When used in this chapter, the following words, terms and phrases shall have the following meanings, unless expressly stated otherwise or unless the context clearly indicates otherwise.
ABANDONED VEHICLEAny inoperable vehicle lacking a currently effective state license and inspection sticker.
ABUTAreas of contiguous lots that share a common lot line, except not including lots entirely separated by a street, public alley open to traffic, or a perennial waterway.
ACADEMIC CLINICAL RESEARCH CENTERAn accredited medical school within this commonwealth that operates or partners with an acute care hospital licensed within this commonwealth pursuant to the Act.

ACCESSORY BUILDINGA building (including but not limited to a private garage, private toolhouse or children's play house or a noncommercial greenhouse) subordinate to and on the same lot with the principal building on the lot, and not to be used for residential purposes unless such building was originally designed for residential uses, as in conjunction with an institution.
ACCESSORY STRUCTUREA structure (including but not limited to a swimming pool, tennis court, fence or wall) serving a purpose customarily incidental to the use of the principal building or use and located on the same lot as the principal building or use.
ACCESSORY USEA use incidental to and customarily associated with a specific principal use, located on the same lot or parcel.
ACREForty-three thousand five hundred sixty square feet.
ADJACENTProperty that touches or is directly across a street, private street or access easement, or right-of-way (other than a principal arterial) from the subject property.
ADMINISTRATORThe person designated by the Board of Supervisors who receives subdivision or land development plans or otherwise acts in a clerical capacity for and on behalf of the Township Planning Commission.
ADULT BOOKSTOREAn establishment having a substantial or significant portion of its stock and trade in, or an establishment which, as one of its principal business purposes, offers for sale books, films, video cassettes, magazines or other periodicals which are distinguished or characterized by their emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas, and, in conjunction therewith, has facilities for the presentation of adult entertainment for observation by patrons. Such establishment or the segment or section devoted to the sale or display of such material in an establishment is customarily not open to the public generally, but only to one or more classes of the public, excluding any minor by reason of age.
ADULT ENTERTAINMENT BUSINESSAn establishment providing:
A. The exhibition of any adult-oriented motion pictures, meaning those distinguished or characterized by an emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas; or
B. Live performance, display or dance of any type which has a significant or substantial portion of the performance, any actual or simulated performance, of specified sexual activities or exhibition and viewing of specified anatomical areas, removal of articles of clothing or appearing unclothed, pantomiming, modeling or any other personal services offered to customers.
ADULT USES"Adult uses" shall include, and be limited to, the following defined terms: "adult bookstore" and "adult entertainment business" as defined herein.
AGRICULTURAL BUILDINGA structure on agricultural land designed, constructed, and used to house farm implements, livestock, or agricultural produce or products used by the owner, lessee, or sublessee or their immediate families, their employees, and persons engaged in the pick up or delivery of agricultural produce or products grown or raised on the premises. The term "agricultural building" shall not include dwellings.
AGRICULTUREFarming, including plowing, tillage, cropping, installation of best management practices, seeding, cultivating, or harvesting for the production of food and fiber products. "Agriculture" does not include animal husbandry, commercial logging and timber harvesting.
AGRITAINMENTAn accessory use to a single-family dwelling or farming use which may include the rental of an accessory structure for the purposes of weddings, family gatherings, reunions, or other similar events, subject to the additional regulations contained in the Zoning Ordinance.

AGRITOURISMAn accessory use that consists of an enterprise that shall be considered any activity conducted as an accessory to an existing and operational farm and offered to the public or to invited groups for the purpose of recreation, education, or active involvement in the farm operation. These activities must be directly related to agricultural or natural resources and incidental to the primary operation of the farm.

AIRPORTAn area and related support facilities used for the landing and takeoff of motorized aircraft that carry people. A public airport shall be an airport that does not meet the definition of "private airport." A private airport shall be limited to a maximum of 15 total landings and takeoffs in any seven day period, and shall not be available for use by the general public.
ALLEYA public or private way affording only secondary means of access to abutting property.
ANIMAL EQUIVALENT UNIT (AEU)One thousand pounds live weight of livestock or poultry animals, regardless of the actual number of individual animals comprising the unit, as defined in 3 Pa.C.S.A. § 503.

ANIMAL HOSPITALA facility for the provision of surgical or other medical treatment to animals. Such animals may be kept in the facility during the recovery period or while under medical treatment only.
ANIMAL HUSBANDRYThe raising and keeping of livestock or poultry for any commercial purpose. The keeping of livestock or poultry as farm pets or for domestic purposes pursuant to the regulations of this chapter shall not be construed as animal husbandry. Does not include "concentrated animal feeding operation" or "concentrated animal operation."
ANIMAL, GRAZINGAnimals that exist wholly or partly on naturally growing pastures which usually consist of true grasses, together with other forage species such as legumes.
ANIMAL, NONGRAZINGAnimals that exist in confined pens, cages, buildings or feeds typically harvested and fed to the animals.
APPLICANTA landowner or developer who has filed an application for a subdivision or land development, including his heirs, successors and assigns.
AUDITORIUMA space containing a stage and seating for meetings and performances.
AUTO GAS STATIONA place where only gasoline and a limited selection of automobile accessories are sold to the public at retail.
AUTO REPAIR STATIONAn area where repairs, improvements and installation of parts and accessories for motor vehicles and/or boats are conducted that involves work that is more intense in character than work permitted under the definition of "auto service station." An auto repair station shall include, but not be limited to, a use that involves any of the following work: major mechanical or body work, straightening of body parts, painting, welding or rebuilding of transmission. Any use permitted as part of an auto service station is also permitted as part of an auto repair station.
AUTO SERVICE STATIONAn area where gasoline is dispensed into motor vehicles, and where no repairs are conducted, except work that may be conducted that is closely similar in character to the following: sale and installation of oil, lubricants, batteries and belts and similar accessories and safety and emission inspections, and sale of prepackaged propane. This use may include a convenience store, provided that all of the requirements for such use are also met. A business that maintains an accessory use of providing motor fuel only for use by vehicles operated by that business shall not, by itself, be considered to be an auto service station. Outside storage of inoperable or unlicensed vehicles at service stations is limited to a maximum two-day period of time for each such vehicle.
AUTO WRECKINGThe dismantling or disassembling of used motor vehicles or recreation vehicles, or the storage, sale or dumping of dismantled, partially dismantled, obsolete or wrecked vehicles or their parts.
AUTO, RECREATION VEHICLE OR BOAT SALES AREAAn open area, other than a street, used for the outdoor or indoor display, sale or rental of new or used motor vehicles, recreation vehicles or boats in operable condition, and where no major repair work is done.
BASEMENTA story in a building (excluding a subterranean building) which has a structural ceiling four feet or more above the average level of finished grade abutting the exterior wall(s) fronting on any road, and the floor level of which is below finished grade at all points on the periphery of the building. A basement shall be counted as one story in determining the permissible number of stories.
BEDROOMAny room or space designated to be used or intended to be used for sleeping purposes. Spaces used for eating, cooking, bathrooms, toilet rooms, closets, halls, storage or utility room and similar uses are not considered bedrooms.

