Establishment of Districts

§ 550-8 Establishment of districts.

Newtown Borough is hereby divided into districts of different types, each type being of such number, shape, kind, and area and of common unity of purpose and adaptability of use that are deemed suitable to carry out the purposes of this chapter.

§ 550-9 Classes of districts.

Newtown Borough is hereby divided into districts as follows:

§ 550-10 Historic District and Map.

As governed by Act 167 (1961) P.L. 282, the Newtown Borough Historic District Ordinance is in Chapter 314, Historic Districts, of this Code and the Historic District shown on the Historic District Map. As provided within Chapter 314, Historic Districts, no building permit for projects requiring a certificate of appropriateness shall be issued for any structure, building or sign within an Historic District until a certificate of appropriateness has been granted by the Borough.

§ 550-11 Zoning Map.

The boundaries of zoning districts shall be as shown upon the map attached to and made a part of this chapter, which shall be designated the "Newtown Borough Zoning Map." The map and all notations, references and other data shown thereon are hereby incorporated by reference into this chapter and shall be as much a part of this chapter as if all were fully described herein. The Floodplain District shall be those areas classified as special flood hazard areas (SFHAs) in the Flood Insurance Study (FIS) and the accompanying Flood Insurance Rate Maps (FIRMs) dated March 21, 2017, and issued by the Federal Emergency Management Agency (FEMA), or the most recent revision thereof, including all digital data developed as part of the Flood Insurance Study.

§ 550-12 District boundaries.

Where uncertainty exists with respect to the boundaries of the various districts, as shown on the map, the following rules shall apply:
A. 
Where district boundaries are indicated as approximately coinciding with the center lines of roads, creeks, streams, or railroad rights-of-way, such center lines shall be construed to be such boundaries. Where district boundaries are so indicated that they are approximately parallel to center lines of roads, creeks, streams, or railroad rights-of-way, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the Zoning District Map.
B. 
Where district boundaries are so indicated that they approximately coincide with lot lines, such lot lines shall be construed to be said boundaries; or where district boundaries are extensions of lot lines or connect the intersections of lot lines, such lines shall be said district boundaries.
C. 
Where district boundaries divide a lot, the location of such boundaries shall be determined by use of the scale shown on the Zoning Map unless the boundaries are indicated by dimensions.
D. 
In case any further uncertainty exists, the Zoning Hearing Board shall interpret the intent of the map as to location of district boundaries.
