A.
GENERAL PROVISIONS
1.
Creation of districts. For the purposes of this ordinance the City of Natchitoches is divided into the following districts:
R-1 Districts: Residence Districts - One-Family
RMH-1 Districts: Residence/Mobile Home Districts - One-Family
R-1.5 Districts: Residence Districts - Town House
R-2 Districts: Residence Districts - Multiple Family
R-3 Districts: Residence Districts - Multiple Family
R-MHP Districts: Mobile Home Park Districts
RED Districts: Residential Estates District
B-1 Districts: Transition Business District
B-2 Districts: Neighborhood Business Districts
B-3 Districts: Community and Central Business Districts
B-A Districts: Businesses Selling Alcoholic Beverages for Consumption on the Premises
B-SOB Districts: Sexually Oriented Business Districts
I-A Districts: Industry-Agriculture Districts
I-1 Districts: Light Industry Districts

2.
Zoning map. The zoning districts and the boundaries thereof are shown on the attached Zoning Map of the City of Natchitoches, 1972, which map is hereby made a part of this ordinance.
3.
District boundaries. Except where specifically shown by dimension or otherwise on the Zoning Map, the boundaries of districts are lot or property lines, the center lines of streets or alleys or such lines extended, railway right-of-way lines, natural boundary lines such as water courses, and the municipal corporate limit lines as they may exist from time to time. Questions concerning the exact location of any district boundary shall be decided by the Planning Commission.
4.
Annexed territory. Zoning for all territory annexed to the City of Natchitoches, Louisiana, hereafter shall be classified by the City Council at the time of annexation.
5.
Application of regulations. Except as hereinafter provided:
a.
No land shall be used or occupied, no structure shall be designed, erected, altered, used, or occupied, and no use shall be operated unless in conformity with the regulations herein prescribed for the district in which such structure or land is located;
b.
No structure shall be designed, erected, altered, used, or occupied to exceed the height limits herein established, to have less building site area, or to have narrower or smaller front, side, and rear yards than herein prescribed for the district in which the structure is located;
c.
No part of a yard or other open space required about any structure for the purpose of complying with the provisions of this ordinance shall be included as a part of the yard or other open space similarly required for another structure;
d.
No Building Site shall be so reduced or diminished that the building site area, yards, or other open spaces shall be smaller than prescribed by this ordinance;
e.
Every structure, other than an accessory structure, hereafter designed, erected, altered, used, or occupied shall have provided and continuously maintained for it a separate Building Site as herein defined;
f.
Every use, unless expressly exempted by this ordinance, shall be operated entirely within a completely enclosed structure.

B.
RESIDENTIAL DISTRICTS
1.
R-1 Districts: One-family residence districts. These districts are composed mainly of areas containing one-family dwellings and open areas where similar residential development seems likely to occur; few two-family and multiple-family dwellings are found in these areas. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches, and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.
a.
Permitted uses. In R-1 Districts only the following uses are permitted:
(1)
Uses by right. The uses listed below are permitted subject to the conditions specified:
Accessory Use
Dwelling, One-Family
Farming and Truck Gardening; need not be enclosed within structure.
Golf Course, but not including commercial miniature course or commercial driving range; need not be enclosed within structure.
Home Occupation
Modular Homes
Name Plate, not exceeding one square foot in area, need not be enclosed within structure.
Park or Playground (public), including Recreation Center; need not be enclosed within structure.

Uses requiring planning commission approval. The uses listed below are permitted upon approval of the location and site plan thereof by the Planning Commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire and police protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:
Fire Station
Livestock and Poultry Raising, including Dairy; need not be enclosed within structure.
Outdoor General Advertising Structure; need not be enclosed within structure.
Pipe Line or Electric Transmission Line; need not be enclosed within structure.
Railroad Right-of-way, but not including shops, yards, and team tracks; need not be enclosed within structure.
School, Elementary and/or Secondary, meeting all requirements of the compulsory education laws of the State of Louisiana.
University or College (non-profit)
Water Storage; need not be enclosed within structure.
Water or Sewage Pumping Station

Special exception uses. These uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the City Commission after a Public Hearing and recommendation by the Planning Commission:

Airport and Dusting Service; need not be enclosed within structure.
Bed & Breakfast
Cemetery; need not be enclosed within structure.
Church, including Parish House, Community House, and Educational Buildings.

