DISTRICT REGULATIONS

§ 155.20 FD - FUTURE DEVELOPMENT DISTRICT.

   (A)   Purpose. The purpose of this district is to classify newly annexed land which is near the development stage. Existing agricultural and residential uses will be protected until urbanization warrants a zoning change.
   (B)   Use regulations. The following uses are permitted in this district:
      (1)   Single-family residential dwelling;
      (2)   Church or other place of public worship;
      (3)   Community center (public);
      (4)   Farm or ranch;
      (5)   Institutions of a religious or philanthropic nature;
      (6)   Private country club with golf course;
      (7)   Public golf course;
      (8)   Public park or playground;
      (9)   Public playfield or stadium;
      (10)   Other uses as designated in § 155.45
   (C)   Development regulations.
      (1)   Lot requirements. (Minimum figures)
         (a)   Lot area: At least 10,000 square feet;
         (b)   Lot width: 70 feet;
         (c)   Lot depth: 100 feet;
      (2)   Yard requirements. (Minimum figures)
         (a)   Front yard: 25 feet;
         (b)   Side yard:
            1.   Interior lot: 7 feet;
            2.   Exterior lot: 10 feet;
         (c)   Rear yard: 25 feet;
      (3)   Height requirements. 
         Maximum building height: 35 feet;
      (4)   Spatial controls.
         Minimum floor space per dwelling: 1,200 square feet.
   (D)   Parking. Off-street parking and loading regulations: see § 155.47.

§ 155.21 SF-1 - SINGLE-FAMILY RESIDENTIAL DISTRICT.

   (A)   Purpose. The purpose of this district is to establish areas for larger than average size homes at a lower than average population density. This district is intended to provide a high degree of privacy and seclusion for its residents.
   (B)   Use regulations. The following uses are permitted in this district:
      (1)   Single-family detached dwelling;
      (2)   Community center (public);
      (3)   Park or playground (public);
      (4)   Public golf course;
      (5)   Public stadium;
      (6)   Other uses as designated in § 155.45.
   (C)   Development regulations.
      (1)   Lot requirements. (Minimum figures)
         (a)   Lot area: At least 10,000 square feet;
         (b)   Lot width: 70 feet;
         (c)   Lot depth: 100 feet.
      (2)   Yard requirements. (Minimum figures)
         (a)   Front yard: 25 feet;
         (b)   Side yard:
            1.   Interior lot: 7 feet;
            2.   Exterior lot: 10 feet;
         (c)   Rear yard: 25 feet.
      (3)   Height requirements.
         Maximum building height: 35 feet.
      (4)   Spatial controls.
         Minimum floor space per dwelling unit: 1,200 square feet.
   (D)   Parking regulations. 
      (1)   Each dwelling will provide off-street parking for two automobiles or other vehicles not to exceed 3/4 ton in capacity.
      (2)   Off-street parking and loading regulations: see § 155.47.

§ 155.22 SF-2 - SINGLE-FAMILY RESIDENTIAL DISTRICT.

   (A)   Purpose. The purpose of this district is to establish residential areas of average urban density. This district should serve as a zone of transition between lower and higher density residential areas.
   (B)   Use regulations. The following uses are permitted in this district:
      (1)   Any use permitted in the “SF-1” District;
      (2)   “SF-2” dwellings;
      (3)   Other uses as designated in § 155.45.
   (C)   Development regulations.
      (1)   Lot requirements. (Minimum figures)
         (a)   Lot area: At least 7,000 square feet;
         (b)   Lot width: 50 feet;
         (c)   Lot depth: 100 feet.
      (2)   Yard requirements. (Minimum figures)
         (a)   Front yard: 25 feet;
         (b)   Side yard:
            1.   Interior lot:
            2.   Exterior lot: 10 feet;
         (c)   Rear yard: 25 feet.
      (3)   Height requirements.
         Maximum building height: 35 feet.
      (4)   Spatial control.
         Minimum floor space per dwelling unit: 800 square feet.
   (D)   Parking regulations.
      (1)   Same as “SF-l” District.

§ 155.23 TF - TWO-FAMILY RESIDENTIAL DISTRICT.

