ARTICLE II

DISTRICTS

Sec. 125-23. - Creation of districts.

For the purposes of this article, the parish is divided into the following districts:

(1)

R-1 districts: residence districts; one-family.

(2)

R-1.5 districts: residence districts; townhouse.

(3)

R-2 districts: residence districts; multiple-family.

(4)

R-3 districts: residence districts; multiple-family.

(5)

B-1 districts: transition business districts.

(6)

B-2 districts: neighborhood business districts.

(7)

B-3 districts: community and central business districts.

(8)

B-I districts: interstate interchange business districts.

(9)

I-A districts: industry-agriculture districts.

(10)

I-1 districts: light industry districts.

(11)

I-2 districts: heavy industry districts.

Sec. 125-24. - Zoning map.

The zoning districts and the boundaries thereof are shown on the attached zoning map of the Parish of Natchitoches, 1991, which map is hereby made a part of this article.

Sec. 125-25. - District boundaries.

Except where specifically shown by dimension or otherwise on the zoning map, the boundaries of districts are lot or property lines, the center lines of streets or alleys or such lines extended, railway right-of-way lines, natural boundary lines such as water courses, and the municipal corporate limit lines as they may exist from time to time. Questions concerning the exact location of any district boundary shall be decided by the planning commission.

Sec. 125-26. - Annexed territory.

All territory annexed from the parish into an incorporated municipality shall be removed from the jurisdiction of the president and parish council at the time of annexation. Concurrently, any existing zoning previously set forth by the parish shall then become a function of the annexing authority, and the responsibility of establishing zoning for the removed territory will be the same authority. All obligations of jurisdiction with regards to the provision of critical services will also become the responsibility of the annexing municipality.

Sec. 125-27. - Application of regulations.

Except as hereinafter provided:

(1)

No land shall be used or occupied, no structure shall be designed, erected, altered, used, or occupied, and no use shall be operated unless in conformity with the regulations herein prescribed for the district in which such structure or land is located;

(2)

No structure shall be designed, erected, altered, used, or occupied to exceed the height limits herein established, to have less building site area, or to have narrower or smaller front, side, and rear yards than herein prescribed for the district in which the structure is located;

(3)

No part of a yard or other open space required about any structure for the purpose of complying with the provisions of this article shall be included as a part of the yard or other open space similarly required for another structure;

(4)

No building site shall be so reduced or diminished that the building site area, yards, or the open spaces shall be smaller than prescribed by this article;

(5)

Every structure, other than an accessory structure, hereafter designed, erected, altered, used, or occupied shall have provided and continuously maintained for it a separate building site as herein defined;

(6)

Every use, unless expressly exempted by this article, shall be operated entirely within a completely enclosed structure.

Sec. 125-58. - R-1 Districts: One-Family Residence Districts.

These districts are composed mainly of areas containing one-family dwellings and open areas where similar residential development seems likely to occur; few two-family and multiple-family dwellings are found in these areas. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches, and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.

(1)

Permitted uses. In R-1 districts only the following uses are permitted:

a.

Uses by right. The following uses are permitted subject to the conditions specified:

1.

Accessory use.

2.

Dwelling, one-family.

3.

Farming and truck gardening; need not be enclosed within structure.

4.

Golf course, but not including commercial miniature course or commercial driving range; need not be enclosed within structure.

5.

Home occupation.

6.

Name plate, not exceeding one square foot in area, need not be enclosed within structure.

7.

Park or playground (public), including recreation center; need not be enclosed within structure.

b.

Uses requiring planning commission approval. The following uses are permitted upon approval of the location and site plan thereof by the planning commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire and police protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:

1.

Fire station.

2.

Livestock and poultry raising, including dairy; need not be enclosed within structure.

3.

Pipe line or electric transmission line; need not be enclosed within structure.

4.

Railroad right-of-way, but not including shops, yards, and team tracks; need not be enclosed within structure.

5.

School, elementary and/or secondary, meeting all requirements of the compulsory education laws of the state.

6.

University or college (nonprofit).

7.

Water storage; need not be enclosed within structure.

8.

Water or sewage pumping station.

c.

Special exception uses. These uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the president and parish council after a public hearing and recommendation by the planning commission:

1.

Bed and breakfast.

2.

Cemetery; need not be enclosed within structure.

3.

Church, including parish house, community house, and educational buildings.

4.

Correctional, detention, or penal institution.

5.

Electric substation; need not be enclosed within structure but must be enclosed within a wall or fence at least ten feet high.

6.

Livestock and poultry raising, including dairy; need not be enclosed within structure.