RMH-1 Districts: Residence/Mobile Home Districts. These districts are composed mainly of areas containing one-family dwellings and accommodates mobile home subdivisions. This district provides for mobile home ownership of structure and lot for those mobile homes approved by the U.S. Department of Housing and Urban Development. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches; and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.
a.
Permitted uses. In RMH-1 Districts only the following uses are permitted;

3.
R-1.5 Districts: Town house districts. These districts are composed of single family attached dwellings on individual lots for sale; served by servitudes of access and providing common open spaces in lieu of typical single family yards. Town houses shall constitute groupings making efficient, economical, comfortable and convenient use of land and open space and serving the public purposes of zoning by means alternative to conventional arrangements of yards and buildable areas. Town house projects shall front at least 120 feet on a public street and be generally compatible with existing development in the neighborhood.
a.
Permitted uses. In R-1.5 Districts only the following uses are permitted:

b.
Building site area. The minimum building site area shall be at least 3,800 square feet per dwelling unit, including lots, common open space, yards and buffer area, adequately landscaped; walkways, and access drives, and including at least 200 square feet per dwelling unit of recreation space. The minimum lot area shall be 2,000 square feet in R-1.5 Districts and 1,440 square feet in other districts, where permitted.
c.
Building height limit. Except as provided in Section III, no structure shall be designed, erected, or altered to exceed thirty-five (35) feet.
d.
Yards required. Except as provided in Section III, the minimum dimension of yards shall be:
Front Yard .....25 ft.
Side Yard (Corner or Adjacent to R-1) .....25 ft.
Rear Yard .....25 ft.
Each town house shall have its own lot yard space of at least 400 square feet, reasonably secluded from view from streets or from neighboring property. Such yard shall not be used for off-street parking or for any accessory building.
e.
Special criteria. Town houses may be appropriately intermingled with other types of housing, except that they shall not be located on lots of less than 120 feet of frontage. Not more than six contiguous town houses shall be built in a row with the same or approximately the same front building line, and not more than 12 town houses shall be contiguous.
The minimum width for the portion of the lot on which the town house is to be constructed shall be 20 feet in R-1.5, and 18 feet in R-2 and R-3. No portion of a town house or accessory structure in or related to one group of contiguous town houses shall be closer than 20 feet to any portion of a town house or accessory structure related to another group or to any building outside the town house area, nor shall any structure be less than 20 feet from a public street.
As provided by the Subdivision Ordinance, design and construction of drives, drainage and location of utilities shall be subject to review and approval by the City, after approval of the preliminary plan by the Planning Commission. Interior access drives shall be constructed of at least 6 inch soil cement base with 1 ½" asphaltic concrete wearing surface or better; at least 22 feet wide, with adequate drainage. Where a property extends more than 400 feet from a public street, additional fire hydrants shall be provided as required by the City.
There shall be a 6 foot high wall or solid fence along the sides and rear of the R-1.5 project, wherever it adjoins an R-1 District.
f.
Grouped parking facilities. Insofar as practical, off-street parking facilities shall be grouped in bays, either adjacent to streets or in the interior of blocks. Practicable methods of drainage shall be assured by developers in connection with common parking facilities, and all such facilities shall be improved to City standards for off-street parking areas, with at least 2 spaces per unit on the lot, plus one visitor parking space per each two units, which may be provided in separate areas. Parking areas shall be at least 65 feet wide where parking or carports are on both sides of a common drive, or at least 42 feet wide where there is parking on one side only; except where diagonal parking is to be provided, parking areas shall be at least 57 feet wide for parking on both sides or 36 feet for parking on one side.
g.
Procedure. Before the Planning Commission considers an application for a R-1.5 Town House District, the proponent shall submit a preliminary subdivision layout to the Planning Commission as the first step. After the preliminary subdivision layout has been approved, the rezoning request will then be considered by the Planning Commission and the City Commission for rezoning. If rezoning is granted, the applicant or developer may then proceed to submit construction plans for review by the City, as set forth in the Subdivision Ordinance. Before approval of the final subdivision plans, restrictions shall be limited, including pavements, landscaping, utilities and services.
4.
R-2 Multiple family residence districts. These districts are composed mainly of areas containing one-family dwellings and open areas where similar residential development seems likely to occur; few two-family and multiple-family dwellings are found in these areas. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.
a.
Permitted uses. In R-2 Districts only the following uses are permitted:

For a multiple-family dwelling

5.
R-3 Districts: Residence districts. These districts are composed mainly of areas containing a mixture of one-family, two-family and multiple-family dwellings. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches; to prevent overcrowding of the land by requiring certain minimum yard and other open spaces for all buildings; and to avoid excessive population density by requiring a certain minimum building site area for each dwelling unit.
a.
Permitted uses. In R-3 Districts only the following uses are permitted:
1.
Uses by right. The uses listed below are permitted subject to the conditions specified:
All uses by right permitted in R-2 Districts and multiple-family dwellings.
2.
Uses requiring planning commission approval. The uses listed below are permitted upon approval of location and site plan thereof by the Planning Commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire and police protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:
All uses requiring Planning Commission approval permitted in the R-2 Districts.
3.
Special exception uses. The uses listed below are subject to the same approval of location and site plan as uses requiring Planning Commission approval; in addition, these uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the City Council after a Public Hearing and recommendation by the Planning Commission.
All Special Exception Uses permitted in R-2 Districts—Nursery, Day Care or Kindergarten, Bed & Breakfast, Fraternity/Sorority House.
b.
Building site area. Except as provided in Section III, the Minimum Building Site area shall be:

6.
R-MHP Mobile Home Park Districts. These districts are composed mainly of areas containing mobile home sites arranged on a large tract, usually under single ownership and designed to accommodate mobile homes for more or less permanent duration along with other uses compatible to such parks which provide related services. Such areas shall be well suited for residential purposes, with commercial and office uses to be prohibited; to encourage a suitable living environment for family life by including among the permitted uses such facilities as schools and churches, and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.
a.
Permitted uses. In R-MHP Districts only the following uses are permitted:
(1)
Uses by right. The uses listed below are permitted subject to the conditions specified:

Special exception uses. These uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the City Commission after a Public Hearing and recommendation by the Planning Commission:
Church, including parish house, community house, and educational buildings.
Electric substation; need not be enclosed within structure, but must be enclosed with a wall at least ten feet high and adequate to obstruct view, noise, and passage of persons.
School, elementary and/or secondary; meeting all requirements of the compulsory education laws of the State of Louisiana.
b.
Building site area. Except as provided in Section III, the minimum building site area shall be:
(1)
For each mobile home lot: 6,000 square feet.
(2)
For all other permitted uses: 10,000 square feet.
c.
Building height limit. Except as provided in Section III, no structure shall be designed, erected, or altered to exceed thirty-five (35) feet.
d.
Yards required. Except as provided in Section III, the minimum dimensions of yards shall be:
(1)
For each mobile home unit:
(a)
Front Yard: twenty (25) feet
(b)
Side Yard: fifteen (15) feet
(c)
Rear Yard: twenty (25) feet
(2)
For all other uses:
(a)
Front yard: twenty-five (25) feet
(b)
Side yard: five (5) feet
(c)
Rear yard: twenty-five (25) feet
7.
Residential Estates District. Residential Estates is the designation of a district uniquely suited for the development and maintenance of rural single-family residential living combined with limited agricultural activities. Large lot sizes are required to maintain the low density rural character, prevent unsanitary conditions, and provide sufficient open space to ensure that the various principal uses are kept at a level of compatible land use intensity. The RED (Residential Estates District) is intended to be applied to areas which are without fully developed services and where is it expected that individual residences will be largely self-sustaining, particularly for sewage disposal. The RED (Residential Estates District) is intended to be applied to areas which are without fully developed services and where it is expected that individual residences will be largely self-sustaining until municipal utility services have been extended into the area. As municipal water and/or wastewater utility services are extended into the Residential Estates District, residences will be connected in accordance with State Law.
a.
Permitted uses: In a Residential Estates District the following buildings and uses and their accessory buildings and uses are permitted.
Dwelling, one-family
Secondary agricultural activities limited to orchards, and plant nurseries.
Keeping or raising of horses, ponies and cows or barnyard animals provided that the total of all such animals shall not exceed one (1) for each acre of lot area.
Public parks, playgrounds and other public recreational facilities.
Public utility equipment and facilities on a site of one (1) acre or less within a dedicated utility easement or right-of-way.
b.
Uses requiring planning commission approval. The uses listed below are permitted upon approval of location and site plan thereof by the Planning Commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire and police protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:
Cemeteries
Churches
Public and private schools
Stables or horse riding academy
Primary agricultural use
c.
Building site area. Except as provided in Section III, the minimum building site area shall be:

d.
Notwithstanding any provision to the contrary in the subdivision regulations or the zoning regulations, curb and gutter shall not be required within areas that are annexed into the City of Natchitoches as Residential Estates Districts. Any new development that is zoned as a Residential Estates District shall have a curb and gutter drainage system installed at the time of street development.

C.
BUSINESS DISTRICTS
1.
B-1 Districts: Transition business district. These districts are composed of land and structures occupied by or suitable for such uses as offices, studios and public parking lots. Although usually located between residential areas and business areas, these districts are in some instances free-standing in residential areas or they may include hospital or college groups and related uses. The district regulations are designed to protect and encourage the transitional character of the districts by limiting the permitted uses of those of a semi-commercial nature and to protect the abutting and surrounding residential areas by requiring certain minimum yard and area standards to be met, standards that are comparable to those called for in the residence districts.
a.
Permitted uses. In the B-1 Districts only the following uses are permitted:

B-2 Districts: Neighborhood business districts. These districts are composed of land and structures occupied by or suitable for furnishing the retail goods, such as groceries and drugs, and the services, such as barbering and shoe repairing, to satisfy the daily household needs of the surrounding residential neighborhoods. Often located on one or more thoroughfares, these districts are small and are within convenient walking distance of most of the areas they will serve. The district regulations are designed to permit the development of the districts for their purpose and to protect the abutting and surrounding residential areas by requiring certain minimum yard and area standards to be met, standards that are comparable to those called for in residence districts. It is intended that additional Neighborhood Business Districts will be created, in accordance with the Amendment Procedure set forth herein, as they are needed to serve new residential areas. To insure that such new districts are actually developed to supply the business needs of the neighborhoods, the amendment creating the district may set a time limit for its development.
a.