   (A)   Purpose. The purpose of this district is to provide for two-family or duplex dwellings of a slightly higher density than the single-family districts. This district may encompass an entire neighborhood or may serve as a zone of transition between low density and high density residential areas.
   (B)   Use regulations. The following uses are permitted in this district:
      (1)   Any use permitted in the “SF-2” Residential District;
      (2)   Attached dwelling units, provided that no more than two dwelling units are attached in one continuous row or group and that no dwelling unit is constructed above another dwelling unit;
      (3)   Other uses as designated in § 155.45.
   (C)   Development regulations.
      (1)   Lot requirements. (Minimum figures)
         (a)   Lot area: At least 7,500 square feet;
         (b)   Lot width: 50 feet;
         (c)   Lot depth: 100 feet.
      (2)   Yard requirements. (Minimum figures)
         (a)   Front yard: 25 feet;
         (b)   Side yard:
            1.   Interior lot: 5 feet;
            2.   Exterior lot: 10 feet;
         (c)   Rear yard: 25 feet.
   (D)   Parking regulations.
      (1)   Two spaces for each dwelling unit (total of four) shall be provided.
      (2)   Off-street parking and loading regulations: see § 155.47.

§ 155.24 MF - MULTI-FAMILY RESIDENTIAL DISTRICT.

   (A)   Purpose. The purpose of this district is to provide for multi-family dwellings of a low to moderate density. Multi-family developments should be designed to ensure compatibility with adjacent uses in the area, including residential dwellings. This district may encompass an entire neighborhood or may serve as a zone of transition between lower density residential and business areas.
   (B)   Use regulations. The following uses are permitted in this district:
      (1)   Any use permitted in the “TF” Two-Family Residential District;
      (2)   Multi-family dwellings;
      (3)   Business and professional offices;
      (4)   Churches and other places of public worship;
      (5)   Day nursery or kindergarten school;
      (6)   Hospital (chronic care);
      (7)   Institutions of a religious and philanthropic nature;
      (8)   Library (public);
      (9)   Nursing home;
      (10)   Private school (primary or secondary);
      (11)   Public or parochial school (primary or secondary).
   (C)   Development regulations.
      (1)   Lot requirements. (Minimum figures)
         (a)   Lot area: At least 10,000 square feet;
         (b)   Lot width: 75 feet;
         (c)   Lot depth: 100 feet.
      (2)   Yard requirements. (Minimum figures)
         (a)   Front yard: 25 feet;
         (b)   Side yard:
            1.   Interior lot: 10 feet;
            2.   Exterior lot: 10 feet;
         (c)   Rear yard: 15 feet.
      (3)   Height Requirements.
         Maximum building height: 35 feet.
      (4)   Spatial controls.
         (a)   Minimum floor area:
            1.   Efficiency apartment: 450 square feet;
            2.   One bedroom apartment: 600 square feet;
            3.   Two bedroom apartment: 750 square feet;
            4.   Three or more bedrooms: 800 square feet;
         (b)   Maximum lot coverage: 65% by all buildings.
   (D)   Parking regulations. The parking requirements for this district are as follows:
      (1)   Business and professional offices other than medical or dental: One space for each 400 square feet of floor area.
      (2)   Churches and other places of worship: One space for each four seats in the main auditorium.
      (3)   Hospital: One space for each two beds, plus one space for each employee on the largest shift.
      (4)   Institutions of a religious and philanthropic nature: Ten spaces, plus one space for each employee.
      (5)   Library: Ten spaces, plus one space for each 300 square feet of floor area.
      (6)   Medical or dental clinic: One space for each 200 square feet of floor area.
      (7)   Multi-family dwelling: Two spaces for each dwelling unit.
      (8)   Nursing home: One space for each two beds.
      (9)   School, private or public: One space for each classroom, plus one space for each four seats in any auditorium, gymnasium or other place of assembly.
      (10)   Off-street parking and loading regulations: See § 155.47.

§ 155.25 MH - MOBILE HOME DISTRICT.

