General Provisions
A. Purpose
For the purpose of promoting and protecting the public health, safety, peace, comfort, convenience and general welfare of the citizens of the Town of Oro Valley and to provide for the social, physical and economic advantages resulting from a comprehensive and orderly planned use of land resources, a Zoning Ordinance and Zoning Map are hereby established and adopted by the Town Council.
B. Title
This ordinance may be cited as the “Oro Valley Zoning Code Revised.”
A. Interpretation
When the provisions of this Code are interpreted or applied, they shall be held to be the minimum requirements for the promotion of the public safety, health, and general welfare.
B. Conflict
The provisions of this Code are not intended to interfere with or abrogate or annul any ordinance, rule, regulation or permit previously adopted or issued, and not in conflict with any provision of this Code, or which shall be adopted or issued pursuant to law relating to the use of building or ordinance not in conflict with this Code; nor it is intended by this Code to interfere with or abrogate or annul any easement, covenant or other agreement between parties, except when this Code imposes a greater restriction, this Code shall control.
C. Repeal
All ordinance or parts of ordinance in conflict with this Code are repealed and, specifically, the following ordinances are repealed: 4, 9, 12, 13, 15, 18, 20, 24, 28, 29, 31, 33, 34, 35, 37, 38, 39, 46, 48, 52, and 54.
The repeal of the ordinances, or parts thereof, specified in Section 20.2 shall not:
A. Affect suits pending or rights existing immediately prior to the effective date of this ordinance;
B. Impair, avoid or affect any grant or conveyance made or right acquired or cause of action now existing under any such repealed ordinance or amendment thereto; or
C. Affect or impair the validity of any bond or other obligation issued or sold in constituting a valid obligation of the issuing authority prior to the effective date of this ordinance.
This ordinance and the various parts thereof are hereby declared to be severable. Should any court of competent jurisdiction hold that any phrase, clause, sentence or section of this ordinance violates or in any way is inconsistent with any statute, State or Federal, or with any provision of the Arizona or United States Constitutions, the remaining phrases, clauses, sentences and sections shall not be affected thereby and shall remain in force and such holding shall not affect the validity of this ordinance as a whole.
Headings of the several sections of this Code are intended as a convenience to indicate the contents of the section and do not constitute a part of the law.
All references to chapters or sections are to the chapters and sections of this Code unless otherwise specified.
This ordinance shall be in full force and effect from and after its passage.
The Town Clerk is hereby directed to cause this Code to be published for the purpose of sale.