BEST MANAGEMENT PRACTICESThat combination of conservation measures, structures, or management practices that reduces or avoids adverse impacts of development on adjoining site's land, water or waterways, and water bodies.
BLOCKProperty bounded on one side by a street and on the other three sides by a street, railroad right-of-way, public park, waterway, Township line or any combination thereof.
BOARDThe Zoning Hearing Board of Moore Township.
BUFFER YARDA strip of land at least 20 feet in width which may be a part of the minimum setback distance and which is free of any principal or accessory building, parking, outdoor storage or any other use than open space designed to eliminate or minimize conflicts between land uses. Land within an existing or future street right-of-way shall not be used to meet a buffer yard requirement.
BUILDINGAny structure having a roof supported by columns or walls, used for the shelter, housing or enclosure of persons, animals or property. "Building" is interpreted as including "or part thereof." Any structure involving a permanent roof (such as a covered porch or a carport) that is attached to a principal building shall be considered to be part of that principal building.
BUILDING COVERAGEThe ratio obtained by dividing the ground floor area of all principal and accessory buildings on a lot (including covered porches, carports and breezeways, but excluding open patios) by the total area of the lot upon which the buildings are located.
BUILDING HEIGHTThe vertical distance of a building measured from the point which is the mean level of the highest and lowest portion of the building site covered by the building to the highest portion of the roof.
BUSINESS OFFICEOffices or private firms or organizations which are primarily used for the provision of executive, management or administrative services. Typical uses include administrative offices, and services including real estate, insurance, property management, investment, personnel, travel, secretarial services, telephone answering, photocopy and reproduction and business offices of public utilities, organizations and associations, or other use classifications when the service rendered is that customarily associated with administrative office services.
CAMPA business or organization offering dormitories, cottages, cabins or similar accommodations, eating facilities, sanitary facilities and recreational or education facilities to the public at large or any segment of the public on other than a transient basis, but does not include campgrounds.
CAMPGROUNDAny lot, parcel or tract of land upon which space is rented for two or more tents, recreation vehicles, camping trailers, travel trailers, pickup coaches, motor homes or any combination thereof for temporary occupancy. Any such land development intended for permanent occupancy or involving the sale of lots, parking space for location of tents, recreation vehicles, travel trailers, pickup coaches or other similar accommodations shall be considered as a residential subdivision and shall meet all standards and requirements in this chapter and Chapter
260, Subdivision and Land Development.
CAREGIVERThe individual designated by a patient to deliver medical marijuana.

CAR WASHWashing and cleaning of automobiles and related light equipment.
CARPORTA building open on two or more sides and used in conjunction with a dwelling for the storage of private motor vehicles.
CARTWAYThe paved portion of a street or highway.
CELLARA part of the interior of a building (excluding a subterranean building) which has a structural ceiling less than four feet above the average level of finished grade abutting the exterior wall(s) fronting on any road. A cellar shall not be counted as one story in determining the permissible number of stories.
CEMETERYA place used for the burial of two or more noncremated humans.
CERTIFIED MEDICAL USEThe acquisition, possession, use or transportation of medical marijuana by patient, or the acquisition, possession, delivery, transportation or administration of medical marijuana by a caregiver, for use as part of the treatment of the patient's serious medical condition, as authorized by certification by the commonwealth pursuant to the Act.

CLINICAL REGISTRANTAn entity that:

A. Holds a permit both as a grower/processor and a dispensary pursuant to the Act; and
B. Has a contractual relationship with an Academic Clinical Research Center under which the Academic Clinical Research Center or its affiliate provides advice to the entity, regarding, among other areas, patient health and safety, medical applications and dispensing and management of controlled substances.
COMMERCIAL COMMUNICATIONS TOWER OR ANTENNAA structure, partially or wholly exterior to a building, used for transmitting or retransmitting electronic signals through the air, and that does not meet the definition of a "standard antenna." Commercial communications antennae shall include, but are not limited to, antennas used for transmitting commercial radio or television signals, or to receive such signals for a cable system, or to retransmit wireless telecommunications. A commercial communications tower shall be a structure over 30 feet in height that is primarily intended to support one or more antenna.
COMMERCIAL CROP STORAGEThe bulk storage of crops where more than 50% of the crops stored were not produced by the owner.
COMMERCIAL FORESTRYThe harvesting of trees for any commercial purpose in areas greater than 10 acres in size or greater than 10% of the lot area.
COMMERCIAL INDOOR RECREATIONA commercial recreational land use conducted entirely within a building, including arcade, arena, art gallery and studio, art center, assembly hall, athletic and health clubs, auditorium, bowling alley, club or lounge, community center, conference center, exhibit hall, gymnasium, library, movie theater, museum, performance theater, pool or billiard hall, skating rink, swimming pool, tennis court.
COMMERCIAL OUTDOOR RECREATIONAny area which is predominantly open space, is used principally for active or passive recreation and is used for a profit-making purpose. Typical uses include driving ranges, miniature golf, swimming pools, tennis courts, outdoor racquetball courts, motorized cart and motorcycle tracks, and motorized model airplane flying facilities.
COMMISSIONThe Planning Commission of Moore Township.
COMMONWEALTHThe Commonwealth of Pennsylvania.

COMMUNITY CENTERA publicly owned and/or publicly operated facility that serves the community at large and provides a venue for cultural events, entertainment, athletic, social, recreational, governmental and/or multipurpose uses. Uses may include, but are not limited to commercial kitchens, classrooms, events involving social or fraternal gatherings, exercise areas, gymnasiums, meeting rooms, multipurpose rooms, office spaces, public and nonprofit social service organizations, spectator sports, swimming pools, and areas for public display, such as a museum, auditorium, theater and/or stage.
COMPREHENSIVE PLANMaps, charts and text duly adopted by the Moore Township Board of Supervisors as the Official Comprehensive Plan of the Township.
CONCENTRATED ANIMAL FEEDING OPERATION (CAFO)Any animal feeding operations that:
A. Has more than 1,000 animal equivalent units (AEUs);
B. Are a concentrated animal operation (CAO) with 301 to 1,000 AEUs; or
C. Exceed, for certain animal group, a threshold number established by the Environmental Protection Agency (EPA).
CONDITIONAL APPROVALAn affirmative action by a commission or the Board of Supervisors indicating that approval will be contingent upon satisfaction of certain specified stipulations.
CONDITIONAL USECertain specified uses which are allowed or denied by the Board of Supervisors after recommendation by the Planning Commission pursuant to express standards and criteria set forth in this chapter.
CONDOMINIUMReal estate, portions of which are designated for separate ownership and the remainder of which is designated for common ownership solely by the owners of those portions, created under either the Pennsylvania Unit Property Act of July 3, 1963, or the Pennsylvania Uniform Condominium Act.
CONSTRUCTIONOn-site erection, fabrication, installation, alteration, demolition, or removal of any structure, facility, or addition thereto, including all related activities, but not restricted to, clearing of land, earth moving, blasting and landscaping.
CONVERSIONTo change or adapt land or structures to a different use, occupancy or purpose.
COUNTYThe County of Northampton, Commonwealth of Pennsylvania.
CROSSWALK OR WALKWAYA strip of land, including a right-of-way, dedicated to public use in order to facilitate pedestrian access through or into a block.
CULTURAL CENTERA building and/or land open to the public which contains exhibits of a cultural interest, such as a museum, art gallery, nature study area, etc.
CURATIVE AMENDMENTA proposed zoning amendment made to the Board of Supervisors by any landowner who desires to challenge on substantive grounds the validity of an ordinance which prohibits or restricts the use or development of land in which he has an interest.
DAY-CARE CENTERA use involving the supervised care of children under age 16 outside of the children's own home(s) primarily for periods of less than 18 hours per child during the average day. This use may also include educational programs that are supplementary to state-required education, including a nursery school or "head start" programs.
A. The following three types of day care are permitted without regulations by this chapter:
(1) Care of children by their own relatives;
(2) Care of children within a place of worship during regularly scheduled religious services; and
(3) Care of one to three children within any dwelling unit, in addition to children who are relatives of the caregiver.
B. FAMILY DAY CARE HOMEA type of day care use that is accessory to and occurs within a dwelling unit, and provides care for four to six children at one time who are not relatives of the primary caregiver.
C. GROUP DAY CARE HOMEA type of day care use that provides care for between seven and 12 children at one time who are not relatives of the primary caregiver, provides care within a dwelling unit, and is registered with the applicable state agency (PA Department of Human Services).
D. CHILD DAY-CARE CENTERA type of day care use that provides care for seven or more children at any one time who are not relatives of the primary caregiver, does not occur within a dwelling unit, and is registered with the applicable state agency (PA Department of Human Services).
DEED RESTRICTIONA restriction on the use of a lot or parcel of land that is set forth in the deed and recorded with the county register of deeds. It is binding on subsequent owners and is sometimes also known as a "restrictive covenant."
DENSITYThe number of dwelling units permitted per acre of land.
DETENTION BASINA structure or facility, natural or artificial, which stores stormwater on a temporary basis and releases it at a controlled rate. A detention basin may drain completely after a storm event, or it may be a body of water with a fixed minimum and maximum water elevation between runoff events.
DETENTION FACILITYA facility for the detention, confinement, treatment or rehabilitation of persons arrested or convicted for the violation of civil or criminal law. Such facilities include an adult detention center, juvenile delinquency center, jail, and prison. These facilities house prisoners who are in custody of municipal/county/law enforcement and the facilities are typically government owned.
DEVELOPERAny landowner, agent of such landowner or tenant with permission from a landowner who makes or causes to be made a subdivision of land or land development.
DEVELOPMENT PLANA proposal for the development of land, prepared in accordance with this chapter, including a plat of subdivision, all covenants relating to use, location and bulk of buildings and other structures, intensity of use or density of development, streets, ways and parking facilities, common open space and public facilities. The phrase "provisions of the development plan" when used in this chapter shall mean both the written and graphic materials referred to in this definition.
DEVELOPMENT PLAN REVIEWThe process whereby authorized officials of the Township review the site plans, maps and other documentation of a development to determine compliance of the stated purposes and standards of this chapter.
DISPENSARYA person, including a natural person, corporation, partnership, association, trust or other entity, or any combination thereof, which holds a current and valid permit issued by the Department of Health (DOH) of the commonwealth to dispense medical marijuana pursuant to the provisions of the Act.

