ARTICLE III

- USE DISTRICTS

Sec. 3.1. - Applications of district regulations.

A.

No building, structure, or land shall hereafter be used or occupied and no building or structure or part thereof shall hereafter be erected, constructed, reconstructed, moved, or structurally altered unless in conformity with all of the regulations herein specified for the district in which it is located.

B.

No part of a yard or other open space or off-street parking or loading space required about or in connection with any building for the purpose of complying with this ordinance shall be included as part of a yard, open space, or off-street parking or loading space similarly required for any other building.

C.

No yard or lot existing at the time of passage of this ordinance shall be reduced in size or area below the minimum requirements set forth herein except where to do so would lead to lots that are less nonconforming than prior to the re-subdivision. Yards or lots created after the effective date of this ordinance [the ordinance from which this appendix is derived] shall meet at least the minimum requirements established by this ordinance.

D.

Regulations of land under water. All lands within the town which are under water and are not shown as included within any district, shall be subject to all the regulations of the district adjacent to the water area. If the water area adjoins two or more districts, the boundaries of each district shall be construed to extend into the water area in a straight line.

E.

Location of streets and public ways. Whenever any street, alley, or other public way is vacated by official action of the governing body of the town, the zoning district adjoining each side of such street, alley, or public way shall automatically extend to the center of same and all area included therein shall then become subject to all appropriate regulations of the extended districts.

Sec. 3.2. - Rules for interpretation of district boundaries.

A.

Where uncertainties exist, such as approximately following the centerlines of streets, highways, or alleys, the boundaries shall be construed to follow such centerlines.

B.

Boundaries indicated, as approximately following platted lot lines, shall be construed to follow such lot lines.

C.

Boundaries indicated, as approximately following town limits, shall be construed as following town limits.

D.

Boundaries indicated as following railroad lines shall be construed to be midway between the tracks.

E.

Boundaries indicated as following shorelines shall be construed to follow such shoreline and, in the event of change in the shoreline, shall be construed as moving with the actual shoreline.

F.

Boundaries indicated as parallel to or extensions of features indicated in section 3.2, subsections A—H, shall be so construed. The scale of the map shall determine distances not specifically indicated on the official zoning map.

G.

Boundaries indicated [as] following other boundary lines, watercourses, and other natural topographical features, such lines shall be construed to be such boundaries.

H.

Where street or property layout existing on the ground is at variance with that shown on the official zoning map, or in other circumstances not covered by section 3.2, subsections A—H, the mayor or his duly authorized representative shall interpret the district boundaries, provided such adjustment does not exceed one acre in area.

Sec. 3.3. - Establishment of districts and zoning map.

A.

In order to classify, regulate and restrict the locations of uses and locations of buildings designated for specific areas; and to regulate and determine the areas of yards, courts and other open spaces within or surrounding such buildings, property is hereby classified into districts as prescribed in this chapter [article].

B.

All land within the corporate limits of the Town of New Llano is hereby divided into the following zoning districts:

R—Single-family Residential District.

RM—Multifamily Residential District.

RMHP—Residential Mobile Home Park District.

C—Commercial District.

ID—Institutional District.

OS—Open Space.

C.

The boundaries of each zoning district are to be indicated upon the official zoning map as approved by the town council of the Town of New Llano. Said map and subsequent amendments thereto shall be considered as a part of this code [ordinance].

D.

If, in accordance with the provisions of this ordinance and statutes, changes are made in district boundaries or other matter portrayed on the official zoning map, such changes shall be made on this official zoning map quarterly after the town council has approved the amendment, and attached to this ordinance. Each such quarterly change of the map shall be dated, signed, and certified. However, amendments shall become effective when adopted by the council.

E.

No change of any nature shall be made in this official zoning map or matter shown thereon except in conformity with the procedures set forth in this ordinance. Any unauthorized changes of whatever kind, by any person or persons, shall be considered a violation of the ordinance and punishable under section 1.13, Violations, of this ordinance.

Sec. 3.4. - Classification of annexed territory.

A.