7.

Lumbering and lumber industry.

8.

Radio and television broadcasting transmitter, but not including studio.

d.

Prohibited uses. The following uses are not allowed in R-1 districts:

1.

Mobile/manufactured homes.

2.

Modular homes.

(2)

Building site area. Except as provided in article III of this chapter, the minimum building site area shall be:

(3)

Building height limit. Except as provided in article III of this chapter, no structure shall be erected or altered to exceed 35 feet.

(4)

Yards required. Except as provided in article III of this chapter, the minimum dimensions of yards shall be:

a.

Front yard: 25 feet.

b.

Side yard: ten feet.

c.

Rear yard: 25 feet.

(5)

Density restriction. Except as provided in article III of this chapter, the maximum gross density (number of individual dwelling units) on any parcel of land or development zoned R-1 is not to exceed one dwelling unit per parcel. Subdivision of the parcel is required to satisfy the density restrictions

Sec. 125-59. - RMH-1 Districts: One-Family Residence/Mobile Home Districts.

The same as R-1 except mobile/manufactured homes are allowed.

Sec. 125-60. - R-1.5 Districts: Townhouse Districts.

These districts are composed of single-family attached dwellings on individual lots for sale; served by servitudes of access and providing common open spaces in lieu of typical single-family yards. Townhouses shall constitute groupings making efficient, economical, comfortable and convenient use of land and open space and serving the public purposes of zoning by means alternative to conventional arrangements of yards and building areas. Townhouse projects shall front at least 120 feet on a public street and be generally compatible with existing development in the neighborhood.

(1)

Permitted uses. In R-1.5 districts only the following uses are permitted:

a.

Uses by right. The following uses are permitted subject to conditions specified:

1.

Accessory use.

2.

Dwelling, one-family.

3.

On-premises advertisement.

b.

Special exception uses. These uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the president and parish council after a public hearing and recommendation by the planning commission: bed and breakfast.

(2)

Building site area. The minimum building site area shall be at least 3,800 square feet per dwelling unit, including lots, common open space, yards and buffer area, adequately landscaped; walkways, and access drives, and including at least 200 square feet per dwelling unit of recreation space. The minimum lot area shall be 2,000 square feet in R-1.5 districts and 1,440 square feet in other districts, where permitted.

(3)

Building height limit. Except as provided in article III of this chapter, no structure shall be designed, erected, or altered to exceed 35 feet.

(4)

Yards required. Except as provided in article III of this chapter, the minimum dimension of yards shall be:

a.

Front yard: 25 feet.

b.

Side yard (corner or adjacent to R-1): 25 feet.

c.

Rear yard: 25 feet.

Each townhouse shall have its own lot yard space of at least 400 square feet, reasonably secluded from view from streets or from neighboring property. Such yard shall not be used for off-street parking or for any accessory building.

(5)

Density restriction. Except as provided in article III of this chapter, the maximum gross density (number of individual dwelling units) on any parcel of land or development zoned R-1.5 is not to exceed six units per acre.

(6)

Special criteria. Townhouses may be appropriately intermingled with other types of housing, except that they shall not be located on lots of less than 120 feet of frontage. Not more than six continuous townhouses shall be built in a row with the same or approximately the same front building line, and not more than 12 townhouses shall be contiguous.

a.

The minimum width for the portion of the lot on which the townhouse is to be constructed shall be 20 feet in R-1.5, and 18 feet in R-2 and R-3. No portion of a townhouse or accessory structure in or related to one group of contiguous townhouses shall be closer than 20 feet to any portion of a townhouse or accessory structure related to another group or to any building outside the townhouse area, nor shall any structure be less than 20 feet from a public street.

b.

As provided by the subdivision chapter, design and construction of drives, drainage and location of utilities shall be subject to review and approval by the parish, after approval of the preliminary plan by the planning commission. Interior access drives shall be constructed of at least six-inch soil cement base with 1½ inches asphaltic concrete wearing surface or better; at least 22 feet wide, with adequate drainage. Where a property extends more than 400 feet from a public street, additional fire hydrants shall be provided as required by the parish.

c.

There shall be a six-foot high wall or solid fence along the sides and rear of the R-1.5 project, wherever it adjoins an R-1 district.

