DISTRICT REGULATIONS

§ 400.1 Purpose.

For the purpose of regulation and restricting the heights and size of buildings and other structures, the percentage of lot that may be occupied, the size of yards, and other open spaces, the density of population, and the location and use of buildings, structure[s], and land for trade, industry, residence, or other purposes, the City of Nolanville is hereby divided into zoning districts, of which there shall be 14 classes in number, and which shall be known as:
R-1S
Single-Family Suburban District
R-1
Single-Family Standard District
R-DT
Downtown Single-Family District
R-TH
Townhouse District
R-2
Two-Family District
R-3
Multifamily District
R-MH
Manufactured Home District
B-1
Professional Business District
B-2
Neighborhood, Community Retail Business District
B-3
Secondary & Highway Business District

General Business District
M-1
Light Manufacturing District

§ 400.2 Zoning Map.

The boundaries of the district[s], described above are shown on a map maintained by the City and which map is designated as the “Zoning Map of the City of Nolanville.”

§ 400.3 Vacated Thoroughfares.

Whenever any street, alley, or other public way is lawfully vacated by the Council of the City of Nolanville, the zoning district adjoining each side of such street, alley, or public way shall be automatically extended to the center of such vacated area and shall be subject to all applicable regulations of the extended districts.

§ 400.4 Future Annexation.

All territory hereafter annexed to the City of Nolanville shall be classified as “R-1” Single-Family Standard District, until permanently zoned by the governing body of the City of Nolanville. The City Planning and Zoning Commission shall, within 90 days, after annexation of any territory to the City of Nolanville, institute proceedings on its own motion to give the newly annexed territory permanent zoning and the procedures to be followed shall be the same as is provided by law for the adoption of original zoning regulations.

§ 400.5 Intensity of Use.

Except as hereinafter provided:
(a) 
No building shall be erected, converted, enlarged, reconstructed, or structurally altered, and no building or land shall be used for any purpose that is not permitted in the district in which the building or land is situated.
(b) 
No building shall be erected, converted, enlarged, reconstructed, or structurally altered to exceed the height limit herein established for district in which the building is situated.
(c) 
The minimum yards and other open spaces, including lot area per family, required by this Ordinance for each and every building existing at the time of passage of this Ordinance, or for any building hereafter erected, shall not be encroached upon or considered as yard or open space requirements for any other building, nor shall any log [lot] area [be] reduced to the area less than the district requirements of this Ordinance.
(d) 
Every building hereafter or structurally altered shall be on a lot as here defined, and in no case shall there be more than one (1) main building on one (1) lot except as otherwise provided in this Ordinance.

§ 401.1 Purpose and Intent.

The R-1S: Single-Family Suburban District is designated primarily for single-family detached development on lots that are a minimum of 6,500 square feet in area. In addition to the use and area regulations of this division, development in the R-1 S: Single-Family Suburban District shall be in compliance with all other applicable provisions of this Ordinance.

§ 401.2 Permitted Uses.

(a) 
The land designated by “P” in Exhibit A, Zoning Ordinance Land Use Chart, shall be permitted in the R-1S: Single-Family Suburban District, subject to compliance with any applicable conditions and all other provisions of this Ordinance.
(b) 
The land uses designated with an “*” (asterisk) in Exhibit A, Zoning Ordinance Land Use Chart shall be permitted in the R-1S: Single-Family Suburban District, subject to meeting the applicable conditions specified in ARTICLE V: DIVISION 9.

§ 401.3 Special Uses.

The land uses designated by “S” in Exhibit A, Zoning Ordinance Land Use Chart, shall be permitted in the R-1 S: Single-Family Suburban District only upon approval of a Special Use Permit by the City Council in accordance with procedures and standards of the Special Use: ARTICLE V: DIVISION 1 and DIVISION 8.

§ 401.4 Temporary Uses.

The following uses shall be permitted in the R-1S: Single-Family Suburban District only upon approval of a temporary use permit in accordance with the procedures and standards of the Temporary Use: DIVISION 2: ARTICLE V Supplementary District Regulations.

§ 401.5 Minimum and Maximum Dimensions.