All areas taken into the town limits of the Town of New Llano shall be classified as a zoning district of the Town of New Llano.

B.

The appropriate town zoning shall be recommended by the planning commission of the Town of New Llano and verified in writing before adoption of an annexation ordinance by the town council of the Town of New Llano. However, the said areas taken into the town may be classified as any district set forth in this ordinance, provided that:

1.

Application be made to the planning commission by an owner with the area to be annexed for whatever other classification or classifications that may be desired;

2.

A public hearing shall have been held by the planning commission, meeting the requirements of section 7 thereof;

3.

The planning commission approves a district classification or classifications requested;

4.

The town council approves by majority vote the district classification approved by the planning commission;

5.

If the planning commission and The town council do not act upon the application within 90 days from date of the application, it shall be deemed denied.

Sec. 3.5. - R—Single-Family Residential District.

A.

Purpose and intent. The purpose and intent of the R-1 Single-Family Residential District is to provide for the location and grouping of low-density, single-family residences with accompanying accessory uses that are protected from the adverse impacts of incompatible nonresidential land uses.

B.

Permitted, accessory and conditional uses. See Table 3.

C.

Property development standards.

1.

Lot area.

a.

Residential lots shall contain an area of not less than 5,000 square feet.

b.

Nonresidential lots shall contain an area not less than 3,000 square feet.

2.

Lot width. All lots shall have a minimum width of 50 feet.

3.

Standard yard requirements and development standards.

a.

Front yard setback. All uses shall have a front yard setback of thirty feet (20').

b.

Side yard. All uses shall have a combined total side yard of eighteen feet (10'), but in no case shall any building be located closer than eight feet (5') from the side property line.

c.

Rear yard. There shall be a rear yard of not less than 30 feet for all uses.

4.

Maximum height limit. No building or structure shall exceed 35 feet above the base flood elevation as established in the current FEMA maps and guidelines.

D.

Site and structure regulations for group/residential care homes.

1.

To ensure safety and compatibility with surrounding uses, site plan approval is required for any board, care and/or community home in this district.

2.

For these uses, no more than four automobiles, vans, trucks, etc., shall be parked outside of a small group home. These must be parked in off-street parking spaces.

3.

All requirements for certification, licensing and monitoring established by the laws of the State of Louisiana, including, but not limited to, R.S. 40:2151 et seq., relative to board and care homes must be complied with and maintained pursuant to this section.

4.

All requirements for certification, licensing, and monitoring established by the laws of the State of Louisiana, including, but not limited to, R.S. 28:475 et seq., relative to group homes for handicapped persons must be complied with and maintained pursuant to this section.

E.

Parking requirements. As provided for in section 5.3.

F.

Height requirements. No building or structure shall exceed 35 feet above the finished grade of the property or base flood elevation as established in the current FEMA FIRMs and guidelines, whichever is higher.

Sec. 3.6. - RM—Residential Multifamily District.

A.

Purpose and intent. The purpose and intent of the RM—Multifamily Residential District is to provide opportunities for low- to moderate-density residential neighborhoods with buildings on individual lots or for more than one building on one lot. The RM district shall accommodate single-family residences attached dwellings that have common walls, including townhouses; congregate and other cluster developments, as well as multifamily structures ranging from duplexes to apartment buildings.

B.

Permitted, accessory and conditional use. See Table 3.

C.

Property development standards.

1.

Lot area.

a.

Single-family detached lots and group/community homes shall contain an area of not less than 5,000 square feet.

b.

Two-family and lot shall have a minimum lot area of 7,000 square feet.

c.

Townhouse lots shall contain a minimum lot area of 1,800 square feet per unit, with a minimum of four units per development.

d.

Multifamily dwellings shall have a minimum lot area of seven thousand (7,500) square feet, or 2,000 square feet per unit, whichever is greater.

e.

All nonresidential lots shall contain an area not less than 10,000 square feet.

2.

Lot width.

a.

Single-family lots shall have a minimum width of 60 feet.

b.

Two-family lots shall have a minimum width of 60 feet.

c.