B-3 Districts: Community and central business districts. These districts are composed of land and structures used to furnish, in addition to the retail goods and services found in Neighborhood Business Districts, the wider range of retail goods and services to satisfy all of the household and personal needs of the residents of the city and its trade area. In addition to the main central business section of the city, other large areas may be established as districts of this type to serve groups or communities of neighborhoods. The district regulations are designed to permit the development of the districts for their purpose in an open, spacious arrangement by requiring certain minimum yard and area standards to be met. To protect the abutting and surrounding residential areas certain restrictions are placed on uses. Although new districts of this type will not often be called for, such districts can be created in accordance with the Amendment Procedure set forth herein, if they are needed. To insure that such districts are actually developed to supply the business needs of the groups of neighborhoods, the amendment creating the district may set a time limit for its development.
a.

4.
B-A Districts: Businesses selling alcoholic beverages for consumption on the premises. These districts are composed of land and structures that are used for purposes which otherwise would fall into a permitted use under one of the "Business District" classifications, but which are used additionally to engage in the business of selling alcoholic beverages of either high or low alcoholic content for consumption on the premises as defined in Chapter 4 of the Code of Ordinances of the City of Natchitoches. This special district is intended to be used exclusively for such businesses as restaurants, cafes, lounges, nightclubs, private clubs, and any other business which is required to obtain a Class "A" permit for the sale of alcoholic beverages for consumption on the premises. This district is designed to protect residential neighborhoods and areas from excessive noise, disturbance, and traffic.
a.
Permitted uses. In the B-A Districts, the following uses are permitted.
(1)
Uses by right. Any of the businesses which would be permissible under any business or industrial permitted uses as outlined in the Zoning Ordinance.
b.
Special approval by Planning Commission. Before engaging in the sale of alcoholic beverages of either high or low alcoholic content for consumption on the premises and made for before application can be made for the issuance of a permit under Chapter 4 of the Code of Ordinances, the property owner, or his lessee, must apply to the Planning Commission for this special zoning of B-A. This zoning classification must be approved by the Planning Commission and ratified by the City Council before the owner, lessee, or occupant can open for business.
c.
Nonconforming use. Any business now holding a valid permit from the city and lawfully engaged in the sale of alcoholic beverages for consumption on the premises as of the effective date of this ordinance shall not be required to seek a rezoning to B-A, but shall be permitted to continue under its present district classification as a nonconforming use, except as follows:
(1)
The number of businesses in a nonconforming use shall not be increased over or exceed the number of businesses existing in the nonconforming use on the effective date of this ordinance.
(2)
The land area occupied by any nonconforming use on the effective date of this ordinance shall not be increased except to provide open off-street parking space or open off-street loading spaces for the nonconforming use, such space to be maintained in accordance with the regulations established elsewhere in the Zoning Ordinance.
(3)
A nonconforming use that has been abandoned or discontinued for any reason, such as, but not limited to, closing, suspension of permit, revocation of permit, destruction of the premises, or the like, for a continuous period of 90 days shall not be re-established, and after the ninety-day period, the nonconforming use shall immediately and without further action on the part of the city terminate. Thereafter, before the property can be used for the sale of alcoholic beverages for consumption on the premises, the owner or lessee must make application to the Planning Commission for rezoning to B-A, and the normal rules for rezoning, including notification of surrounding property owners and public hearing shall apply.
(4)
Notwithstanding the foregoing, if the nonconfomring use is discontinued in order to comply with an order or action of the State or Federal Government, then in that event the use shall not be deemed to have been abandoned or discontinued.
5.
B-SOB Districts. Sexually oriented businesses. These districts are composed of land and structures that are used for purposes which otherwise would fall into a permitted use under one of the "business district" classifications, but those businesses which additionally are licensed and regulated under Chapter 19, Article VII of the Code of Ordinances of the City of Natchitoches.
a.
Permitted uses. In the B-SOB Districts, the following uses are permitted.
(1)
Uses by right. Any of the businesses which would be permissible under any business or industry permitted uses as outlined in the Zoning Ordinance.
b.
Special approval by planning commission. Before engaging in any business which is regulated and licensed under Chapter 19, Article VII of the Code of Ordinances and before application can be made for the issuance of a permit under the Code of Ordinances, the property owner, or his lessee, or operator must apply to the planning commission for this special zoning of B-SOB. This zoning classification must be approved by the planning commission for this special zoning of B-SOB after notice to surrounding property owners and compliance with all other procedures set forth in the city's zoning ordinance, including specifically the amendment procedure as stated in section VIII of the city's amended zoning ordinance. This zoning classification must be approved by the planning commission and ratified by the city council before the owner, lessee, or occupant can open for business.
c.
Nonconforming use. Any business now lawfully engaged in the sale of items which are regulated and permitted under Chapter 19, Article VII of the Code of Ordinances as of the effective date of this Ordinance [No. 67-1999] shall not be required to seek a rezoning to B-SOB, but shall be permitted to continue under its present district classification as a nonconforming use, except as follows:
(1)
The number of businesses in a nonconforming use shall not be increased over or exceed the number of businesses existing in the nonconforming use on the effective date of this Ordinance [No. 67-1999].
(2)
The land area occupied by an nonconforming use on the effective date of this Ordinance [No. 67-1999] shall not be increased except to provide open off-street parking space or open off-street loading spaces for the nonconforming used, such space to be maintained in accordance with the regulations established elsewhere in the zoning ordinance.
(3)
A nonconforming use that has been abandoned or discontinued for any reason, such as, but not limited to, closing, suspension of permit, revocation of permit, destruction of the premises, or the like, for the continuous period of 60 days shall not be re-established, and after the sixty-day period, the nonconforming use shall immediately and without further action on the part of the city terminate. Thereafter, before the property can be used for the sale of items which are regulated and permitted under Chapter 19, Article VII of the Code of Ordinances, the owner or lessee must make application to the planning commission for the re-zoning to B-SOB, and the normal rules for rezoning, including notification of surrounding property owners and public hearing shall apply.
(4)
Notwithstanding the foregoing, if the nonconfomring use is discontinued in order to comply with an order or action of the State or Federal Government, then in that event the use shall not be deemed to have been abandoned or discontinued.