   (A)   Purpose. The purpose of this district is to establish a suitable environment for mobile home use and to eliminate the often negative impacts of these dwellings on adjacent areas.
   (B)   Use regulations.
      (1)   Mobile homes and travel trailers shall be located only in approved mobile home parks with the following exceptions:
         (a)   A mobile home may be used as an office structure on a lot doing business as, and licensed for, mobile homes and/or recreational vehicle sales;
         (b)   Travel trailers may be used as temporary offices on construction sites.
      (2)   A travel trailer, motor home or camper may be kept on the premises of a residential dwelling but may not be used as living quarters or for the conduct of business.
      (3)   The normal and customary accessory uses, including office and/or maintenance buildings for the mobile home park, recreation buildings, swimming pool, laundry and storage facilities for use by mobile home park residents and open recreation areas.
   (C)   Development regulations.
      (1)   Area and spacing requirements.
         (a)   A mobile home park shall be at least two acres in size and there shall be no more than 12 mobile homes per acre.
         (b)   There shall be at least a 20-foot space between mobile homes. When mobile homes are parked end-to-end, this space shall be not less than ten feet.
         (c)   Each mobile home shall be located at least 25 feet from the property lines of the mobile home park which abuts a public street or highway.
         (d)   Vehicular entrances to or exits from a mobile home park shall be at least 200 feet along streets from any school, public playground, church, hospital or library.
      (2)   Streets and walkways.
         (a)   Each mobile home park shall adjoin a public street and each mobile home lot shall have direct access to a private interior street at least 25 feet in width. The internal street or streets shall be continuous and connect with other internal streets or with public streets or be provided with a paved cul-de-sac.
         (b)   Internal access drives shall be provided to each mobile home space and shall be at least 25 feet in width.
         (c)   Walkways not less than two feet wide shall be provided from the mobile home lot to the service buildings within each mobile home park.
      (3)   Anchoring and storage.
         (a)   Each mobile home shall rest upon a concrete slab of sufficient strength to support the wheels and the front parking jack. Each slab shall be at least eight feet by ten feet and have a minimum thickness of four inches.
         (b)   Each mobile home shall be firmly anchored to the slab upon which it rests by means of tie-downs and anchors secured in accordance with regulations established by the Texas Manufactured Housing Standards Act.
         (c)   The area underneath a mobile home shall not be used for storage but shall be screened with material similar in composition and characteristics to that used to construct the mobile home.
      (4)   Landscaping and screening.
         (a)   All streets, drives and walkways within a mobile home park shall be surfaced with pavement in accordance with city specifications.
         (b)   Exposed ground surfaces throughout the mobile home park shall be completely and permanently landscaped. These surfaces shall be protected with a vegetative growth that is capable of preventing soil erosion and objectionable dust.
         (c)   In the event a mobile home park backs or sides upon a residential, business, commercial or industrial district, a solid screening fence at least six feet in height shall be erected along the property line between the two districts.
   (D)   Parking regulations.
      (1)   Two parking spaces for each mobile home lot, plus one additional space for each three lots shall be provided.
      (2)   Off-street parking and loading regulations: see § 155.47.

§ 155.26 NS - NEIGHBORHOOD SERVICE DISTRICT.

   (A)   Purpose. The purpose of this district is to provide limited convenience goods and personal services for persons in surrounding residential areas. Since this district is often an integral part of the residential area it serves, development regulations should complement those of adjacent uses.
   (B)   Use regulations. The following uses are permitted in the “NS” Neighborhood Service District:
      (1)   Any use permitted in the “MF” Multi-Family District;
      (2)   Art gallery or museum;
      (3)   Bakery or confectionery shop (retail);
      (4)   Barber or beauty shop;
      (5)   Book store;
      (6)   Cleaning and pressing shop (small retail);
      (7)   Drapery, needlework or weaving shop;
      (8)   Florist or garden shop;
      (9)   Food or grocery store (small retail);
      (10)   Handicraft or hobby shop;
      (11)   Laundry or cleaning (self-service);
      (12)   Office, professional and administrative;
      (13)   Pharmacy;
      (14)   Private country club with golf course;
      (15)   Studio for artist, photographer, musician or health specialist;
      (16)   Stationery or card shop;
      (17)   Tailor shop;
      (18)   University or college;
      (19)   Other related uses and those special uses designated in § 155.45.
   (C)   Development regulations.
      (1)   Lot requirements: None.
      (2)   Yard requirements: (Minimum figures)
         (a)   Front yard: 25 feet;
         (b)   Side yard:
            1.   Interior lot: None required except when adjoining a residential district, then 15 feet;
            2.   Exterior lot: 10 feet.
         (c)   Rear yard:None required where an alley exists on the rear of the lot, tract or plot; otherwise, a minimum rear yard of ten feet shall be provided. When adjoining a residential district, a minimum rear yard of 25 feet shall be provided. Where rail lines exist at the rear of lots or tracts occupied by industrial or commercial buildings, the buildings may be located for direct service by rail transportation.
      (3)   Height requirements:
         Maximum building height: 35 feet.
   (D)   Parking regulations. The parking regulations for the “MF” District shall apply, plus the following requirements:
      (1)   Retail or personal service: One space for each 200 square feet of floor area. Minimum of five spaces.
      (2)   Off-street parking and loading regulations: See § 155.47.

§ 155.27 GR - GENERAL RETAIL DISTRICT.

