ZONING DISTRICTS

§ 157.100 DISTRICTS.

   For the purpose of this chapter, the town is hereby divided into the following zoning districts.
   (A)   Residence districts.
      (1)   A1 Agricultural (ten acre minimum);
      (2)   RL Large Lot Residential (one d.u./acre);
      (3)   R1 Single-Household Residential;
      (4)   R2 Single-Household Residential (six d.u./acre);
      (5)   R3 Medium Density Residential (ten d.u./acre); and
      (6)   R4 Multiple Household Residential (15 d.u./acre).
   (B)   Commercial districts.
      (1)   C1 Town Core Commercial District;
      (2)   C2 General Commercial District;
      (3)   C3 Neighborhood Commercial District; and
      (4)   C4 Highway/Large Scale Commercial District.
   (C)   Office and industrial districts.
      (1)   O1 Arterial Office District;
      (2)   O2 Office Park District; and
      (3)   I1 Industrial Park District.
   (D)   Overlay and special districts.
      (1)   TC Town Core District;
      (2)   AC Highway Corridor District; and
      (3)   FP Floodplain Overlay District.

§ 157.101 OFFICIAL MAP.

   (A)   The location and boundaries of the districts established by this chapter are set forth on the zoning map entitled, “Town of Newburgh Zoning District Map”, which is incorporated herein, and hereby made a part of this chapter. Said map, together with everything shown thereon and all amendments thereto, shall be as much a part of this chapter as though fully set forth and described herein.
   (B)   The following rules shall apply with respect to the boundaries of the various districts as shown on the Zoning District Map.
      (1)   The district boundaries are either streets or alleys unless otherwise shown and where districts designated on the map accompanying and made a pan of this chapter are bounded approximately by street or alley lines, said street or alley shall be construed to be the boundary of such district.
      (2)   In areas not subdivided into lots and blocks, wherever a district is indicated as a strip adjacent to and paralleling a street or highway, the depth of such strips shall be in accordance with dimensions shown on the map measured at right angles from the centerline of the street or highway, and the length of frontage shall be in accordance with dimensions shown on the map from section, quarter section, or division lines, or centerlines of streets and highways or railroad rights-of-way, unless otherwise indicated.
      (3)   Where a district boundary line divides a lot in single ownership on the effective date of this chapter, the Plan Commission, after due hearing, may extend the regulations for either portion of such lot.
      (4)   The zoning district map is to be updated every 90 days by the Administrator.

§ 157.102 ESSENTIAL PUBLIC SERVICES.

   The erection, construction, alteration or maintenance by public utilities, municipal departments or commissions, of overhead, surface or underground gas, electric, steam or water, distribution or transmission systems, collection, communication, supply or disposal systems, including mains, drains, sewers, pipes, conduits, tunnels, wires, cables, fire alarm boxes, police call boxes, traffic signals, hydrants, towers, poles, electrical substations, gas regulator stations and other similar equipment and accessories in connection therewith, reasonably necessary for the furnishing of adequate service by such public health, safety or general welfare, shall be exempt from the regulations of this chapter, except for the following:
   (A)   The installation shall conform to Federal Communications and Federal Aviation Administration rules and regulations, and those of other authorities having jurisdiction; and
   (B)   Landscaping, screening and yard requirements for the buildings and structures shall be determined by the Site Review Advisory Committee. Buildings and structures that cover a ground area of less than ten square feet are exempt from the landscaping, screening and yard requirements.

§ 157.103 ZONING OF ANNEXED LAND.

   Land hereafter annexed to, or consolidated with, the town shall be assigned an R1 Single Household classification unless otherwise designated in the annexation ordinance.
