ARTICLE VII

- NONCONFORMING USES, STRUCTURES AND LOTS

Sec. 36.189. - Existing nonconforming uses.

The nonconforming use of a structure, land or water which existed as of April 19, 2011, may be continued by the existing owner and any subsequent owner as long as the nonconforming use is not terminated at any time for a period over two years.

Sec. 36.190. - Abolishment or replacement.

When a nonconforming use or structure is damaged by fire, explosion, flood, the public enemy or other calamity, it may be replaced or restored by the aggrieved property owner only.

Sec. 36.191. - Existing nonconforming structures.

The nonconforming structure existing as of April 19, 2011, or the date of any amendment of this chapter, may be continued although its size or location does not conform with the lot width, lot area, yard, height, parking, loading and access provisions of this chapter. Residential nonconforming structures may be extended, enlarged, reconstructed, moved or structurally altered as long as such activities do not increase the extent to which the structure fails to conform to the standard of this chapter.

Sec. 36.192. - Changes and substitutions.

Once a nonconforming use or structure has been changed to conform, it shall not revert back to a nonconforming use or structure.

Sec. 36.193. - Substandard lots.

In any residential development, a one-family detached dwelling and its accessory structures may be erected on any legal lot or parcel which was of record in the county register of deeds office before April 19, 2011, or the date of any applicable amendment to this chapter.

Sec. 36.194. - Nonconforming signs.

This article shall not apply to nonconforming signs, such signs being governed by section 36.159.
