Chapter 21.39

REGULATIONS FOR COMMUNITY PLAN ZONING DISTRICTS OR "CP" DISTRICTS

21.39.010 - Purpose.

The purpose of this Chapter is to provide regulations for review of development in those areas of the County for which a community plan has been adopted. For purposes of this Chapter, the term "community plan" means a plan for a specific geographical area identified by the Monterey County General Plan as a Community Area or Development Incentive Zone, in which the plan contains specific development policies adopted for the Community Plan area with measures to implement those policies as appropriate for each parcel in the Community Plan area.

21.39.020 - Applicability.

A.

This Chapter shall apply to all lands for which a Community Plan has been adopted and which have been zoned "CP".

B.

Where the provisions of this Title and the provisions of the adopted Community Plan differ, the provisions of the Community Plan prevail.

C.

Any regulation, standard, or procedure of this Title not otherwise addressed by the Community Plan's regulations, standards, or procedures, shall be applicable to the area governed by the Community Plan.

21.39.030 - Uses allowed.

A.

Uses allowed within the "CP" district are those uses for which the Community Plan specifically provides.

B.

Other uses allowed by this title may be considered provided:

1.

Such uses are not inconsistent or incompatible with the Community Plan; and

2.

Such uses comply with all the requirements and standards of this title.

C.

Single room occupancy facilities pursuant to Section 21.64.033 may be considered within areas designated by a Community Plan as Mixed Use or High Density Residential subject to approval of a Use Permit (ZA).

D.

Homeless shelter, pursuant to Section 21.64.320 is an allowed use within areas designated by a Community Plan as Mixed Use or High Density Residential.

E.

Small residential care facility is an allowed use within areas designated by a Community Plan as Low Density Residential, Medium Density Residential, High Density Residential, Mixed Density Residential or Mixed Use.

F.

A large residential care facility may be considered, subject to a Use Permit in each case, within areas designated by a Community Plan as Low Density Residential, Medium Density Residential, High Density Residential, Mixed Density Residential or Mixed Use.

G.

Employee housing providing accommodations for up to six (6) employees is an allowed use within areas designated by a Community Plan as Low Density Residential, Medium Density Residential, High Density Residential, Mixed Density Residential or Mixed Use.

H.

Supportive housing contained within the housing types of this section, pursuant to those permitting requirements of the specific housing type;

Reserved.

J.

Transitional housing or transitional housing development contained within the housing types of this section, pursuant to those permitting requirements of the specific housing type.

21.39.040 - Design guidelines and development standards.

Development within all areas with a Community Plan District shall be subject to design guidelines and development standards that are adopted as part of the Community Plan or as appendices to the Community Plan.
