NEIGHBORHOOD COMMERCIAL DISTRICTS C-1

§ 27-701 Intent.

The regulations of this district are designed to encourage certain limited commercial activity at locations near residential neighborhoods which are not readily accessible to other commercially zoned areas. The uses permitted are intended to satisfy limited shopping and/or service needs and are not oriented toward high traffic volume nor the full range of commercial activity which is provided for in other districts.

§ 27-702 Permitted Uses.

1. 
Stores and shops for all types of retail trade not otherwise prohibited by law not including gasoline stations, repair garages or automobile body shops.
2. 
Personal services shops such as beauty shops, barbers, dry cleaners, tailors, etc.
3. 
Multiple commercial use complex or shopping center subject to the conditions of § 27-802, Subsection 2.
4. 
Clinics and offices of Pennsylvania-licensed medical practitioners.
5. 
Restaurants, but not of the drive-in, drive through or fast food categories as defined in Part 1.
6. 
Offices and workshops of plumbers, electricians, cabinetmakers, etc.
7. 
Upon approval by the Zoning Hearing Board, the following Special Exception uses are permitted provided that the use complies with the conditions listed herein and the applicable requirements specified in Part 20 of this chapter.
A. 
Gasoline stations and repair garages subject to the conditions as found in § 27-802, Subsection 16.
8. 
Day-care center shall be a permitted use, provided that the following conditions are met:
A. 
The property shall be served by public water and sewer facilities.
B. 
Applicants shall obtain written approval or licensure of the day-care center from the Pennsylvania Department of Welfare.
C. 
Plans for the construction or modification of the facility shall be reviewed/approved by the Pennsylvania Department of Labor and Industry, and written proof of said review/approval shall be provided.
D. 
Unloading and loading of children from vehicles shall only be permitted on the driveway or on the approved parking area.
E. 
Off-street parking shall be provided at the rate of one space for each employee, plus four spaces for the first 10 licensed capacity slots for children, plus one space for each additional 10 slots for children approved for the center. Off-street parking shall also be provided for vehicles owned and operated by the facility as a part of its day-care services.
F. 
Play areas for children shall be fenced and shall be located no closer than five feet to any lot line or road right-of-way, except that play area setbacks may be reduced to 25 feet from side and rear lot lines when a dense screen planting is established and maintained within the setback area.

§ 27-703 Special Exception Uses.

1. 
Upon approval by the Zoning Hearing Board, the following special exception uses are permitted, provided that the use complies with the conditions listed herein and the applicable requirements specified in Part 20 of this chapter:
A. 
Self-storage facilities, provided that the following conditions are met:
(1) 
Self-service storage facilities (mini-warehouses) are permitted, provided that the applicant has met his/her burden of proof that the proposed use meets all applicable regulations and ordinances.
(2) 
Self-storage facilities shall be located on lots with a minimum area of five acres and a minimum lot width of 250 feet.
(3) 
Self-storage facilities proposed on a lot with an existing principal use shall be considered an additional principal use, and not an accessory use to the existing principal use. The erection of the second principal use shall be in compliance with § 27-1208 of this chapter and shown as part of the required land development plan.
(4) 
One off-street parking space shall be provided for each 25 storage units, plus one per each 250 square feet of office space, plus two per any residential use associated with an on-site manager.
(5) 
Parking shall be provided by parking/driving lanes adjacent to the buildings. These lanes shall be at least 26 feet wide when cubicles open onto one side of the lane only, and at least 30 feet wide when cubicles open onto both sides of the lane.
(6) 
Required parking spaces may not be rented as, or used for, vehicular storage.
(7) 
Except as noted above, all storage shall be kept within an enclosed building except that the storage of flammable, highly combustible, explosive or hazardous chemicals shall be prohibited. Any fuel tanks and/or machinery or other apparatuses relying upon such fuels shall be stored only in an external storage area as described above.
(8) 
Because of the danger from fire or explosion caused by the accumulation of vapors from gasoline, diesel fuel, paint, paint remover, and other flammable materials, the repair, construction, or reconstruction of any boat, engine, motor vehicle, or furniture is prohibited.
(9) 
Warehouses shall be used solely for the dead storage of property. The applicant shall adequately demonstrate that all rental and/or use contracts shall specifically prohibit the following examples of uses expressly prohibited upon the site:
(a) 
Auctions, commercial wholesale or retail sales, or garage sales.
(b) 
Residential occupancy.
(c) 
The servicing, repair, or fabrication or motor vehicles, boats, trailers, lawn mowers, appliances, or other similar equipment.
(d) 
The operation of power tools, spray-painting equipment, table saws, lathes, compressors, welding equipment, kilns, or other similar equipment.
(e) 
The establishment of a transfer and storage business.
(f) 
Any use that is noxious or offensive because of odors, dust, noise, fumes, or vibrations.
(10) 
The self-storage facilities will be surrounded by a six-foot- to eight-foot-high fence, with the construction plan and materials to be approved by the Zoning Hearing Board.
(11) 
All outdoor lights shall be shielded to direct light and glare only onto the site and may be of sufficient intensity to discourage vandalism and theft. Said lighting and glare shall be deflected, shaded and focused away from all adjoining property.
(12) 
Design Standards. Design review shall be required for all new construction and expansions of self-service storage buildings to ensure the development has a high-quality design and is appropriate to the desired character of the zone it is located in and the adjacent neighborhood.
(a) 
Fences and Walls. Fences and walls, including entry gates, shall be constructed of high-quality materials and shall be compatible with the design and materials of the building(s) and site. The design guidelines for fences and walls and the following provisions shall apply to self-service storage facilities:
1) 
Decorative metal, wrought iron or chain-link fences are preferred.
2) 
Barbed or razor wire fences and walls made of precast concrete blocks are prohibited.
3) 
Street-front landscape areas required by the design guidelines or elsewhere in this Code shall not be fenced.
(b) 
Self-service storage facilities shall be one story.
(c) 
Materials. Self-service storage facility buildings shall be surfaced in high-quality materials that are approved by the Zoning Hearing Board.
(d) 
All driveway and parking areas shall be paved.
(e) 
Self-storage facilities and warehouses shall be constructed of high-quality materials.

§ 27-704 Lot Area, Building Height and Yard Requirements.

1. 
A lot area, lot width, lot coverage, lot depth, and building height satisfying the requirements of the following table shall be provided for every principal building hereafter erected, altered or added to in this district.

A. 
Where a side or rear yard adjoins a residential district, said yards shall be no less than 50 feet.
B. 
No building shall exceed 2 1/2 stories or 35 feet in height unless authorized as a Special Exception by the Zoning Hearing Board.

§ 27-705 Minimum Off-Street Parking and Loading Requirements.

Off-street parking and loading shall be provided in accordance with Part 14 of this chapter.

§ 27-706 Signs and Advertising Structures.

Signs shall be permitted in accordance with Part 15 of this chapter.

§ 27-707 Supplementary District Regulations.

The Supplementary District Regulations in Part 12 shall apply, where applicable, as additional requirements for this district.

§ 27-708 Environmental Improvements and Energy Conservation Requirements.
