Sec. 98-126. - Board of appeals.

A board of Appeals shall be appointed as specified in Wis. Stats. § 62.23(7), as amended from time to time, the members of which shall serve without compensation. The board of appeals shall have all the powers and duties, and be subject to all requirements and methods of procedures, specified in Wis. Stats. § 62.23(7), except the power to grant conditional use permits and other special exceptions which is vested in the board and the plan commission as provided in article III of this chapter. The board of appeals shall follow procedure consistent with state law. No action of the board of appeals shall have the effect of permitting, in any district, any land uses prohibited in such district by this chapter. Applications for board of appeals' hearings for appeals or variance requests shall be accompanied by a fee as set forth in chapter 62.

Sec. 98-127. - Enforcement and penalties; void permits.

(a)

The building inspector and zoning administrator shall jointly and severally enforce this chapter by means of building permits, conditional use permits, inspections, and the issuance of fines and/or compliance orders. The building inspector or zoning administrator may issue fines as set for in subsection (c) below. The building inspector and/or zoning administrator may refer any violations of this chapter to the village attorney for prosecution. Each violation and each day a violation continues or occurs shall constitute a separate offense.

(b)

Neither the building inspector, zoning administrator, village clerk, village deputy clerk, nor other official may issue a permit which is not permitted by this chapter. Any permit issued contrary to this chapter shall be null and void.

(c)

Any person who shall violate any provision of this chapter shall forfeit an amount no less than $75.00 and not more than $1,000.00 together with the costs of prosecution. Each violation and each day a violation continues or occurs shall constitute a separate offense.

Sec. 98-128. - Amendments.

The village may amend this chapter following the procedures prescribed by Wis. Stats. § 62.23.

Sec. 98-129. - Separability.

Invalidation of any part of this chapter by a court shall not invalidate the rest of the chapter.

Sec. 98-130. - Annexation.

All territory annexed by the village shall become part of the RS district until definite boundaries and regulations to the contrary are recommended by the plan commission and adopted by the village board.

Sec. 98-131. - Conflicting provisions repealed.

All ordinances or parts of ordinances in conflict with any of the provisions of this chapter are repealed.