(7)

Grouped parking facilities. Insofar as practical, off-street parking facilities shall be grouped in bays, either adjacent to streets or in the interior of blocks. Practicable methods of drainage shall be ensured by developers in connection with common parking facilities, and all such facilities shall be improved to parish standards for off-street parking areas, with at least two spaces per unit on the lot, plus one visitor parking space per each two units, which may be provided in separate areas. Parking areas shall be at least 65 feet wide where parking or carports are on both sides of a common drive, or at least 42 feet wide where there is parking on one side only. Except where diagonal parking is to be provided, parking areas shall be at least 57 feet wide for parking on both sides or 36 feet for parking on one side.

(8)

Procedure. Before the planning commission considers an application for a R-1.5 townhouse district, the proponent shall submit a preliminary subdivision layout to the planning commission as the first step. After the preliminary subdivision layout has been approved, the rezoning request will then be considered by the planning commission and the president and parish council for rezoning. If rezoning is granted, the applicant or developer may then proceed to submit construction plans for review by the parish, as set forth in the subdivision chapter. Before approval of the final subdivision plan, restrictions shall be limited, including pavements, landscaping, utilities and services.

Sec. 125-61. - R-2 Districts: Multiple-Family Residence Districts.

These districts are composed mainly of areas containing one-family dwellings and open areas where similar residential development seems likely to occur; few two-family and multiple-family dwellings are found in these areas. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches and to preserve the openness of the areas by requiring certain minimum yard and area standards to be met.

(1)

Permitted uses. In R-2 districts only the following uses are permitted:

a.

Uses by right. The following uses are permitted subject to the conditions specified:

1.

Accessory use.

2.

Community homes.

3.

Dwelling, one-family.

4.

Dwelling, one-family townhouse.

5.

Dwelling, two-family.

6.

On-premises advertising.

b.

Special exception uses. These uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the president and parish council after a public hearing and recommendation by the planning commission: bed and breakfast.

(2)

Building site area. Except as provided in article III of this chapter, the minimum building site area shall be:

Sec. 125-62. - R-3 Districts: Multiple-Family Residence Districts.

These districts are composed mainly of areas containing a mixture of one-family, two-family and multiple-family dwellings. The district regulations are designed to protect the residential character of the areas by prohibiting all commercial activities; to encourage a suitable neighborhood environment for family life by including among the permitted uses such facilities as schools and churches; to prevent overcrowding of the land by requiring certain minimum yard and other open spaces for all buildings; and to avoid excessive population density by requiring a certain minimum building site area for each dwelling unit.

(1)

Permitted uses. In R-3 districts only the following uses are permitted:

a.

Uses by right. The following uses are permitted subject to the conditions specified:

1.

All uses by right permitted in R-2 districts.

b.

Uses requiring planning commission approval. The following uses are permitted upon approval of location and site plan thereof by the planning commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:

1.

All uses requiring planning commission approval permitted in the R-2 districts.

c.

Special exception uses. The following uses are subject to the same approval of location and site plan as uses requiring planning commission approval; in addition, these uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the board of appeals in accordance with the provisions of article VII governing special exceptions:

1.

All special exception uses permitted in R-2 districts: bed and breakfast, nursery, day care and kindergarten.

(2)

Building site area. Except as provided in article III of this chapter, the minimum building site area shall be:

(3)

Building height limits. Except as provided in article III of this chapter, no structure shall be erected or altered to exceed 45 feet.

(4)

Yards required. Except as provided in article III of this chapter, the minimum dimensions of yards shall be:

a.

Front yard: 20 feet.

b.

Side yard: ten feet.

c.

Rear yard: 25 feet.

(5)

Density restriction. Except as provided in article III of this chapter, the maximum gross density (number of individual dwelling units) on any parcel of land or development zoned R-3 is not to exceed 12 units per acre.

Sec. 125-83. - B-1 Districts: Transition Business Districts.

These districts are composed of land and structures occupied by or suitable for such uses as offices, studios and public parking lots. Although usually located between residential areas and business areas these districts are in some instances freestanding in residential areas or they may include hospital or college groups and related uses. The district regulations are designed to protect and encourage the transitional character of the districts by limiting the permitted uses to those of a semi-commercial nature and to protect the abutting and surrounding residential areas by requiring certain minimum yard and area standards to be met, standards that are comparable to those called for in the residence districts.

(1)

Permitted uses. In the B-1 districts only the following uses are permitted:

a.

Uses by right. The following uses are permitted subject to the conditions specified:

1.

Accessory use.

2.

Antique store.

3.

Apothecary (limited to the sale of pharmaceuticals and medical supplies).

4.

Art gallery or museum.

5.

Bed and breakfast.

6

Church; including parish house, community house and educational building.

7.

Clinic, dental and medical.

8.

Club or lodge, private, not including one the chief activity of which is a service customarily carried on as a business.

9.