   (A)   Purpose. The purpose of this district is to provide specialty goods and business services for the surrounding community. This classification includes a wider range of business activities than the Neighborhood Service District and should provide for the development of shopping centers and office parks. The General Retail District should serve as a zone of transition between commercial and high density residential areas.
   (B)   Use regulations. The following uses are permitted in the General Retail District:
      (1)   Any use permitted in the “NS” Neighborhood Service District, except single-family and two-family dwellings;
      (2)   Animal hospitals (indoor soundproof kennels);
      (3)   Antique shops (inside display);
      (4)   Auto parts, sales and repair (new merchandise, inside display or inside repair);
      (5)   Bowling alley;
      (6)   Business and trade schools;
      (7)   Cafeteria;
      (8)   Gasoline service station and/or automobile laundry;
      (9)   Greenhouse or plant nursery;
      (10)   Hotels and motels;
      (11)   Household appliance service and repair (inside storage of merchandise only);
      (12)   Mimeograph, print or office supply;
      (13)   Mortuary or funeral parlor;
      (14)   Newspaper printing or job printing;
      (15)   Restaurants, including drive-in restaurants;
      (16)   Supermarket;
      (17)   Swim or tennis club;
      (18)   Television station or radio station;
      (19)   Theater, other than drive-in;
      (20)   Other specialty retail stores selling primarily new merchandise indoors, including electronic, furniture, hardware and discount stores;
      (21)   Other related uses and those special uses designated in § 155.45;
      (22)   Retail sales of welding supplies with screened and fenced storage facilities for gas cylinders;
      (23)   Mini-storage warehouse;
      (24)   Auto sales;
      (25)   Contractor shops with a maximum 2,000 square-feet floor area and no outside storage permitted.
   (C)   Development regulations.
      (1)   Lot requirements: None.
      (2)   Yard requirements:
         (a)   Front yard: 25 feet;
         (b)   Side yard:
            1.   Interior lot: None required except when adjoining a residential district, then 15 feet;
            2.   Exterior lot: 10 feet;
         (c)   Rear yard: None required where an alley exists on the rear of the lot, tract or plot; otherwise, a minimum rear yard of ten feet shall be provided. When adjoining a residential district, a minimum rear yard of 15 feet shall be provided. Where rail lines exist at the rear of lots or tracts occupied by industrial or commercial buildings, the buildings may be located for direct service by rail transportation.
      (3)   Height requirements:
         Maximum building height: 75 feet.
   (D)   Parking regulations. The parking requirements for this district are as follows:
      (1)   Business and professional offices other than medical or dental: One space for each 300 square feet of floor area.
      (2)   Bowling alley: Six spaces for each lane.
      (3)   Church or other place of public worship: One space for each four seats in the main auditorium.
      (4)   Gasoline service station: Six spaces minimum.
      (5)   High school or college: One space for each classroom, laboratory or instructional area, plus one space for each four students accommodated in the institution.
      (6)   Hospital: One space for each two beds, plus one space for each employee on the largest shift.
      (7)   Hotel or motel: One space for each room, unit or guest accommodation.
      (8)   Institutions of a philanthropic nature: Ten spaces, plus one for each employee.
      (9)   Library or museum: Ten spaces, plus one space for each 300 square feet of floor area.
      (10)   Medical or dental clinic: One space for each 200 square feet of floor area.
      (11)   Mortuary or funeral home: Ten spaces for each parlor.
      (12)   Nursing home: One space for each two beds.
      (13)   Places of public assembly not listed: One space for each three seats provided.
      (14)   Restaurant or cafeteria: One space for each three seats under maximum seating arrangement (minimum of five spaces).
      (15)   Retail or personal service: One space for each 200 square feet of floor area (minimum of five spaces).
      (16)   Schools, elementary or junior high: One space for each classroom, plus one space for each four seats in any auditorium, gymnasium or other place of assembly.
      (17)   Theaters or meeting rooms: One space for each three seats.
      (18)   Off-street parking and loading, regulations: See § 155.47.

§ 155.28 CB - CENTRAL BUSINESS DISTRICT.

   (A)   Purpose. The purpose of this district is to provide a high density mixture of retail and business services for the benefit of persons working or residing in the area. There will be only one contiguous CBD Central Business District.
   (B)   Use regulations. The following uses are permitted in this district:
      (1)   Any use permitted in the “GR” General Retail District, including single- and two-family dwellings;
      (2)   Commercial indoor amusement such as a billiard hall;
      (3)   Wholesale businesses, storage buildings and warehouses;
      (4)   Any other use or service which is similar to the uses herein listed and those specified in § 155.45.
   (C)   Development regulations.
      (1)   Lot requirements: None.
      (2)   Yard requirements:
         (a)   Front yard: No front yard is required except that a structure larger than one story must be set back from the property line two feet for each story, plus one foot for every ten feet of building width.
         (b)   Side yard: No side yard is required except that when a structure adjoins a residential district two feet for each story, plus one foot for each ten feet of building width shall be maintained.
         (c)   Rear yard: None required where an alley exists on the rear of the lot, tract or plot; otherwise, a minimum rear yard of ten feet shall be provided. Where rail lines exist at the rear of lots or tracts occupied by industrial or commercial buildings, the buildings may be located for direct service by rail transportation.
      (3)   Height requirements:
         Maximum building height: 75 feet.
   (D)   Parking regulations. None. Off-street parking and loading regulations: see § 155.47.