DISPENSARY FACILITYAny building or structure used to dispense medical marijuana by a licensed dispensary.

DISTRICT or ZONING DISTRICTA portion of the territory of the Township within which certain uniform regulations and requirements or various combinations thereof apply under the provisions of this chapter.
DRIVEWAYA privately owned and constructed vehicular access from an approved private or public road into a lot or parcel having frontage on the road.
DWELLING UNIT or HOUSING UNITOne or more rooms intended to be occupied by one family as separate living quarters, containing sanitary facilities and kitchen facilities and having direct access from the outside or through a common hall.
DWELLING, RESIDENCE or RESIDENTIAL STRUCTUREAny building, vehicle or portion thereof designed or used exclusively as the residence or sleeping place of one or more persons. The term "dwelling" shall not be deemed to include an automobile court, rooming house, tourist home, hotel, motel, hospital, nursing home, dormitory, fraternity, sorority house or other group residence.
B. (1) A transportable single-family dwelling designed so that it can be:
(a) Transported on a highway;
(b) Used for permanent occupancy, office or place of assembly contained in one unit or in two units designed to be joined into one integral unit capable of again being separated for repeated towing, which arrives at a site complete and ready for occupancy except for minor and incidental unpacking and assembly operations; and
(c) Constructed so that it may be used without a permanent foundation.
(2) Mobile home does not include travel trailers or modular homes.
C. MODULAR HOMEA single-family dwelling designed for transportation after fabrication in one or more units and arriving at a site where it is assembled on a permanent foundation and connected to utilities.
D. TWO-FAMILY DWELLINGA detached or semidetached building where not more than two individual family dwelling units are entirely separated by vertical walls or horizontal floors, unpierced except for access to the outside or to a common cellar.
E. MULTIFAMILY DWELLINGA building designed for occupancy of families living independently of each other and containing three or more dwelling units per building.
(1) LOW-RISE APARTMENTA multifamily dwelling in a building not exceeding three stories in height where individual dwelling units share a common outside access. Each unit shares with other units a common yard area which is in the sum of the required lot areas of all of the dwelling units within the building.
EASEMENTA right-of-way or restriction granted for limited use of private land within which the owner of the property may be restricted from erecting permanent structures but shall have the right to make any other use of the land which is not inconsistent with the rights of the grantee.
EMERGENCY SERVICESFacilities for conduct of public safety and emergency services, including police and fire protection services and emergency medical and ambulance services.
ENGINEERThe registered professional engineer designated by the Board of Supervisors to perform all duties required of the Engineer by the provisions of this chapter.
ESSENTIAL SERVICESIncludes the provision of gas, electricity, steam, communication, telephone, sewer, water, public safety and other similar services. The facilities required to provide such services shall consist of the following:
A. Limited facilities are equipment which does not require enclosure within a building or which can be constructed within a public right-of-way (including poles, towers, wires, mains, drains, sewers, pipes, conduits, cables, fire alarm boxes, police call boxes, traffic signals and hydrants).
B. Major facilities are equipment which requires enclosure within a building or construction on its own site (including gas storage areas, substations, telephone exchanges and telephone booths).
EXPANSIONAny structural modification which increases the existing structure's envelope or footprint.
FAMILYOne or more persons living together in a single dwelling unit as a traditional family or the functional equivalent of a traditional family. It shall be a rebuttable presumption that six or more persons living together in a single dwelling unit, who are not related by blood, adoption, or marriage, do not constitute the functional equivalent of a traditional family. This definition does not intend to prohibit group homes and/or community living arrangements that are determined to be protected by the Federal Fair Housing law, provided such facilities are licensed and permitted under the authority of the Department of Welfare of the Commonwealth of Pennsylvania or other state department or agency. In determining the functional equivalent of a traditional family, the following criteria shall be present:

A. The group shares the entire dwelling unit.
B. The group lives and cooks together as a single housekeeping unit.
C. The group shares expenses for food, rent, utilities or other household expenses.
D. The group is permanent and stable, and not transient or temporary in nature.
E. Any other factor reasonably related to whether the group is the functional equivalent of a family.
FARM PONDAccessory ponds established in conjunction with an agricultural use. Such ponds shall conform to the requirements for mining and excavation, as provided in this chapter, and have a maximum size of 3/4 of an acre and have a maximum ratio of one pond per five acres. All boundaries of excavation are to be wholly within the building setback line of the property.
FAST-FOOD EATING PLACEA building in which food is prepared and served to the public for consumption both on or off the premises.
FEEA payment of funds to the Township for any of the applications or other entitlements.
FEEDLOTA structure or area of land on which domestic animals are fattened for market.
FENCEA barrier of fabricated materials placed or arranged as a line of demarcation between lots or to enclose a lot or portion thereof.
FILLSand, gravel, earth, or other materials of any composition whatsoever placed or deposited by human activity.
FINANCIAL INSTITUTIONAn establishment that is engaged in the business of a bank, savings and loan association, or credit union that is regulated by state or federal authority. Such establishment includes, without limitation, an office building or portion thereof devoted to such use, a drive-up facility, and a facility containing one or more automated teller machines.
FLOODPLAINA relatively flat or low land area adjoining a river, stream or watercourse which is subject to partial or complete inundation once in every 100 years.
FLOODWAYThe designated area of a floodplain required to carry the discharge waters of a flood of 100-year magnitude.
FLOOR AREAThe total area of all floors as measured to the outside surfaces of exterior walls or from the center line of party walls separating two buildings, but excluding cellars, basements, crawl spaces, attics without floors, open porches, balconies and terraces.
FORESTRYThe management of forests and timberlands when practiced in accordance with accepted silvicultural principles, through developing, cultivating, harvesting, transporting and selling trees for commercial purposes, which does not involve any land development.
FORM OF MEDICAL MARIJUANAThe characteristics of the medical marijuana recommended or limited for a particular patient, including the method of consumption and any particular dosage, strain, variant and quantity or percentage of medical marijuana or particular active ingredient.

