ARTICLE VIII

Amendments

§ 350-62 General.

The Board of Supervisors may introduce and consider amendments to this chapter and to the Zoning Map as proposed by a member of the Board of Supervisors, by the Planning Commission, or by a petition of a person residing or owning property within the Township.

§ 350-63 Petitions.

Petitions for amendments shall be filed with the Board of Supervisors and referred to the Planning Commission and to the Erie County Department of Planning, and the petitioner, upon such filing, shall pay an advertising deposit and a filing fee, payable to the Township in accordance with a schedule fixed annually by the Board of Supervisors. The Planning Commission shall review the proposed amendment and report its findings and recommendations, in writing, to the Board of Supervisors.

§ 350-64 Referral to Planning Commission.

Any proposed amendment presented to the Board of Supervisors without written findings and recommendations from the Planning Commission shall be referred to the Planning Commission and the Erie County Department of Planning for review prior to public hearing by the Board of Supervisors. The Planning Commission and County Planning shall report their findings and recommendations, in writing, to the Board of Supervisors within 30 days of the referring action.

§ 350-65 Hearing; notice.

A. 
Before voting on the enactment of an amendment, the Board of Supervisors shall hold a public hearing thereon, pursuant to public notice. In addition, if the proposed amendment involves a Zoning Map change, notice of said public hearing shall be conspicuously posted by the municipality at points deemed sufficient by the municipality along the tract to notify potentially interested citizens. The affected tract or area shall be posted at least one week prior to the date of the hearing.
B. 
In addition to the requirement that notice be posted as set forth above, where the proposed amendment involves a Zoning Map change, notice of the public hearing shall be mailed by the municipality at least 30 days prior to the date of the hearing by first-class mail to the addressees to which real estate tax bills are sent for all real property located within the area being rezoned, as evidenced by tax records within the possession of the municipality. The notice shall include the location, date and time of the public hearing.

§ 350-66 Curative amendments.

A landowner in North East Township who desires to challenge on substantive grounds the validity of this chapter or the Zoning Map or any provision thereof which prohibits or restricts the use or development of land in which he has an interest may submit a curative amendment to the Board of Supervisors with a written request that his challenge and proposed amendment be heard and decided as provided in Article VI as well as Article IX of the Pennsylvania Municipalities Planning Code.[1] As with other proposed amendments, the curative amendment shall be referred to the Township Planning Commission and the Erie County Department of Planning at least 30 days before the hearing is conducted by the Board of Supervisors.

§ 350-67 Repealer.

From and after the effective date of enactment of this chapter, all provisions of the North East Township Ord. No. 2005-001, as amended, are repealed to the extent they are inconsistent with this chapter. Ordinance No. 2001-004 (Article XII) and Ord. No. 2013-002 (Article XIII) are incorporated and their respective provisions shall remain in full force and effect as an integral part of this chapter and are not repealed.