All lots and improvements within the “R-1S” District shall meet the following requirements:
(a) 
Minimum Lot Area per dwelling:
The Minimum Lot Area per Dwelling Unit in the R-1S: Single-Family Suburban District shall be 6,500 square feet, subject to ARTICLE V: DIVISION 5.
(b) 
Minimum Lot Width:
The Minimum Lot Width for residential uses in the R-1S: Single-Family Suburban District shall be 65 feet, subject to ARTICLE V: DIVISION 5.
(c) 
Minimum floor area per unit:
The Minimum Floor Area per Dwelling Unit in the R-1S: Single-Family Suburban District shall be 1,200 square feet, subject to ARTICLE V: DIVISION 5.
(d) 
Minimum Front Yard:
The minimum front yard in the R-1S: Single-Family Suburban District shall be 20 feet except for front-entry garages and carports which shall be 25 feet, subject to ARTICLE V: DIVISION 5.
(e) 
Minimum Side Yard:
The minimum side yard in the R-1S: Single-Family Suburban District shall be 5 feet, subject to ARTICLE V: DIVISION 5.
(f) 
Minimum Rear Yard:
The minimum rear yard in the R-1S: Single-Family Suburban District shall be 10 feet, subject to ARTICLE V: DIVISION 5.
(g) 
Maximum % Coverage:
The maximum % coverage in the R-1S: Single-Family Suburban District shall be 50 percent for all uses, subject to ARTICLE V: DIVISION 5.
(h) 
Maximum Height:
The maximum height of buildings and structures in the R-1S: Single-Family Suburban District shall be three stories or 35 feet for all uses, subject to ARTICLE V: DIVISION 5.

§ 401.6 Flags and Flag Poles.

Flag poles shall not exceed twenty-five (25) feet in height, must have a minimum setback of fifteen (15) feet and the flag shall not exceed fifteen (15) square feet in surface area.

§ 402.1 Purpose and Intent.

The R-1: Single-Family Standard District is designated primarily for single-family detached development on lots that are a minimum of 6,000 square feet in area. In addition to the use and area regulations of this division, development in the R-1: Single-Family Standard District shall be in compliance with all other applicable provisions of this Ordinance.

The land uses designated with an “*” (asterisk) in Exhibit A, Zoning Ordinance Land Use Chart shall be permitted in the R-1: Single-Family Standard District, subject to meeting the applicable conditions specified in ARTICLE V: DIVISION 9.

§ 402.3 Special Uses.

The land uses designated by “S” in Exhibit A, Zoning Ordinance Land Use Chart, shall be permitted in the R-1: Single-Family Standard District only upon approval of a Special Use Permit by the City Council in accordance with procedures and standards of the Special Use: ARTICLE V: DIVISION 1 and DIVISION 8.

§ 402.4 Temporary Uses.

The following uses shall be permitted in the R-1: Single-Family Standard District only upon approval of a temporary use permit in accordance with the procedures and standards of the Temporary Use: ARTICLE V: DIVISION 2.

§ 402.5 Minimum and Maximum Dimensions.

All lots and improvements within the “R-1” District shall meet the following requirements:
(a) 
Minimum Lot Area per
dwelling: The Minimum Lot Area per Dwelling Unit in the R-1: Single-Family Standard District shall be 6,000 square feet, subject to ARTICLE V: DIVISION 5.
(b) 
Minimum Lot Width:
The Minimum Lot Width for residential uses in the R-1: Single-Family Standard District shall be 60 feet, subject to ARTICLE V: DIVISION 5.
(c) 
Minimum floor area per unit:
The Minimum Floor Area per Dwelling Unit in the R-1: Single-Family Standard District shall be 1,000 square feet, subject to ARTICLE V: DIVISION 5.
(d) 
Minimum Front Yard:
The minimum front yard in the R-1: Single-Family Standard District shall be 20 feet except for front-entry garages and carports which shall be 25 feet, subject to ARTICLE V: DIVISION 5.
(e) 
Minimum Side Yard:
The minimum side yard in the R-1: Single-Family Standard District shall be 5 feet, subject to ARTICLE V: DIVISION 5.
(f) 
Minimum Rear Yard:
The minimum rear yard in the R-1: Single-Family Standard District shall be 10 feet, subject to ARTICLE V: DIVISION 5.
(g) 
Maximum % Coverage:
The maximum % coverage in the R-1: Single-Family Standard District shall be 50 percent for all uses, subject to ARTICLE V: DIVISION 5.
(h) 
Maximum Height:
The maximum height of buildings and structures in the R-1: Single-Family Standard District shall be two stories or 35 feet for all uses, subject to ARTICLE V: DIVISION 5.