INDUSTRY DISTRICTS
1.
I-A Districts: Industry-Agriculture districts. These districts are comprised of lands lying within areas set forth on the Master Plan for industrial development. Existing land uses therein are mainly agriculture, livestock raising or vacant, and these regulations are designed to protect the essentially open character of the districts by prohibiting the establishment of uses that are unsuited or unrelated to the district as a whole. It is intended that a subdivision of land within these areas shall be approved and proper zoning action be executed before land uses other than those specified herein shall be permitted.
a.
Permitted uses. In I-A Districts only the following uses are permitted:

The district regulations are designed to allow a wide range of industrial activities subject to limitations designed to protect nearby residential and business districts.

I-2 Districts: Heavy industry districts. These districts are composed of land and structures used for heavy manufacturing and related activities or suitable for such uses. Located for convenient access from existing and future arterial thoroughfares and railway lines, these districts are in many instances separated from residential areas by business or light industry areas or by natural barriers; where they are adjacent to residential areas some type of artificial separation may be required. The district regulations are designed to permit the development of the district for almost any industrial uses, subject to the minimum regulations necessary for the mutual protection of the uses.

GENERAL PROVISIONS
1.
Creation of districts. For the purposes of this ordinance the City of Natchitoches is divided into the following districts:
R-1 Districts: Residence Districts - One-Family
RMH-1 Districts: Residence/Mobile Home Districts - One-Family
R-1.5 Districts: Residence Districts - Town House
R-2 Districts: Residence Districts - Multiple Family
R-3 Districts: Residence Districts - Multiple Family

2.
Zoning map. The zoning districts and the boundaries thereof are shown on the attached Zoning Map of the City of Natchitoches, 1972, which map is hereby made a part of this ordinance.
3.
District boundaries. Except where specifically shown by dimension or otherwise on the Zoning Map, the boundaries of districts are lot or property lines, the center lines of streets or alleys or such lines extended, railway right-of-way lines, natural boundary lines such as water courses, and the municipal corporate limit lines as they may exist from time to time. Questions concerning the exact location of any district boundary shall be decided by the Planning Commission.
4.
Annexed territory. Zoning for all territory annexed to the City of Natchitoches, Louisiana, hereafter shall be classified by the City Council at the time of annexation.
5.
Application of regulations. Except as hereinafter provided:
a.
No land shall be used or occupied, no structure shall be designed, erected, altered, used, or occupied, and no use shall be operated unless in conformity with the regulations herein prescribed for the district in which such structure or land is located;
b.
No structure shall be designed, erected, altered, used, or occupied to exceed the height limits herein established, to have less building site area, or to have narrower or smaller front, side, and rear yards than herein prescribed for the district in which the structure is located;
c.
No part of a yard or other open space required about any structure for the purpose of complying with the provisions of this ordinance shall be included as a part of the yard or other open space similarly required for another structure;
d.
No Building Site shall be so reduced or diminished that the building site area, yards, or other open spaces shall be smaller than prescribed by this ordinance;
e.
Every structure, other than an accessory structure, hereafter designed, erected, altered, used, or occupied shall have provided and continuously maintained for it a separate Building Site as herein defined;
f.
Every use, unless expressly exempted by this ordinance, shall be operated entirely within a completely enclosed structure.

B.
RESIDENTIAL DISTRICTS
1.
R-1 Districts: One-family residence districts. These districts are composed mainly of areas containing one-family dwellings and open areas where similar residential development seems likely to occur; few two-family and multiple-family dwellings are found in these areas. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches, and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.
a.
Permitted uses. In R-1 Districts only the following uses are permitted:

This district provides for mobile home ownership of structure and lot for those mobile homes approved by the U.S. Department of Housing and Urban Development. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches; and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.
a.
Permitted uses. In RMH-1 Districts only the following uses are permitted;