§ 155.29 C - COMMERCIAL DISTRICT.

   (A)   Purpose. This district is designed for intensive retail or commercial uses which serve a city- wide or regional area. The Commercial District should serve as a buffer zone between industrial development and general retail or multi-family areas.
   (B)   Use regulations. The following uses are permitted in this district:
      (1)   Any use permitted in the “GR” General Retail District;
      (2)   Amusement facility - indoor and outdoor;
      (3)   Animal hospital or clinic (outside kennels);
      (4)   Automobile, new or used sales (outside);
      (5)   Automobile painting, repair, seat cover, muffler installation;
      (6)   Automobile used auto parts (inside);
      (7)   Auditorium, arena, coliseum;
      (8)   Bakery, wholesale;
      (9)   Boat sales, rental, storage, repair;
      (10)   Bus station or terminal;
      (11)   Cabinet, carpentry or upholstery shop;
      (12)   Cleaning and dyeing plant (commercial);
      (13)   Cleaning plant, bags or carpets (special equipment);
      (14)   Cold storage plant;
      (15)   Contractor’s shop and storage yard;
      (16)   Engine and motor repair;
      (17)   Exterminator;
      (18)   Farm equipment sales, service, repair;
      (19)   Feed store;
      (20)   Food locker plant (for consumer use);
      (21)   Freight depot or terminal (railroad or truck);
      (22)   Hauling or storage yard;
      (23)   Heavy machinery - sales and storage;
      (24)   Job printing or newspaper printing;
      (25)   Laboratory - scientific research and testing;
      (26)   Milk depot, dairy or ice cream plant;
      (27)   Paint shop;
      (28)   Pawn shop;
      (29)   Petroleum products - storage, wholesale;
      (30)   Plumbing shop;
      (31)   Railroad or motor freight terminal;
      (32)   Secondhand store, used furniture or rummage sale/shop;
      (33)   Storage and sale of furniture or appliances outside of building;
      (34)   Terminal, storage and baggage;
      (35)   Theater (drive-in);
      (36)   Trade or commercial school;
      (37)   Trailer, mobile home, camper - rental or sales;
      (38)   Warehouse - storage or sales;
      (39)   Wholesale establishment - office, sales, storage;
      (40)   Other uses as designated in § 155.45.
   (C)   Development regulations. 
      (1)   Lot requirements: (Minimum figures)
         (a)   Lot area: 3,000 square feet;
         (b)   Lot width: 25 feet at the front street building line.
      (2)   Yard requirements:
         (a)   Front yard: 25 feet;
         (b)   Side yard:
            1.   Interior lot: No requirement except when adjoining a residential district, then 15 feet;
            2.   Exterior lot: 10 feet.
         (c)   Rear yard: None required where an alley exists on the rear of the lot, tract or plot; otherwise a minimum rear yard of ten feet shall be provided. When adjoining a residential district, a minimum rear yard of 15 feet shall be provided. Where rail lines exist at the rear of lots or tracts occupied by industrial or commercial buildings, the buildings may be located for direct service by rail transportation.
      (3)   Height requirements:
         Maximum building height: 75 feet.
   (D)   Parking regulations. The parking regulations for the “GR” General Retail District shall apply, plus the following requirements:
      (1)   Commercial outdoor amusement: 20 spaces, plus one space for each 100 square feet of floor area over 1,000 square feet.
      (2)   Golf course: 40 spaces for each nine holes.
      (3)   Mobile home, travel trailer, motor home, camper lot: One space for each 1,000 square feet of lot area for outdoor use.
      (4)   Motor vehicle - new and used vehicle lot: One parking space for each 1,000 square feet of floor area for outdoor use.
      (5)   Repair, storage or wholesale facility: One space for each two employees on the maximum shift or one space for each 1,000 square feet of floor area, whichever is greater.
      (6)   Off-street parking and loading regulations: See § 155.47.

§ 155.30 LI - LIGHT INDUSTRIAL DISTRICT.