§ 402.6 Flags and Flag Poles.

§ 403.2 Permitted Uses.

(a) 
The land uses designated by “P” in Exhibit A, Zoning Ordinance Land Use Chart, shall be permitted in the R-DT: Downtown Single-Family District, subject to compliance with any applicable conditions and all other provisions of this Ordinance.
(b) 
The land uses designated with an “*” (asterisk) in Exhibit A, Zoning Ordinance Land Use Chart shall be permitted in the R-DT: Downtown Single-Family District, subject to meeting the applicable conditions specified in ARTICLE V: DIVISION 9.

(c) 
Minimum floor area per unit:
The Minimum Floor Area per Dwelling Unit in the R-TH: Townhouse District shall be 1,000 square feet, subject to ARTICLE V: DIVISION 5.
(d) 
Minimum Front Yard:
The minimum front yard in the R-TH: Townhouse District shall be 25 feet, subject to ARTICLE V: DIVISION 5.
(e) 
Minimum Side Yard:
For attached dwelling units the minimum side yard in the R-TH: Townhouse District shall be 0 feet subject to ARTICLE V: DIVISION 5. For detached dwelling units the minimum side yard in the R-TH: Townhouse District shall be 5 feet, subject to ARTICLE V: DIVISION 5.
(f) 
Minimum Rear Yard:
The minimum rear yard in the R-TH: Townhouse District shall be 10 feet, subject to ARTICLE V: DIVISION 5.
(g) 
Maximum % Coverage:
The maximum % coverage in the R-TH: Townhouse District shall be 50 percent for all uses, subject to ARTICLE V: DIVISION 5.

In addition to the use and area regulations of this division, development in the R-2: Two-Family District shall be in compliance with all other applicable provisions of this Ordinance.

§ 405.2 Permitted Uses.

(a) 
The land uses designated by “P” in Exhibit A, Zoning Ordinance Land Use Chart, shall be permitted in the R-2: Two-Family District, subject to compliance with any applicable conditions and all other provisions of this Ordinance.
(b) 
The land uses designated with an “*” (asterisk) in Exhibit A, Zoning Ordinance Land Use Chart shall be permitted in the R-2: Two-Family District, subject to meeting the applicable conditions specified in ARTICLE V: DIVISION 9.

The Minimum Floor Area per Dwelling Unit in the R-2: Two-Family District shall be 1,000 square feet, subject to ARTICLE V: DIVISION 5.
(d) 
Minimum Front Yard:
The minimum front yard in the R-2: Two-Family District shall be 25 feet, subject to ARTICLE V: DIVISION 5.
(e) 
Minimum Side Yard:
The minimum side yard in the R-2: Two-Family District shall be 6 feet, subject to ARTICLE V: DIVISION 5.
(f) 
Minimum Rear Yard:
The minimum rear yard in the R-2: Two-Family District shall be 10 feet, subject to ARTICLE V: DIVISION 5.

§ 412.5 Minimum and Maximum Dimensions.

All lots and improvements within the “M-1” District shall meet the following requirements:
(a) 
Minimum Lot Area per dwelling:
There shall be no Minimum Lot Area per Dwelling Unit requirement in the M-1: Light Manufacturing District, subject to ARTICLE V: DIVISION 5.
(b) 
Minimum Lot Width:
There shall be no Minimum Lot Width requirement in the M-1: Light Manufacturing District.
(c) 
Minimum floor area per unit:
The minimum floor area per unit in the M-1: Light Manufacturing District shall be 600 square feet, subject to ARTICLE V: DIVISION 5.

Minimum Front Yard:
There shall be no minimum front yard requirement in the M-1: Light Manufacturing District, subject to ARTICLE V: DIVISION 5.
(e) 
Minimum Side Yard:
There shall be no minimum side yard requirement in the M-1: Light Manufacturing District, subject to ARTICLE V: DIVISION 5.
(f) 
Minimum Rear Yard:
The minimum rear yard in the M-1: Light Manufacturing District shall be 15 feet for all uses, subject to ARTICLE V: DIVISION 5.