FUNERAL HOMEAn establishment engaged in undertaking services such as preparing the human dead for burial and arranging and managing funerals.
GENERAL MERCHANDISE STOREA use that primarily sells routine household goods, groceries, prepared ready-to-eat foods and similar miscellaneous items to the general public, but that is not primarily a restaurant, and that includes a building with a floor area less than 7,000 square feet. A convenience store involving the sale of gasoline shall be regulated as an auto service station.
GLAREThe effect produced by brightness sufficient to cause annoyance, discomfort, or loss in visual performance and visibility.
GOLF COURSEA tract of land laid out with at least nine holes for playing a game of golf and improved with tees, greens, fairways, and hazards. A golf course may include a clubhouse and shelters as accessory uses.
GOVERNMENT SERVICES AND FACILITIESMunicipal, county, state or federal government buildings or facilities designed and intended to be occupied by the government or designed and intended for public use sponsored by such governments. Does not include detention facility.
GRADEThe elevation of finished ground or paving.
GREENHOUSEA horticultural use or operation occurring within a partially or totally enclosed structure, including but not limited to the sale of products produced in such structure.
GROCERY STOREA retail establishment which primarily sells food, but also may sell other convenience and household goods, and which occupies at least 5,000 square feet but not more than 25,000 square feet of gross floor area.
GROUP HOMEA dwelling unit operated by a responsible individual, family or organization with a program to provide a supportive living arrangement for individuals where special care is needed by the persons served due to age, emotional, mental, developmental or physical disability. This definition shall expressly include facilities for the supervised care of persons with disabilities subject to protection under the Federal Fair Housing Act, as amended. Group homes must be licensed where required by any appropriate government agencies, and a copy of any such license must be delivered to the Zoning Officer prior to the initiation of the use. A "group home" typically involves an individual residing on the premises for more than 30 days at a time.
GROWER/PROCESSORA person, including a natural person, corporation, partnership, association, trust or other entity, or any combination thereof, which holds a current and valid permit from the DOH to grow and process medical marijuana in the commonwealth, pursuant to the provisions of the Act.

GROWER/PROCESSOR FACILITYAny building or structure used to grow medical marijuana by a licensed grower/processor that has a current and valid license from the DOH pursuant to the Act.

GUN CLUBAny club, organization, individual, group of individuals, or use, whether operated for profit or not, which caters to or allows the use of firearms.
HARDSHIPA restriction on property so unreasonable that it results in an arbitrary and capricious interference with basic property rights. "Hardship" relates to the physical characteristics of the property, not the personal circumstances of the owner or user, and the property is rendered unusable without the granting of a variance.
HEARINGAn administrative proceeding conducted by the Board of Supervisors or the Zoning Hearing Board pursuant to this chapter.
HOME OCCUPATIONA. A routine, accessory and customary nonresidential use conducted within or administered from a portion of a dwelling, which includes any dwelling unit either residential or agricultural, or its permitted accessory building that:
(1) Meets the definition, standards and limitations of a "general home occupation" or a "no-impact home-based business" within the following definitions;
(2) Only include uses that are clearly incidental and secondary to the principal residential use;
(3) Does not include any retail or wholesale sales on the premises (other than over the phone and through the mail) nor any industrial use (other than custom crafts and sewing);
(4) Specifically does not include the following: hotel, motel, nursing home, boardinghouse, restaurant, stable or kennel; and
(5) The total floor area used for the home occupation shall not exceed 25% of the total floor area of the principal dwelling unit or 750 square feet, whichever is more restrictive.
B. (1) Involves a maximum of three total persons working on the premises; only one of whom is permitted to be a nonresident of the dwelling working on the premises at any one point in time with the potential for additional persons to be employed to work off-site; and
(2) Does not meet the definition and standards of "no-impact home-based business."
C. NO-IMPACT HOME-BASED BUSINESSA business or commercial activity administered or conducted as an accessory use which is clearly secondary to the use as a residential dwelling and which involves no customer, client, or patient traffic, whether vehicular or pedestrian, pickup, delivery or removal functions to or from the premises, in excess of those normally associated with residential use. The business or commercial activity must satisfy the following requirements:
(1) The business activity shall be compatible with the residential use of the property and surrounding residential uses.
(2) The business shall employee no employees other than family members residing in the dwelling.
(3) There shall be no display or sale of retail goods and no stockpiling or inventory of a substantial nature.
(4) There shall be no outside appearance of a business use, including, but not limited to, parking, signs or lights.
(5) The business activity may not use any equipment or process which creates noise, vibration, glare, fumes, odors or electrical or electronic interference, including interference with radio or television reception, which is detectable in the neighborhood.
HOSPICEA facility where terminally ill individuals and their families receive support services from a team of health care providers and others to meet their physical, psychological, social, emotional, and spiritual needs.
HOSPITALA use involving the diagnosis, treatment or other medical care of humans that includes, but is not limited to, care requiring stays overnight. A medical care use that does not involve any stays overnight shall be considered an "office." A hospital may involve care and rehabilitation for medical, dental or mental health, but shall not primarily include housing or treatment of the criminally insane or persons actively serving an official sentence after being convicted of a felony. A hospital may also involve medical research and training for health care professionals.
HOTELA building or group of buildings with an outside entrance in common, which contains six or more rooms and is designed, arranged and used for the overnight lodging of travelers or for the temporary occupancy of transients and the business conduct of which it is licensed under applicable laws. Any such use that customarily involves the housing of persons for periods of time longer than 90 days shall be considered a boardinghouse and shall meet the requirements of that use. A hotel may also include a restaurant, meeting rooms, nightclub, newsstand, amusement arcade, gift shop, swim club, exercise facilities, tavern and similar customary accessory amenities, and provided such use shall only be allowed as a principal use of the property if such use is allowed by the applicable district regulations.

IMPERVIOUS COVERAny surface which does not absorb rain; all buildings, parking areas, driveways, roads, sidewalks, and any areas in concrete, asphalt or other equivalent surfaces.
INDUSTRIAL SERVICESEstablishments providing industrial services to individuals or businesses. This classification includes dry-cleaning plants; metal, machine, and welding shops; cabinetry and woodworking shops; furniture upholstery shops; and similar businesses engagements in custom fabrication and repair.
INFRASTRUCTUREStreets, water and sewer lines, and other public facilities necessary to the functioning of a community.
INTENSIVE AGRICULTUREAn agricultural use including but not limited to feedlots, confinement livestock, or poultry operations taking place in structures or closed pens (i.e., CAFOs or CAOs).
JUNK or SALVAGEAny discarded material or articles (including scrap metallic or nonmetallic items, abandoned vehicles and equipment, paper, glass, containers and structures). Junk or salvage shall not include refuse or garbage kept in a proper container for the purpose of prompt disposal.
JUNKYARD or SALVAGE YARDAny land or structure where junk or salvage is discarded, bought, sold, exchanged, stored, bailed, cleaned, packed, disassembled or handled. "Junkyard" does not include those structures where used furniture or household equipment is stored, bought or sold, nor those structures or land where automobiles not abandoned are stored, bought or sold.
KENNELAny establishment wherein four or more dogs and other domesticated pets four months of age or older are kept for the purpose of breeding, boarding, sale or show purposes.
KITCHEN FACILITIESConsists of all of the following: a sink with piped water, a permanent cookstove and a refrigerator.
LAND AREAThe total area of space or surface occupied, measured in square feet.
LAND DEVELOPMENTA. The improvement of one or two or more contiguous lots, tracts or parcels of land for any purpose involving:
(1) A group of two or more residential or nonresidential buildings, whether proposed initially or cumulatively, or a single nonresidential building on a lot or lots regardless of the number of occupants or tenure; or
(2) The division or allocation of land or space, whether initially or cumulatively, between or among two or more existing or prospective occupants by means of or for the purpose of streets, common areas, leaseholds, condominiums, building groups or other features.
C. Development in accordance with Section 503(1.1) of the Pennsylvania Municipalities Planning Code.
LAND USEThe type of use activity occurring on a land parcel or within a building situated upon a land parcel.
LANDOWNERThe legal or beneficial owner or owners of land, including the holder of an option or contract to purchase (whether or not such option or contract is subject to any condition), a lessee if he is authorized under the lease to exercise the rights of the landowner or other person having a proprietary interest in land.
LAUNDROMATAn establishment providing washing, drying and/or dry-cleaning machines on the premises for rental use to the general public for family laundering and/or dry-cleaning purposes.
LIBRARYA facility in which literary and artistic materials, such as books, periodicals, newspapers, pamphlets, prints, records, and tapes, are kept for reading, reference, or lending.
LIVESTOCKIncludes all cattle, horses, ponies, donkeys, mules, hogs, sheep, goats, rabbits, hares, poultry and any other similar creature raised for human use or profit, but shall not include dogs, cats or similar creatures customarily kept as household pets.
LOADING, OFF-STREETAn unobstructed area provided and maintained for the temporary parking of trucks and other motor vehicles for the purpose of loading and unloading goods, wares, materials, and merchandise.
LOTAny parcel or tract of land intended as a unit of ownership, transfer of ownership, use, rent, improvement or development. Contiguous nonconforming lots under common ownership shall be considered one lot.
A. CORNER LOTA lot situated at and abutting the intersection of two streets having an interior angle of intersection not greater than 135°.
B. INTERIOR LOTA lot other than a corner lot whose sides do not abut a street.
C. REVERSE FRONTAGE LOTA lot which fronts on one public street but provides vehicular access solely from another public street at the rear of the lot.
LOT AREAThe area contained within the lot lines, excluding space within existing street rights-of-way.
LOT DEPTHThe mean average horizontal distance between the front and the rear lot lines.
LOT LINESThe property lines bounding the lot.
A. FRONT LOT LINEThe line separating the lot from an existing street right-of-way.
B. REAR LOT LINEThe lot line opposite and most distant from the front lot line. (A three-sided lot has no rear lot line.)
C. SIDE LOT LINEAny lot line other than a front or rear lot line. A "side street lot line" is a side lot line separating a lot from a street.
LOT WIDTHThe horizontal distance between the side lot lines measured at the minimum prescribed front yard setback line as set forth in this chapter or as otherwise prescribed in §
300-29D(2).
LUMBERYARDA facility where building materials such as lumber, plywood, drywall, paneling, cement blocks and other cement products, and other building products are stored and sold. Lumberyards may also process lumber by performing millwork, planning, cutting, and other customizing processes.
MANUFACTURINGAn industrial use which shall include but not be limited to the production, processing, cleaning, and testing of materials, goods, foodstuffs, and products, and the commercial generation of electricity.
MANUREAnimal excrement, including poultry litter, which is produced at an agricultural operation. The term includes materials such as bedding and raw materials which are commingled with that excrement.
MEDICAL MARIJUANAMarijuana for certified medical use as legally permitted by the commonwealth and the provisions of the Act.