College fraternity or sorority house.

10.

Convalescent home.

11.

Correctional, detention or penal institution, electric substation; need not be enclosed within structure but must be enclosed within a wall or fence at least ten feet high.

12.

Fire station.

13.

Floral shop.

14.

Gift shop.

15.

Greenhouse.

16.

Hospital or sanitarium.

17.

Institution for children or the aged.

18.

Interior decorating shop.

19.

Library or reading room.

20.

Name plate or sign, not exceeding three square feet in area, need not be enclosed within a structure.

21.

Nursery, day care or kindergarten.

22.

Office.

23.

Off-premises outdoor advertising.

24.

On-premises advertisement.

25.

Pipe line or electric transmission line.

26.

Radio and television broadcasting studio, but not including transmitter.

27.

Railroad right-of-way, but not including shops, yards, and team tracks; need not be enclosed within structure.

Studio for professional work or teaching of any form of fine arts, photography, music, drama, dance, but not including commercial gymnasium.

29.

Telephone exchange, but not including administrative offices, shops or garages.

30.

University or college, nonprofit.

31.

Water storage; need not be enclosed within structure.

32.

Water or sewage pumping station.

33.

YMCA, YWCA, and similar institutions.

(2)

Building site area. Except as provided in article III of this chapter, the minimum building site area shall be 7,200 square feet.

(3)

Building height limit. Except as provided in article III of this chapter, no structure shall be designed, erected, or altered to exceed 35 feet.

(4)

Yards required. Except as provided in article III of this chapter, the minimum dimensions of yards shall be:

a.

Front yard: 25 feet.

b.

Side yard: five feet.

c.

Rear yard: 25 feet.

(5)

Density restrictions. Except as provided in article III of this chapter, the maximum gross density, defined as the floor area ratio (the ratio of building square feet to lot size), on any parcel of land or development zoned B-1 is not to exceed 0.50.

Sec. 125-84. - B-2 Districts: Neighborhood Business Districts.

These districts are composed of land and structures occupied by or suitable for furnishing the retail goods, such as groceries and drugs, and the services, such as barbering and shoe repairing, to satisfy the daily household needs of the surrounding residential neighborhoods. Often located on one or more thoroughfares, these districts are small and are within convenient walking distance of most of the areas they will serve. The district regulations are designed to permit the development of the districts for their purpose and to protect the abutting and surrounding residential areas by requiring certain minimum yard and area standards to be met, standards that are comparable to those called for in residence districts. It is intended that additional neighborhood business districts will be created, in accordance with the amendment procedure set forth herein, as they are needed to serve new residential areas. To ensure that such new districts are actually developed to supply the business needs of the neighborhoods, the amendment creating the district may set a time limit for its development.

(1)

Permitted uses. In B-2 districts only the following uses are permitted:

Automobile filling station, where the primary function is the retail sale of gasoline, oil, grease, tires, batteries and accessories, and where services are limited to installation of items sold, washing, polishing, and greasing; fuel pumps need not be enclosed within structure.

9.

Bakery, retail.

10.

Bank.

11.

Barber shop or beauty shop.

12.

Bed and breakfast.

13.

Book store.

14.

Camera and photographic supplies store.

15.

Candy, nut and confectionery store.

16.

Catering shop.

17.

Church.

18.

Clinic, dental or medical.

19.

Club or lodge, private.

20.

College.

21.

Convalescent home.

b.

Special exception uses. These uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the president and parish council after a public hearing and recommendation by the planning commission:

1.

Automobile and truck sales room and/or repair where the primary function is the retail sale of new automobiles and the retail sale of used automobiles, accessories, tires and batteries is a secondary function only; may not conduct dismantling.

2.

Farm equipment and supplies store.

(2)

Building site area. There is no minimum required building site area.

(3)

Building height limits. Except as provided in article III of this chapter, no structure shall be designed, erected, or altered to exceed 35 feet.

(4)

Yards required. Except as provided in article III of this chapter, the minimum dimensions of yards shall be:

a.

Front yard: 25 feet.

b.

Side yard: none.

c.

Rear yard: 25 feet.

(5)

Density restriction. Except as provided in article III of this chapter, the maximum gross density, defined as the floor area ratio (the ratio of building square feet to lot size), on any parcel of land or development zoned B-2 is not to exceed 0.70.

Sec. 125-85. - B-3 Districts: Community and Central Business Districts.