3.
R-1.5 Districts: Town house districts. These districts are composed of single family attached dwellings on individual lots for sale; served by servitudes of access and providing common open spaces in lieu of typical single family yards. Town houses shall constitute groupings making efficient, economical, comfortable and convenient use of land and open space and serving the public purposes of zoning by means alternative to conventional arrangements of yards and buildable areas. Town house projects shall front at least 120 feet on a public street and be generally compatible with existing development in the neighborhood.
a.
Permitted uses. In R-1.5 Districts only the following uses are permitted:

b.
Building site area. The minimum building site area shall be at least 3,800 square feet per dwelling unit, including lots, common open space, yards and buffer area, adequately landscaped; walkways, and access drives, and including at least 200 square feet per dwelling unit of recreation space. The minimum lot area shall be 2,000 square feet in R-1.5 Districts and 1,440 square feet in other districts, where permitted.
c.
Building height limit. Except as provided in Section III, no structure shall be designed, erected, or altered to exceed thirty-five (35) feet.
d.
Yards required. Except as provided in Section III, the minimum dimension of yards shall be:
Front Yard .....25 ft.
Side Yard (Corner or Adjacent to R-1) .....25 ft.
Rear Yard .....25 ft.
Each town house shall have its own lot yard space of at least 400 square feet, reasonably secluded from view from streets or from neighboring property. Such yard shall not be used for off-street parking or for any accessory building.
e.
Special criteria. Town houses may be appropriately intermingled with other types of housing, except that they shall not be located on lots of less than 120 feet of frontage. Not more than six contiguous town houses shall be built in a row with the same or approximately the same front building line, and not more than 12 town houses shall be contiguous.
The minimum width for the portion of the lot on which the town house is to be constructed shall be 20 feet in R-1.5, and 18 feet in R-2 and R-3. No portion of a town house or accessory structure in or related to one group of contiguous town houses shall be closer than 20 feet to any portion of a town house or accessory structure related to another group or to any building outside the town house area, nor shall any structure be less than 20 feet from a public street.
As provided by the Subdivision Ordinance, design and construction of drives, drainage and location of utilities shall be subject to review and approval by the City, after approval of the preliminary plan by the Planning Commission. Interior access drives shall be constructed of at least 6 inch soil cement base with 1 ½" asphaltic concrete wearing surface or better; at least 22 feet wide, with adequate drainage. Where a property extends more than 400 feet from a public street, additional fire hydrants shall be provided as required by the City.
There shall be a 6 foot high wall or solid fence along the sides and rear of the R-1.5 project, wherever it adjoins an R-1 District.
f.
Grouped parking facilities. Insofar as practical, off-street parking facilities shall be grouped in bays, either adjacent to streets or in the interior of blocks. Practicable methods of drainage shall be assured by developers in connection with common parking facilities, and all such facilities shall be improved to City standards for off-street parking areas, with at least 2 spaces per unit on the lot, plus one visitor parking space per each two units, which may be provided in separate areas. Parking areas shall be at least 65 feet wide where parking or carports are on both sides of a common drive, or at least 42 feet wide where there is parking on one side only; except where diagonal parking is to be provided, parking areas shall be at least 57 feet wide for parking on both sides or 36 feet for parking on one side.
g.
Procedure. Before the Planning Commission considers an application for a R-1.5 Town House District, the proponent shall submit a preliminary subdivision layout to the Planning Commission as the first step. After the preliminary subdivision layout has been approved, the rezoning request will then be considered by the Planning Commission and the City Commission for rezoning. If rezoning is granted, the applicant or developer may then proceed to submit construction plans for review by the City, as set forth in the Subdivision Ordinance. Before approval of the final subdivision plans, restrictions shall be limited, including pavements, landscaping, utilities and services.
4.
R-2 Multiple family residence districts. These districts are composed mainly of areas containing one-family dwellings and open areas where similar residential development seems likely to occur; few two-family and multiple-family dwellings are found in these areas. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.

The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches; to prevent overcrowding of the land by requiring certain minimum yard and other open spaces for all buildings; and to avoid excessive population density by requiring a certain minimum building site area for each dwelling unit.
a.
Permitted uses. In R-3 Districts only the following uses are permitted:

The uses listed below are subject to the same approval of location and site plan as uses requiring Planning Commission approval; in addition, these uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the City Council after a Public Hearing and recommendation by the Planning Commission.

Such areas shall be well suited for residential purposes, with commercial and office uses to be prohibited; to encourage a suitable living environment for family life by including among the permitted uses such facilities as schools and churches, and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.

Special exception uses. These uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the City Commission after a Public Hearing and recommendation by the Planning Commission:

Building site area. Except as provided in Section III, the minimum building site area shall be:

Building height limit. Except as provided in Section III, no structure shall be designed, erected, or altered to exceed thirty-five (35) feet.