MEDICAL MARIJUANA DELIVERY VEHICLE OFFICEAny facility used to house delivery vehicles for supplying marijuana plants or seeds to one or more grower/processor facilities and/or dispensary facilities.

MEDICAL OFFICEA use providing consultation, diagnosis, therapeutic, preventive or corrective personal treatment services by doctors, dentists, medical and dental laboratories and similar practitioners of medical and healing arts for humans licensed for such practice by the State of Pennsylvania.
MEMBERSHIP CLUB OR CAMPAn association of persons which owns, leases or occupies an establishment operated solely for a recreational, social, fraternal, religious, political or athletic purpose and whose activities are confined to the members and guests and are not extended to the general public (including the establishment so operated). But it does not include such clubs and camps whose chief activity is a service carried on primarily for business or gain.
METAL FABRICATIONAll activities, including minor welding, involved in the assembly, altering, servicing, repairing, warehousing or storing, or adapting for sale of previously prepared metal products.
MINERAL EXTRACTIONThe removal from the surface or beneath the surface of the land of bulk mineral resources using significant machinery. This use also includes accessory stockpiling and processing of mineral resources. Mineral extraction includes but is not limited to the extraction of sand, gravel, topsoil, limestone, sandstone, oil, coal, clay, shale and iron ore. The routine movement of and replacement of topsoil during construction shall not by itself be considered to be mineral extraction.
MOBILE HOMEA transportable, single-family dwelling intended for permanent occupancy, contained in one unit or two or more units designed to be joined into one integral unit capable of again being separated for repeated towing, which arrives at a site complete and ready for occupancy except for minor and incidental unpacking and assembly operations, and constructed so that it may be used without a permanent foundation.

MOBILE HOME LOTA parcel of land in a mobile home park, improved with the necessary utility connections and other appurtenances necessary for the erection thereon of a single mobile home.

MOBILE HOME PARKA parcel, or contiguous parcels, of land which has been so designated and improved that it contains two or more mobile home lots for the placement thereon of mobile homes.

MOTELA building or group of buildings containing individual rooms or accommodations, each of which is provided with a separate exterior entrance and a parking space and is offered principally for temporary occupancy by motor vehicle travelers (including auto courts, motor courts, motor inns and motor lodges).
MOTOR FREIGHT TERMINALThe building plus contiguous space to which freight is brought for transfer, assembly and sorting for shipment by motor truck.
NATURAL RESOURCEExisting natural elements relating to land, water, air, plant and animal life, including but not limited to soils, geology, topography, surface and subsurface waters, wetlands, vegetation, and animal habitats.
NOISEThe intensity, duration, and character of sound from any and all sources.
NONCONFORMING BUILDINGA building or part of a building manifestly not designed to comply with the applicable use or extent of use provisions in this chapter or amendment heretofore or hereafter enacted, where such building lawfully existed prior to the enactment of such ordinance or amendment or prior to the application of such ordinance or amendment to its location by reason of annexation.
NONCONFORMING LOTA lot which does not conform to the minimum width, depth or area dimensions specified for the district where such lot is situated, but was lawfully in existence at the time of enactment of this chapter or is legally established through the granting of a variance by the Board. Contiguous nonconforming lots under common ownership shall be considered one lot.
NONCONFORMING STRUCTUREA structure or part of a structure manifestly not designed to comply with the applicable use or extent of use provisions in this chapter or amendment heretofore or hereafter enacted, where such structure lawfully existed prior to the enactment of such ordinance or amendment or prior to the application of such ordinance or amendment to its location by reason of annexation. Such nonconforming structures include but are not limited to nonconforming signs.
NONCONFORMING USEA use which does not comply with the applicable use provisions of this chapter but which was lawfully in existence prior to the enactment of this chapter.
NUISANCEAny thing, condition, or conduct that endangers health and safety, or unreasonably offends the senses, or obstructs the free use and comfortable enjoyment of property, or essentially interferes with the comfortable enjoyment of life.
NURSING HOMEA licensed establishment which provides full-time convalescent or chronic care for three or more individuals who are not related by blood or marriage to the operator and who, by reason of chronic illness or infirmity, are unable to care for themselves. No care for the acutely ill or surgical or obstetrical services shall be provided in such a home.
OCCUPANCYThe purpose for which a building or portion thereof is utilized or occupied.

