ARTICLE X

- INTERPRETATION, CONFLICT AND VALIDITY

Sec. 42-295. - Interpretation.

In their interpretation and application, the provisions of this chapter shall be held to be minimum requirements adopted for the promotion of the public health, safety, morals, or general welfare. Whenever the requirements of this chapter are at variance with the requirements of any other lawfully adopted rules, regulations, ordinances, deed restrictions or covenants, the most restrictive or that imposing the higher standards shall govern.

Sec. 42-296. - Validity.

Should any section or provision of this chapter be declared by the courts to be unconstitutional or invalid, such decision shall not affect the validity of this chapter as a whole, or any part thereof other than the part so declared to be unconstitutional or invalid.

Sec. 42-297. - Repeal of conflicting ordinances.

Ordinance No. 752 of the city, dated November 1997, titled "Zoning Ordinance and Flood Hazard Ordinance" as related to zoning; Ordinance No. 892, dated May 2001, and all amendments thereto are hereby repealed. This chapter shall become effective 30 days after adoption of the ordinance from which this chapter is derived.