Maximum % Coverage:
The maximum % coverage in the M-1: Light Manufacturing District shall be 55 percent for all uses, subject to ARTICLE V: DIVISION 5.
(h) 
Maximum Height:
The maximum height of buildings and structures in the M-1: Light Manufacturing District shall be three stories or 40 feet for all uses, subject to ARTICLE V: DIVISION 5.
(i) 
When Adjacent to a Residential District, a Side Yard:
The minimum side yard in the M-1: Light Manufacturing District when adjacent to a residential district shall be 35 feet for all uses, subject to ARTICLE V: DIVISION 5.

§ 412.6 Flags and Flag Poles.

Flag poles shall not exceed thirty-five (35) feet in height and must have a minimum setback of twenty-five (25) feet and the flag shall not exceed twenty-four (24) square feet in surface area.

§ 413.1 Purpose and Intent.

The M-2: Heavy Manufacturing District is designed primarily to accommodate a wide variety of repair/service and industrial uses. In addition to the use and area regulations of this division, development in the M-2: Heavy Manufacturing District shall be in compliance with all other applicable provisions of this Ordinance.

§ 413.2 Permitted Uses.

(a) 
The land uses designated by “P” in Exhibit A, Zoning Ordinance Land Use Chart, shall be permitted in the M-2: Heavy Manufacturing District, subject to compliance with any applicable conditions and all other provisions of this Ordinance.
(b) 
The land uses designated with an “*” (asterisk) in Exhibit A, Zoning Ordinance Land Use Chart shall be permitted in the M-2: Heavy Manufacturing District, subject to meeting the applicable conditions specified in ARTICLE V: DIVISION 9.

§ 413.3 Special Uses.

§ 414.5 Minimum and Maximum Dimensions.

The Minimum Lot Area per Dwelling Unit for residence uses in the A-1: General Agriculture District shall be two acres or 87,120 square feet, subject to ARTICLE V: DIVISION 5.
(b) 
Minimum Lot Width:
The Minimum Lot Width for residential uses in the A-1: General Agriculture District shall be 200 feet, subject to ARTICLE V: DIVISION 5.
(c) 
Minimum floor area per unit:
The Minimum Floor Area per Dwelling Unit in the A-1: General Agriculture District shall be 1,200 square feet, subject to ARTICLE V: DIVISION 5.
(d) 
Minimum Front Yard:
The minimum front yard for all uses in the A-1: General Agriculture District shall be 40 feet, subject to ARTICLE V: DIVISION 5.
(e) 
Minimum Side Yard:
The minimum side yard in the A-1: General Agriculture District shall be 25 feet for residential uses, and 25 feet for nonresidential uses, subject to ARTICLE V: DIVISION 5.
(f) 
Minimum Rear Yard:
The minimum rear yard in the A-1: General Agriculture District shall be 20 feet, subject to ARTICLE V: DIVISION 5.

Maximum Height:

§ 414.6 Flags and Flag Poles.

Flag poles shall not exceed twenty-five (25) feet in height and must have a minimum setback of fifteen (15) feet and the flag shall not exceed fifteen (15) square feet in surface area.

§ 415.1 Applicability and Purpose.

(a) 
This Ordinance [division] shall apply solely to the following tract, which shall herein be referred to as the subject property:
Generally located north of the railroad, west of 10th Street, south of Lorrie Ave, and east of FM 439, as depicted in Attachment “B” [to Ordinance Z19-08 #3.]
(b) 
General purpose.
The purpose of the Main Street Spur District is to support a pedestrian-oriented, mixed-use urban development environment, with convenient access to shopping, employment, and neighborhood retail services. The intent is to revitalize Nolanville’s Main Street to be the center of life in the community. Therefore, an efficient, compact land use pattern; encouraging pedestrian activity; promoting a more functional and attractive community through the use of recognized principles of urban design; and allowing property owners flexibility in land use, while prescribing regulations assisting in promoting a walkable and aesthetically pleasing downtown area.

§ 415.2 Main Street Spur District.

This District shall be commonly referred to as the Main Street Spur District.

§ 415.3 Base Zoning District.

The subject property shall be governed by the rules applicable in B-1 Professional Business District unless otherwise amended in this ordinance.

§ 415.4 Downtown Overlay District.

