereby adopted a Zoning or Districting Plan for the City as provided by law.
The Chapter establishes various districts including therein all territory within the boundaries of the City. Within such districts certain regulations shall be in effect relating to the uses of land, the uses of buildings, the location and height of buildings, the open spaces about buildings, and the dimensions and areas of lots. The Chapter defines certain terms used herein, provides for the administration, amendment, and enforcement of the provisions thereof, and prescribes the penalties for violation of such provisions.
The City Council is hereby established as the Planning Agency of the City of Monte Sereno. The City Planner may be assigned and delegated by ordinance such duties and authority with respect to acting on applications for use permits and variances, and by ordinance or resolution as appropriate such other duties, as may be delegated by the City Council.
In the performance of his/her functions the City Planner or his/her designee may, with the permission of the owner or for probable cause to believe that a violation of this Chapter has occurred, enter upon any land and make examinations and surveys, provided that such entries, examinations and surveys do not interfere with the use of the land by the persons lawfully entitled to the possession thereof.
This Title is adopted to promote and protect the public health, safety, peace, morals, comfort, convenience and general welfare, and for the following more particularly specified purposes:
A.
To guide, control, and regulate future growth in accordance with plans for community development.
B.
To protect the high amenity residential character of the City in a setting of rural atmosphere and natural scenic beauty.
C.
To promote the efficient, economical provision of such urban facilities as water, sewerage, drainage, and other public services in manner consistent with the residential and rural nature of the City.
