ARTICLE IX
Parking and Loading
§ 300-71 Intent.
Off-street parking, loading and stacking requirements and regulations are established for the following purposes:
§ 300-72 When required.
Off-street parking, loading and stacking spaces shall be provided as a condition precedent to occupancy of all buildings under the following circumstances:
A.
At the time any new structure is constructed or a new use is established.
B.
At the time any existing structure on the effective date of this chapter is altered or enlarged so as to allow a greater number of users.
C.
At the time a structure's use is changed to another use which requires more off-street parking, loading or stacking facilities.
§ 300-73 Number of spaces required.
A.
The number of off-street parking, loading and stacking spaces required shall be based on the schedule in § 300-80 at the end of this article.
B.
Any use not specifically listed on the requirement schedule shall furnish parking, loading and stacking spaces as required by the Planning Board. The Planning Board shall use the spaces indicated on the schedule as a guide for determining requirements for unlisted uses.
C.
Any use requiring 1/2 or more of a parking space shall be deemed to require the full space.
§ 300-74 Construction and maintenance standards.
A.
The required number of parking, loading and stacking spaces as set forth in this article, together with driveways, aisles and other circulation areas, shall be improved with impervious material to provide a durable and dust-free surface.
B.
All parking, loading and stacking areas shall provide for proper drainage of surface water to prevent the drainage of such water onto adjacent properties and walkways. This condition is subject to approval of the Town Engineer.
C.
The owner and/or lessee of the property used for parking, loading and stacking shall maintain such area in good condition without potholes and free from dust, trash and other debris. The Planning Board may require the placing of pedestrian trash receptacles in parking lots.
§ 300-75 Access.
A.
The design of all parking, loading and stacking areas shall be such as to demonstrate safe and efficient means of movement for both vehicles and pedestrians.
B.
Any parking area for over 10 vehicles shall be designed in such a manner that any vehicles leaving or entering the parking areas from or into a public or private street shall be traveling in a forward motion.
C.
Access or driveways for parking, loading or stacking spaces shall be located in such a way that any vehicle entering or leaving shall be clearly visible for a reasonable distance to any pedestrian or motorist approaching the access or driveway from a public or private street.
§ 300-76 Lighting.
A.
Any parking, loading or stacking area required by a commercial, industrial or multifamily use shall provide outdoor lighting. Such outdoor lighting shall be designed for security and traffic safety reasons.
B.
No outdoor lighting shall be erected, operated or maintained in such a manner as to create an annoyance to surrounding properties or that creates a public safety hazard due to glare. The light sources must be indirect, diffused or shielded type fixtures. All such lighting shall be approved by the Planning Board.
§ 300-77 Parking areas.
A.
Shared parking. The off-street parking requirements of two or more uses, structures or parcels of land may be satisfied by the same parking areas to the extent that it can be shown by the owners that their operations and parking needs do not overlap in point of time. If the uses, structures or parcels are under separate ownership, the right to share use of parking areas must be evidenced by a deed, lease, contract or other appropriate written document to establish joint use.
B.
Location.
(1)
Off-street parking spaces for residential dwellings must be located on the same lot as and within 200 feet of the dwelling.
(2)
Off-street parking for nonresidential uses shall be located on the same parcel or on another parcel, provided that the furthest parking space is not farther than 500 feet from the building as measured in a straight line and provided that the physical settings of the project and off-site parking will provide adequate pedestrian safety and access. The land on which off-site parking is located shall be held in fee simple ownership by the owner of the use served or in such other tenure which will ensure continued availability for parking as long as is needed, subject to approval by the Town Attorney.
C.
Size of spaces and aisles.[1]

Each parking space shall have dimensions as required by the Town Design Criteria. Parking spaces for physically handicapped people shall be sized per the requirements of the New York State Uniform Fire Prevention and Building Code. All dimensions above are exclusive of driveways, aisles and other circulation areas.
(2)
Aisles for traffic shall be as required by the Town Design Criteria.
D.
Use restrictions. Required parking areas shall be available for the parking of operable passenger automobiles of residents, customers, patrons and employees only and shall not be used for storage of vehicles or materials or for the parking of trucks used in conducting the business or use.
§ 300-78 Loading areas.
A.
Except as required otherwise in this chapter, every hospital, institution, hotel, business or industrial use hereafter established shall provide the type and number of loading spaces required in this section.
B.
Location. All required loading facilities shall be situated so as to conveniently serve the building(s) for which they are intended without blocking or otherwise interfering with the use of accessways, parking or stacking facilities, public streets or sidewalks.
D.
Number required. The Planning Board may require off-street loading spaces at its discretion based on an examination of a proposed facility's usage, likelihood of truck traffic and arrangement of buildings and parking areas.