OFFICEA use that involves administrative, clerical, financial, governmental or professional operations and operations of a similar character. This use shall include neither retail nor industrial uses, but may include business offices, medical offices, laboratories, photographic studios and/or television or radio broadcasting studios.
OFFICIAL MAPThe Official Map as adopted or amended by the Board of Supervisors showing the characteristics of streets, watercourses and public grounds.
OFFICIAL ZONING MAPThe map as adopted or amended by the Board of Supervisors which designates the location and boundaries of zoning districts.
OPEN SPACEThe unoccupied area of a lot. Open space does not include the areas of principal and accessory structures, streets, driveways and parking areas, but may include areas occupied by walkways, patios and porches without roofs, playgrounds and other areas occupied by outdoor recreation or play apparatus, gardens and trees.
OPEN SPACE, COMMONA parcel or parcels of land or an area of water or a combination of land and water within a development site designed and intended for the use or enjoyment of residents of a development, not including streets, off-street parking areas and areas set aside for public facilities.
OPEN SPACE, USABLEOpen space of a lot or tract used for residential purposes, exclusive of required front and side yard areas, which is suitable for specified use(s) or as outdoor open space for the residents.
ORCHARDA group of fruit or nut trees, either small and diverse and grown for home use, or large and uniform (i.e., of one variety) and cultivated for revenue. Such a collection must be planted, managed, and renewed by the household or farmer and should not be confused with a naturally occurring grove.
ORDINANCEThe Moore Township Zoning Ordinance of 2010, or any provisions or amendment thereof, enacted by the Board of Supervisors, including the Official Zoning Map.
OUTDOOR STORAGEThe storage of any material for a period greater than 24 hours, including items for sale, lease, processing, and repair (including vehicles) not in an enclosed building.
OUTDOOR STORAGE, BULKGoods for sale, storage, or display that have a large size, mass, or volume and are not easily moved or carried, such as railroad ties, large bags of feed, or fertilizer, wood, etc.
OUTDOOR STORAGE, NONBULKGoods for sale, storage, or display that are distinguished from bulk items by being small in size or volume and not requiring a mechanical lifting device to move them. Includes such items as bikes, lightweight furniture, lawn accessories, and other items that can easily be moved indoors during close of business.
OVERLAY ZONING DISTRICTAn area where certain additional requirements are superimposed upon a base zoning district or underlying district and where the requirements of the base or underlying district may or may not be altered.
PARKAny area which is predominantly open space, is used principally for active or passive recreation and is not used for a profit-making purpose.
PARKING FACILITIESAny public or private land area designed and used for parking motor vehicles including parking lots, garages, private driveways, and legally designated areas of public streets.
PATIOAn area or courtyard which is not covered by a roof or permanent awning and is designed for outdoor living purposes as an accessory use to a structure.
PAVEDGround covered with stone, brick, concrete, asphalt, gravel, iron ore, or other substantial matter making a firm, smooth, and level surface.
PERFORMANCE BONDAn agreement by a subdivider or developer with the Township for the amount of the estimated construction cost guaranteeing the completion of physical improvements according to plans and specifications within the time prescribed by the subdivider's agreement.
PERFORMANCE GUARANTEEFinancial security which may be accepted by the Township in lieu of a requirement that certain improvements be made by a developer before a plat is approved (including letters of credit, performance bonds, escrow agreements and other similar collateral or surety agreements).
PERMITA document issued by the proper Township authority authorizing the applicant to undertake certain activities.
A. ZONING PERMITA permit issued indicating that a proposed use, building or structure is in accordance with this chapter, which authorizes an applicant to proceed with said use, building or structure.
B. BUILDING PERMITA permit indicating that a proposed construction, alteration or reconstruction of a structure is in accordance with the construction provisions of any building code which may be adopted by the Township, which authorizes an applicant to commence with said construction, alteration or reconstruction.
C. OCCUPANCY PERMITA permit issued upon completion of the construction of a structure or change in use of a structure or parcel of land or reoccupancy of a structure or land indicating that the premises comply with the provisions of this chapter and may be used for the purposes set forth in the occupancy permit.
PERMITTED USEAny use which does not require special action by the Zoning Hearing Board or by the Planning Commission before a zoning permit is granted by the Zoning Officer.
PERSONAn individual, partnership, organization, association, trust or corporation. When used in a penalty provision, "person" shall include the members of such partnership, the trustees of such trust and the officers of such organization, association or corporation.
PERSONAL SERVICESPlaces primarily providing services oriented to personal needs which do not involve retail sales or professional advisory services. Personal services include barber- and beauty shops, shoe repair shops, household appliance repair shops and other similar establishments.
PLACE OF WORSHIPBuildings, synagogues, churches, religious retreats, monasteries, seminaries and shrines used primarily for religious and/or spiritual worship for more than 10 persons at a time and that are operated for nonprofit and noncommercial purposes. If a religious use is primarily residential in nature, it shall be regulated under the appropriate dwelling type.
PLAN or PLATA map or chart indicating the subdivision or resubdivision of land which, in its various stages of preparation, can include the following:
A. SKETCH PLANAn informal plan, identified as such with the title "sketch plan" on the map, indicating existing features of a tract and its surroundings and the general layout of the proposed subdivision.
B. PRELIMINARY PLANA complete plan, identified as such with the title "preliminary plan," accurately showing proposed streets and lot layout and such other information as required by this chapter.
C. FINAL PLANA complete and exact plan, identified as such with the title "final plan," prepared for official recording as required by this chapter to define property rights and proposed streets and other improvements.
PLANT NURSERYAn operation for the cultivating, harvesting, and sale of plants, bushes, trees, and other nursery items grown on site or established in the ground prior to sale, and for related accessory sales and uses.
PORCHA roofed or unroofed structure projecting from the front, side or rear wall of a building.
PRINCIPAL USEThe predominate or main use of the lot. The landowner shall declare the principal use at the time of any application to the Zoning Officer.
PRINTINGProcess, or business of producing printed material by means of inked type and a printing press or by similar means. Includes printing, publishing, binding and similar operations.
PROFESSIONAL OFFICEAn office maintained for the conduct of a licensed profession, including but not limited to an accountant, architect, author, community planner, dentist, engineer, insurance agent, landscape architect, lawyer, minister, notary, optometrist, physician or realtor.
PROTECTION RATEThe percentage of an area of natural resource that must remain undisturbed.
PUBLIC NOTICENotice published once each week for two successive weeks in a newspaper of general circulation in the Township. Such notice shall state the time and place of the hearing and the particular nature of the matter to be considered at the hearing. The first publication shall not be more than 30 days and the second publication shall not be less than seven days from the date of the hearing.
QUARRYAny natural or excavated opening in the ground from which clay, gravel, slate, limestone, sandstone or other rocks or minerals or material are obtained by stripping, digging, blasting or other means, except for anthracite or bituminous coal stripping. "Blasting" shall mean the explosion of dynamite, black powder, fuse, blasting cap, detonators, electric squibs or other explosives as defined in the Regulation for Pits and Quarries, 1959 edition, issued by the Commonwealth of Pennsylvania through the Department of Labor and Industry, as amended.
RECREATION VEHICLEA vehicle of any size, which is designed as a temporary dwelling for travel, recreational and vacation uses and which is self-propelled or is designed to be towed or carried by another vehicle (including campers, pickup coaches, travel trailers and motor homes).
REGISTRYThe registry established by the DOH for all medical marijuana organizations and practitioners in the commonwealth pursuant to the provisions of the Act.

RESEARCH LABORATORYA building or group of buildings in which are located facilities for scientific research, investigation, testing or experimentation, but not facilities for the manufacture or sale of products, except as incidental to the main purpose of the laboratory.
RESORTA building or group of buildings located on a lot containing 10 acres or more combining lodging of members and guests, service of food to lodgers and/or nonlodgers, retail sale of commodities and services and facilities for educational activities and recreation for lodgers and/or nonlodgers.
RESTAURANTA building in which food is prepared and served to the public for consumption within the building.
RETAIL STORESale or rental of commonly used goods, and merchandise for personal or household use. Typical uses include department stores, apparel stores, furniture stores and establishments providing the following products or services: household cleaning and maintenance products, drugs, cards, stationary, notions, books, tobacco products, cosmetic and specialty items; flowers, plants, hobby materials, toys and handcrafted items; apparel, jewelry, fabrics and like items; cameras, photography services, household electronic equipment, sporting equipment, kitchen utensils, home furnishings and appliances, art supplies and framing, arts, antiques, paint and wallpaper, carpeting and floor covering, interior decorating services, office supplies, bicycles and auto parts (inside a building with no repair services).
RIDING STABLEThe commercial boarding or hacking of six or more horses.
RIGHT-OF-WAYLand reserved for the public or the abutting owners for use as a street, alley, interior walk or for other public purposes.
RIPARIAN BUFFERA vegetated buffer strip along a watercourse that filters stormwater and provides wildlife habitat.
ROOMING HOUSE or BOARDINGHOUSEA situation or building in which an owner of a dwelling rents at least one but not more than six rooms for residential purposes, but does not furnish meals.
RUNOFFThe rainfall, snowmelt, or irrigation water flowing that has not evaporated or infiltrated into the soil, but flows over the ground surface.
SANITARY FACILITIESAll of the following: a sink with piped water, a toilet and a bathtub or shower.
SCHOOLAny use, building, or structure, which is held, used or controlled exclusively for 1) public educational purposes by the local school district or other governmental entity; 2) a charter school; or 3) a private school, which is defined as an individual, association, copartnership, or corporation, or department, division, or section of such organizations, that designates itself as an educational center that includes kindergarten, elementary, or secondary schooling below college level and that provides instructional services. A private school may be a parochial, religious, denominational, for-profit, or not-for-profit school.
SCREENA screen or obstruction of sufficient height (but not less than six feet high) to effectively visually obscure the area being screened from adjoining areas.
SETBACKThe minimum distance by which any building or structure must be separated from a street right-of-way or lot line.
SEWAGE DISPOSAL SYSTEM, CENTRALIZED/ON-LOTA public utility system or other system designed to collect, centrally treat and dispose of sewage from users in compliance with regulations of the appropriate state agency and of the Township. Any system which is not a centralized sewage disposal system shall be deemed an on-lot system. A centralized sewage disposal system shall also include a "community on-lot disposal system" as defined by the Department of Environmental Protection.
SEWER CONNECTIONThe connection consisting of all pipes, fittings and appurtenances from the drain outlet of a dwelling or building to the inlet of the street or main collector sewer pipe of the sewerage system serving the subdivision or land development.
SHOPPING CENTERA group of retail and other commercial establishments that is planned, owned and managed as a single property. On-site parking is provided for customers and employees.
SHORT-TERM RENTALAny dwelling unit owned or managed by a person or entity which is rented or leased to a transient visitor for a period of less than 30 days. This term shall not include a hotel as that term is defined in this chapter.