Interior townhouse lots shall measure no less than 30 feet and corner townhouse lots shall measure no less than 40 feet.

d.

Minimum lot width for a multifamily development is 120 feet.

e.

Nonresidential lots shall have a minimum width of 100 feet.

3.

Standard yard requirements and development standards.

a.

Front yard setback. All uses other than townhouses shall have a front yard setback of at least 20 feet.

Front building lines shall be no closer than ten feet from the property line on lots that contain townhouses.

b.

Side yard. All uses other than townhouses and multifamily developments shall have a combined total side yard of 15 feet, but in no case shall any building be located closer than seven feet from the side property line.

There shall be no minimum side yard requirement between lots that contain townhouses, provided that in no case shall any townhouse be built located any closer than ten feet from the street side property line, and a ten-foot setback shall be provided where a lot containing a townhouse abuts a lot containing a separate residential structure.

c.

Multifamily developments shall have a minimum side yard of 20 feet, but in no case shall the building be any closer than ten feet from the property line.

d.

Rear yard. There shall be a rear yard of not less than 25 feet for all uses.

4.

Maximum height limit. No building or structure shall exceed 35 feet above the base flood elevation as established in the current FEMA maps and guidelines.

D.

Site and structure regulations for group/residential care homes.

1.

To ensure safety and compatibility with surrounding use, site plan approval is required for any board, care and/or community home in this district.

2.

For these uses, no more than four automobiles, vans, trucks, etc., shall be parked outside of a small group home, and no more than six automobiles shall be parked outside of a large group home. These must be parked in off-street parking spaces.

3.

All requirements for certification, licensing and monitoring established by the laws of the State of Louisiana, including, but not limited to, R.S. 40:2151 et seq., relative to board and care homes must be complied with and maintained pursuant to this section.

4.

All requirements for certification, licensing, and monitoring established by the laws of the State of Louisiana, including, but not limited to, R.S. 28:475 et seq., relative to group homes for handicapped persons must be complied with and maintained pursuant to this section.

E.

Parking requirements. As provided for in section 5.3.

Sec. 3.7. - RMP—Residential Mobile Home Park District.

A.

Purpose and intent. The purpose and intent of the Residential Mobile Home Park District is to provide for the location and regulation of mobile home parks. Residential Mobile Home Park Districts should be compatible with adjacent land uses.

B.

Permitted, accessory and conditional uses. See Table 3.

C.

Individual mobile home site development standards.

1.

Lot area.

a.

Minimum area per space shall be 3,500 square feet.

b.

Minimum space width: Fifty feet.

c.

Minimum space depth: Seventy feet.

2.

Standard yard requirements and development standards.

a.

Front yard minimum: Fifteen feet.

b.

Side yard minimum: Five feet.

c.

Rear yard minimum: Ten feet.

d.

Distance between structures minimum: Fifteen feet from permanent structures.

e.

Coverage: No more than 50 percent of a [lot] may be covered with structures such as the mobile home, carports and storage buildings.

D.

Site and structure regulations.

1.

All tongues shall be removed once mobile home is in place. Those not detachable shall be screened by landscaping.

2.

All open area under mobile home shall be enclosed by skirting.

3.

Mobile homes must meet the minimum standards as a HUD manufactured home unit in accordance with the Manufactured Home Construction and Safety Standards (HUD Code).

E.

Parking requirements as provided in section 5.3.

F.

Height requirements. No building or structure shall exceed 35 feet above the finished grade of the property or base flood elevation as established in the current FEMA FIRMs and guidelines, whichever is higher.

Sec. 3.8. - C—Commercial District.

A.

Purpose and intent. The purpose and intent of the Commercial District is to accommodate a wide variety of commercial and retail uses, as well as offices, businesses and personal services that serve the needs of the community and the region.

B.

Permitted uses, accessory and conditional [uses]. See Table 4.

C.

Property development standards.

1.

Lot area. Minimum lot area for each zoning lot shall be 10,000 square feet.

2.

Residential uses shall meet the minimum area requires in the RM district.