(1) 
The Downtown Overlay is hereby created and applied upon the subject property. The boundary of the Overlay District shall be the same as the perimeter of the subject properties.
(2) 
Through application of the Downtown Overlay, the following rules, requirements and restrictions apply to the subject property:
(a) 
Permitted Uses:
All uses as they are permitted within the B-1 Professional Business District are allowed within the Main Street Spur Overlay except as it is amended within this ordinance.
i. 
Other uses permitted: Within the Downtown Overlay only, in addition to the other uses allowed in the B-1, Professional Business District, the following uses are permitted:
(1) 
Brewery/Winery/Distillery[.]
(2) 
Mixed Use Development[.]
(3) 
Mobile Food Vendors[.]
(b) 
Alcohol Sales:
The sale of beer, including the sale of beer to be consumed on the permitted premises, is allowed so long as the sale of alcohol is made in compliance with state law and other city ordinance.
(c) 
Prohibited Uses:
The following uses are specifically prohibited in the Downtown District:
(1) 
HUD-Code manufactured homes.
(2) 
Television and radio broadcasting towers.
(3) 
Automobile rental or sales (except where no outside display or storage occurs.)
(4) 
Automobile car-washing establishments (except as incidental to primary use).
(5) 
Heavy machinery storage, rental, sales and repair.
(6) 
Machinery, farm sales, repairing and overhauling.
(7) 
Warehouse storage.
(8) 
Lumberyards.
(9) 
Self-storage warehouses.
(10) 
Junkyards, automobile wrecking yards, salvage yards and scrap operations.
(11) 
Storage or refining of petroleum or its products.
(12) 
Sexually-oriented businesses.
(13) 
Outside open storage (screened and unscreened).
(14) 
Recreation vehicle (RV) parks.
(15) 
Pawn Shops[.]
(16) 
Check Cashing Facilities[.]
(3) 
Signs:
Specific standards for signs within the Downtown Overlay must be in compliance within Article 3.07, Signs, within the Code, except for as amended.
(a) 
Signs Prohibited: Pole signs[.]
(b) 
Sidewalk signs are permitted subject to the following requirements:
(1) 
The sign must be located on the sidewalk directly in front of a building that is built to the property line.
(2) 
The sign must be transportable and displayed at a designated location on the sidewalk only during the hours that the business it advertises is open to the public.
(3) 
The sign must not create a sight obstruction that poses a safety problem for vehicles and/or pedestrians.
(4) 
The sign may not be wider than the lesser of one-third the width of the sidewalk or thirty (30) inches.
(5) 
The sign may not be more than four (4) feet high.
(4) 
Parking:
Specific standards for parking within the Downtown Overlay must be in compliance within Division 6 of the Code, except for as amended:
(a) 
Where street parking, or adjacent parking lots are available, an applicant may apply for an alternative parking plan to be approved by the city manager.
(b) 
All parking shall be screened from the public right-of-way with either landscaping, or a combination of landscaping material and fencing. A fence alone shall not constitute screening.
(c) 
All parking areas within the Downtown Overlay are required to provide internal landscaping.
(5) 
Landscaping:
Landscaping should be appropriate for an urban context, emphasizing the built environment rather than camouflaging it. Landscaping does play an important supporting role, however, in providing shade, visual and textural relief, and recreation opportunities.
(a) 
Landscaping at street frontages is intended to enhance the pedestrian experience and should consist of regularly spaced shade trees and low ground cover plantings. For retail frontages, minimal or no landscaping should occur between the sidewalk and building face. In general, pedestrians should have a clear line of sight at eye level between building faces on either side of the street.
i. 
Street Trees shall be required at a general spacing of 40 feet for Shade Trees and 20 feet for Ornamental Trees along any side of the lot that is directly adjacent to the right-of-way. The city administrator may consider alternative spacing, species, and location based on existing conditions. Shade Trees shall be planted in a parkway strip or tree well that is sized and equipped with underground root barrier treatments. Ornamental Trees shall not require root barrier treatments.
(b) 
A minimum of one (1) shade tree is required per twelve (12) parking spaces. The shade trees shall be distributed throughout the site so that no parking space is more than fifty (50) feet away from an adjacent shade tree.
(6) 
Sidewalks:
Sidewalks located within the Downtown Overlay District shall be at least six (6) feet wide and constructed along all street frontages.

§ 415.5 Compliance Required.

All persons, buildings, properties, sites, and structures located within the overlay district shall comply with this ordinance.