SIGNA visual display which is affixed to, painted or represented directly or indirectly upon a building, structure, wall or land and which directs attention to an object, product, place, activity, person, institution, organization or business. A sign shall not include any display of official court or public office notices nor any traffic control device nor the flag, emblem or insignias of a nation, state, county, municipality, school or religious group.
A. OFF-PREMISES SIGNA sign which directs attention to a business, commodity, service or entertainment conducted, sold or offered elsewhere than upon the premises where the sign is located or to which it is affixed.
(1) OFF-PREMISES DIRECTIONAL SIGNA sign indicating the location of a business, service or use which does not exceed six inches in height and 36 inches in width and employs white block lettering not exceeding four inches in height on a green (PMS) background.
B. ON-PREMISES SIGNA sign which directs attention to a business, profession or industry conducted on the premises or to products sold, manufactured or assembled upon the same premises upon which it is displayed or to which it is affixed (including signs offering premises for sale, rent or development or advertising the services of professionals or advertising building trades during construction or alteration).
(2) CHARITABLE/COMMUNITY SERVICE IDENTIFICATION SIGNA sign identifying the name of the charitable or community service organization (including churches, volunteer fire companies and other nonprofit organizations) and/or a commodity or service provided by such organization.
D. PARALLEL SIGNA sign which is attached to or is part of the facade of a building and does not extend more than one foot from such facade.
E. PROJECTING SIGNA sign which is attached to the facade of a building and extends more than one foot, but not more than six feet, from such facade.
F. WINDOW SIGNA sign affixed to or visible through a window of a building.
SIGN, GROSS SURFACE AREA OFThe entire area within a single continuous perimeter enclosing the extreme limits of such sign and in no case passing through or between any adjacent elements of the same. However, such perimeter shall not include any structural or framing elements lying outside the limits of such sign and not forming an integral part of the display.
SITE ALTERATIONIncludes regrading the existing topography, filling lakes, ponds, marshes or floodplains, clearing vegetation or altering watercourses.
SITE AREAAll land area within the site as defined by the deed and determined by a site survey.
SITE AREA, BASEThe site area minus existing road and utilities rights-of-way, land which is not contiguous or is separated from the parcel by a road or other public easement, and land shown on a previous subdivision or land development plans as reserved from development for natural resource reasons, recreation and/or open space preservation.
SITE AREA, NET BUILDABLEThe area of a tract of land remaining after subtracting land which is not contiguous, land within existing rights-of-way, land within required rights-of-way, land within easements and covenants, and area identified as resource protection land [as determined in §
300-35C(2)(b)].
SLAUGHTERHOUSEA use involving the killing of animals for the production of food or some other commercial product. A commercial stockyard or similar facility that primarily involves the bulk storage or transferring of animals on the way to slaughter shall also be considered a slaughterhouse. This shall not include a custom butcher shop that does not involve the killing of animals which is a retail sales use.
SLOPEThe degree of deviation of a surface from the horizontal, usually expressed in percent or degrees.
SOIL SURVEYA scientific survey of soil conditions and characteristics prepared by an engineer or soil scientist and approved or certified by the United States Soil Conservation Service.
SOLAR COLLECTORAny object that uses solar radiation for a useful purpose, including but not limited to windows, walls, roofs and collectors.
SOLAR ENERGY FACILITYAn electric generating facility, whose main purpose is to generate and supply electricity on a large-scale and consists of one or more solar energy systems and other accessory structures and buildings, including substations, electrical infrastructure, transmission lines and other appurtenant structures and facilities. A solar energy facility is a system which has a rated capacity of more than 18 kilowatts or that has a lot coverage collector area of more than 1,000 square feet.

SOLAR ENERGY SYSTEMA solar collector or other device or structural design feature of a structure that relies upon sunshine as an energy source and is capable of collecting, distributing, and storing (if appropriate to the technology) the sun's radiant energy for beneficial use. A Solar Energy System shall consist of one or more roof- and/or ground-mounted solar collection device(s) with solar related equipment, which has a rated capacity of less than or equal to 18 kilowatts or that has a lot coverage collector area of less than or equal to 1,000 square feet and is intended to primarily reduce and supplement on-site consumption of utility power.