   (A)   Purpose. This district is designed for light manufacturing, assembly, fabrication and heavy commercial activities. The Light Industrial District should be used as a buffer zone between heavy industrial and commercial development.
   (B)   Use regulations. The following uses are permitted in this district:
      (1)   Any use permitted in the “C,” “GR,” “NS” and “MF” districts, excluding hotels, motels, apartments, residences, elementary or secondary schools and hospitals;
      (2)   Advertising display manufacturers;
      (3)   Apparel and other products assembled from finished textiles;
      (4)   Automobile or other vehicles - engine rebuilding;
      (5)   Batching or mixing plant - Portland cement, concrete, mortar or plaster (commercial);
      (6)   Bookbinding other than by hand;
      (7)   Bottling works for all beverages;
      (8)   Carpet manufacturing and cleaning;
      (9)   Ceramic and pottery manufacture;
      (10)   Coal, coke or wood yard;
      (11)   Cosmetics manufacture;
      (12)   Drug and pharmaceutical manufacture;
      (13)   Electrical appliance, equipment assembly, supplies or similar products, including electrical machinery;
      (14)   Electronic products manufacture;
      (15)   Food products processing;
      (16)   Fur goods manufacture excluding tanning and dyeing;
      (17)   Furniture and upholstery manufacture;
      (18)   Heavy equipment, storage, repair and sales, earth moving;
      (19)   Household appliance products, assembly and manufacture from prefabricated parts;
      (20)   Ice, dry or natural;
      (21)   Junk, iron or rag storage or bailing;

      (24)   Machines, business; including typewriter, accounting machines, calculators, card-counting equipment or similar products;
      (25)   Machinery, miscellaneous; including repairs;
      (26)   Machine tools; including metal lathes, metal presses, metal stamping machines, woodworking machines or similar products;
      (27)   Mattresses; including rebuilding or renovating;
      (28)   Musical instruments; including pianos or organs;
      (29)   Orthopedic or medical appliances; including artificial limbs, braces, supports, stretchers or similar products;
      (30)   Paper products; including envelopes, stationery, bags, boxes, shipping containers, bulk goods, tubes, wallpaper, printing or similar products;

      (37)   Tools or hardware; including bolts, nuts, screws, doorknobs, drills, hand tools or cutlery, hinges, house hardware, locks, non-ferrous metal castings, plumbing appliances or similar products;
      (38)   Toys and novelty products;
      (39)   Vehicles, children’s; including bicycles, scooters, wagons, baby carriages or similar vehicles;
      (40)   Venetian blinds, window shades or awnings.
      (41)   Wrecking yards and junk yards.
   (C)   Development regulations.
      (1)   Lot requirements: None.
      (2)   Yard requirements:
         (a)   Front yard:
            1.   Where none of the frontage on either side of the street between the two intersecting streets is located in a residential district, no front yard is required;
            2.   Where the frontage on one side of the street between two intersecting streets is located partly in the “LI” District and partly in a residential district, the front yard will conform to the residential district regulations for a distance of not less than 300 feet from the district boundary;
            3.   Where a front yard is required along the frontage on one side of a street, the front yard requirements of the property directly opposite on the other side of the street will be at least 25 feet;
         (b)   Side yard: No side yard is required except that a side yard of at least 25 feet in width will be provided on the side of the lot adjoining or across a side street from a residential district;
         (c)   Rear yard:
            1.   None required where an alley exists on the rear of the lot, tract or plot; otherwise, a minimum rear yard of ten feet shall be provided;
            2.   When adjoining a residential district, a rear yard of at least 50 feet in depth will be provided upon that portion of a lot adjoining a residential district. This requirement does not apply where the property in the residential district also backs up to a rear street;
            3.   Where rail lines exist at the rear of lots or tracts occupied by industrial or commercial buildings, the buildings may be located for direct service by rail transportation.
      (3)   Lot requirements:
         Maximum building height: 75 feet.
   (D)   Parking regulations. The parking regulations for the “C” Commercial District shall apply, plus the following requirements:
      (1)   Manufacturing, processing, repairing and storage facilities: One space for each two employees or one space for each 1,000 square feet of floor area, whichever is greater.
      (2)   No parking, storage or similar use is permitted in the required front, side or side exterior yards within 25 feet of the street line.
      (3)   No parking, storage or similar use is permitted within 25 feet of the rear property line.
      (4)   Off-street parking and loading regulations: See § 155.47.

§ 155.31 HI - HEAVY INDUSTRIAL DISTRICT.

   (A)   Purpose. This district provides for heavy manufacturing and industrial activities which generate noise, odor or dust beyond the site boundaries. These regulations are designed to eliminate the negative impacts these uses can have on adjacent areas.
   (B)   Use regulations. Any use permitted in the “LI” Light Industrial District, plus the following, are allowed:
      (1)   Acetylene gas manufacture or storage;
      (2)   Acid manufacture;
      (3)   Alcohol manufacture;
      (4)   Ammonia, bleaching powder or chlorine manufacture;
      (5)   Arsenal;
      (6)   Asphalt manufacture or refining;
      (7)   Blast furnace;
      (8)   Bag cleaning;
      (9)   Boiler works;
      (10)   Brick, tile, pottery or terra cotta manufacture other than the manufacture of handcraft or concrete products;
      (11)   Candle manufacture;
      (12)   Celluloid manufacture or treatment;
      (13)   Cement, lime, gypsum or plaster of paris manufacture;
      (14)   Cement mixing plant for cement, mortar, plaster or paving materials;
      (15)   Coke ovens;
      (16)   Cotton gins;
      (17)   Cotton seed oil manufacture;
      (18)   Creosote manufacture or treatment;
      (19)   Disinfectants manufacture;
      (20)   Distillation of bones, coal or wood;
      (21)   Dyestuff manufacture;
      (22)   Exterminator and insect poison manufacture;
      (23)   Emery cloth and sandpaper manufacture;