Residential Estates District. Residential Estates is the designation of a district uniquely suited for the development and maintenance of rural single-family residential living combined with limited agricultural activities. Large lot sizes are required to maintain the low density rural character, prevent unsanitary conditions, and provide sufficient open space to ensure that the various principal uses are kept at a level of compatible land use intensity. The RED (Residential Estates District) is intended to be applied to areas which are without fully developed services and where is it expected that individual residences will be largely self-sustaining, particularly for sewage disposal. The RED (Residential Estates District) is intended to be applied to areas which are without fully developed services and where it is expected that individual residences will be largely self-sustaining until municipal utility services have been extended into the area. As municipal water and/or wastewater utility services are extended into the Residential Estates District, residences will be connected in accordance with State Law.
a.
Permitted uses: In a Residential Estates District the following buildings and uses and their accessory buildings and uses are permitted.
Dwelling, one-family
Secondary agricultural activities limited to orchards, and plant nurseries.
Keeping or raising of horses, ponies and cows or barnyard animals provided that the total of all such animals shall not exceed one (1) for each acre of lot area.
Public parks, playgrounds and other public recreational facilities.
Public utility equipment and facilities on a site of one (1) acre or less within a dedicated utility easement or right-of-way.
b.
Uses requiring planning commission approval. The uses listed below are permitted upon approval of location and site plan thereof by the Planning Commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire and police protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:

c.
Building site area. Except as provided in Section III, the minimum building site area shall be:

Notwithstanding any provision to the contrary in the subdivision regulations or the zoning regulations, curb and gutter shall not be required within areas that are annexed into the City of Natchitoches as Residential Estates Districts. Any new development that is zoned as a Residential Estates District shall have a curb and gutter drainage system installed at the time of street development.

BUSINESS DISTRICTS

B-1 Districts: Transition business district. These districts are composed of land and structures occupied by or suitable for such uses as offices, studios and public parking lots. Although usually located between residential areas and business areas, these districts are in some instances free-standing in residential areas or they may include hospital or college groups and related uses. The district regulations are designed to protect and encourage the transitional character of the districts by limiting the permitted uses of those of a semi-commercial nature and to protect the abutting and surrounding residential areas by requiring certain minimum yard and area standards to be met, standards that are comparable to those called for in the residence districts.

Often located on one or more thoroughfares, these districts are small and are within convenient walking distance of most of the areas they will serve. The district regulations are designed to permit the development of the districts for their purpose and to protect the abutting and surrounding residential areas by requiring certain minimum yard and area standards to be met, standards that are comparable to those called for in residence districts. It is intended that additional Neighborhood Business Districts will be created, in accordance with the Amendment Procedure set forth herein, as they are needed to serve new residential areas. To insure that such new districts are actually developed to supply the business needs of the neighborhoods, the amendment creating the district may set a time limit for its development.

In addition to the main central business section of the city, other large areas may be established as districts of this type to serve groups or communities of neighborhoods. The district regulations are designed to permit the development of the districts for their purpose in an open, spacious arrangement by requiring certain minimum yard and area standards to be met. To protect the abutting and surrounding residential areas certain restrictions are placed on uses. Although new districts of this type will not often be called for, such districts can be created in accordance with the Amendment Procedure set forth herein, if they are needed. To insure that such districts are actually developed to supply the business needs of the groups of neighborhoods, the amendment creating the district may set a time limit for its development.