SPECIAL EXCEPTION USEA use for which the Zoning Hearing Board may grant permission following a public hearing and findings of fact consistent with this chapter, provided that the use complies with the conditions and standards required by this chapter.
STEEP SLOPESAreas of 3,000 square feet or greater which have a slope which is greater than 8% and which, because of the slope, are subject to higher rates of stormwater runoff and, therefore, erosion.
STORMWATERThe flow of water which results from precipitation and which occurs immediately following rainfall or snowmelt.
STORMWATER MANAGEMENTThe system, or combination of systems, designed to treat stormwater, or collect, convey, channel, hold, inhibit, or divert the movement of stormwater on, through, and from a site.
STORY AND HALF STORYThat portion of a building included between the surface of any floor and the ceiling next above it and having a vertical distance of not less than seven feet shall be considered a full story. Any such portion of a building having a distance of less than seven feet shall be considered a half story. Basements shall be considered full stories while cellars shall not be considered as being stories or half stories.
STREAMA channel such as river or creek that carries flowing surface water, including perennial streams and intermittent streams with defined channels, and excluding man-made irrigation and drainage channels.
STREAMSIDE SETBACK AREAThose areas within 100 feet of each side of a year-round or intermittent stream as measured by field survey from the top of bank of the defined water flow channel.
STREETA public or private thoroughfare which affords the principal means of access to abutting property, including avenue, place, way, parkway, drive, lane, boulevard, highway, road and any other thoroughfare except an alley.
A. EXPRESSWAYDesigned for large volumes of high-speed through traffic with access limited to selected grade-separated or at-grade intersections.
B. ARTERIAL STREETDesigned primarily to carry traffic and generally should not provide access to land which would interfere with their primary traffic functions. They are also designed for medium to heavy volumes at moderately high speeds with restricted vehicular access to abutting properties.
C. COLLECTOR STREETDesigned to carry a moderate volume of traffic between local streets and arterials and provide only limited vehicular access to the abutting properties.
D. LOCAL STREETDesigned to provide direct access to abutting properties or gather traffic from marginal access streets and provide routes to collector streets.
E. LOCAL ACCESS STREETDesigned to provide direct access to individual uses. They serve to provide the connecting link between the beginning or end point of a trip and the higher categories of streets. Local access streets are further classified as:
(1) CUL-DE-SAC STREETA street which is permanently terminated at one end by a vehicular turnaround and intersects another street at the other end. Cul-de-sac streets have a maximum length of 1,000 feet and furnish access to no more than 20 lots or ultimately have an average daily traffic count in excess of 200 vehicles. The length of a cul-de-sac street shall be measured from the center of the intersecting road to the center of the cul-de-sac.
(2) LOOP STREETA street which intersects other streets on each end and may intersect a cul-de-sac street at some point between each end. A loop shall not ultimately furnish access to more than 75 dwelling units or ultimately have an average daily traffic count in excess of 600 vehicles.
F. ACCESS STREETDesigned to provide access from a residential lot only to an approved street where the residential lot does not have frontage on an approved street. The access street shall have a minimum right-of-way of 50 feet.
STRUCTURAL ALTERATIONAny change in the structural parts of a structure, such as walls, columns, beams, girders, floors, roof or ceiling, or any addition to any structure or the moving of a structure from one location to another. Structural alteration does not include normal maintenance or minor repairs or improvements as defined in the Township Building Permit Ordinance.
STRUCTUREAny man-made object having an ascertainable, stationary location on or in land or water, whether or not affixed to the land. The term "structure" shall include buildings, signs, fences, walls, towers, swimming pools and similar structures. "Structure" shall be interpreted as including the words "or part thereof."
SUBDIVISIONThe division or redivision of a lot, tract or parcel of land by any means into two or more lots, tracts, parcels or other divisions of land, including changes in existing lot lines for the purpose, whether immediate or future, of lease, partition by the court for distribution to heirs or devisees, transfer of ownership or building or lot development; provided, however, that the subdivision by lease of land for agricultural purposes into parcels of more than 10 acres, not involving any new street or easement of access or any residential dwelling, shall be exempted.
SUBDIVISION, MINORA. A subdivision:
(1) Into not more than three lots;
(2) Which involves no extension of municipal water or sewer facilities, no new road or street (other than access street); and
(3) Which provides for and does not adversely affect the potential development of the remainder of the tract.
B. A subdivision for the purpose of joining or annexing a lot to an existing lot, parcel or tract of land and which provides a covenant in the deed of the lot to be conveyed which joins it with and makes it an inseparable part of the parcel to which it is joined.
C. A subdivision of any lot which has undergone three successive minor subdivisions shall comply with the requirements of a major subdivision.
D. Approval of successive minor subdivisions of a tract of land shall be separated by a minimum of one year (i.e., one minor subdivision per tract of land per year).
SWIMMING CLUBBuildings and grounds owned by a nonprofit organization used for swimming for recreational purposes by members who are invited or elected to join with the use of the facilities restricted to members and their guests and not open to the general public.
SWIMMING POOLA body of water or receptacle for water having a depth at any point greater than 30 inches which is primarily used or intended to be used for swimming or bathing.
TARGET RANGEAn area or structure specially designed for the safe use of archery and/or the discharging of rifles, shotguns, pistols, silhouettes, skeet, trap, black powder, or any similar firearm for the purpose of sport shooting or military/law enforcement training.
TAVERNA place where alcoholic beverages are served as a primary or substantial portion of the total trade. The sale of food may also occur.
TEMPORARY BUILDINGA building which is not designed to last or to be used for more than one year.
TEMPORARY OR SEASONAL OCCUPANCYThe use of any premises, building or structure for living and/or sleeping purposes for less than 100 consecutive days in any calendar year.
TEMPORARY STRUCTUREA structure which is not permitted to last or to be used for a specific use for more than one year.
TENNIS CLUBBuildings and grounds owned by a nonprofit organization used for tennis for recreational purposes by members who are invited or elected to join with the use of the facilities restricted to members and their guests and not open to the general public.
TEXTILE INDUSTRYIndustrial use that transforms basic fiber (natural or synthetic) into a product, such as yarn or fabric, that is further manufactured into usable items, such as apparel, sheets, towels, and textile bags for individual or industrial consumption. Main processes include preparation and spinning of fiber, knitting or weaving of fabric, and the finishing of the textile. Establishments that make textile products (except apparel) by generally cutting and sewing (e.g., purchasing fabric and cutting and sewing to make nonapparel textile products, such as sheets and towels). Processes include cutting and sewing and the manufacture of garments in establishments that first knot fabric and then cutting and sewing the fabric into a garment.
TOURIST HOMEA dwelling in which at least one but not more than six rooms are offered for overnight accommodations for transient guests, for compensation.
TOWNSHIPThe Township of Moore, Northampton County, Pennsylvania.
TRADE SCHOOLA facility that is primarily intended for education of a work-related skill or craft or a hobby that does not primarily provide state-required education to persons under age 16. This shall include a dancing school, martial arts school or ceramics school.
TRAILERSee "mobile home dwelling" (under "dwelling") and "recreation vehicle."
TRANSIENT VISITORAn occupant of a dwelling unit or bedroom for not more than 30 days, unless the occupant is related to the owner as married spouse, parent or child, grandparent or grandchild, or brother or sister.

TRANSPORTATION TERMINALA facility for loading, unloading, and interchange of passengers and baggage between modes of transportation, including bus stations, taxi terminals, and public transit facilities.
USEThe purpose for which land, a sign, a structure or a building is arranged, designed or intended, or for which it may be occupied or maintained, or any activity, occupation, business or operation which may be carried on.
UTILITY SUBSTATIONA structure or facility which collects, processes and/or distributes a public utility commodity, not including wireless telecommunication services. Substations may include on site generators for emergency use only and not for distribution to the surrounding area.
VARIANCEA granting of permission to use or alter land or structures which requires a variation from the strict application of a requirement of this chapter. Variances are granted only in the case of exceptionally irregular, narrow, shallow or steep lots or other exceptional physical conditions, whereby strict application of regulations would result in practical difficulty and unnecessary hardship. Variances are granted only if specific requirements are met. A variance may not be granted to permit a use which is not permitted in the zoning district involved.
VETERINARIAN OFFICEA facility for the medical treatment of small domestic animals, which is staffed by a least one doctor of veterinary medicine, and which meets the following additional requirements:
A. Proper waste disposal with no detectable odors beyond the property line;
B. No outdoor dog runs or play areas;
C. No indoor or outdoor boarding of animals, except for indoor boarding directly related to medical treatment; and
D. Verification is provided to the Township that the building design or construction will prevent noise from animals being audible from adjacent properties or tenants.
WAREHOUSEA building or group of buildings primarily used for indoor storage, transfer and distribution of products and materials, but not including retail uses or a truck terminal. The term "warehouse" shall include distribution facility, fulfillment center, logistics facility and similar uses.

WATER CONNECTIONThe connection consisting of all pipes, fittings and appurtenances from the water pipe to the inlet pipe of the distribution system within the dwelling or nonresidential unit.
WATER SUPPLY SYSTEM, CENTRALIZED/ON-LOTA public utility system or other system designed to transmit water from a common source to users in compliance with the requirements of the appropriate state agencies and the Township. Any system not deemed a centralized water supply system shall be an on-lot system.
WATERCOURSEA discernible, definable natural course or channel along which water is conveyed ultimately to streams and/or rivers at lower elevations. A watercourse may originate from a lake or underground spring(s) and be permanent in nature or it may originate from a temporary source such as runoff from rain or melting snow.
WETLANDSAreas of undrained, saturated soils, supporting wetland vegetation, where the water table is at or near the surface or where shallow water covers the site due to permanent or seasonal inundation of surface water or groundwater or other areas meeting the wetlands criteria set by the Department of Environmental Protection or the United States Army Corps of Engineers.
WIND ENERGY FACILITYAn electric-generating facility whose main purpose is to supply electricity, consisting of one or more wind turbines and other accessory structures and buildings, including substations, meteorological towers, electrical infrastructure, transmission lines and other appurtenant structures and facilities.
WIND TURBINEA wind energy conversion device that produces electricity; typically three blades rotating about a horizontal access and positioned up-wind of the supporting tower.
WOODLANDSAreas of one acre or greater which contain an average of one or more trees measuring six inches in caliper or greater, per 5,000 square feet. All associated layers of growth, including but not limited to, the canopy, understory and floor, shall be considered as part of the woodland.
YARDAn open space on the same lot with a building or group of buildings which lies between the principal building or group of buildings and the nearest lot line and which is unoccupied and unobstructed from the ground upward except as herein permitted.
A. FRONT YARDA yard extending the full width of the lot between a building and the front lot line or side street lot line.
B. REAR YARDA yard extending the full width of the lot between a building and a rear lot line.
C. SIDE YARDA yard extending from the front yard to the rear yard between a building and the nearest side lot line.
ZONING AMENDMENTA change in the wording, context, or substance of this title or a change in the zoning or district boundaries of the Official Zoning Map, to be made part of this title.