      (53)   Shoe polish manufacture;
      (54)   Smelting of tin, copper, zinc or iron ores;
      (55)   Soap manufacture other than liquid soap;
      (56)   Soda and compound manufacture;
      (57)   Stock yard or slaughter of animals or fowls;
      (58)   Stone mill or quarry;
      (59)   Stove polish manufacture;
      (60)   Tallow, grease or lard manufacture or refining from, or of, animal fat;
      (61)   Tanning, curing or storage of raw hides or skins;
      (62)   Tar distillation or manufacture;
      (63)   Tar roofing or water proofing manufacture;
      (64)   Tire recapping or vulcanizing;
      (65)   Tobacco (chewing) manufacture or treatment;
      (66)   Vinegar manufacture;
      (67)   Wool pulling or scouring;
      (68)   Yeast plant.
   (C)   Development regulations.
      (1)   Lot requirements: None;
      (2)   Yard requirements:
         (a)   Front yard:
            1.   Where none of the frontage on either side of the street between two intersecting streets is located in a residential or commercial district, no front yard is required;
            2.   Where the frontage on one side of the street between two intersecting streets is located partly in District “HI” and partly in a residential district, the front yard shall conform to the residential district regulations for a distance of not less than 300 feet from the district boundary;

         Maximum building height: 75 feet.
   (D)   Parking regulations. The parking regulations for the “LI” Light Industrial District will apply, plus the following requirements:
      (1)   No parking, storage or similar use is permitted in the required front, side and side exterior yards within 25 feet of the street line;
      (2)   No parking, storage or similar use is permitted in the required rear yard within 25 feet of the rear property line;
      (3)   Off-street parking and loading regulations: see § 155.47.

§ 155.32 PD - PLANNED DEVELOPMENT DISTRICT.

   (A)   Purpose. This district is designed to provide for the unified and coordinated development of tracts for a variety of purposes, including shopping centers and industrial parks. Modifications of normal district regulations are permitted if they meet the intent of the standards and enhance the living or working environment of the area.
   (B)   Use regulations. A structure in this zoning district may be used for any use allowed in any district contained in this chapter. However, it must be demonstrated that the uses are in conformance with the purpose and intent of the Comprehensive Master Plan.
   (C)   Development regulations.
      (1)   General area, yard and height requirements shall conform to those requirements of the intended use except that modifications are permitted, provided they are in the best interests of the persons in the district.
      (2)   A minimum land area computed in acreage is required before applications for planned development will be approved. Minimum acreage requirements for typical uses are set forth below:
         (a)   General retail shopping center: 1 acre;
         (b)   Housing development: 1 acre;
         (c)   Mobile home park: 2 acres;
         (d)   Commercial use development: 3 acres;
         (e)   Industrial park: 10 acres.
         (f)   Medical centers or hospitals; civic or community centers; office centers; recreation centers or any combination of (a) through (e) above: No minimum.
      (3)   A comprehensive site plan of the development is required and must be approved and filed as part of this chapter prior to the issuance of any building permit. Appropriate regulations in this chapter and all subdivision requirements for the city shall be complied with. Information to be included in the plan is as follows:
         (a)   Ingress and egress to the property;
         (b)   Public or private streets;
         (c)   Sidewalks;
         (d)   Utilities and drainage;
         (e)   Yards, height, maximum building coverage, open spaces;
         (f)   Landscaping and screening;
         (g)   Trash pickup, trash delivery.
   (D)   Special requirements.
      (1)   A commercial or industrial district separated by an area of different use shall be at least 300 feet apart when on the same side of the major street they front.
      (2)   A solid screening fence of at least six feet in height shall be built along that boundary of a commercial or industrial planned development district which adjoins residential property under different ownership.
      (3)   When a commercial or industrial planned development district extends more than 300 feet back from a major street and adjoins property developed or zones for residential use under different ownership or if such land abuts other land in a “PD” District under different ownership, then the proposed use so located may be approved only under the following conditions. An area of at least 150 feet in width be provided in which no structure except for a screening fence or necessary lights shall be permitted. This area shall be measured between the boundary of the adjoining property described in the this section and any intended structure and shall extend the entire depth of the commercial or industrial use area which is in excess of the 300 feet of depth allowed in the preceding paragraph. A paved parking area may be provided within this 150-foot area.
      (4)   Lighting devices outside of building structures and in parking lots shall not be operated so as to produce direct or reflected light or glare across adjoining property lines.
      (5)   Loudspeakers or similar devices in conjunction with commercial uses shall not operate so as to direct sound across adjoining property lines.
   (E)   Planned development garden homes. The following development regulations shall apply solely within the Planned Development District - Garden Homes created herein:
      (1)   Minimum lot requirements:
         (a)   Lot area: 6,000 sq. ft.
         (b)   Lot width: 55 feet;
         (c)   Lot depth: 100 feet;
      (2)   Minimum yard requirements:
         (a)   Front yard: 15 feet, or as approved on site plan for lots on cul-de-sac;
         (b)   Rear yard: 10 feet, except for garage openings, which shall be a minimum of 15 feet from the rear lot line.
         (c)   Side yard:
            1.   Minimum side yard setbacks shall be determined by the developer and subject to approval by the Planning and Zonin Commission and the City Council as part of the Site Development Plan.
            2.   On a corner lot, the width of the yard along the side street shall not be less than 12 feet.
      (3)   Height requirements:
         Maximum building height: 35 feet.
      (4)   Spatial control:
         (a)   Minimum floor space per dwelling unit: 1,200 sq. ft.;
         (b)   Maximum lot coverage, excluding alleys, public rights-of-way and access easements: 60%;
      (5)   Parking regulations:Each dwelling unit will provide off-street parking for two automobiles or other vehicles not to exceed 3/4-ton in capacity;
      (6)   Other requirements: all construction and development within the Planned Development District - Garden Homes created herein shall comply with all other appropriate restrictions and regulations as found in this code of ordinances, the zoning ordinance and the subdivision ordinance of the City of Mount Pleasant.