These districts are composed of land and structures used to furnish, in addition to the retail goods and services found in neighborhood business districts, the wider range of retail goods and services to satisfy all of the household and personal needs of the residents of the parish and its trade area. In addition to the main central business section of the parish, other large areas may be established as districts of this type to serve groups or communities of neighborhoods. The district regulations are designed to permit the development of the districts for their purpose in an open, spacious arrangement by requiring certain minimum yard and area standards to be met. To protect the abutting and surrounding residential areas certain restrictions are placed on uses. Although new districts of this type will not often be called for, such districts can be created in accordance with the amendment procedure set forth herein, if they are needed. To ensure that such districts are actually developed to supply the business needs of the groups of neighborhoods, the amendment creating the district may set a time limit for its development.

(1)

Permitted uses. In the B-3 districts only the following uses are permitted:

a.

Uses by right. The following uses are permitted subject to the conditions specified:

Accessory use.

2.

Air conditioning sales and service.

3.

Ambulance service.

4.

Amusement, commercial; miniature golf course and golf driving range; need not be enclosed within structure.

5.

Antique store.

6.

Apothecary.

7.

Apparel and accessory store.

8.

Appliance store.

9.

Armory.

10.

Art gallery or museum.

11.

Artificial limb manufacture.

12.

Auditorium.

13.

Density restriction. Except as provided in article III of this chapter, the maximum gross density, defined as the floor area ratio (the ratio of building square feet to lot size), on any parcel of land or development zoned B-3 is not to exceed 1.0. Building sites located within a central business district area, as shown on the zoning map, will have a density restriction as defined by the floor area ratio of 5.0.

Sec. 125-86. - B-I Districts: Interstate Interchange Business Districts.

The interstate interchange business districts comprise land that is directly adjacent to an interstate highway access point and the local roadway that it intersects. The businesses located at these roads are intended to accommodate interstate travelers and local residents by providing retail sales and services in the automotive, food, lodging and convenience sales industries to those that utilize the interstate highway system. The district regulations are designed to encourage the development of the interchange areas in a manner that minimizes vehicular traffic conflicts and complements the existing character of the area. To protect the surrounding areas, certain restrictions are placed on uses and building placement. Although new districts of this type will not often be called for, such districts can be created in accordance with the amendment procedure set forth herein, if they are needed. To ensure that such districts are actually developed to supply the business needs of the intended users, the amendment creating the district may impose a time limit for project development.

(1)

Permitted uses. In the B-I districts only the following uses are permitted:

a.

Uses by right. The following uses are permitted subject to the conditions specified:

Sec. 125-116. - I-A Districts: Industry-Agriculture Districts.

These districts comprise lands lying within areas set forth on the master plan for industrial development. Existing land uses therein are mainly agriculture, livestock raising or vacant, and these regulations are designed to protect the essentially open character of the districts by prohibiting the establishment of uses that are unsuited or unrelated to the district as a whole. It is intended that a subdivision of land within these areas shall be approved and proper zoning action be executed before land uses other than those specified herein shall be permitted.

Permitted uses. In I-A districts only the following uses are permitted:

b.

Uses requiring planning commission approval. The following uses are permitted upon approval of the location and site plan thereof by the planning commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire and police protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:

Special exception uses. These uses are declared to possess such characteristics of unique or special form that each specific use shall be considered an individual case and shall be subject to approval of the president and parish council after a public hearing and recommendation by the planning commission:

Acid manufacture (hydrochloric, nitric, picric, sulphuric, sulphanous, carbolic).

2.

Animal black, lamp black, or bone black manufacture.

3.

Animal reduction.

4.

Automobile wrecking, dismantling or salvage; need not be enclosed within structure but must be enclosed within a fence not less than seven feet nor more than ten feet high and adequate to screen the area from public view.

Cement, lime, gypsum and plaster manufacture.

Clay and clay products manufacture; need not be enclosed within structure.

Fertilizers manufacture or processing.

11.

Garbage dumping; need not be enclosed within structure.

Glue, size, or gelatin manufacture.

13.

Junk yard, including storage, baling or sale of rags, paper, iron, or junk; need not be enclosed within structure but must be enclosed within a fence not less than seven feet nor more than ten feet high and adequate to screen the area from public view.

Meat slaughtering and/or packing.

Metal ingots, pigs, castings, sheets, or bars manufacture.

Building site area. The minimum building site area shall be 10,000 square feet.

Building height limit. Except as provided in article III of this chapter, no structure shall be designed, erected, or altered to exceed 45 feet.

Yards required. Except as provided in article III of this chapter, the minimum dimensions of yards shall be:

Front yard: 25 feet.

b.

Side yard: ten feet.

c.

Rear yard: 25 feet.
