- ADMINISTRATION AND ENFORCEMENT
(a)
The board of aldermen shall have the ultimate power to override, ratify, amend, grant or reject any decision or recommendation from the planning and zoning board.
(b)
The planning and zoning board's decision to grant a variance shall constitute a recommendation to the board of aldermen. The planning and zoning board shall recommend a variance when, in its opinion, undue hardship will result from requiring strict compliance to the city's ordinances. In recommending a variance that involves a conditional use of property, the planning and zoning board shall prescribe only conditions that it deems necessary or desirable in the public interest.

Any person violating any provision of this chapter within the corporate limits of the city shall be guilty of a misdemeanor and, upon conviction, shall be fined an amount not to exceed $200.00. Each day that such violation continues shall be a separate offense. Prosecution or conviction under this provision shall never be a bar to any other remedy or relief for violation of this chapter.
(b)
The penalty provided in subsection (a) of this section should not be construed as exclusive, and the city hereby provides that any other remedy available to it, in the enforcement of this chapter, in law or in equity, including, but not limited to, an injunction in a court of competent jurisdiction, is not intended to be, and is not foreclosed by the provision of such penalty.

Upon enlargement of the city limits, whereby new areas are incorporated within the city limits, unless it is otherwise provided in the chapter incorporating same, such new areas shall, ipso facto, have the same classification as to use and area, and be zoned in accordance with the area adjacent thereto, and where same is adjacent and contiguous to more than one area of different use and area classification, shall be zoned and classified in accordance with the areas having the longest common boundary line with the new territory so added.