3.

Lot width. Minimum lot width of 75 feet at the building line.

4.

Lot depth. Minimum lot depth of 140 feet is required.

5.

Front yard. Front building lines shall be no closer than ten feet from the street right-of-way line.

6.

On corner or through lots, the required front yard will be provided on both streets.

7.

Side yard. A minimum of five feet is required for side yards except on the side(s) of a lot abutting any adjacent dwelling or residential area district, in which case there shall be a side yard setback of no less than ten feet in depth.

8.

Rear yard. No rear yard is required for nonresidential lots except where a lot abuts an existing dwelling or residential area or district, in which case there shall be a rear yard of not less than ten feet in depth.

D.

Parking requirements as provided in section 5.3.

E.

Height requirements. No building or structure shall exceed 45 feet above the finished grade of the property or base flood elevation as established in the current FEMA FIRMs and guidelines, whichever is higher.

F.

Screening. See section 5.2 of this ordinance.

G.

Portable/temporary buildings. Portable or temporary structures are only permitted as accessory structures located in the rear year. No portable or temporary structures shall be allowed as the primary structure on a lot. Portable buildings will be required to have a concrete slab and skirting, unless used as storage for residential use.

Sec. 3.9. - ID—Institutional District.

A.

Purpose and intent. The purpose and intent of the Institutional District is to accommodate uses of a civic, religious, educational or public nature and to encourage safe and efficient use and accessibility for the public.

B.

Permitted uses, accessory and conditional uses. See Table 4.

C.

Property development standards.

1.

Lot area. Minimum lot area for each zoning lot shall be 10,000 square feet.

2.

Lot width. Minimum lot width of 75 feet at the building line.

3.

Lot depth. Minimum lot depth of 140 feet is required.

4.

Front yard. Front building lines shall be no closer than ten feet from the street right-of-way line.

5.

On corner or through lots, the required front yard will be provided on both streets.

6.

Side yard. A minimum of five feet is required for side yards except on the side(s) of a lot abutting any adjacent dwelling or residential area district, in which case there shall be a side yard setback of no less than ten feet in depth.

7.

Rear yard. No rear yard is required for nonresidential lots except where a lot abuts an existing dwelling or residential area or district, in which case there shall be a rear yard of not less than ten feet in depth.

D.

Site plan approval. To ensure safety and compatibility with surround uses, site plan approval is required for any new ID building or addition to an existing building (but not for renovations to existing buildings unless the renovation increases the intensity of use) containing 20,000, or more, gross square feet of floor area. If construction is to take place in phases, a general schematic plan shall be submitted.

E.

Height requirements. No building or structure shall exceed 35 feet above the finished grade of the property or base flood elevation as established in the current FEMA FIRMs and guidelines, whichever is higher.

F.

Parking requirements. Parking requirements for this district shall be in accordance with the provisions of section 5.3 of this ordinance.

G.

Screening. Screening requirements for this district shall be in accordance with the provisions of section 5.2 of this ordinance.

Sec. 3.10. - OS—Open Space District.

A.

Purpose and intent. The purpose and intent of the Open Space District is to preserve public and private undeveloped areas, and, where appropriate, to provide opportunities for outdoor recreation while protecting sensitive or fragile environmental areas and preserving scenic qualities.

B.

Permitted, accessory and conditional use. See Table 4.

C.

Property development standards.

1.

Building setbacks. All buildings must be set back from all property lines one foot for each foot of building height.

2.

Facility setbacks. All outdoor activity facilities, such as playgrounds, swimming pools, basketball courts, tennis courts, or baseball fields, must be set back 50 feet from any residentially zoned property.

D.

Parking requirements. Parking requirements for this district shall be in accordance with the provisions of section 5.3 of this zoning ordinance.

E.

Height requirements. No building or structure shall exceed 35 feet above the finished grade of the property or base flood elevation as established in the current FEMA FIRMs and guidelines, whichever is higher.

F.

Screening. Screening loading requirements for this district shall be in accordance with the provisions of section 5.2 of this ordinance.