4.
B-A Districts: Businesses selling alcoholic beverages for consumption on the premises. These districts are composed of land and structures that are used for purposes which otherwise would fall into a permitted use under one of the "Business District" classifications, but which are used additionally to engage in the business of selling alcoholic beverages of either high or low alcoholic content for consumption on the premises as defined in Chapter 4 of the Code of Ordinances of the City of Natchitoches. This special district is intended to be used exclusively for such businesses as restaurants, cafes, lounges, nightclubs, private clubs, and any other business which is required to obtain a Class "A" permit for the sale of alcoholic beverages for consumption on the premises. This district is designed to protect residential neighborhoods and areas from excessive noise, disturbance, and traffic.
a.
Permitted uses. In the B-A Districts, the following uses are permitted.
(1)
Uses by right. Any of the businesses which would be permissible under any business or industrial permitted uses as outlined in the Zoning Ordinance.
b.
Special approval by Planning Commission. Before engaging in the sale of alcoholic beverages of either high or low alcoholic content for consumption on the premises and made for before application can be made for the issuance of a permit under Chapter 4 of the Code of Ordinances, the property owner, or his lessee, must apply to the Planning Commission for this special zoning of B-A. This zoning classification must be approved by the Planning Commission and ratified by the City Council before the owner, lessee, or occupant can open for business.
c.
Nonconforming use. Any business now holding a valid permit from the city and lawfully engaged in the sale of alcoholic beverages for consumption on the premises as of the effective date of this ordinance shall not be required to seek a rezoning to B-A, but shall be permitted to continue under its present district classification as a nonconforming use, except as follows:
(1)
The number of businesses in a nonconforming use shall not be increased over or exceed the number of businesses existing in the nonconforming use on the effective date of this ordinance.
(2)
The land area occupied by any nonconforming use on the effective date of this ordinance shall not be increased except to provide open off-street parking space or open off-street loading spaces for the nonconforming use, such space to be maintained in accordance with the regulations established elsewhere in the Zoning Ordinance.
(3)
A nonconforming use that has been abandoned or discontinued for any reason, such as, but not limited to, closing, suspension of permit, revocation of permit, destruction of the premises, or the like, for a continuous period of 90 days shall not be re-established, and after the ninety-day period, the nonconforming use shall immediately and without further action on the part of the city terminate. Thereafter, before the property can be used for the sale of alcoholic beverages for consumption on the premises, the owner or lessee must make application to the Planning Commission for rezoning to B-A, and the normal rules for rezoning, including notification of surrounding property owners and public hearing shall apply.
(4)
Notwithstanding the foregoing, if the nonconfomring use is discontinued in order to comply with an order or action of the State or Federal Government, then in that event the use shall not be deemed to have been abandoned or discontinued.
5.
B-SOB Districts. Sexually oriented businesses. These districts are composed of land and structures that are used for purposes which otherwise would fall into a permitted use under one of the "business district" classifications, but those businesses which additionally are licensed and regulated under Chapter 19, Article VII of the Code of Ordinances of the City of Natchitoches.
a.
Permitted uses. In the B-SOB Districts, the following uses are permitted.
(1)
Uses by right. Any of the businesses which would be permissible under any business or industry permitted uses as outlined in the Zoning Ordinance.
b.
Special approval by planning commission. Before engaging in any business which is regulated and licensed under Chapter 19, Article VII of the Code of Ordinances and before application can be made for the issuance of a permit under the Code of Ordinances, the property owner, or his lessee, or operator must apply to the planning commission for this special zoning of B-SOB. This zoning classification must be approved by the planning commission for this special zoning of B-SOB after notice to surrounding property owners and compliance with all other procedures set forth in the city's zoning ordinance, including specifically the amendment procedure as stated in section VIII of the city's amended zoning ordinance. This zoning classification must be approved by the planning commission and ratified by the city council before the owner, lessee, or occupant can open for business.
c.
Nonconforming use. Any business now lawfully engaged in the sale of items which are regulated and permitted under Chapter 19, Article VII of the Code of Ordinances as of the effective date of this Ordinance [No. 67-1999] shall not be required to seek a rezoning to B-SOB, but shall be permitted to continue under its present district classification as a nonconforming use, except as follows:
(1)
The number of businesses in a nonconforming use shall not be increased over or exceed the number of businesses existing in the nonconforming use on the effective date of this Ordinance [No. 67-1999].
(2)
The land area occupied by an nonconforming use on the effective date of this Ordinance [No. 67-1999] shall not be increased except to provide open off-street parking space or open off-street loading spaces for the nonconforming used, such space to be maintained in accordance with the regulations established elsewhere in the zoning ordinance.
(3)
A nonconforming use that has been abandoned or discontinued for any reason, such as, but not limited to, closing, suspension of permit, revocation of permit, destruction of the premises, or the like, for the continuous period of 60 days shall not be re-established, and after the sixty-day period, the nonconforming use shall immediately and without further action on the part of the city terminate. Thereafter, before the property can be used for the sale of items which are regulated and permitted under Chapter 19, Article VII of the Code of Ordinances, the owner or lessee must make application to the planning commission for the re-zoning to B-SOB, and the normal rules for rezoning, including notification of surrounding property owners and public hearing shall apply.

Notwithstanding the foregoing, if the nonconfomring use is discontinued in order to comply with an order or action of the State or Federal Government, then in that event the use shall not be deemed to have been abandoned or discontinued.

INDUSTRY DISTRICTS
1.
I-A Districts: Industry-Agriculture districts. These districts are comprised of lands lying within areas set forth on the Master Plan for industrial development. Existing land uses therein are mainly agriculture, livestock raising or vacant, and these regulations are designed to protect the essentially open character of the districts by prohibiting the establishment of uses that are unsuited or unrelated to the district as a whole. It is intended that a subdivision of land within these areas shall be approved and proper zoning action be executed before land uses other than those specified herein shall be permitted.
a.
Permitted uses. In I-A Districts only the following uses are permitted:

The uses listed below are permitted upon approval of the location and site plan thereof by the Planning Commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire and police protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:
Fire Station
Pipe Line or Electric Transmission Line; need not be enclosed within structure
Railroad Right-of-Way, but not including shops, yards, and team tracks; need not be enclosed within structure
Revival, Church
School, Elementary and/or Secondary, meeting all requirements of the compulsory education laws of the State of Louisiana

Building site area. Except as provided in Section III, the minimum building site area shall be:

Building height limit. Except as provided in Section III, no structure shall be erected or altered to exceed thirty-five (35) feet.
d.
Yards required. Except as provided in Section III, the minimum dimensions of yards shall be:

Side Yard .....10 ft.

I-1 Districts: Light industry districts. These districts are composed of land and structures used for light manufacturing or wholesaling, or suitable for such uses, where the use and its operation do not directly adversely affect nearby residential and business uses. These districts are usually separated from residential areas by business areas or by natural barriers. The district regulations are designed to allow a wide range of industrial activities subject to limitations designed to protect nearby residential and business districts.

Located for convenient access from existing and future arterial thoroughfares and railway lines, these districts are in many instances separated from residential areas by business or light industry areas or by natural barriers; where they are adjacent to residential areas some type of artificial separation may be required. The district regulations are designed to permit the development of the district for almost any industrial uses, subject to the minimum regulations necessary for the mutual protection of the uses.