§ 155.33 FP - FLOOD PLAIN DISTRICT.

   (A)   Purpose. This overlay district is designed to identify those areas which are subject to flooding and to ensure the safety of the general public. This district shall be identified by the letters “FP” as a prefix to the underlying district zoning classification.
   (B)   Use regulations.
      (1)   In this district no land shall be used except for one or more of the following uses to the extent that they are not prohibited by other regulations or ordinances and provided that such uses do not require aboveground structures, filling or storage of equipment, except as herein specifically authorized:
         (a)   Agricultural activities, including the ordinary cultivation of land or legal forms of animal husbandry;
         (b)   Electrical substation;
         (c)   All types of local utilities, including but not limited to water distribution and waste water collection systems, water and waste water treatment facilities and water quality monitoring stations or other structures required to provide water and sewerage, telephone, gas and electrical service;
         (d)   Parks, community center, playgrounds, public golf courses;
         (e)   Private commercial open area amusements such as golf courses, driving ranges and similar uses when approved by special use zoning action;
         (f)   Facilities that would warrant no flood protection, such as accessory private open space in conjunction with commercial or residential development, community unit recreational areas or recreation developments;
         (g)   Parking areas associated with a part of contiguous land use.
      (2)   No building or structure shall be erected in that portion of a district designated with a flood plan “FP” prefix other than those listed in this section.
      (3)   There shall be no dumping, excavation, storage or filling operations within that portion of a district having a flood plain “FP” prefix designation except under conditions of this chapter.
   (C)   Establishment of a Flood Plain District.
      (1)   The Flood Plain District shall include all areas subject to inundation by flood water of the 25-year frequency.
      (2)   The Flood Plain District designated on the Official Zoning District Map of the City of Mount Pleasant shall be deemed an overlay on any zoning district now or hereafter applicable to any lot. Should the Flood Plain District be declared inapplicable to any tract by reason of the action of:
         (a)   The City Council in amending these sections; or
         (b)   Any court of competent jurisdiction interpreting the same or determining the legal effect of the same, then the zoning applicable to such lot shall be deemed to be in the district in which it is located without consideration of these sections.
      (3)   The source of this delineation shall be the most recent Flood Hazard Boundary Map or Flood Insurance Rate Map, as the case may be, issued separately or as part of detailed studies by or on behalf of the U.S. Department of Housing and Urban Development - Flood Insurance Administration. The City Council and the Planning and Zoning Commission shall have the authority to approve these studies and the City Council may designate other areas as a Flood Plain District.
   (D)   Municipal liability. The granting of a zoning permit in the Flood Plain District shall not constitute a representation, guarantee or warranty of any kind by the city or by any official or employee thereof of the practicability or safety of the proposed use. The issuance of the zoning permit shall create no liability upon the city, its officials or employees.
